One Phoenix homebuyer thought he had found a great deal when Zavier Kay Hafiz of ZK Group sold him a house in 2012 and even provided the financing.

The buyer was making regular monthly payments to Hafiz when another lender began foreclosure on the house.

An FBI and Arizona Attorney General’s Office investigation found that Hafiz, also known as Xavier Hafiz DeAnda and Hafiz K. Sanad DeAnda, had taken out his own loan on the house. He wasn’t making payments on that loan, which the buyer knew nothing about.

The investigation found Hafiz, 31, misled almost 40 other homebuyers on similar real-estate deals in Arizona. In May, he pleaded guilty to fraud and was sentenced to six years in prison and ordered to pay $3.5 million in restitution.

Thanks to bad deals like the ones perpetrated by Hafiz, Arizona ranks No. 4 nationally for mortgage fraud, according to a leading monitor of the crime.

During the past year, federal and state regulators have cracked down on dozens of fraudulent real-estate deals in Arizona that have cost homebuyers and investors hundreds of millions dollars.

In May, former Phoenix contractor Paxton Jeffrey Anderson was sentenced in U.S. District Court to eight years in prison for mortgage fraud .

His bookkeeper, Joseph John Plany, got a four-year term. They were ordered to pay $3.27 million in restitution for lying to lenders to get construction loans, often in the names of their friends and family without their permission.

Anderson and Plany would use the money from the construction loans for their own expenses, including trips to the Kentucky Derby and gambling, according to court documents. Many victims of the scheme lost homes to foreclosure and were forced into bankruptcy. “Anderson was the mastermind See REAGOR, Page 3R

Qu es t i o n : We recently bought a 10-acre ranchette in Mesa. Shortly after we closed, my wife was riding one of her horses in the rear portion of our corral, and her horse fell. We discovered that there was a large fissure that had only been partially filled in before being covered with dirt. We hired an engineer who determined that there was not only this large fissure, but also two smaller fissures in our corral. We wished that we had been warned by either the seller or our real estate agent.

The seller said that he had no responsibility to warn us because he had never lived in the property, which had always been a rental. Our real estate agent said that she had no knowledge of any fissures. Did somebody have to tell us?

An s w er : If the seller did not know about the fissures, the seller has no personal liability to you. If the one large fissure was partially filled in, however, I suspect that the seller probably knew about this fissure because one of the seller’s renters probably required the seller to pay for the cost of repairing it.

Generally, the repair of a fissure is to fill in the fissure, add dirt, and then blade over the fissure.

As far as the liability of your real estate agent, fissures are so common in some areas of Maricopa County that a real estate agent may have a duty to investigate and disclose any fissures that are not “open and obvious� to a buyer.

In other words, the standard of care of real estate agents in that area of Maricopa County may require investigation for fissures. If the real estate agent has liability to the buyer for failure to investigate and disclose fissures, the seller should also have liability to the buyer under the doctrine of respondeat superior (“the master is responsible for the wrongs of his servant� ).

Unfortunately, even after the repair of the fissures, you will have to disclose the existence of fissures when you sell; such disclosure could affect the value of your home.

Basic elements like walls, windows and floors are reinvented to solve design conundrums, such as homes built on footprints the size of studio apartments or surrounded on all sides by other buildings. Frequently, the materials of choice are a combination of reinforced concrete, wood and glass.

With interest in micro-housing growing worldwide, such innovations have made Japanese architecture a leading force in contemporary home design. A new book, “The Japanese House Reinvented” (Monacelli Press) by Philip Jodidio, surveys over 50 contemporary homes, by both emerging and established firms.

“Faced with the constraints of very dense urban areas and a lifestyle that has long taken into account small spaces, Japanese architects and their clients have shown a surprising willingness to experiment,” writes Jodidio, who has written more than 100 books on contemporary architecture, including monographs on architects Tadao Ando and Shigeru Ban. The elegant houses in the book seem almost miraculously livable and show a way forward for challenging architectural puzzles. But they are not for the timid.

In a Yokohama house designed by Takeshi Hosaka Architects, the basement level of a 980-square-foot house features a hardwood floor that slopes sharply upward at one end toward the street-level window above, resembling a sleek sort of skateboard ramp. There is

Arizona has ranked in the top five states for mortgage fraud on the LexisNexis Annual Mortgage Fraud Report since the housing boom, when cashback deals became common. The deals, made possible by loose lending guidelines, revolved around speculators flipping houses among themselves every few months and taking cash out of each deal.

At the time, I remember some, who thankfully aren’t in the real-estate industry anymore, questioning whether cash-back deals and other mortgage fraud really hurt anyone.

These bad real-estate deals artificially inflate home values, lead to foreclosures and cost taxpayers, who back many of the fraudulent mortgages through government-owned Fannie Mae and Freddie Mac, billions of dollars every year.

We are all victims of mortgage fraud.

Like many Americans, Japanese tend to prefer houses over apartments, and roughly 60 percent of Japanese dwellings are single-family homes, Jodidio writes. Many of them are in dense urban

areas.

See-through flooring, reflective ceilings, plentiful balconies, mezzanines and inner courtyards, and windows and walls at surprising angles are more the rule than the exception among homes by these Japanese architects. Windows come in all shapes and sizes, frequently appearing at unexpected angles. And light-drenched inner courtyards are juxtaposed by frequently closed-looking exteriors.

The Arizona Multihousing Association has once again partnered with SRP and the Drowning Prevention Coalition of Arizona to educate kids and adults about water safety, especially in apartment

This year , keeping kids safe around water can be as easy as A-B-C. Adu l t s u p er v i s i o n — While you are visiting your community pool, designate one responsible adult who is dedicated to watching the kids around water. The “Water Watcher� should have a whistle or ribbon, something to remind themselves they are responsible for the safety of kids in

water. This also means no drinking alcohol, talking on the phone or texting.

Bar r i er s t o w at er — When you bring kids down to the pool, be sure to close the pool gate completely. We don’t want kids to get in or out without an adult. Every community pool has a locking gate. It is our responsibility to keep that gate closed for the safety of all neighbors.
