Don’t disclose sex offender info, but don’t lie, either Question: I know that there was a major lawsuit involving non-disclosure of a sex offender in the Silverleaf community of north Scottsdale.

I own a small brokerage firm with several agents. I tell my agents that, if

they are asked about sex offenders in the community, they cannot disclose any such knowledge without the consent of the seller, but they cannot lie.

In other words, if the agent knows that there is a sex offender in the community, the agent can say: “I am not obligated to disclose that information.”

But the agent cannot lie and say: “I don’t know.” Am I instructing my agents correctly?

Answer: Yes. The practical result is that your real estate agent answering truthfully will cause the buyer to make an independent investigation to deter-

mine if there is a sex offender in the community. An independent investigation by the buyer is already strongly encouraged by language in the standard Arizona real estate purchase contract.

All it took was interest rates to climb from 3.5 percent to more than 4 percent, and a forecast that new-home prices would climb as much as 8 percent this year.

The builder’s vice president, Ken Peterson, said while no one can forecast the future, trends in the Valley’s homebuilding market “have been very positive so far.” » New-home builders including Christopher Todd Communities are jumping into metro Phoenix’s housing market with different types of houses. » Projects in communities on the Valley’s edges in Buckeye, Maricopa and Peoria that stalled during the crash have recently been revived. » And after Arizona lost more than 200,000 construction jobs when newhome permits plummeted from 64,000 in 2006 to less than 10,000 in 2009, contractors are hiring again.

Rising interest rates — and the expectation home prices will rise soon — spurred a lot more people to buy new houses in metro Phoenix during the past month.

That means higher wages for construction workers, which is good news.

But ultimately, it will also mean high prices for new-home buyers.

Ryan Brault of real-estate research firm Metrostudy said Phoenix-area builders are also facing higher land costs now.

That’s because many of the lots builders have been selling new homes on during the past few years were acquired for bargain prices during the crash.

And Kitnick said lumber costs are up

Many of those skilled construction workers found jobs in Texas and Colorado and haven’t returned to Arizona.

New-home prices in metro Phoenix climbed about 2.8 percent in 2016 and 3 percent in 2015.

“Yet, during the last two years, home construction costs increased 25 to 30 percent,” said Belfiore.

He estimates new-home prices will climb 6 to 8 percent in the Valley this year and 5 to 7 percent during 2018.

The median price of a new metro Phoenix house is about $302,000 now.

That compares with about $247,000 for an existing home in the area.

Consumers who recently bought new houses beat the price increases, though many took out mortgages with slightly higher rates than a year ago.

We all love a good deal, so the recent jump in new-home sales makes sense.

Whether buyers are willing to pay 7 percent more will determine if the Valley’s new-home market continues to recover.

Since homebuilding was one of metro Phoenix’s biggest economic drivers before the boom and crash, I hope so.

About 19,000 new homes were built across the region last year. That”s far off the peak, and about half of what would be considered a healthy market for Phoenix’s growth.

Three of those new homes sold on my block.

Not only did those houses mean more jobs for the housing industry, their sales boosted my home’s value.

We can all appreciate the jobs and the housing appreciation.

RENTER’S Legal Q & A Question: Recently, there was a fire that started next door to my apartment. I feel that my landlord should reimburse me for the smoke damage to my clothes.

He claims that his insurance only covers the building, not the personal property of tenants. What are my rights?

Answer: This is a good reason why the rental agreement should recommend that a tenant obtain renters insurance. If the landlord does not own the apartment next door then the landlord would not be liable to reimburse the tenant for smoke damage to the clothes. The resident may have a claim against the next-door apartment, but the person should obtain independent legal advice before pursuing that course of action. However, if a tenant decides to bring forth a lawsuit and does not prevail, then the tenant would be responsible to the landlord for attorney fees and court costs. It is important to note that if a tenant is threatening to sue a landlord for negligence, he or she must show a duty to do so on the landlord’s part and breach of that duty.

If you’re grilling for Memorial Day, be sure to stay safe Summer holidays get many of us thinking about a big barbecue and some time outdoors enjoying the sun.

Taking care of a community grill is much like taking care of your own barbecue. As a griller, you have a responsibility to take care of the equipment too and protect your neighbors. » Clean the grill first. Before you start barbecuing, take two minutes and

wipe down the grates to be sure they are free of debris and the last griller’s leftovers. » Getting the grill fire going. Read the instructions on the grill and use the right tools to light the barbecue. If you are building a fire in a charcoal grill and using an accelerant, be especially careful as these can cause flare-ups. » Keep a water bottle closeby. It’s best to keep a water bottle or baking soda nearby when grilling, in case something catches fire or the grill gets

too hot. A small squirt bottle of water will keep this in check and prevent burned food. » Keep an eye out and protect yourself too. Never, ever leave your grill unattended while you are cooking. Hot grills can flare up in seconds. » Clean up after yourself. When you are done grilling, take a minute to wipe down the grill and remove any food debris left there. You can use a piece of tin foil and the tongs or a grill brush to clean the hot grill.

» Turn off the gas or extinguish the fire when you are done. This sounds simple but you would be surprised how many people forget to turn off the gas or don’t close the valve completely on a propane grill. Not only does this waste gas; it’s a serious safety hazard. Double check the valve before heading back inside. If you’re using a charcoal barbecue, you must make sure that flames are completely extinguished.
