It started with the sofa. Jaki Sooper had been living in her Gainey Ranch home since it was ÿrst built in 1999 and, while nothing was wrong with the two-story house, it was feeling a bit dated. Ordinarily, whenever she wanted to
refresh things, Sooper would just move the furniture around, rearranging instead of remodeling. She loves color and has fun mixing di“ erent decor styles. But by last year, she really needed a new sofa. And maybe a chair. As she started looking for furniture to suit her space, she realized she wanted a di“ erent space for the furniture. What happens to mortgage in a home transfer? Christopher Combs Guest Columnist
Question: You had a recent column about a daughter not having to pay off the mortgage on a Phoenix home she inherited from her mother. You said that the daughter could just continue to make the monthly payments, even though there was a due-on-sale clause in the mortgage requiring immediate payment of the entire amount of the mortgage upon any transfer of the home. Here is my question: My boy-
friend and I live in a home in Goodyear. Because of my bad credit, the deed and the $180,000 mortgage are both only in my boyfriend’s name. The $180,000 mortgage has a due-on-sale clause. We are breaking up and my boyfriend is moving back to Massachusetts. He has agreed to sign a deed transferring the home to me in exchange for me paying him $20,000. Will I be allowed just to continue to make the monthly payments to the mortgage company, or will the mortgage company require me to pay off the entire $180,000 mortgage immediately? Answer: The legal answer is that you could be required to pay the entire
$180,000 mortgage immediately. Under federal law there are certain exceptions to immediate payment of the entire amount of the mortgage after a transfer of the home. These exceptions include a transfer of the home after death to a relative, during lifetime to a spouse or children, or during lifetime to your own Revocable Living Trust. There is no exception for a transfer from a boyfriend to a girlfriend. The practical answer to your question, however, is that you should not have to immediately pay the $180,000 mortgage. You should be able to just make the monthly payments. The reason is that
mortgage lenders just want monthly payments, and don't want to foreclose on homes, even if they have that right under a due-on-sale clause. Mortgage lenders are in the business of making loans, not in the business of owning real estate after a foreclosure. Note: In the rare circumstance that a lender learns of a transfer of a mortgage that violates a due-on-sale clause, the lender will normally still do nothing, except maybe ask for a small penalty or an increase in the interest rate, which some struggling Savings and Loan companies did during the Savings and Loan crisis in the early 1990s.

These homes would give Snoopy house envy, and they’re all for a good cause. Metro Phoenix designers, builders, engineers and architects are currently working on this year’s luxury homes for the annual Design for Dogs competition, which beneÿts the Arizona Animal Welfare League. Last year, the designer dog house competition raised more than $20,000 for the no-kill shelter and saved 4 ,000 animals. This isn’t the typical type of home building I report on, but I couldn’t resist. Of the dozen doghouses designed and put up for auction in 2017, custom home builder Rafterhouse’s Ru“t erhouse won Best in Show. The quaint miniature white home with picket fence, red door and American ‘ ag also came with astroturf in the front yard for its pooch occupant. Creo Architects’ ultra-modern K9 Couch made with metal and wood - and
what looks like famed architect Frank Gehry in‘uences - took second prize. Black Ink Interiors and Luster Custom Homes created Puppacabana, complete with black and white striped cushions and view of a pool. It won third place. The hip orange and white wood “Dog Pavillion,” created by JE Dunn Construction and design ÿrm Stantec, won the People’s Choice Award. There’s still time to get tickets to this year’s event, sponsored by the tile and ‘ ooring ÿrm Facings of America. Attendees can bid on a cool new home for their own favorite pet. Tickets to the Design for Dogs event on Feb. 23 are $4 5 for one and $80 for two. It’s being held at Facing’s Scottsdale design studio. “We love to design for kids and animals. It’s so fun and such a great cause,” said Scottsdale designer Laura Kehoe, who’s Paw Palava plush pink dog house sold for $2,000 last year, the highest price paid for one of the designer dog houses. A man bought the pink pooch palace for his daughter and her dog. What a lucky pup.
ly 20 years ago, when he was running an art-ÿnish painting business and she hired him to do all the walls in her thennew house. Over the course of that project, the two became friends — and stayed that way. Five years ago, Sprague put down the paintbrush and opened his own interior design studio. So Sooper signed up as a client. “When Jaki called me, she didn’t know what direction she wanted to go,” Sprague said. “She just wanted a change.”
They selected fun new lighting ÿxtures to deÿne the di“ erent areas. And, of course, they chose paint colors. Or rather, they chose a paint color. Sprague suggested a radical change for his pigment-loving friend. What about a single neutral tone for all the walls downstairs? Something that would unite the whole space and allow the brightly-toned artwork to pop. It wouldn’t be white, he promised. But maybe a very, very, very pale grey? Although Sooper was skeptical, she agreed. With the major decisions made, they brought in the contractors. And, since the work was going to take over the entire ÿrst ‘oor , Sooper packed her belongings into the garage and moved out — for three months. So much for a simple sofa.

