Insurance cut spurs surge in refinancing

Outdoor living spaces have come a long way from the days when “outdoor furnishings� meant a few inexpensive folding chairs around a flimsy plastic table.

Many homeowners were paying attention last month when President Barack Obama announced insurances rates on Federal Housing Administration mortgages would be cut in half.

Nationally, the number of people refinancing their FHA mortgage to take advantage of the rate cut and lower their payment has already shot up 74 percent, according to the Mortgage Bankers Association. The mortgage insurance premium dropped from 1.35 percent of the loan amount to 0.85 percent on Jan. 26. “We are seeing the biggest FHA boom in my 12 years in the business,� said Justin Oliver of Phoenix-based Nova Home Loans.

The average Arizona homeowner with an FHA mortgage can save about $900 a year with the rate cut, according to the federal government.

Most can refinance through a streamlined process that doesn't require an appraisal or the full application process with an income verification. Those Valley homeowners still underwater with FHA mortgages also qualify for the simpler refinance process.

In 2014, about 20 percent of the home buyers in Phoenix used FHA mortgages.

What's not clear yet is if the insurance-rate cut is spurring more buyers now, but it will take longer for that trend to play out since finding and purchasing a house usually takes a month or two.

The White House estimates as many as 250,000 U.S. home buyers will use FHA mortgages to purchase during the next three years. That’s up slightly from previous years.

Sammy Glassman, a real estate agent with HomeSmart Elite, is seeing more buyers in the Phoenix market now, but attributes the increase to another lower mortgage rate.

Interest rates on home loans are at their lowest level since mid-2013. The current rate on a 30-year mortgage is 3.6 percent, according to government mortgage giant Freddie Mac. That compares to 4.63 percent a year ago. “Buyers have a huge opportunity to save money now with the two rate cuts,� said Jamie Korus, president of Phoenixbased Alliance Financial Resources Phoenix and chair of the national Mortgage Banker’s political action committee.

The rebound of the Valley’s housing market is riding on those buyers, particularly Millennials and those boomeranging from foreclosures during the crash, taking advantage of the current lower rates.

Question: I sold my Chandler home five years ago for $75,000. The buyers made a $25,000 down payment and I financed the buyers with a $50,000 “seller carry-back� loan, i.e., the buyers agreed to pay me $50,000 in monthly payments over 10 years at 12 percent interest. The buyers are now going through a divorce and eight months ago stopped making the monthly payments.

My title company has now scheduled a foreclosure sale in approximately 90 days. Will this foreclosure sale be a silent auction or will potential buyers bid against each other?

Who will own this home if no potential buyers attend the foreclosure sale? If someone buys this home at the foreclosure sale, I know that this buyer will have to pay my costs, such as recording fees and title company fees, but who pays these costs if no one buys this home?

Answer: First, the foreclosure sale, usually at the courthouses steps or at a title company’s office, is a public auction. In other words, the title company representative holding the foreclosure sale will receive bids from prospective buyers until accepting the highest bid.

Second, inasmuch as the majority of foreclosure sales have no prospective buyers, there will probably be no bidding and you should expect to become the owner again of the home.

Third, if you become the owner of the home again, you will not receive any reimbursement for your costs.

Note: After you become the owner of the home, you should give five days’ written notice to the buyer who bought your home to demand possession of the home in order for you to rent or sell the home. If the buyer will not move out after the five days’ written notice, you can institute eviction proceedings.

Pattern panache Designer Elaine Smith has a new collection of luxury outdoor pillows reflecting her love of fashion, nature and exotic locales. There are Latin American and African kuba cloth prints; menswear-inspired houndstooth; chinoiserie

Question: Recently, my landlord

commented that he would like the utility company to individually meter the units so the tenants can pay their own electric bills. I moved into my apartment community because utilities are included with the rent.

Can my landlord do this?

Answer: No. A.R.S. Section

33-1341 (B) provides that a ruler or regulation adopted after a tenant enters into a rental agreement is enforceable only if a 30-day notice of its adoption is given to the tenant and it does not constitutes a substantial modification of the rental agreement.

Requiring tenants to now pay the electric bills, which were previously the responsibility of the landlord would surely constitute a substantial modification of the rental agreement and would be unenforceable.
