As market improves, HARP less attractive

Several national housing and finance regulators came to Phoenix on Friday to talk about the federal refinancing program known as HARP being extended for a year.

Their message: More than 10,000 metro Phoenix homeowners can refinance through the Home Affordable Refinance Program and lower their monthly payments, even if they owe more than their house is worth.

It’s always good to remind people of people of aid if they don’t know it’s available. But was it really worth the trip?

Top officials from the Treasury Department, the Federal Housing Finance Agency and government owned Fannie Mae and Freddie Mac traveled here to talk about a program that started winding down more than a year ago.

They are encouraging the last homeowners eligible to tap the program before mortgage-interest rates climb higher. “Arizona has the eighth biggest pool of homeowners still available for HARP,� Megan Moore of Federal Housing Finance told a small group at Friday’s event. “Spread the word to anyone who may qualify.�

HARP has helped a lot of Arizona homeowners — almost 160,000 — refinance and cut their payments since early 2009 when President Barack Obama announced his housing plan in Mesa. But most of the Arizona homeowners who tapped HARP did it a few years ago before home prices started to rebound.

When the finance program was expanded in 2011 to help homeowners no matter how underwater they were on their mortgages, it was wildly popular in metro Phoenix, where home values fell by half during the crash.

But now the popularity of HARP has waned, several Valley mortgage lenders say.

Maurice Cohn of Glendale-based Eagle Home Mortgage, a 25-year Valley veteran in lending, told me that he isn’t seeing many people interested in refinancing with HARP. Dean Wegner of Scottsdale-based Academy Mortgage said when the ex-

Question: Before I signed a six-month listing agreement for the sale of my Tempe home, I had a telephone conversation with my real estate broker. My broker said that, although office policy required a sixmonth listing agreement, I could cancel this six-month listing agreement at any time after two months. I recorded this telephone conversation without the broker's knowledge.

When I decided after two months that I no longer wanted to sell my home, I told my broker to cancel the sixmonth listing agreement. My broker refused to cancel my six-month listing agreement and denied ever having the telephone conversation with me. When I told my broker that I recorded thisconversation, my broker said that recording a telephone conversation in Arizona without his permission was illegal. Is my broker right?

Answer: No. One party to a telephone conversation in Arizona can record that telephone conversation without the consent of the other party. Arizona Revised Statutes Section 13-3012(9). Therefore, if you have a reasonable basis for identifying the other party to your telephone conversation as your real estate broker, the recording of the telephone conversation should be admissible in any legal proceeding to cancel after two months the six-month listing agreement.

These intimate spaces, frequently placed at the front of a home but also occasionally sited within the center of a home, to the side of the house or even in the backyard, have long been employed as an architectural element that blends the indoors with the outdoors. The Valley’s climate makes them not only practical but also oh-so-enjoyable most of the year, so it’s no surprise that they’re frequently requested by home buyers or that some architects include them in renderings whenever appropriate.

A way to add dimension “I always try to design a house with as many courtyard opportunities as possible,� said Gene Kniaz, owner of Tempebased Spiral Architects.

Courtyards, he explained, allow an architect to “point the building in different directions, so you’re ‘pulling and stretching’ the house and opening it up to other views, and it just makes the home more interesting.�

We know that people spend a lot of time in their courtyard and that it really does become part of their home.�
