Phoenix-based agency has grown by building out from m the t cutting edge

Buying a home starts with an online search for many people these days. Home shoppers often check out houses on their phones as they drive neighborhoods. Real-estate agents can complete sales digitally without any paper.

But real estate wasn’t a high-tech experience when CEO Matt Widdows started Phoenix-based HomeSmart in 2000. There were no great mobile apps for agents or easy-to-use online home-search websites.

He owned a medical computer company in the 1990s but had a real-estate license and was very interested in the industry. Widdows believed metro Phoenix real-estate agents could save time, make more money and sell more houses with digital help.

HomeSmart launched with two agents and a receptionist in a small office. One of the first things Widdows did at his fledgling company was create a mobile app for the brokerage’s agents to use to search houses from their cars. That was groundbreaking technology in the early 2000s.

And he didn’t stop there.

The vice president of the Chicago White Sox and a security broker are among this week’s top five buyers of luxury homes in metro Phoenix.

$2,661,400 Security broker Neil Goldstein paid cash for a 5,722-square-foot house at Red Rock in Phoenix.

Goldstein is a security broker with American Securities in New York City. The 2000 home has a front courtyard with fireplace and a breakfast room adjoining the kitchen. Glen R. and Linda F. Bair sold the house through their trust. Glen Bair was an orthopedic surgeon in the Valley.

$2,350,000 Klam Partners LLC, an Illinois company bought a new house at Desert Mountain Golf Communi-

ty in Scottsdale. The 4,761square-foot house sits on an acre and includes four bedrooms, five baths and a four-car garage.

$2,275,000 The vice president of the Chicago White Sox, Kenny Williams, bought a 2004 house at DC Ranch in Scottsdale. Williams, a former major league outfielder and his wife, Zoraida Sambolin, a television journalist, bought the 3,662-square-foot house through their trust. The home features a backyard with garden, customtiled patio, 30-foot length pool and six-hole putting green. The home also includes a yoga or exercise studio with mirrored wall and a separate casita. Scottie Pierce, as trustee of the Richard and Scottie Pierce Revocable Trust, sold the house. Richard Pierce, who died in 2011, had served in both the House and the Senate of the Maine Legislature.

Qu es t i o n : We have lived in Ariz ona for more than six years and have a good FICO score. There is another individual with my name (even the same middle initial) who has very bad credit, including several judgments by credit-card companies.

I am now purchasing a Sun City home, and I filled out an identity statement for the title company. The title company said that there will now be a delay of at least 30 days in closing because of this identity confusion. The seller refuses to agree to an extension of the closing. Help!

An s w er : First, under Ariz ona law a mortgage loan used to buy a home (or other real property) has priority over any judgments and liens against the buyer of the home. Therefore, even if you were the individual with judgments by the credit-card companies, the title company should be able to issue a lender’s title policy to the mortgage lender insuring that the mortgage loan is in first position on the home.

Second, the other title policy issued by a title company in a transaction is the owner’s title policy that will be issued to you as the new owner of the home. A standard exclusion in an owner’s title policy is that there is no coverage for acts “ created, suffered or assumed� by the new owner of the home.

This exclusion would eliminate title insurance coverage for judgments by a buyer’s credit card companies. Therefore, even if the title company assumes that you are the “ bad� buyer with the judgments by the credit card companies, the title company should not be concerned about any liability either under the lender’s title policy issued to the lender or under the owner’s title policy issued to you as the new owner of the home.

Note: Even though this Arizona law does not apply to IRS tax liens that are governed by federal law, the IRS has ruled that mortgage loans to purchase a home or other real property will have priority over IRS tax liens.

In 2009, HomeSmart was one of the first brokerages in the U.S. to go completely paperless on real-estate transactions.

Last year, the brokerage introduced the first lighted “ for sale” signs in metro Phoenix.

Today, anyone who walks into a HomeSmart branch likely will see a big-screen TV first and be greeted from by a “ virtual receptionist” sitting in an office miles or states away. The receptionist can unlock doors and page agents.

Widdows said HomeSmart is currently working on a new digital program for clients and agents that will show them who called about their property, who toured it and who is checking out their listings online. “ I want to revolutioniz e how we do sales transactions,” Widdows told me. “ Everyone is used to real estate online now, and if we can make it easier for consumers and agents, they will love it.”

HomeSmart’s tech innovation, low agent fees and no commission structure propelled its rapid growth, even during the downturn. It’s now the biggest real-estate brokerage in Ariz ona with about 5,726 agents. Nationally, the brokerage has 10,000 agents in 15 states as well as agents in China.

