Home sales above $3 million soar in Valley Election jitters may have kept some metro Phoenix homebuyers on the sidelines.

But the biggest spenders weren’t deterred.

Multimillion-dollar mansions were a hot commodity in the Valley during September with seven selling for prices above $3 million, according to Walt Danley Realty's latest luxury home market

report. And many of the buyers paid cash.

In September 2015, only one house with that hefty price sold in Phoenix.

Also, we already know October will be another good month for home sales above $3 million.

Several buyers, including Phoenix Suns guard Eric Bledsoe shelled out that and more for Valley estates. Billion-

aire oilman and Portland hockey team owner William Gallacher paid $11.11 million for a mansion in north Scottsdale.

The big-dollar buying spree comes after a bit of slowdown in the area’s high-end housing market.

Special power of attorney Question: My brother is taking a two-year sabbatical for a mission to Africa and wants to give me a power of attorney to hire a real estate broker to sell his Chandler home. Do we need to do this?

Answer: In this internet age, I question whether your brother needs to give you a power of attorney. If your brother still wants to give you a power of attorney, I would recommend a special power of attorney.

A special power of attorney is limited to authorizing the sale of a specific asset such as this Chandler home. (On the other hand, a general power of attorney would give you control over all of your brother’s personal and real property.) This special power of attorney must meet the requirements of the title company that will insure the title for any buyer, so I would suggest that you contact the title company that will be used for the sale of your brother’s Chandler home to get a special power of attorney form approved by that title company.

Note: Although you can get forms for a power of attorney online, or at a stationery store, many of these forms do not have language required by a title company, e.g., the requirement that the power of attorney specify the method of terminating the power of attorney.

I have an issue with a renter in my complex that lives below me. My lease specifically states no smoking, yet this renter smokes in his apartment without any regard to other tenants. I’ve brought this matter repeatedly to management over the last 6 months without any solid result.

I have pursued this question with the landlord/tenant agency for the City of Phoenix and a non-profit organization. The non-profit made several attempts to speak with the owners of the property without success.

The apartment manager will not allow the non-profit a way to discuss making this multi-housing facility a non-smoking complex with the owners.

The complex advertises they have a “non-smoking” policy on their leasing office and supposedly does not allow renters to smoke in their apartments.

I am at a dead end. I cannot find any other source to talk with the owners of this property. Obviously, I will be the one that will have to move.

If the lease specifically states no smoking inside the apartment, the resident that is complaining about the neighbor smoking should submit a written non-compliance notice to the landlord. This notice is pursuant to A.R.S. § 33-1361 of the Arizona Residential Landlord and Tenant Act. The notice gives the landlord five (5) days in the case of health and safety issues or ten (10) days to correct the problem.

If they do not correct the problem within those time frames, the tenant can legally break the lease and move out. This would be your only recourse in this particular situation. You could also sue for damages if you can show you suffered some sort of injury as a result of the landlord’s failure to enforce their own lease.

Children and adults should strive to understand more about autism and how it impacts those who live with it. Thanks to the heroic efforts of leaders like Denise Resnik, founder of SARRC, researchers and community leaders, SARRC is building First Place, the first residential property where adults with autism can live more independently and receive supportive training and services. Recently, Phoenix was recognized in a PBS News Hour story as a city that is leading the way for adults with autism because of programs like this. This housing development and the pilot apartment living program at 29 Palms in Phoenix stand as models for

how apartments can offer healthy and safe living opportunities.

The demand for housing options for those with autism continues to grow.

Nearly 1 in 68 children have been identified with autism spectrum disorder according to the Centers for Disease Control and Prevention. As these youth grow into adulthood, apartment living can be a positive place for them to develop and thrive.

The AMA has embraced the role the industry can play in helping residents and apartment management companies

understand the impact autism has on our residential communities and offering more tools for education and awareness.

Arizona Multihousing Association has developed a committee of members to help raise funds and awareness for nonprofits working on these issues. Our industry will continue to work to educate operators on how they can create more residential opportunities and support systems for adults with autism.
