Northern neighbors Canadians are spending big across the U.S., but in the Valley, they’re selling more homes than they are buying Oh, Canadians, why aren’t you buying more homes in metro Phoenix?

Our neighbors north of the border are spending a record amount on U.S. houses, but their pace of purchases hasn’t picked up much in the Valley.

Canadians spent about $19 billion on American homes during the past year, says the latest National Association of Realtors report. That’s more than double the $9 billion they spent during the 12 months that ended in April 2015.

Arizona housing analyst Mike Orr told me Canadians bought 44 Valley homes in June. That’s up from 36 in June 2016, but is “dismal” compared with past years, he said.

‘Adverse possession’ won’t help man keep building Question: I recently read in the newspaper about a gentleman who had owned a building for many years in a Maricopa County “island” near Tempe.

The gentleman lost the building be-

cause he technically never had title to the land under the building.

Didn’t the gentleman acquire title to the land under the building by adverse possession against Maricopa County? If not, would there have been a different result if he had paid property taxes for all of those years?

Answer: First, the law of adverse possession generally does not apply to land owned by the United States, or by a state, county or town. Therefore, the gentleman who owned the building would have no adverse possession claim against Maricopa County for the land under the building.

Second, payment of property taxes can be a factor in a claim for adverse possession in some states, but is generally not a factor in Arizona.

HONOLULU - A Honolulu apartment high-rise where a blaze recently killed three people failed to update its fire alarms to meet safety standards despite an engineering firm recommending the changes after another fire four years ago, city records show.

The Associated Press acquired the engineering firm’s 2013 report, which found fire alarms in the 36-story complex did not meet the city’s fire code because they were not loud enough and did not have flashing lights. The firm recommended replacing the system.

The residential tower built in 1971 was not required, however, to meet the standards because they were not part of the fire code at that time, so property managers broke no laws. Several residents said they had trouble hearing the fire alarms during the July 14 fire, and fire safety experts say those warnings are crucial to saving lives.

The Honolulu Fire Department declined to release its inspection records for the Marco Polo building, citing the ongoing investigation. An AP review of permits filed with the city’s Department of Planning and Permitting revealed that building managers never applied for permits to upgrade the system.

Buying bargains Canadians went on a metro Phoenix buying spree during the housing crash, when foreclosure homes were bargains, and the loonie was worth more than the dollar. They were behind 6 percent of all

in apartments, strobe lights or other visual aids installed in common areas, and hallways with smoke detectors.

Honolulu only requires older buildings to bring their alarm systems up to code during a major renovation, said Curtis Lum, spokesman for the planning department.

Building managers commissioned a fire safety assessment by the engineering firm S.S. Dannaway after the 2013 fire. It found that fire alarms within the apartments were not loud enough and recommended adding speakers to the main living areas and bedrooms of every unit.

It also said the system did not have visual triggers in hallways or common areas and didn’t detect smoke in inside hallways.

“You have to have a working fire alarm system that can notify the occupants in the event of a fire,” said Samuel Dannaway, lead author of the report and now vice president of fire protection technology with Coffman Engineers.

“It’s extremely important. It’s so basic to what we do, especially in these very tall buildings.”

His report recommended replacing the system at a cost of $1.2 million, but that never happened. It also suggested adding a sprinkler system for $4.5 million, which also was not done but isn’t required of older buildings in Hawaii and many other places.

After this month’s fire, Honolulu Mayor Kirk Caldwell introduced a mea-

sure to require residential high-rises to install sprinkler systems and have audible fire alarms throughout the building.

Several residents who escaped the blaze, which broke out on the 26th floor, said they didn’t realize they were in danger until they opened their doors.

“It didn’t sound quite like a normal, traditional fire alarm,” said Air Force cyber-technician Cory La Roe, who lives on the fifth floor, adding that there were no announcements or flashing lights when the fire ignited.

Gordon Kihune, who has lived in the building for about 12 years, said he didn’t hear the alarms until he opened his apartment door on the 13th floor. He said he has a hearing problem and there were no lights for people who are hearing impaired.

Angela Kim, who lives on the 30th floor, said she can only hear the sirens if her apartment door is open.

Michael Anderson on the 17th floor said he has heard alarms and seen flashing lights at the end of the hallway during fire drills.

“If people on the fire floor . didn’t hear the alarm, that would be a yellow or red flag for the investigators,” said Robert Solomon, a fire protection engineer with the National Fire Protection Association.

The organization sets safety standards for local, state and federal jurisdictions to adopt. It says high-rises, especially those without sprinkler systems, should have alarm systems with loud sirens, flashing lights, a voice announce-

ment system for firefighters to guide evacuations and self-closing doors to help prevent flames from spreading.

