bers are growing — can face a complicated question: whether to charge rent, and how much. • Circumstances vary by household. • For Terri Gifford, a self-employed mom in New Rochelle, N.Y., who renovates old homes, it wasn’t an easy decision. • Gifford and her husband, Peter, agreed with their 23-year-old son, Brian, that he’ll pay them $300 a month in rent. He has lived in their house for two years, since he graduated from Harvard University. At first he didn’t have a job, and now he works as a paralegal in a law firm, gearing up for his marriage in November and taking the Law School Admission Test in October. See RENT, Page 3R

If you’re looking for a house now, it probably will take a little longer to obtain a mortgage to buy it. The expected delay is due to a new federal rule that’s supposed to give consumers more protection when they’re making one of their biggest financial decisions. The “Know before you oweâ€? requirements went into effect last week. The biggest change for borrowers will be the three days they get to review all the final costs of their home loan before they sign. In the past, many borrowers didn’t see a final tally of their mortgage costs until the day they signed. “Even if you have bought and sold many homes in the past, if you applied for a loan today you would be surprised at the number of changes due to the new rule,â€? mortgage lender and expert Amy Swaney of Scottsdale’s Citywide Home Loans told me. Swaney, who recently was named one of Housing Wire’s Real Estate Finance’s Women of Influence for 2015, said there are new forms for mortgages that must be given to borrowers in “mandatory time framesâ€? and that have required “cooling offâ€? periods attached to them. Here’s what homebuyers taking out a mortgage now can expect: Âť A loan-estimate form three days after they apply for a mortgage that they must agree to before an appraisal is started. Âť A full-disclosure of their exact loan costs three days before they close. Âť A three-day delay on their closing, if they don’t receive their mortgage-cost disclosure form in time. Dean Wegner of Academy Mortgage has become an expert on these federal requirements, which officially are known as TRID, or the Truth in Lending Act (TILA) and the Real Estate Settlement Procedures Act (RESPA) Integrated Disclosure Rule. “This entire process is to slow down the finance portion of buying a home so that consumers can be informed of financing options,â€? said Wegner, who sits on the Arizona Department of Real Estate’s TRID Committee. “And so they can better underSee REAGOR, Page 3R

Question: We signed the standard Arizona Association of Realtors residential purchase contract for the purchase of a $280,000 Prescott home. One week before the close of escrow, a large pine tree in the backyard fell over during a monsoon storm. Does the seller have the responsibility to replace this large pine tree? Answer: The standard residential purchase contract provides that, if there is any loss or damage to the premises during escrow by reason of an act of God, the risk of loss is on the seller, provided that the cost of repair will not exceed 10 percent of the purchase price. If the cost of repair exceeds more than 10 percent of the purchase price, either the seller or the buyer can cancel the purchase contract. “He’s not making a ridiculous amount of money,” Gifford said. “I didn’t really want to charge him rent, but Brian wanted me to. He felt better about it. I didn’t think $300 was a crazy amount of money. “My son wanted to contribute, and we came up with an amount where he felt like he was contributing, but that he wouldn’t be broke and could save for his future.” According to a Pew Research Center study in July analyzing Census Bureau data, Millennials — defined as those ages 18 to 34 in 2015 — are now less likely to be living independently of their families and establishing their own households than they were during the depths of the Great Recession, which began in 2007 and ended in 2009. In the first four months of 2015, Pew says, the share of young adults living in their parents’ homes increased to 26 percent from 24 percent, despite the uptick in employment and full-time jobs since 2010. The study doesn’t take into account rent or an increasing number of Generation Xers — ages 35 to 51 — who also have moved home with Baby Boomer parents. With another, younger son who’s away at college and her husband working long hours in construction, Gifford, 56, said the rent Brian pays goes mainly toward food and other expenses. She loves to cook, and Brian, in turn, does a range of errands, from filling up her gas tank to going shopping and helping with the dog. He’ll be moving out after his wedding. “It’s definitely an adjustment, having an older child living at home. I can’t ask as

