Need to perk up your property pronto and add some ambience?

It’s hard to beat citrus trees for their organic beauty and — particularly important in the low desert — their shade. Those waxy green leaves are a huge plus, too, because they stay lovely yearround, consistently lending color to your landscape. And thanks to the bounty they provide, citrus, along with other fruit and nut trees, of course, score major bonus points over their other branched brethren. After all, who doesn’t appreciate their sweet rewards? “You don’t have to go to Fry’s or Bashas’ � to gather oranges, grapefruit, lemons and limes, said Joshua Grabenbauer, a certified nursery professional with Moon Valley Nursery in Chandler. “You just go to your backyard.�

Most varieties of citrus grow well throughout the Valley, as do many varieties of deciduous fruit trees, including apples, apricots, figs, peaches, persimmons, plums and a few pears, said Debora Moritz, a Valley-based master gardener with the University of Arizona’s College of Agriculture and Life Sciences Cooperative Extension. In more temperate parts of the state, folks also have success growing varieties of nuts and cherries.

So if your environs could use some enhancing, do a little research. Moritz recommends the Extension service’s website at extension.arizona.edu/ for some tips and insights from her and Grabenbauer.

Then get outside and don’t be afraid to get a little dirt on your hands. (And if you are, plenty of Valley nurseries will do the planting for you.)

Qu es t i o n : We live in a gated community in Chandler. There are covenants, conditions, and restrictions (CC&Rs) that should be enforced by our homeowners association. Due to the economy and numerous foreclosures in our gated community, there has been a shortage of funds in the bank account of our homeowners association.

The result is that the swimming pool and other common areas have not been properly maintained, and violations by individual homeowners of the CC&Rs have not been enforced for years.

A new board of directors and a new property management company have recently done a wonderful job in correcting the maintenance problems with the swimming pool and other common areas.

There are still major violations of the CC&Rs such as homes painted with an unapproved color, and minor violations of the CC&Rs such as flower pots at the front door and weird porch light fixtures. Has enforcement of the CC&Rs been waived because these violations have gone on for years?

Even if these violations by existing homeowners have been “grandfathered,� can the CC&Rs be enforced against new homeowners?

An s w er : CC&Rs typically have a non-waiver provision, which is enforceable under Arizona law. A nonwaiver provision provides that a failure by the HOA to enforce a restriction of the CC&Rs in the past should not waive the right to enforce the restriction in the future. For example, if the HOA fails for years to enforce a paint color or landscaping CC&R, the HOA should still be able to enforce this CC&R against both existing and new homeowners.

Grabenbauer said lemon trees are hardy specimens that grow vigorously and produce a lot of fruit even in tough conditions and with occasional neglect.

“Arizona has the worst soil in the nation, and the lemon tree does fine out here,” he said. “Not everyone has a green thumb, but a lemon tree is not going to die on you as long as you follow our planting and watering instructions. You do that, and you’ll have a highly productive, fruit-bearing tree.”

Moritz is a big fan of the Meyer Lemon, which she believes probably has an orange somewhere back in its ancestry because of its sweeter, less acidic taste.

“It’s a great lemon for baking because you can use less sugar in your recipes since you get great lemon flavor without the sourness,” she said, noting it also has a more compact size than other lemon varieties, making it a good choice for tight spaces.

She recommends finding a plant labeled as an “Improved Meyer Lemon,” which designates that the plant has been inspected and is free of the citrus tristeza virus, a disease carried by different kinds of aphids.

Oranges: To eat or not to eat And there’s no need to feel limited to lemons, Grabenbauer and Moritz said. Arizona Sweet oranges are wonderful for juicing and eating out of hand, he said, and if you’re on the lookout for a beautiful hedge, try planting

several sour-orange trees. Just be forewarned that this variety does live up to its name; the fruit is not for eating (it also produces long thorns on its branches). Nevertheless, its verdant appeal and fragrance are a nice addition to any yard.

