Sunshine, affordable housing and lower taxes are drawing more Baby Boomers to Arizona.

Many in this huge group don’t want to retire like their parents but are picking the same state to do it in.

A couple of new rankings show Arizona, and particularly several Valley cities, are the most popular for Baby Boomers to move to after they stop working full time. » Arizona ranked second behind Florida for drawing the most people over 60, according to personal finance firm Smartasset. It analyzed the latest Census data from 2015 and found Arizona grew by 27,576 retirees. It also attributed the state’s low property taxes to the trend. » Mesa topped the list for U.S. cities with the most new residents over 60, drawing 3,442. Phoenix ranked No. 4 with 1,470, Chandler No. 5, with 1,458, Peoria No. 7 with 1,310 and Gilbert No. 8 with 1,002. » Tucson ranked No. 1 and metro Phoenix No. 4 in the nation for the best places to retire, according to apartment researcher Zum-

per. It analyzed crime, weather, demographics and health-care stats as well as rents for its ranking.

Started with Sun City Phoenix began to draw retirees in droves when Del E. Webb opened the first Sun City on the city’s western edge in 1960.

Sunshine, golf, affordable homes and the recent invention of inexpensive air-conditioning attracted retirees to the Valley.

The Valley’s Sun Cities multiplied over the next few decades.

Other “age-restricted” retirement communities with links, clubhouses and restaurants followed, including Sun Lakes in Chandler and Trilogy in Peoria.

Robson Communities’ Pebblecreek in Goodyear is now the topselling Valley community for buyers 55 and older, according to Belfiore Real Estate Consulting.

Poisonous oleanders may prove deadly nuisance to keeping goats, chickens Question: We have lived in Gilbert on a fiveacre lot for more than 20 years, and we have always had goats and chickens in our backyard. A new neighbor has planted oleanders on his side of the property line between our homes. We do not have the money to build a block wall to protect our home. We have

explained to our new neighbor that oleanders are poisonous, and that our goats and chickens could die. We offered to pay for the cost of removing the oleanders and for the cost of different plants. Our new neighbor rejected our offer. Is there anything else that we can do?

Answer: If the surrounding community is similar to your home with goats and chickens, your new neighbor may be lia-

ble for the tort of private nuisance. A private nuisance is an unreasonable interference with another person’s use or enjoyment of their property, and a court could order your new neighbor to replace the oleanders with different plants.

If the surrounding community has no other homes with goats and chickens, and has a significant number of oleanders, however, there may not be a private nui-

sance because there may not be an unreasonable interference.

Note: These types of disputes with neighbors generally occur when new home subdivisions start being built in rural areas.

Building for Boomers As Baby Boomers began to turn 50, builders started to try to figure out what this huge population nearing retirement would want.

It wasn’t clear then that Arizona’s sunshine and affordable home prices would be enough.

What was clear was many Baby Boomers didn’t plan on really retiring and want something different than

The rate on 15-year, fixed-rate home loans, popular with homeowners who

To calculate average mortgage rates, Freddie Mac surveys lenders across the country between Monday and Wednesday each week.

The average doesn’t include extra fees, known as points, which most bor-

One point equals 1 percent of the loan amount. T he average fee for a 30-year mortgage was 0.5 point, unchanged from last week.

The fee on 15-year loans also held steady at 0.5 point.

Developer DMB, known for its highend communities including DC Ranch in Scottsdale, decided to build for the huge group of potential homebuyers. In January 2015, it launched Victory at Verrado in Buckeye, and 250 people lined up to buy a home in the age-restricted community.

The demand from retirees reminded some of 1960, when hundreds lined up to buy in the first Sun City.

Some apartment communities tow unfamiliar cars There is nothing more frustrating than leaving an event and walking back to your car, only to find that you have been towed for a parking violation. Itâ&#x20AC;&#x2122;s time consuming and expensive to get your car back from the tow company.

To protect their property and the residents who live there, some apartment communities contract with towing companies to ensure their residents can access their spaces and cars that shouldnâ&#x20AC;&#x2122;t be there are removed. Cars abandoned in parking lots or unregistered vehicles can

create safety issues for communities and towing is a simple way to remove these dangers from the area.

For visitors to these communities, there are simple steps you can take to avoid having your vehicle towed away.

Remind your guests to double check for signage in parking lots. By law, there must be signage posted with contact information in parking lots being monitored. Most communities have prominent signage that shows where guest spots are.

This signage may be at the entrance to the lot so look for notices to guide you to legal parking spaces. Towing companies typi-

cally take photos of the car illegally parked before towing it. If you want to dispute the tow, ask to see the photos.

Only the company that is authorized to tow from a particular lot, may remove vehicles. Owners should check to be sure that the same towing company has your vehicle. You should also ask for a receipt for any fees you pay to the company.

Most towing companies only accept cash or credit cards; you may want to ask what method of payment is preferred.

Before you drive to the companyâ&#x20AC;&#x2122;s location, take a photo of the sign that states the fine or fees. Each city regulates the

size of the sign and the information that has to be included. You can also call the company to confirm their hours of operation. Ask if you need documentation of ownership or other paperwork to retrieve your vehicle from the impound lot.

Remember to be civil in your dealings with the towing company and/or management companies. If you feel that your towing was illegal, be sure to keep documentation of each step and contact legal counsel if needed.
