What does President Trump mean for housing?

It’s early days in President Donald Trump’s administration, but he’s already moving fast to make changes in the housing market.

An hour after being sworn in, Trump stopped a cut to FHA costs that could save first-time homebuyers $500 a year.

The longtime real-estate developer’s other plans could cap the popular mortgage-interest deduction, do away with the federal financial and mortgage watchdog and privatize mortgage giants Fannie Mae and Freddie Mac. Also, Trump’s order Wednesday to start a border wall as well as his plans to deport many more illegal immigrants mean fewer available construction workers, particularly for homebuilding.

The mortgage-interest deduction Trump’s pick to run the U.S. Treasury Department, former Wall Street banker and movie producer Steve Mnuchin, wants to limit the mortgagerate deduction.

It’s not clear yet what he plans exactly. But housing advocates, including the National Association of Realtors, are concerned because deducting interest payments on mortgages is a big draw for many U.S. homeowners.

Now, the mortgage-interest deduction is capped at $1 million on loans, if you are married and filing jointly. The cap is $500,000 for homeowners filing taxes solo.

When Mary Ann Ridenour and Bill Ridenour became empty nesters last year, their 3,200-square-foot home suddenly seemed superfluous.

The 2010 Dodd-Frank Wall Street Reform legislation, a regulatory package to help prevent another housing boom and bust, could be on Trump’s chopping block.

Mnuchin has said he wants to get rid of parts of Dodd-Frank that are slowing bank lending.

Some housing analysts say the mortgage reform part of the legislation has kept some homebuyers from getting loans.

Other housing advocates say the lending rules are needed so borrowers aren’t preyed on and pushed into subprime loans like during the boom.

Paying delinquent rent doesn’t necessarily end troubles Question: My sister has owned a dress shop in a major Phoenix shopping center for 12 years. Last year she was $50,000 delinquent in her rent, primarily because of higher annual common area maintenance charges due to a large increase in real property taxes for the shopping center.

My sister eventually was able to pay the entire $50,000 in delinquent rent,

plus all of the shopping center attorney’s fees and costs. She was current on her rent when she was “locked out” over a weekend. (She has now learned that the shopping center wanted a boutique retailer to take her leased space for three times the rent.) Although my sister’s lawyer said that there was nothing that could be done, my sister still does not understand how she can be “locked out” when she was current on her rent.

Is that the law?

Answer: Yes. In a commercial lease, i.e., a retail, office, or industrial lease, the tenant cannot “cure” a default for delinquent rent by paying the delinquent rent and the landlord’s attorney’s fees and costs. The landlord still has the right to accept any payments, and then retake possession of the leased premises by either filing a forcible eviction lawsuit or exercising self-help with a “lock out” of the tenant.

A residential tenant living in an

apartment or a home has much greater protection than a commercial tenant.

One, a residential tenant can stop any eviction proceedings by paying the rent and the landlord’s attorney’s fees and costs. Two, the landlord does not have any right to “lock out” a residential tenant, but must always file a lawsuit to evict a residential tenant.

In fact, roughly 20 million people in the United States live in trailer houses, also referred to as mobile homes, according to Census numbers.

For the Ridenours, the impetus for moving into a trailer was cutting costs.

Mary Ann Ridenour, a 49-year-old who works full-time as a court reporter, started a side business a year earlier. The couple wanted more cash to support her endeavor, so the $1,800 monthly mortgage payment on their house in Summerville, South Carolina, needed to go.

“We were working our butts off to live in this big house that we didn’t need,” Ridenour said. “We thought, ‘Why are we paying this ridiculous mortgage on this home?’ It was strapping us.”

They bought a 3-bedroom, 2-bath trailer with a half-acre of land about 10 years ago, for $143,000. The trailer, whose previous owners had used it as a summertime crash pad, was 2 miles from the beach and across the street from native marshlands outside Charleston. The Ridenours moved in last July.

“I love my trailer,” said Kodi Bryant, 40, who purchased the home in Golden, Colorado for $20,000. Her side deck offers a view of the downtown Denver skyline and the Rocky Mountains.

“I looked at apartments in the Denver area, but they were so expensive,” she said. “I didn’t want to work in a cubicle and come home to a cubicle.”

