Will Victory be a win for Boomers?

W

hile attending a Christmas party three years ago, Tucson-area resident Tom Moser was inspired to make a dramatic change.

He noticed that the hosts had built an addition onto their home to accommodate aging parents, and it made Moser wonder why he and his wife, Kristin, were living in a big home while his 80-something father lived across town by himself. Moser said he knew his dad wasn’t thriving in that environment, and he knew something had to be done; he just wasn’t sure what. “At the party, I had flashbacks to what I’d seen as a young boy,� said Moser, an Indiana native who grew up around Amish and Mennonite families; the latter would sometimes connect their homes. “And I got to thinking that my parents gave so much to myself,

my sister and my brother. It was time for me to give something back.�

‘He feels he has a palace’ Moser decided he could best do that by having his father move in to his home, but he didn’t see a way to build onto his two-story home. So he went online to explore other options, and in a few minutes’ time, he discovered there was a subdivision a few miles away that offered Lennar Homes floor plans designed specifically for multiple generations living under one roof.

Today, he and his wife live in a 3,000-square-foot NextGen home, known as the Home Within a Home, while his father, Lee, lives in the adjacent “mini home� on the property.

More than 250 people lined up in Buckeye early Tuesday morning to buy a house in Victory at Verrado, metro Phoenix’s newest community for buyers 55 and older.

Buyers also lined up when Del E. Webb opened the first Sun City, also in the West Valley, on Jan. 1, 1960.

Arizona developments continue to draw home buyers at or nearing the age when they can start collecting Social Security and stop working full time.

Del Webb’s Sun Cities defined retirement living for America’s first generation of post-war retirees. Now builders are trying to create communities for the 76 million Baby Boomers, many of whom don’t plan on retiring, and want something different than their parents did at 60.

Victory’s developer, Scottsdalebased DMB Associates, has built Verrado and DC Ranch and several other higher-end developments in Arizona, California and Hawaii.

DMB has spent the past decade and millions of dollars researching what Boomers will want in a community, looking at where they will want to live, what amenities they want nearby and what features they will want in a home.

The developer has found hiking is more important to most Boomers than golf. Yoga and education classes are more important than bowling and craft sessions. Welcoming neighborhoods with high-tech houses that don’t look like all the other homes on the block are also key for many Boomers.

The developer calls Victory a “district� within Verrado. There are no gates or walls separating the 1,200-acre neighborhood it from the rest of the 7,600-acre development. A big patio with an outdoor teaching kitchen is near the entrance. Hiking trails up the White Tank Mountains are accessible from the community.

The Vic is the community’s bar and restaurant. The Spa at the Victory club will have spinning and yoga studios as well as all the top fitness equipment.

There will be an arts studio and a sports den with a full wall of TVs, billiards tables and lounge. A vineyard and chef’s garden are being planted.

To ensure a diversity of houses, Victory will be the first active-adult community in Arizona to offer homes by multiple builders. Home prices in the first phase start at $240,000 and can go well above $500,000 depending on what See REAGOR, Page R3

Question: After we purchased our home in Gilbert last year, we noticed that our neighbors were using a portion of our land for the driveway to their home.

We were concerned about adverse possession. Therefore, we contacted the sellers of our home, and they said that our neighbors have been using that driveway for more than 10 years.

The sellers also said that they never gave our neighbors permission to use the driveway. We then sent our neighbors a certified letter stating that they had permission to use the driveway now, but that at any time we could rescind our permission. Although our neighbors signed a receipt for the certified letter almost a year ago, they have never responded to us. Do our neighbors have any right to use this driveway?

