Crystal and Anastazio Belmontes spent the past few years working on cleaning up their credit record and saving money to buy a Phoenix home.

The couple had cash in the bank and was looking at houses earlier this year, when their car died and their medical insurance costs soared.

It was a tough phone call for Crystal, a 32-year-old accountant, to make when she contacted their real estate agent to say the search for a house was off. But her agent knew about a new program that has helped more than 1,000 Valley homebuyers with down payments.

With more than a $5,000 down-payment grant from the Arizona Housing Finance Authority’s Home Plus program, the Belmontes were able to obtain a mortgage on a three-bedroom house in Laveen last month. Their house cost less than $160,000 and is bigger, with enough bedrooms for them and their three children.

They are paying only about $150 a month more than they did to rent, and the tax deduction could make up the difference.

The Belmontes’ payments also could drop within five years if they build up 20 percent equity in their home and are no longer required to pay mortgage insurance on their government-backed loan. “We had been renting for 10 years and thought we might not ever get into our own house,� Crystal Belmontes told me. “We love our home.

Our children are so happy we are right next to a park, and a school is near by.�

Since the housing crash, lenders are requiring bigger down payments from buyers. “The down payment seems to be the biggest issue for first-time and boomerang buyers now,� said Dirk Swift, homeownership programs administrator for the Arizona Housing Department’s Finance Authority. “Expenses are going up. Wages are stagnant. Rents are sky high, and then there’s student loan debt.�

The Home Plus program was launched in Maricopa County late last year.

Qu es t i o n : Twenty years ago, we bought a small house in Tempe for our daughter who was a student at ASU. Since she graduated we have been renting the house, mostly to Arizona State University students.

We never had any problems. Last summer we rented the house to a boyfriend and girlfriend who went to law school at ASU. Big mistake! Although both of them signed the lease, and both have paid checks for their onehalf of the rent and the security deposit, in the lease itself my husband mistakenly put only the girlfriend’s name on the line in the lease for the names of the “Tenants.� The boyfriend and girlfriend have now broken up, and the boyfriend has moved out. The boyfriend says that he has no liability on the lease because his name was not listed specifically as a tenant, and that the girlfriend has liability for only one-half of the rent. The boyfriend says that he will sue us for punitive damages if we try to collect rent from him, or try to evict his former girlfriend, who can only afford one-half of the rent. Is he right? We no longer want to rent to ASU students, especially ASU law school students!

Can we refuse to rent to ASU students?

An s w er : First, if both the boyfriend and the girlfriend signed the lease, and if both the boyfriend and the girlfriend each paid one-half of the monthly rent, the boyfriend and girlfriend are jointly and severally liable for the entire amount of the monthly rent, even though by mistake the boyfriend’s name was not specifically listed as a tenant. Second, college students, including law school students, have no protection under fair housing laws, and a landlord is not required to rent to college students. A California appeals court has specifically ruled that a subdivision developer in Bakersfield could refuse to sell homes to buyers that were lawyers.

Flowers are the face of a garden, providing color and texture. But a few wellplaced landscape accessories can give it character and a dash of personality.

Accessories can range from water fixtures, like ponds and streams, to outdoor furniture and appliances, fountains to statuary, miniature fairy gardens to antiques. Give it some thought, however. “There’s some wonderful stuff out there (to collect) and it’s awfully tempting, but you have to be really careful not to overdo it,� said Linda Engstrom, a landscape designer from Portland, Ore. She advises putting no more than two or three items in one area. “It gets too cluttered and the eye doesn’t know where to go,� she said. “You need some negative space.�

Many of those items also can be highmaintenance.

And landscape accessories should fit the architectural style of the home, Engstrom said. “I had a client once who had a Tudor house but who wanted a Japanese garden. That wasn’t such a great idea, but I was able to give her a Japanese-style garden semi-enclosed in the backyard, and it wasn’t jarring,� she said.

Engstrom doesn’t like the trend toward elaborate outdoor living rooms with weather-proof furniture. “I can’t picture leaving that stuff out

Many of us think we need to complain to the management company or the owner of our rental home, but those folks donâ&#x20AC;&#x2122;t have any â&#x20AC;&#x153;powerâ&#x20AC;? over the outages. But there are a lot of easy things to do to make

outages easier.

Question: Can my landlord limit the

Readers who have non-emergency, general landlord-tenant, fair housing or multi-housing real estate questions

Answer: Yes, subject to a few restrictions. Generally, your landlord can limit the number of pets, prohibit them altogether or impose weight, size and breed limitations. Many liability insurance companies require restrictions on animals in order to provide coverage. If the landlord changes the rules, he normally cannot enforce the revisions against a resident who is in compliance with the old regulations.

For example, he cannot convert to a no-pet community and then make everyone get rid of their animals. If a resident with a handicap requires an animal to assist him or her, and the animal would violate the landlordâ&#x20AC;&#x2122;s pet restrictions, the landlord will need to make an exception for the assistive animal when reasonable to do so. For example, a no-pet community would need to waive the rule to allow a blind resident to have a Seeing Eye dog.
