Reasons for optimism in 2016 market Metro Phoenix’s housing market recovery has been long and slow. But it’s on track. And this year is poised to be the best year for home sales and prices in the Valley in nearly a decade.

Last year, home prices, sales and new construction rebounded from 2014’s disappointing results. Foreclosures continue to shrink.

Arizona housing analyst Tom Ruff calls 2015 an “average yearâ€? for housing and that’s with some double-digit gains. “The success of 2015 doesn’t rise to champagne corks popping off but there were market improvements in almost every way," said Ruff, who works for the Information Market, owned by the Arizona Regional Multiple Listing Service. Âť Resales were up 10 percent in 2015, according to ARMLS’ new STAT report. Âť The region’s existing home price climbed 9 percent. Âť New home construction jumped 46 percent, according to RL Brown Housing Reports. Âť And pending foreclosures are down 26 percent to the lowest level since 2006.

More Millennials deciding to buy homes, and boomerang buyers, who lost houses to foreclosure, qualifying for mortgages again gave Phoenix’s market a boost last year. The big bump from those big groups is expected to come this year. But most from these groups aren’t buying million-dollar mansions.

The Valley’s luxury market isn’t faring as well. The first half of 2015 was strong for sales of houses priced above $800,000. But in December, these pricier deals dropped 30 percent. Declines in the stock market are mostly to blame for a slowdown in high-end home sales, say analysts. Ruff has been predicting 2016 will be a “breakout year’ for metro Phoenix’s housing market for a few years.

He is still optimistic but a few issues and events have him feeling a little more cautious: not enough affordable homes, gas prices and the presidential election.

ARMLS’ pending sales index shows the Valley’s sales climbing this month, while the area’s median price dips a bit.

Metro Phoenix has a lot of great events that draw visitors and home buyers in January. But, of course, in 2015 the Valley hosted Super Bowl XLIX. But Rough said if 2016 shapes up to be another average year for housing, that’s still a very good thing.

After all, who can complain about a 9 percent increase in home prices.

Question: We recently hired a contractor to do some remodeling work on the bathroom of our Glendale home. We asked that he only work between 8 a.m. and 12 p.m. while our daughter was in preschool. Before any work was started, we signed an agreement with the contractor that he would be paid every two weeks based on hours worked and materials purchased.

Three days ago the contractor slipped in the bathroom and broke his ankle. He now wants us to pay for his medical bills because he said he was our employee, and that as our employee we should have had workers’ compensation insurance to cover his medical bills. Do we have to pay the medical bills for our contractor’s broken ankle?

Answer: Probably not. If the contractor was your employee, and you did not have workers’ compensation insurance, you could have liability for his medical expenses. The contractor was probably an independent contractor, however, and you should have no liability for his medical bills.

The key factor in distinguishing between an employee and an independent contractor is control. In other words, did you have the right to control how your contractor performed the work, or did you just want the work done? Although the requirement of only working during the hours of 8 a.m. to 12 p.m. while your daughter was in preschool may be evidence of control, the contractor was not actually required to work during those hours, but he could only work during those hours.

Payment every two weeks for hours worked and materials purchased was probably just for convenience, and was probably not a “paycheck� for an employee. Therefore, you should not be liable for the medical expenses for your contractor’s broken ankle.

“It makes perfect sense, style-wise,” says New York City designer Elaine Griffin. “We began seeing the rise of black appliances as sleek and stylish non-white alternatives to pricier stainless options at the new millennium, and black as the ‘new neutral’ wall color has been gaining popularity over the past decade.”

You can go ultramodern or traditional when bringing black into the kitchen.

High-end, Euro-style lacquered cabinetry from companies like Boffi, Poliform and Bulthap is sleek and sexy. Marble countertops and geometric fixtures can create a glamorous, jewel-box kitchen, great for entertaining.

Put the hue on Shaker-style cabinets, add rustic French tile, smooth quartz counters and hand-rubbed brass fittings, and you’ve got a sophisticated space. Or add a walnut or maple slab island and saddle leather stools for an industrial look.