many questions,” she said. “But he’s a great kid. He’s very independent, and very family-oriented. … I think Brian is pretty appreciative of the fact that he saves money, and I help him out quite a bit.” Raven Brown, 35, on the border between Millennial and Gen X, has lived with her mom in her mother’s three-bedroom apartment in Manhattan since 2009. Brown is a Ph.D. student in public and urban policy at the New School and works as a researcher. She wanted to help her mom, who has chronic health problems, and she has huge school loans. She’s been paying more than half of the apartment’s $2,200 a month rent since February. “We talked about it and it seemed like a good amount. She likes to have me around!” Brown said, laughing. “Paying rent feels the same as not paying rent. It’s helpful to my mom. … We’re a close family.” After losing her job in 2008, Rossana Alvarado, 41, a stay-at-home single mom with an 11-year-old son, Noah, and a 17month-old son, Oliver, moved back to the four-bedroom house that her mom, Consuelo Martinez, 75, and stepdad, Al Marti-
nez, 71, own in La Puente, Calif. She moved out in 2014 but came back last July. “The negative part is that it’s embarrassing,” Alvarado said. “Everyone will tell you not to be so embarrassed, that it happens to a lot of people. The good feeling is my mom felt like a mom again. I was given this chance to bond with her, and I’m happy Noah and my mom have bonded beyond what I could ever hope.” The first time around, her rent to her parents was set at $500 a month, she said. It increased to $600, with food costs included, when she came back. Alvarado receives disability income monthly. Her mom and stepdad, a retired electronics technician, bumped up the rent because there was another mouth to feed: her second child. “To me, there aren’t any complications charging rent. I love Rossana very much,” Al Martinez said. “The understanding was, ‘I’m helping you. You’re helping me. I would have you here for free if I could afford it.’ “I’m retired and don’t have an income, except Social Security and one small pension and my wife’s Social Security. Charging rent is a given.”
stand the 30-year financial obligation they are agreeing to.” The new mortgage rule, created by the Consumer Financial Protection Bureau, was supposed to go into affect earlier this year but was delayed so more lenders and title agencies could prepare for it. Now, lobbyists from the real-estate and lending industries are asking federal lawmakers to move implementation of the rule to early 2016. But the White House has said it will veto any legislation that delays implementation because the rules are intended to inform and protect consumers in the mortgage process. Subprime mortgages with high interest rates and hidden costs were pushed by some big lenders during the boom because of the bigger fees they generated. Many borrowers who took out the loans didn’t understand them and couldn’t afford the payments. Many of those bad loans led to foreclosures and the real-estate-market crash in 2008. “I think it is a good thing that the borrower will have time to think about any unexpected changes to his or her loan terms,” said housing expert Mike Orr with the W.P. Carey School of Business at Arizona State University. After all, what’s a three-day delay on a mortgage that you could be making payments on for 30 years?

Simple actions will improve fi re safety in your apartment Since this week is national Fire Prevention Week (National Fire Protection Association), it’s a great time to talk about fire safety at home. Test your smoke alarm. Take a minute to test your smoke detector and ensure all are operating properly. Have an escape plan. Running a little
exercise where you and your family test out a route to get out will make an emergency less scary. Be aware while you are cooking. Forty percent of home fires start in the kitchen and unattended cooking can be a major factor in a fire. Learn how to put out a fire on the stovetop and in the oven. Keep a fire extinguisher handy in the kitchen. Teach
your children about how to properly use the microwave and stove to prevent scalding burns. Only invest in a space heater with auto-off or overheating protection. Always turn off heaters and be sure they are operating away from anything that could catch fire like furniture or curtains. Be very careful with candles. Place
candles away from other objects. Never go to sleep while a candle is still burning. All of these tips are simple and fast. Take some time out this week to talk with your family about fire safety. A.R.S. 33-1375 states that the landlord or tenant must give at least thirty (30) days written notice to terminate a month to month tenancy, or an existing lease agreement on its expiration. It is not unusual to see these sixty (60) day notices. Many property management companies are now requiring it. A landlord cannot change the notice requirement in the middle of an existing lease, only renewals or new leases.