Moritz favors pigmented oranges, also known as blood oranges, including Moro, which is good for eating and juicing, and boasts a nice hint of raspberry. Segments of another blood orange, Cara Cara, work wonderfully in salads. She also likes Dancy mandarins, which are heavy producers, easy to peel “and the fruit holds well on the tree so that I can have fruit from November almost into May.” “The fruit gets sweeter and sweeter as it remains on the tree.”

That said, Moritz noted that personal taste should guide your selection because, after all, “it makes no sense to spend the time and energy on growing fruit you won’t use.”

Keep citrus looking good As for its looks, citrus originated as Southeast Asian subtropical shrubs and healthy plants require little pruning, Moritz said. In the desert, citrus trees actually are “two trees in one.”

The fruiting variety is grafted onto a desert-adapted root stock. Any small branches that sprout out below the graft will be root stock and should be removed because it will not produce the fruit you want. In addition, “water sprouts” or “suckers” — weakly attached branches that grow rapidly — should be removed. And in spite of the fact that you’ll see lots of trees “skirted” — meaning the lower branches have been removed to expose the

trunk — this practice “actually increases maintenance and decreases fruit production,” she said. “But people copy what they see done around them.”

Citrus trees are naturally low-branching, so she prunes up to a foot off the ground.

The low branches shade the root zone, allowing it to stay cooler and retain moisture.

Citrus bark is more like “skin” and is subject to sunburn in the Valley’s environment, so a latex-based paint applied to the trunk can provide a temporary shade screen.

She said homeowners also should keep in mind that although some varieties of citrus will grow here, the plants may not be well adapted to the intense desert heat, so production could suffer. Similarly, low-desert citrus varieties are desert-adapted but they’re not native, so they will always require more water and more nitrogen than desert trees.

Once established, however, citrus does well with just regular deep watering and routine fertilization.

One more insider tip? Don’t put limes and citrons in the front yard, Moritz said. Limes are frost sensitive, so they should be planted near a structure that can provide protection. And citrons, which often have “amazinglooking fruit” like the Buddha’s Hand variety that features fingerlike appendages, “tend to be more scraggly looking trees.”

Before renting a home or condo, check on HOA rules Renting a home or condo in a community with a homeowners association can have its own set of rules for care and behavior. An HOA can protect the rights of homeowners and renters, but there’s also a standard set of responsibilities that the renter and the homeowner share that should be reviewed and followed.

If you are renting in a multifamily

condominium development, it’s worth spending time reviewing the HOA guidelines so you don’t run afoul of them or incur fines unexpectedly.

ments offer assigned parking, and your owner will request your car’s license plate information for the HOA or security. If you allow guests to park in your space, you should notify the HOA. If you are renting a home in a neighborhood with an HOA, there will be different parking rules about street and driveway parking, and the length of time that cars are allowed.

The owner has filed a forcible detainer against me because my guest discharged a gun on the property when I was not home. Can I be evicted when I did not know anything about the situation?

Answer: Arizona law indicates that tenants

must conduct themselves and others on the premises with their consent in a manner that will not disturb neighborsâ&#x20AC;&#x2122; peaceful enjoyment of the premises. In another section of Arizona law, tenants are responsible for the actions of their guests, if the tenant could reasonably be expected to be aware that such actions might occur and the tenant did not attempt to prevent those actions to the best of the tenantâ&#x20AC;&#x2122;s ability. There is also United States Supreme Court case HUD vs. Rucker (one strike and you are out rule) that presents arguments that if a tenant gives access to a guest, then access means that the tenant has control of that guest.

If the guest is involved in such actions, then the tenant is responsible for those actions whether or not the tenant knew or should have known about the actions. There is not a specific case that has been tried in Arizona on this issue, but in my legal opinion, based on law and arguments mentioned above, it is more likely than not that eviction would be the likely result.