Answer: Probably. Although the law is basically the same, there is a difference between adverse possession — ownership of the land — and a prescriptive easement, or the right to go over another person’s land for ingress and egress. If your neighbors have been using the driveway regularly for more than 10 years without permission from the sellers of your home, your neighbors probably have acquired a prescriptive easement to use the driveway over your land. A survey of the driveway should be obtained and an easement for the driveway should be recorded by you and your neighbors. Even if you or your neighbors do nothing now, you will have to disclose this prescriptive easement claim to any buyer of your home. Note: Permission generally terminates any potential adverse possession or prescriptive easement claim. After 10 years, however, your neighbors acquired a prescriptive easement. Therefore, your certified letter granting permission was legally void.

Those buyers are typically Baby Boomers in search of a casita, an attached suite or even a converted garage space to accommodate aging parents. “I’ve had several clients say, ‘I need a house that has a casita because my mom’s going to be living with us,’ � she said, adding that she believes the recent housing crisis and increasing health-care costs have a lot to do with the trend. “Health care is so expensive, you can eat up your savings so fast living in an assisted-living facility, and a lot of these older parents don’t need all the extra care but they’re paying for it. That’s why it makes more sense to live together.�

Mike Dowell, senior vice president of marketing for Lennar Homes’ Arizona division, said the Home Within a Home line has been available since late 2011, when the initial floor plan, dubbed “Evolution,� debuted in the East Valley subdivision of Layton Lakes. Today, there are 13 NextGen floor plans, nine single-story versions and four two-story options; some suites even have a one-car garage, patio or sec-

ond bedroom. In fact, he added, the line represented about 25 of the company’s home sales in 2014. From the beginning, the goal was to have a stand-alone home but also make the suite an integral part of the architecture. With these homes, Dowell said, “you don’t know (the suite’s) there.�

Although 68 percent of families who bought a Home Within a Home use the expansive suite for older parents, the additional space offers other uses as well.

Dowell said another 14 percent of buyers use the space to accommodate adult children, 10 percent use it as a home office, 4 percent use it as a guestroom, 2 percent convert it into a “man cave� and another 2 percent use it to house a roommate. The beautiful thing about the concept, he noted, is that it evolves with a family’s changing needs. Today, a suite might serve as a craft room, tomorrow it might serve as a lair for college-age boomerang kids and, 15 years from now, it might be a home base for elderly relatives.

“Now, we are at a similar moment where a new idea of retirement is being born in the Phoenix area with Victory.�

Competition to attract Boomer home buyers is stiff. Victory opens as more than 1,000 active-adult communities are under way or on the drawing board nationally.

More than 3,000 people toured Victory the weekend before sales started.

Nick Taratsas, DMB senior vice president and general manager of Victory, said

he talked to potential buyers from across the country, Canada and the Valley at the community last week. “The big patio was packed at Victory.

We plied our potential buyers with food and wine, and many looked at home sitting there enjoying the view of the mountains and the model homes,� he said. “We are pretty happy with the feedback from builders and potential buyers so far.�

DMB doesn’t yet have a tally for sales

Flexibility is key Lennar is far from being the only builder attuned to this rising need. Dennis

Webb, vice president of Tempe-based Fulton Homes, said some of Fulton’s floor plans allow homebuyers to carve out an inlaw suite by converting a two-car garage, then adding an oversize RV garage for vehicle storage. “Everyone wants a little bit different configuration,� he said, and the key to successful homebuilding right now is flexibility. Indeed, he said Fulton Homes’ ability to customize a comfortable guest suite, at a reasonable price, has landed the company sales that might not otherwise have happened.

Moser’s sister was so impressed by the setup he’d found that she and her husband decided to purchase the home to the left of the Mosers, complete with a mini home for her in-laws. Then, Moser’s mother-inlaw decided to move from her longtime Phoenix home and purchased the home to the right of their house. Although the lifestyle his family has chosen is not for everybody, he said he thinks multigenerational options are going to be more of the norm in the future. “With the economics we’re all facing, I think this will push people to live together,� he said.

Some researchers don’t think the next wave of retirees will move in droves from their hometown to retire like their parents did. How many houses sell in Victory during the next few months, and where the buyers come from could be an early indicator of what many Boomers will want.