The average price of a trailer home, which usually does not include the land under it, is about $73,000, according to

The legislation created the watchdog agency the Consumer Financial Protection Bureau. That agency’s director, Richard Cordray, said at a Wall Street Journal event earlier this week he has no plans to step down or change his agency’s charge to protect consumers.

Affordability was what prompted Emily McBroom, 33, and her husband, Jesse McBroom, 32, to buy a trailer house outside Denton, Texas, for their first home.

“We could get a brand-new trailer home with the newest appliances and pay less than the cheapest rent in the area,” Emily McBroom said. Their twobedroom, 600-square-foot trailer cost $29,000.The couple have their trailer on more than 7 acres of wooded land.

McBroom said it came down to priorities: They wanted to own a place, pay down student debt and having enough money to travel.

“It takes a certain person who will live in a trailer,” she said.

Talk about the federal government handing over the biggest mortgage backers in the country to the private sector has been swirling around for a while.

The U.S. had to take over the failing Fannie and Freddie during the crash.

Treasury pick Mnuchin backs privatizing the mortgage giants.

But analysts say the 30-year fixed rate mortgage, the most popular option for U.S. homebuyers, would go away if the Fannie and Freddie didn’t have government backing.

Plus, it could cost billions to wrest the mortgage giants from government control.

Fewer immigrants, fewer construction workers Trump moved to a start building a wall between the U.S. and Mexico this week, something that could have a big impact on border state Arizona’s already shrunken construction workforce.

Metro Phoenix’s homebuilding market, still recovering from the crash, doesn’t have the labor to keep up with buyers now. The average time to build a Valley house doubled to six months in 2016.

Arizona builders and housing analysts are really concerned about this one.

And that FHA cut Trump’s pick for secretary of Housing and Urban Development Ben Carson said he would look at reversing the drop in Federal Housing Administration fees.

The Obama administration announced the cut in early January, a move welcomed by the housing industry because it makes buying a home more affordable for many first-timers.

The Realtors Association estimates about 750,000 to 850,000 homebuyers will face higher costs, and 30,000 to 40,000 homebuyers will be left on the sidelines this year without the cut of 0.25 basis points to FHA insurance premiums.

Carson’s appointment cleared the Senate Committee on Banking, Housing and Urban Affairs Tuesday. Now it goes to a full Senate vote.

Some housing market watchers speculate Carson and Trump aren’t against the FHA cut. They just didn’t like the outgoing president getting credit for it.

Based on Trump’s current agenda, there are many more moves that the housing industry and homeowners can thank or blame him for during the next four years.

Now, the landlord wants to charge me for nine days of rent for the next month, claiming it took nine days to complete all of the cleaning and repairs to the property. Do I have to pay for the nine extra days?

Answer: If it really took nine days to repair and/or cleaning property as a result of you leaving it in bad condition, then yes the landlord can charge you for the nine days. In fact, if the landlord lost a renter as a result of the landlord not being able to deliver the property in good and clean condition on the first day of the new month, you could be charged for the actual damages resulting from your failure to leave the premises in good and clean condition. Always move out on time and leave the premises clean. Take pictures or video of the condition when you move out.

Many apartment owners provide smoke-free communities The dangers of smoking, and even the risks of secondhand smoke, have been well-documented. In buildings where smoking is permitted, non-smoking residents may still experience secondhand smoke in common areas and see smoke drifting into their units.

About two years ago, the Arizona Multihousing Association partnered with the Arizona Department of Health Services to educate residents and operators and

create more smoke-free options for residents of apartment communities. Nearly 100 buildings boast the Smoke-free Living designation across the state. Some operators are shifting toward the smokefree community designation as leases expire. Once a smoker moves out, the owner can repaint, replace carpeting or flooring and even replace appliances where smoking impacted its use, and then rent the home as a smoke-free home.

Children and older adults who may

have breathing issues enjoy more benefits from smoke-free living. If a resident is struggling with negative health effects from secondhand smoke, they should contact their apartment/property manager immediately. There you can share your concerns and explore how this issue can be addressed.

Many residents now look for communities designated as smoke-free living communities. Studies show residents view this as an amenity and some even report being willing to pay more to live in

a smoke-free home.

Residents who are interested in smoke-free living can ask managers to explore adopting a no-smoking rule or even becoming a smoke-free property.
