Most people think location, location, location is the most important mantra for the housing market. But in metro Phoenix, the bigger maxim for real estate is growth, growth, growth.

Drawing more residents and higher paying jobs are key to the Valley’s economy and housing market and are the focus of many of the area’s leaders now. But if the region loses its luster as a relatively affordable housing market and a desirable place to live in the desert, then attracting jobs and people will be even tougher.

A new real estate effort from Arizona State University’s W.P. Carey School of Business is trying to tackle these hefty growth issues, and potentially some others including school funding. The college tapped former State Land Department Commissioner Vanessa Hickman to lead a group that will work with the biggest landowners in Arizona and the West to research and plan for growth.

In her last job, Hickman was in charge of leasing, selling and managing 9.2 million acres across the state to get the most money for the land’s primary beneficiary — Arizona’s K-12 education system.

She knows well the difficulties in planning for growth. The Land Department is notoriously underfunded and hampered by operating laws more than a 100 years old.

During the past 20 years, growth advocates and land preservationists have tried several times to pass reform initiatives. They were unsuccessful in their efforts, which would have given the state agency more money for land planning and allow it to compete with other big landowners for development.

Their arguments for state land reform are for the agency to plan better for future growth and provide more money for schools.

Arizona Gov. Doug Ducey hasn’t appointed a new commissioner yet. “If growth planning is done incrementally, we lose opportunities for both developing and preserving land,� Hickman told me in an interview. “We can bring together the big landowners, government officials and others impacted to make better

Question: My husband and I are in an argument about how to hold title to real estate in order to avoid probate. My husband says that if the deed to our home says “and/or,” the surviving spouse will automatically acquire title to the real estate without any probate. According to my husband, the reason that no one knows about the benefit of “and/or” on a deed is that lawyers and title companies make money on the paperwork for spouses generally holding title to real estate as community property with right of survivorship. I say that the law requires the deed to say community property with right of survivorship to avoid probate. Who is right?

Answer: You are right. The holding of title “and/or” may avoid probate of motor vehicles and bank accounts but will not avoid probate of real estate.

Arizona has specific requirements in order for the surviving spouse to acquire the deceased spouse’s interest in real estate without probate, including written acknowledgement by both spouses that the surviving spouse will hold title to the real estate.

Note: if you and you husband owned your home “and/or,” you would own your home as 50 percent-50 percent tenants-in-common.

Either you or your husband could sell or mortgage their individual 50 percent tenant-in-common interest without the other spouse’s consent; after death, the 50 percent tenant-in-common interest of the deceased spouse would generally require probate.

WASHINGTON — U.S. home rental prices rose at a steady rate in January, but prices barely budged or even dipped in parts of the Midwest and Mid-Atlantic.

Real estate data firm Zillow said Friday that prices increased a seasonally adjusted 3.3 percent in January compared with 12 months earlier. But some major cities are finding themselves with an excessive supply of apartments and houses, reducing price pressures for renters.

In the wake of the Great Recession, more Americans are shifting away from home ownership, often because their low-incomes make it difficult to save for a down payment or they live in cities with expensive housing.

64 percent at the end of 2014, the lowest level in two decades, according to the Census Bureau. Some of that decline also reflects the ravages from the housing bust that triggered the recession in late 2007, as foreclosures and overbuilding left plenty of empty houses.

Still, builders have started to respond to the greater demand as the job market improves and more millennials seek apartments. Over the past 12 months, there has been a 24.5 percent increase in groundbreakings for apartment complexes, according to a separate Census report released this week.

As more apartments come on the market, price pressures should ease for renters, said Svenja Gudell, director of economic research at Zillow.

Modest increases or slight declines should help improve affordability,

making it easier for renters to eventually transition to home ownership.

The additional supply is already evident in a few key markets.

Zillow reported that rents have fallen 0.5 percent in the Chicago area and 0.3 percent in Minneapolis over the past year.

“Chicago did a whole lot of overbuilding during the housing boom,” Gudell said, noting that some select downtown neighborhoods in the Windy City still have prices rising at or above the national average.

Dann Wunderlich, 24, lives with his fiancee in a “spacious” one-bedroom apartment in Chicago’s Buena Park neighborhood. Together, they pay $1,050 a month, well below what Wunderlich says he was paying in 2011 for an apartment elsewhere in the city.

“People in our area move year to year because they’re consistently

finding a better price,” Wunderlich said. “I know that’s what we did until we found this apartment. If we found a better apartment with a cheaper rent, we would move.”

Similarly, construction has been making more apartments available around Baltimore and Washington, where rental prices rose 1.5 percent and 1.3 percent, respectively. A separate report by the rental marketplace Apartment List found that rents for a two-bedroom apartment in metro Washington were averaging $1,990 a month, up just 0.1 percent over the past year.

Other parts of the country are experiencing a rental boom.

Rents surged 16.2 percent in Fort Myers, Florida. The San Francisco Bay area also posted a double-digit gain.

The Sonoran Desert Tortoise’s habit is spread across metro Phoenix and Tucson. The turtle is on a list to become an endangered species, which means landowners must figure out how to protect the turtles’ habitat and still develop.

“Arizona’s brand for growth is its open space, desert and affordable

housing,” said Mark Stapp, director of the Masters of Real Estate Development program at ASU, who recruited Hickman.

“Landowners and government officials need to work within the regulatory environment to protect what draws people to the state.”

Arizona’s underfunded education

system isn’t a big draw for people and businesses moving to the state. Finding ways to help the State Land Department earn more money off its holdings could go a long way to improving schools.

Address parking issues early in order to prevent problems You pull into the parking lot late at night, after a long day, and someone is in your spot. Almost as annoying is when the guy next to you has managed make it impossible for you to squeeze your car in for the night. Now what?

Parking can be one of the biggest challenges in multifamily communities. It’s important to know your rights and be a good neighbor to prevent parking issues.

Before you sign your lease, ask these key

questions: 1. Is parking free in the community?

This might be something to negotiate in a new lease or in a renewal. Some companies might offer free parking with your lease for a few months as an incentive.

2. How many spaces does each apartment get? If you need two spaces for a spouse, partner or roommate, be sure to ask about the availability of a second space and where that space will be located.

3. Is there covered parking?

Ask your manager if your community has open spaces for visitors or overnight guests. Can those spaces be reserved?

Many projects in downtown areas have private lots where guests can pay for parking and there are meters on public streets. These might be options worth scouting out before you need them.

Parking issues can escalate into bigger challenges if left unaddressed. It’s important to work through issues with neighbors in a calm and respectful manner. If

your parking neighbor repeatedly takes two spaces, take photos to demonstrate your issue.

If you feel your parking issue requires management handling, don’t be afraid to ask them to intervene. They may have myriad options to help, including warning repeat offenders or taking legal action if necessary.

There is parking allowed on the street overnight. My question to the manager was “Won’t that cause a lot of parking problems on the street?� She advised “We have that issue cleared. If you ‘own’ a car, whether you park in the complex lot or the street, it’s still $17/month.�

Really? Is this legal? I’m sure it probably is.

Is there a percentage of increase allowed for rents in Chandler or is it up to the complex without limitations?

Answer: It would seem to me that you

cannot charge to park on the street since that is public property, not private.

There is no percentage of increase - the landlord can charge whatever they like and if the tenant does not want to pay it, their alternative is to move out.
