The Valley’s luxury housing market is picking up a bit after too many highpriced listings hit the market and overshot demand from deep-pocketed buyers.

Seven-figure home sales in the Phoenix area were up about 10 percent in March from the previous year.

“Overall, the first quarter of 2017 was a much busier quarter for million-dollar homes than in 2016,” Phoenix housing expert Mike Orr told me.

Almost 300 Valley homes sold for more than $1 million in March, according to the Arizona Regional Multiple Listing Service.

While most of those houses were in Paradise Valley, Scottsdale and Phoenix’s uptown, Biltmore and Arcadia neighborhoods, million-dollar home sales are also on the rise in some southeast and West Valley communities.

In March, there were about 2,300 houses with prices at $1 million or more for sale in metro Phoenix. Almost 350 of those had price tags above $3 million.

Most Valley luxury real-estate agents are happy to see the uptick in million-dollar home sales, but they also caution their clients prices at that end of the market aren’t climbing at the same paces.

Contracts on houses priced between $1 million and $1.5 million jumped 40 percent.

her car towed. Apparently signs were just posted saying “head in parking only” and her car was left in the backed-in position overnight. I contacted the management company to ask the reason for the new rule since it isn’t in the CC&R’s or rules & regulations for the complex. Also, shouldn’t I have been told about the new rule or asked to approve it as an owner? Please give your advice on how to proceed.

Answer: Unfortunately, parking problems in a condominium are routine. In many communities, there simply never seems to be enough parking spaces or parking areas themselves are too small, making it difficult to maneuver an owner’s vehicle. Even if an owner has an assigned space, the CC&Rs and rules often impose additional restrictions. In general, a condominium association exercises broad authority in regulating parking issues. In any condominium association, there are two possible types of restrictions (and protections) on parking: 1) the contractual CC&Rs; and 2) the requirements of Arizona statutes related to towing vehicles from private property.

In general, the Association can only enforce parking restrictions that are in the recorded CC&Rs or incorporated by a set of published Rules and Regulations. These restrictions must also be reasonable. This not only applies to the restrictions about parking (where to park, how long a vehicle can be parked, etc.), but it also applies to the method by which the Association can enforce those rules (i.e. imposing fines, sending a letter, booting or towing the vehicle). In this case, if the CC&Rs and rules do not discuss towing as a remedy for a parking violation, then the Association’s actions may be unlawful. Simply put, if the CC&Rs are silent as to towing as a remedy for a parking violation, the tow may be wrongful and the Association may be liable for the charges an owner would incur in retrieving the vehicle.

In considering the same facts with regard to Arizona’s laws about towing, the Association’s actions in

this case are even more of a problem. The state statutes (A.R.S. 9-499.05) prohibit a private property owner (here, the Association) from towing a vehicle unless there are signs posted at the property. The law requires that those signs provide the following information: 1) the restrictions on parking; 2) what happens to vehicles violating the parking restrictions; the maximum cost to the owner of the vehicle, including storage fees, etc.; and 4) the telephone number and address where the owner can locate the vehicle. These signs must be “clearly visible” and readable from anywhere in the parking area. Signs must also be posted at each entrance to the condominium complex.

It is obvious that a “head in parking only” sign is insufficient to warn an owner, tenant, or guest that the vehicle could be towed. Even if the CC&Rs contained clear restrictions listing towing as an available remedy for a violation, this community’s lack of proper signage is unlawful. The condominium association could be liable to the owner and/or the tenant for the improper tow.

Planning your move eases stress at end of school year Next weekend cars, trucks and moving vans will be pulling up outside of dorms and apartment buildings across Arizona. Students will be wrapping up another school year and leaving their dorms rooms behind.

For these students (and those helping them move), planning the move can be stressful. Many dorms require that students leave within a day or two of completion of their exams. Hundreds of people moving boxes, looking for parking

and pulling dollies, will swarm campuses, all with the same goal.

Universities often give students a list of action items to prepare and execute to complete their move out.

Set a timeline: Schedule an appointment with the resident adviser or manager for your final walk-through. This will prevent you from scrambling to find someone to help when everyone else is doing the same.

Coordinate with roommates: Review how you’ll with any final fees before students leave for summer break.

Dispose of discards responsibly: Check ASU’s “Ditch the Dumpster” program to learn about how you can recycle and upcycle items. The university has teamed with local nonprofits to take quality unwanted goods and recycle them to benefit the community. This keeps waste out of landfills and helps individuals and families in need.

Clean up your apartment: It can be tempting to leave trash or not to do a final cleaning. Most college dorms and apartments charge a cleaning fee if you leave a mess.

Protect yourself: The chaos created by friends and parents coming in and out of buildings can make it easier for thieves to get into buildings during a busy moving week. Stay extra vigilant and don’t prop open doors or leave your room open while you run to your vehicle.

The end of school year comes fast and it can be tough to study for finals and plan for a move at the same time. Planning can ease the stress.