Widdows’ innovation at HomeSmart has landed him on one of the most prestigious list for real estate leaders in the world. He ranked No. 29 on the 2016 Swanepoel Power 200 list of the most influential leaders in real estate. That’s up several

spot on the list from 2015.

HomeSmart “ builds all of its technology in-house, such as its digital transaction management system that runs a fully paperless operation, which helps it achieve remarkable efficiency,” according to the Swaneopoel ranking. “ For example, HomeSmart processed over 19,000 transactions with just 30 employees.”

Last year, HomeSmart reviewed more than 1.42 million paperless contract pages for those transactions. “ Being that me and my wife both work, having electronic signing for various steps of the process made it much easier,” said John Shaff, a certified physicians assistant with OrthoAriz ona, who worked with HomeSmart to buy a Phoenix home with his wife Charlotte last year. “ Working with HomeSmart was great and very easy. The process was very smooth, and the staff and assistants were always available and their response time was almost always immediate” , Todd Sumney, HomeSmart’s chief marketing officer, said the company’s goal is to review all home sales contracts digitally within 24 hours.

HomeSmart’s tech strategy helped it grow during the housing crash, when it drew agents who needed a more efficient and less expensive way to sell homes. The brokerage was also able to buy competitors including Phoenix-based Dan Schwartz Realty in 2008.

Bobby Lieb, one of the top real estate agents for sales in Ariz ona, joined HomeSmart in 2010. “ When the market got weird five to six years ago, I felt like it was time to make a change,” he said. “ I met with a few local real estate companies, and they all wanted me to give 15 to 20 percent of my income to them, which was ludicrous to me.”

Lieb brought 140 agents with him and formed HomeSmart Elite, which now has 500 agents. “ Matt would call me every couple of weeks and ask me if there was anything that he could do to improve the company, and he would listen,” Lieb said.

Widdows knows agents and clients want to be heard. During 2015, 136,187 calls came into HomeSmart’s corporate offices, and the brokerage says 87 percent of those calls were answered before they went to voice mail.

Last fall, HomeSmart moved into a new corporate headquarters in north Scottsdale. Widdows oversaw the conversion of the former warehouse space into a cool work space with floor-to-ceiling windows, big screen TVs for remote meetings and training classes,a gym and club roo.

He said technology and keeping costs low were also his strategy for HomeSmart’s new offices. “ Matt has put so much into making the corporate office a great environment for his employees,” said Carol Perry, Home-

Smart’s chief business development officer. “ He designed it himself and built it with the thought that he wanted the team to want to be at the office. And they do.”

She said Widdows does a lot for his team, but he expects a lot from them too.

Friends, colleagues and competitors describe the HomeSmart founder as “ an adrenaline junkie,” who is in constant motion and always looking for the next competitive move. “ Matt saw an opening with his competitors by providing a low-cost platform for agents and drove a semi through it,” said John Vatistas, founder of newly-formed Launch Real Estate. “ Just ask those who compete against him at that level.”

Widdows readily acknowledges his fervor for the business, and in the next breath talks about expansion plans for HomeSmart into new states and searching for the newest technology to help its agents, homebuyers and sellers. “ I don’t really reflect backward,” he said. “ We need to always be moving forward.”

April also marks Earth Month, and it’s a reminder that we can do our part to conserve in our apartments, too. Here’s how: LED bu l bs . Head to the hardware store for new light bulbs. LED lights conserve energy, burn cooler and last for years. You

can often find these bulbs on sale in April, so it’s a great time to make the investment.

Lo w -fl o w fau cet s . Grab a few lowflow faucet heads there, too. These faucet regulators will help you conserve water.

They are inexpensive and easy to swap out in your apartment. Some faucet heads allow you to regulate the water flow, too, so if you’re washing dishes, you can turn it up to give you more water pressure.

complex in October. Within the past 6 months all of the grass has been allowed to die, the trees need pruning and have broken branches that can be a hazard, weeds are waist high and there is trash all over the once beautiful complex.

This month, all tenants received notification that the management of the complex had been assigned to a new company. I feel myself getting very depressed about going home and I am embarrassed to invite anyone over because they have to walk through the complex and see how horrible it looks. My question is: What are legal grounds for terminating a lease early without penalty? I want to move as soon as possible, but I canâ&#x20AC;&#x2122;t afford to lose my deposit or be assessed a penalty for leaving 4 months early.

Answer: I would request that the tenant send the landlord non-compliance notices.

They could serve a 10 day notice for material breach pursuant to ARS 33-1361 for the failure to maintain the property. As for those items which constitute a health and safety issue, a 5 day notice to terminate should be sent to the landlord.

If the landlord fails to address these matters within the time frames of the notices, the lease can be terminated without the imposition of any penalties.