The association’s guidelines do not require updated fire alarms in older buildings to bring them up to code unless the system is so old that replacement parts cannot be found or other problems lead fire departments to mandate it, Solomon said.

Dannaway said his firm inspected several other Honolulu high-rise buildings with old fire alarm systems and “all of them have that same audibility problem.”

Asked whether the Marco Polo highrise had made any of the changes recommended in 2013, Andrew Fortin, spokesman for Associa Hawaii, which manages the building, said he could not comment because the questions were the subject of the ongoing investigation.

Honolulu Fire Capt. David Jenkins said he could not answer for the same reason.

Longtime resident Thomas Schmidt, who lives on the 26th floor close to where the fire started, said many apartments have louvered doors with horizontal slats that allow ocean breezes to cool the units, but he said those doors may have contributed to the fire’s spread.

“I’m absolutely overwhelmed with joy that I’m still here, because my neighbors across the hall are all dead,” said Schmidt, 74. “If we had been home, I might have got burned up in the fire, too.”

Valley home purchases then.

But then in 2015 as home prices began to bounce back and the loonie fell against the dollar, Canadians began to sell more Arizona houses than they purchased.

Last summer, housing expert Tom Ruff of The Information Market did an analysis on Valley homes bought and sold by Canadians using north-of-theborder tax mailing addresses on property records.

He concluding that for every Canadian buying a metro Phoenix home, another nine are selling.

Diane Brennan, a Scottsdale real-estate agent, host of “That Real Estate Show” on TV and radio and a native Canadian, told me any data showing a big increase in Canadians buying Arizona homes doesn’t make sense to her.

She said most of her clients from her home country are selling Arizona homes

for nice profits and buying elsewhere in the U.S.

as, California and New Jersey were the only other states to rank ahead of Arizona.

Homebuyers from Europe are offsetting some waning demand from Canadians in metro Phoenix, says the Realtor report.

When I wrote about the trend of more Canadians starting to sell instead of buy in the Phoenix-area last year, I received many emails and calls from Canadians telling me how much they love Arizona’s desert and don’t plan on selling.

We owe our neighbors to the north a big thank you. The record number of Canadians buying Valley houses during the crash helped our housing market recover more quickly.

And who can blame an owner for selling when the value of their house has more than doubled? That’s part of the American way.

International draw “I had many international clients — mostly Canadian and Chinese — during 2010 and 2011 when Phoenix AZ had firesale pricing on housing. Much higher current prices coupled with a stronger U.S. dollar have brought my international buyers to a trickle,” said an unnamed real-estate agent from Arizona, who responded to the Realtor survey.

Despite the drop in Canadian homebuyers, Arizona ranks fifth among U.S. states attracting the most international homebuyers, according to the Realtor’s report.

RENTER’S Legal Q & A Question: My landlord is charging me for water usage. My unit does not have a separate meter.

I do not believe that they can charge me water if they cannot tell how much water I am using. They say they will not accept my rent payment unless I include the $30.00 water charge. What are my rights?

Answer: If you lease includes a provision that the tenant will pay the water and the allocation method is described in the lease or in an addendum then the landlord may charge in that fashion. Units do not need to be separately metered. Look into recycling options for your apartment community Living in an apartment community offers so many advantages for individuals and families looking for the right combination of amenities and convenience. Most newer communities offer a long list of specialized amenities to make life there easier and fun. One of the few challenges in an apartment community may be recycling.

The majority of the newer apartment communities offer on-site recycling, in a variety of ways. Some communities have

bins and some even have a valet service where residents just leave recyclable items on their doorstep. Some management companies have added community recycling bins on-site and have a private contractor pick up the items.

For those communities that don’t offer recycling, there are many ways that residents can still participate. Some cities have recycling drop-offs where community residents can take their items regularly. It’s easy to check with your city to see if they offer this service. Using a small, clean bin at

home to gather your recycling can make this easy.

One of the most important things to remember when recycling is that items need to be clean and free of plastic bags. Recycling plants often report dirty garbage like pizza boxes in the recycling bins. Cans with leftover food or dirty food bags slows down the recycling process and can attract unwanted pests into the trash. Please do not bag or tie recycling either. Plastic bags cansnot be recycled in commercial or household bins; they can get caught in the sorting

machine. You can always reuse grocery store plastic bags or return them to the store for recycling.

Recycling processes continue to improve and many are working to reduce overall trash and waste. Each of us has a part to play in this and it’s great to take advantage of opportunities at work, at home, and in restaurants to help keep waste out of landfills.