A few things to remember if you’re going to get a black kitchen right: Contrast is key. Going overboard with black will get you a kitchen that resembles a bad mall hair salon, says Griffin.

Use black on the cabinets and a paler hue on counters and floors, or vice versa.

“Make sure your floors and countertops are very light to balance and contrast the super-dark cabinets. Working with black is a balancing act and re-

“Simple white tile with black grout is a great way to get some light in the space and give a nod to classic kitchens.”

Killam suggests including wood elements like a butcher-block island countertop. “Wood lower cabinets would work with black countertops and upper shelving, for example. I would keep the wood finishes as natural as possible … and relatively pale so the overall effect isn’t too heavy,” she says.

Ikea offers the Sektion kitchen cabinets in black, and there is a range of coordinating black kitchen fittings there too, including drawer pulls, storage items and trash cans. (www.ikea.com) You can repaint existing cabinetry if you’re budget-conscious. Consider Benjamin Moore’s Midsummer Night, Sherwin-Williams’ Black Fox, Valspar’s Raven Black or Behr’s Black Suede. Many

shades of black pick up other hues in an interesting way — midnight blues, chocolates and sooty grays, for example.

Choose the right finish: Save the glossy paint for trim or you’ll be swabbing fingerprints forever.

“Like a little black dress, accessories make a statement in a black kitchen, so choose your hardware and fixtures with care,” advises Griffin. “Polished or antiqued brass and black is a white-hot finish option right now, for both contemporary and traditional looks.”

Add a cool stool; Houzz has a big selection. Recent offerings include stools with chic, slim hairpin legs, as well as comfy-looking upholstered ones, and several stools in snazzy hues like red, orange and blue. (www.houzz.com) Embossed or painted concrete, sculpted limestone, pressed tin or wallpaper would be a striking complement to black

cabinetry and fittings.

Add an Art Deco touch to a black kitchen with Giorbello’s Water Jet glass tiles. Daltile’s Bamboo Forest faux wood tile would be a durable, style-savvy backsplash or floor. Italian ceramic tile maker Fap has a matte-black subway tile in its new Boston collection. (www.wayfair.com; www.italytile.com) The right lighting is important in a black kitchen. Killam likes skylights and large windows to take advantage of natural light.

To avoid what Griffin calls “black hole syndrome,” install lights at multiple height levels: ceiling, pendant, undercabinet and even countertop lamps.

Lamps Plus has forged-iron and rubbed-bronze chandeliers and pendants.

Hudson Valley Lighting’s Lydney polished black nickel pendant would work well in any style of kitchen. GE’s got a slate, French-door refrigerator with a smudge-resistant finish. Ikea offers a black cooktop. Upscale brands like AGA and Le Cornue have black enameled stoves. Jenn-Air’s Obsidian fridge has a black interior, ostensibly making even the humblest leftovers look magazine-worthy.

with my tenant, where both of the roommates are responsible for the entire lease. The lease indicates that the tenants must pay with a check, money order or cashierâ&#x20AC;&#x2122;s check in the full amount. Over the past several months I have allowed the roommates to pay half of the rent each in two separate checks. This creates all types of accounting nightmares for me that I want to eliminate. Further more if one of the tenantâ&#x20AC;&#x2122;s is late on their check and the other one pays on time and I accept the money that is paid on time then I risk having accepted a partial payment and not being able to evict if the other roommate does not pay. In my lease there is a non-waiver provision that indicates that event if I allowed violations in the past that at any time I can stop the violations and demand that the residents comply with the lease provisions that they agreed to. When I told the residents they would have to pay in one check they became argumentative and belligerent and indicated that they would not comply and would pay in two separate checks the following month. Can I enforce the lease?

Answer: Yes. If you have a non-waiver provision in the lease, you can enforce he payment of a separate check for the entire rent. If the tenants pay with two separate checks you can return the checks with a 5-day notice for failure to pay rent. If they fail to provide you with one check you can file a forcible detainer action.
