Amenity attractive to homebuyers even if it doesn’t add much value It’s hot and the time of year when homes with a cool pool are even more appealing.

More Phoenix-area buyers are diving into deals for houses with pools now, say real-estate agents.

I think it was last week — the day the temperature hit 119 — I saw Lloyd Fox of Long Realty’s Facebook post. “The inferno is coming and homes with pools have an increased value when 120 is in the forecast,” he shared. “Cannot wait to put this central Phoenix home on market in a few weeks.”

I stared longingly at the photo of the backyard of the house with an inviting pool, not far from where I live, for a few minutes.

“There’s definitely more interest in pools now,” Fox told me. “All the buyers I am working with from out of state want a pool.”

Moving to metro Phoenix and buying a home with a swimming pool is part of the Valley’s special version of the American Dream.

He said many buyers now want a house that already has a pool so they don’t have to wait and pay more to have one built.

How much value does a pool add?

How much value a pool adds to a Valley home is one of those tough questions with an answer that doesn’t always make homeowners happy.

Fox said although it can cost $30,000 or more to build a pool, that concrete pond only adds about $10,000 to the value of a Phoenix-area home.

Appraisers can add up to 50 percent of what a homeowner paid for a pool to a property’s value, said Arizona housing analyst Mike Orr.

Can’t disclose that neighbors are disabled seniors Question: We want to sell our Glendale home.

Our next-door neighbor has an assisted living facility for six to eight senior citizens. My understanding is that the Fair Housing Act does not prohibit discrimination based on age. If we are asked by a buyer, “Who is the next-door neighbor?” are we allowed to say that it is an assisted living facility

for six to eight senior citizens?

Answer: Probably not. Fair housing protection generally applies to senior citizens living in an assisted living facility. Not because of age, but because senior citizens are probably disabled as defined by the Fair Housing Act. Disability is generally defined as being unable to perform daily functions without some assistance. Therefore, senior citizens living in an assisted care

facility are generally disabled.

(A similar example of “disabled” under the Fair Housing Act is that someone who is overweight by ten pounds is obviously not disabled, but if someone is overweight by 400 pounds, they are probably disabled). If you are asked by a prospective buyer who the neighbor is that lives next door, you cannot say, “An assisted living facility for senior citizens.”

You cannot lie, however, and must answer truthfully. For example, you can truthfully say, “That is not a subject for proper discussion.”

Note: Age, except for families with children under 18, is not a protected class under the Fair Housing Act. For example, a landlord that owns a rental home in Tempe is allowed to advertise “no rental to ASU college students under 30.”

But now with triple digit temps, homes with pools are very tempting.

“East Valley homes with really cool pools are more attractive to buyers and command top dollar,” Darwin Wall of Chandler’s ProSmart Realty told me.

Cooler the pool, higher the price There are some very cool newer mansions in the East Valley with resortlike backyards.

Look at Los Angeles Dodgers outfielder Andre Ethier Gilbert mansion with a tropical paradise backyard listed for $5 million Multimillion-dollar mansions in Paradise Valley and north Scottsdale have some amazing zero-edge pools with views of the Valley. Some come with water slides akin to features you would find at a resort or water park. One home has its own very long and winding lazy river.

Pricier pools surrounded by a backyard resort-oasis do typically add more to the value of a home in Arizona, say real-estate agents.

It’s too early to track how many more Valley homes are selling with pools this summer or if buyers are paying more for them.

I’ll follow up on that at the end of summer.

It’s not all fun and games Of course, anyone living the American Dream in Arizona in a home with a pool knows the money and work it takes to maintain it.

RENTER’S Legal Q & A Question: Last year our apartment complex decided to charge a $5/month parking fee if we used the covered parking space assigned to that particular apt.

Originally, there was no charge. Upon renewal this year, it’s $25/month to use that space. There are some uncovered spaces available (first come, first served). Those are $17/month. There is parking allowed on the street overnight. My question to the manager was “Won’t that cause a lot of parking problems on the street?” She advised “We have that issue cleared. If you ‘own’ a car, whether you park in the complex lot or the street, it’s still $17/ month.”

Really? Is this legal? I’m sure it probably is. Is there a percentage of increase allowed for rents in Chandler or is it up to the complex without limitations?

Answer: It would seem to me that you cannot charge to park on the street since that is public property, not private.

There is no percentage of increase - the landlord can charge whatever they like and if the tenant does not want to pay it, their alternative is to move out.

Practice safe storage and use of fireworks on Fourth of July July 4th marks one of Arizona’s favorite holidays. Cities across Arizona host giant displays of fireworks and festivals with music, food and fun for the whole family. These events represent your safest option when it comes to fireworks, especially this dry summer.

The in-store displays and tents in the parking lots are offering many different kinds of small and larger fireworks for sale and use during this short season. The heat and the lack of rain over the past

weeks creates a significant danger when it comes to fireworks. While these are technically legal, buyers and users of fireworks need to take special precautions in the use and the storage of these items. » Don’t light fireworks near any trees, grass, structures, or covered spaces. Always choose an open, preferably paved space for lighting fireworks. The sparks, even from a simple sparkler, could cause a fire. » Always keep a fire extinguisher or a bucket of water close by when using fire-

works. Place spent fireworks in water and be sure they are totally out before you dispose of them. They should be thrown away in a metal trashcan, away from other materials. » Keep your pets away from fireworks. Most animals are scared by the noise and the display so they are better off indoors. » Check the rules in your apartment community before lighting up fireworks.

You could be held responsible for damage caused or fined for breaking their rules. » To store fireworks, be sure you place

them in safe container, away from any source of fire. It’s best if they are stored indoors in a cool, dry place. In Arizona, fireworks can only be used at designated times during the year.

Celebrating the birth of our nation in July comes with all of the best summer has to offer. In this drought season, the best way to celebrate might be an event in your community where you can enjoy a professional fireworks display and time with your friends and neighbors.
