Home prices are poised to recover fully from the 2007-11 crash. All it will take is another year of steady price and sale gains like we saw in 2016.

Phoenix-area home prices climbed about 6 percent last year. The area’s median hit $244,000in December, according to housing analyst Mike Orr’s Cromford Report.

And our current median home price is only about 6 percent off from the area’s peak of $260,000 for the boom year 2006.

We are so close. All we need is a repeat of last year for Valley home sales.

Mortgage lender is entitled to proceeds from sale Question: After we refinanced our Glendale home a year ago my husband was injured in a car accident and unable to work for three months. We could not make our mortgage payments, and we have now lost our home to foreclosure.

Our mortgage lender was the only bidder at the foreclosure sale and now owns

our home. In our neighborhood the home prices have been appreciating, and the mortgage lender should be able to sell the home for more than the amount of the loan plus the foreclosure costs. Are we entitled to any of this profit?

Answer: Probably not. A foreclosure sale is generally a public auction at the office of a title company or at the courthouse. If a buyer purchases a home at the

foreclosure sale for more than the amount of the mortgage loan plus the foreclosure costs, the former owner of the home is entitled to those excess proceeds (after fulfilling statutory requirements). As a practical matter, however, usually the only buyer at a foreclosure sale is the mortgage lender, and the mortgage lender makes a “credit bid” in the amount of the mortgage loan plus the

foreclosure costs. The mortgage lender then has a deed to the home. If the mortgage lender as the new owner of the home thereafter sells the home for a profit, the mortgage lender is entitled to all of this profit. Therefore, your mortgage lender is probably entitled to all of the profit from any sale of your home.

Home prices are still rising — they’re currently averaging just below all-time highs set in 2006, according to the CaseShiller Home Price Indices. Combine that with slim housing inventory in many markets, and you may believe you’ve missed the opportunity to buy your first, or your next, home.

But bank-owned properties, also known as real-estate owned houses, could be an affordable option for firsttime or move-up homebuyers. Lenders are anxious to unload repossessed properties, and without emotional ties, they’re often more inclined to sell a property below market value.

“I was kind of homeless!” Sheila Asseline of South Lake Tahoe, California, says, laughing as she recounts her housing situation of five years ago. “I was living with my daughter and her husband

because I had sold a house and hadn’t found a replacement property.”

But then she got a call from her real estate agent, telling her about a bankowned house that had just been listed on the market.

“I just jumped on it because I thought it was going to be a good investment. And it turned out to be a great investment.”

With cash in hand from the sale of her previous home, Asseline acknowledges she was at an advantage. In fact, her offer on the house was accepted over a higher offer from another would-be buyer because that bid was contingent on obtaining financing.

“I found the process extremely simple,” she adds. “I put in an offer, and [the bank] countered back, and I accepted it.

It turned out to be really easy.” Two weeks later, the sale closed.

After declaring the foreclosure crisis over in September, real estate research firm Attom Data Solutions noted a 27

percent increase in foreclosure activity the very next month. In addition, at the end of the third quarter, vacant bankowned properties were up 67 percent from one year ago.

“Even in the best of times, there is some percentage of homes that get foreclosed,” says Steve Udelson, president of Altisource Online Real Estate, which operates Hubzu.com. For buyers who aren’t finding affordable homes in their target neighborhoods, it’s well worth their time to investigate foreclosed homes, he adds.

While buying “distressed” properties can seem complicated, it’s really a matter of getting into the foreclosure process at the right time. There are basically three stages: » Pre-foreclosure is when the owner of a property who has become late on mortgage payments receives a notice of default from the lender. » A public auction is held if the loan

defaults. This is when professional investors battle it out, making lowball offers. Many times, because the bids are too far below market value, the bank will simply repossess the property. » A bank-owned sale or auction. This is where Udelson says potential homebuyers have the greatest opportunity. At this point, you have a seller who is motivated to sell. Banks want to get these properties off their books as soon as possible, he says.

In recent years, financing has become more flexible. One federal loan program now allows you to buy a qualifying house and finance improvements and repairs as a part of the loan package to purchase the property; the Federal Housing Administration-backed 203(k) loan allows the mortgage to be based on the home’s value after the rehab, or the home’s purchase price and cost of repairs, whichever is less. Mortgage loan limits vary by location.

And homebuilding, the slowest part of the Valley’s housing market to recover, saw an overdue double-digit increase.

A closer look at 2016’s key indicators: » Home sales climbed 4 percent, according to the Arizona Regional Multiple Listing Service. » The number of homes for sale fell almost 2 percent. » Foreclosures plummeted 22 percent. » And homebuilding climbed more than 13 percent, according to RL Brown’s Phoenix Housing Market Letter.

None of these key indicators took huge, unexpected swings during 2016, so it shouldn’t be that hard to repeat in 2017.

Valley.

So let’s forget about boom and bust, and make slow and steady the new mantra for a solid housing market in metro Phoenix.

Here’s the Twitter version of Information Market real-estate expert Tom Ruff’s forecast for metro Phoenix’s housing market.

“2016 was better than 2015, 2017 should be even better,” he wrote.

Sounds to me like a forecast for the final stage in the Valley’s housing recovery.

New housing mantra in Phoenix The recovery has been slower than most of us wanted for our home values.

But the less-frenzied pace still has the Valley winning the recovery race against other boom-and-bust cities like Las Vegas and Tampa, where home values haven’t recovered as much as in the

Question: Recently, my landlord

commented that he would like the utility company to individually meter the units so the tenants can pay their own electric bills. I moved into my apartment community because utilities are included with the rent. Can my landlord do this?

Answer: No. A.R.S. Section 33-1341 (B) provides that a ruler or regulation adopted after a tenant enters into a rental agreement is enforceable only if a 30-day notice of its adoption is given to the tenant and it does not constitute a substantial modification of the rental agreement.

Requiring tenants to now pay the electric bills, which were previously the responsibility of the landlord would surely constitute a substantial modification of the rental agreement and would be unenforceable.

Keep track of extra fees when budgeting monthly rent When you move into a new rental, you start by tabulating the costs of rental application fees, first and last months’ rent, pet deposits, security deposits and lease cancellation fees. Tabulate monthly expenses to ensure your home is one you can afford.

Every rental community and home is different, though. All assess different fees for services and amenities. Before signing a lease, research all costs and

fees that could be charged monthly or annually.

If you have a pet, there’s likely to be a pet deposit and some communities charge a monthly fee in addition. Parking spaces may be at a premium and your home may only include one parking space. If you need more parking, ask what the monthly or annual costs are.

Storage space outside your home may come with a monthly or annual fee. If you need additional space and want easy access, inquire about costs for storage

units.

On the flip side, there may be savings associated with some fees. Your home may have an assessment for maintenance that covers landscaping or pest control. Some communities include basic utilities like water, electric and gas in rent, while others have residents pay individual bills. Ask if your community includes basic cable or satellite, or if there are discounts with preferred providers.

Communities with event spaces, barbecues, chef kitchens and movie-screen-

ing rooms may allow residents to rent these spaces for special events. Ask for a list of rental and cleaning costs.

When you research an upcoming move, ask the manager or leasing agent for a complete list of fees and fines the community has. Ask for a list of the services your rent covers, ie: utilities, maintenance, pest control, etc. ... so you can do a more accurate budget for your home.