Together, they sketched out a more open entertaining space — without the dining room wall, picked out new woodlook ceramic ‘ooring, and found stonelike tiles to add drama to the wall around the gas ÿreplace. They decided to update the kitchen by painting the cabinets a dark grey and adding white quartz countertops.
Once the renovations were complete, the next part of the work began: deciding which of Sooper’s possessions to put back in the house, and where to put them. She had large collections of paintings and ceramics, but also of more unusual items like antique handkerchiefs, tansu chests, playful garden sculptures made

of brightly painted metal, and a variety of objects with hearts on them. Some of her things also had sentimental value, like those she’d inherited from her mother. Together, Sooper and Sprague sorted through it all, ÿnding places to feature the best-loved items, and letting go of the rest. “I had to get rid of a lot of stu“ ,” Sooper said. “I’m not one for clutter, but I still had things I’d picked up over the years. I got rid of a lot and I don’t miss it at all.” While it took several go-rounds to reduce the excess — including a few latenight sessions that may or may not have involved wine — Sooper didn’t have to purchase anything except for the new sofa and chairs. “Jaki had so much to choose from that we didn’t have to shop,” Sprague said. “She had everything we needed to accessorize that house and make it perfect.”
An open space for eclectic tastes Sprague said he enjoyed working with a client who was open to creative design solutions. In some instances, Sooper even pushed him to make things more unusual — like the kitchen island,
for which Sprague commissioned a custom-stenciled top after Sooper told him she didn’t want it to be the same white quartz as the perimeter counters. “I have a very eclectic look,” Sooper said. “I like industrial; I like antiques; I like color. Mostly I like fun.” As a result, one large abstract painting now hangs high over the dining room, where it is set o“ by steel mesh chairs, a wooden pedestal table, and a chandelier that suggests lightsabers. Vividly painted stools and sparkly crystal lights contrast with the clean lines of the kitchen cabinets. The powder room is wrapped ‘oor to ceiling in wallpaper that looks like river stones. And an antique tansu chest serves as a console behind the new couch. The playful mix of furnishings is set o“ by the open and clean-looking space around them. The combination, Sooper and Sprague agreed, is a good one. As for their friendship, both said it grew stronger during their collaboration. That’s a good thing, Sooper said, because “we’ll have to do the upstairs next.”

With technology today, there are so many new ways to pay your rent and be sure that it’s received on time. Most apartment communities and owners also provide for a couple of ways for their residents to deliver their rent to make it easy. You don’t want a late or missed payment to be recorded on your lease and ÿnd its way on to your credit report. Your community probably has a night box where checks can be dropped o“ . It’s smart to double check that your dropped payment was received. You
don’t want to have a payment get lost behind a door or in a box. Some renters still like to pay with a mailed check and the mail system is usually reliable to deliver in just a few days. Your lease probably stipulates when their payment must be received or when it must be postmarked. Just be sure that your payment is dated for your on-time payment. If you are paying in person in o‘ce, you may be able to get a receipt for your payment, if you need it. This can be a safe way of ensuring that your monthly payment was received. Online payments can be great and automated. Always make sure that there are enough funds in your account to cover the full payment. If your bank is sending electronic checks, be sure that
the checks are leaving the bank early enough. These often take 3-5 days if the money is being mailed to another bank. Your payment may need to draw from your account 3-5 days before the end of the month to conÿrm that it’s received by the due date.
