Time was, young families with average incomes who were shopping for a first house would choose a small one in an affordable neighborhood — maybe with just a hint of a yard and a carport, rather than a half-acre lot and a twocar garage.

Qu es t i o n : When we purchased our Buckeye home we were in Phase One of the subdivision. The developer’s sales agent said that Phase Two and Phase Three of the subdivision would have larger homes on larger lots. The sales agent said that, therefore, our lower-priced home would have strong appreciation in value.

The homes in Phase Two and Phase Three have recently been completed, and these homes are smaller homes on smaller lots. The sales agent no longer works for the developer. Do we have a claim against the developer for damages because of the sales agent’s false representations?

An s w er : If you can prove that the sales agent knew at the time that the representations were false, then you should have a claim against the developer for the fraudulent representations of its sales agent.

If at the time of the representations the sales agent honestly believed that Phase Two and Phase Three would have larger homes on larger lots, and that due to an unforeseen change in circumstances, e.g., financial difficulties of the developer, the developer was required to decrease the home size and lot size in Phase Two and Phase Three, you probably would not have a claim against the developer for damages.

Note: a purchaser of a home in a subdivision should always read carefully the subdivision public report required by the Arizona Department of Real Estate because the developer is required to disclose in the subdivision public report all material facts about the subdivision.

Romem offers one way to prevent them from going the way of wall-to-wall carpeting. “ I think that one solution for people who are finding it hard to afford a home today is to seriously consider which city they want to live in,” he says. “ It’s extremely hard to be a first-time homebuyer in the expensive coastal cities — not just in San Francisco, but in L.A. and Seattle, and on the East Coast as well.”

He suggests would-be homeowners consider more affordable locales, such as Texas, Atlanta or parts of the Midwest. “ It’s a big deal to move, but that can make the difference between being able to buy a home and being a renter until the day you retire,” he says.

Bu y ing the second home first A starter home is “ smaller, it’s cheaper and in an area that might not be in an area where you eventually want to settle down,” says Dr. Issi Romem, chief economist for BuildZoom, a real estate construction marketplace. But these days, first-time buyers aren’t choosing starter homes.

That’s partly because novice homeowners have become “ a financially select group,” according to Romem. “ Not everyone who would have become a first-time homebuyer a few years ago can become one now,” he says.

Stagnant wages, rising home prices and tight housing inventory are skewing the population of buyers toward higher earners — and they’re buying bigger homes.

In fact, in 2013, first-time buyers purchased homes with an average 1,845 square feet, while the average home in the U.S. is just 1,819 square feet, according to Romem’s analysis of data from the Census Bureau’s American Housing Survey. “ So those homebuyers who probably would have been looking for the lowestend homes 10 years ago during the housing boom are today just not able to buy.

And those that are able to buy are looking further upmarket,” Romem says.

and planning to upgrade in five years or so, first-time homeowners are buying and staying put, according to research conducted by the National Association of Realtors. “ When they do purchase, they’re planning on living there longer than buyers that we’ve seen in the past,” says Jessica Lautz, NAR’s managing director of survey research. “ They’re expecting to live there 10 years.”

That trend is borne out in another survey, fielded by Bank of America in early

2016. The research found that 75% of first-time buyers would prefer to skip the starter home stage and find a house that meets their present and future needs.

And more than one-third of those surveyed (35%) said they intended to be “ one and done” — actually planning to retire in their first home.

Sav ing the starter home So is this the end of the starter home?

NAR’s research also finds that 80% of first-time homebuyers are still purchasing single-family homes.

Romem says that trend is unlikely to continue if economic pressures and construction trends don’t change. That means a fundamental shift in what we consider a starter home. “ We might not all be able to raise our kids in single-family homes anymore,” he suggests. Instead, parents will likely be raising families in condos, “ the way people in other parts of the world do.”

His final piece of advice is blunt. “ To be realistic, first-time homebuyers should just accept a condo — or accept that they need to move to Texas.”

Tips for enjoying the outdoors in a community setting The beginning of fall, and the break in the heat, inevitably means it is time to head back outdoors. The covers can come off the outdoor furniture so we can enjoy morning coffee or evening dinners on the patio. Patios and balconies in apartment communities are popular amenities and they should be used often, while still respecting your neighbors and the community.

doors? Be sure to collect all of the dirty dishes and food from the table and return them inside. If you have music playing outside, maintain a volume that allows your neighbors to enjoy their homes as well.

Before investing in an outdoor furniture set for your patio, review your lease. Some communities have restrictions outlined in your lease that recommend certain types of furniture, and most require you have seating intended for outside. Many communities prohibit

umbrellas on patios because of safety issues.

For those of us who love plants and flowers, many communities allow you to grow and display these on the deck.

There are likely rules about the health of those plants and how far they can extend beyond your patio. If you have been planning on a bird feeder, check to see if these are allowed.

Your management company wants to keep the community looking great and safe for all residents.
