The real-estate ÿrms are doing away with some of the worst parts of selling a house and drawing people who want to sell fast with little hassle, in exchange for a lower price.

Sellers must disclose solar panel lease info to new buyers Christopher Combs Guest Columnist

Question: Last year we purchased a home in Arcadia. The home had solar panels on the roof. The purchase contract and the title insurance policy said nothing about solar panels. After moving into our home, we started receiving notices from a solar panel company say-

ing that we owed them monthly lease payments for the solar panels. Apparently, four years ago our seller had signed a 15-year lease for the solar panels, but never told us. Do we have to make these lease payments?

Answer: Probably not. The seller should have disclosed the solar panels lease to you. There could then have been negotiations with the seller to determine who would make the monthly payments for the solar panels lease. At this

time, however, you should have no obligation to make these monthly payments. You should be the owner of the solar panels as they are attached ÿxtures to your home. Most solar panel companies, however, will record documentation showing that the solar panels are subject to a lease or to a loan, e.g., a UCC-1 ÿnancing statement. Your title insurance policy showed no such recording and, if accurate, you own the solar panels free and clear. Your seller,

however, will probably have to make the monthly payments on the solar panels lease.

Note: Since October 2017, the Arizona Association of Realtors has a new form, Solar Loan Assumption Addendum, that should be used in the sale of a home with solar panels that are not owned by the seller, but are subject to a lease or other ÿnancing.

Last year, the couple found a new single-story house they loved nearby but had to sell fast so they could buy it.

The couple saw ads for both OfferPad and Opendoor and went on their websites and asked for offers.

“We went with Opendoor because its offer was higher," JoAnn Moore said. "It was so quick and easy. Opendoor even came to us to sign the closing documents at a nearby Denny's."

The two companies use different formulas for valuing homes. I have heard from people who went with OfferPad because it presented a higher offer.

Rise of the iBuyer Opendoor and OfferPad, nicknamed “iBuyers” by the real-estate and investment communities because they use technology and conduct much of the transaction online, have both attracted a lot of investment money.

San Francisco-based Opendoor is bigger and hit unicorn status last year, meaning it’s a startup valued at more than $1 billion. It launched ÿrst and began purchasing Valley homes in 2014.

Arizona housing analyst Mike Orr of the Cromford Report called the growth of Opendoor “tremendous,” with a 15 percent increase in home sales last year.

Opendoor bought about 1,600 Phoenix-area houses last year and sold 1,500, for 3,100 transactions.

Gilbert-based OfferPad launched in the Valley in 2015. Last year, it closed 1,800 home purchases and resales in metro Phoenix.

Both companies operate in more than a handful of U.S. cities and compete against each other in a few of those, including the Phoenix area, Atlanta and Las Vegas.

Homebuyers can check out Opendoor houses for sale using a keypad access code from 6 a.m. to 9 p.m. because the houses are empty. It also has a program to buy back a house within 30 days if the buyer isn’t happy.

OfferPad pays to move homeowners who sell to it.

Not for everybody The two iBuyer ÿrms are growing, but there are still plenty of homeowners who want the top price for their house and are willing to go through open houses and longer times to sell to get it.

And the iBuyers don’t want to buy every Valley house. Million-dollar and historic homes aren’t part of their buying plans for now .

“We want to ÿnd homes priced between $200,000 and $500,000 that we can pay the consumer the most for,” said Matt Bohn, OfferPad’s COO. “But there are times we do transactions above and below that.”

Opendoor focuses in the Valley on buying houses priced between $150,000 and $500,000 that were built after 1960.

Its average Valley purchase price was about $215,000 last year.

“Opendoor is a company built around trying to solve pain points for buyers and sellers in real-estate transactions,” said Kerry Melcher, the company’s Phoenix general manager, who has been a Valley real-estate agent for the past two decades. “We really want to make homeowners great offers, but sometimes we don’t

have the best solution for them.”

Melcher said Opendoor has programs to refer those homeowners to real-estate agents.

Agents here to stay Many Valley real-estate agents weren’t pleased to see Opendoor or OfferPad, which was started by two local agents, launch. Of course, their concern was about the business these iBuyers would take from them.

The two ÿrms are growing but still have less than 4 percent of metro Phoenix’s home sales.

Opendoor is working to expand its relationship with real-estate agents, paying them referral fees and giving them early access to its listings.

Both ÿrms can help agents who have buyers who need to sell ÿrst.

“Real-estate agents often have clients

who ÿnd a house they love, but they need to sell fast to get it,” said Valley real-estate agent veteran Jim Sexton, who joined Opendoor last year to help build the company’s relationship with agents.

“We are a much more Realtor-focused company than a few years ago.”

Opendoor and OfferPad have shaken up the real-estate market, but the ÿrms could be enticing more people to buy and sell more often. And that is good for home values and real-estate agents.

A research report last year from Evercore ISI compared what the iBuyers growth could mean for the housing market to how the expansion of Home Depot boosted the DYI market.

Like with most things, it's about paying for convenience. Would you forgo a few thousands dollars to avoid would-be buyers checking out your not-so-clean home?

Question: I’m on a lease for an apartment. I informed management that I was looking for a house to buy and may have to break the lease if I found one before the lease end. They informed me that I was getting a $136/ month discount and if I broke my lease, they would charge me $136 more per month for the entire length of the lease, plus another $1,230 for an early termination fee.

I’ve always paid my rent early and wondered if these charges are unreasonable because of my being a good renter. It seems pretty high to me.

Answer: The $136 monthly discount is considered a rental concession. Both rental concessions and early termination fees are recoverable as damages should you prematurely terminate your lease. These fees should be in writing in order to be enforceable.

Arizona case law holds that these early termination damages are enforceable only in an amount that is reasonable in light of anticipated or actual loss caused by the breach. The law also requires a landlord a reasonable effort to mitigate its damages.

Landlords can bring a civil lawsuit after a resident prematurely vacates the apartment under A.R.S. § 33-1373. The suit is for all rents owed until the lease expires or management re-rents the unit. Included in this are any concessions, lease break fees and property damages beyond normal wear and tear.

As long as the apartment is not re-rented, you remain liable for the term of the lease.

Why do you need renters insurance?

Renters insurance can protect you and your roommates from a wide variety of exposure. It’s never easy to think about the losses that could occur, but this affordable insurance can provide important protections.

Renters are not required by law to carry renters insurance, but some owners may require it for a lease. In multifamily communities, it’s often recommended but not required. If you live in a rental home with roommates, you should ask your insurance provider if you can split a plan or if it’s best to get separate policies.

For those who carry renters insurance,

it’s always a good idea to document your valuables. This could include artwork, electronics, and jewelry or other valuables. Taking photos of the valuables and making sure you know their value will help if there’s ever a claim. It can be tough to remember all the precious items that you own in the event of a burglary or other loss event.

Personal property coverage: Accidents like ÿre or water damage can occur in any kind of rental home.

Renters insurance can protect you by covering the electronics, furniture and personal belongings in the case of damage in your home.

Roommates may also be covered in your renters insurance. It’s best to add those names to your policy so if there’s a claim, the company knows that they are

covered by the renters policy.

In the case of an accident or a burglary, your personal possessions are not covered by the landlord’s insurance policy.

Those losses are the renter’s alone. If there’s damage to a building in a monsoon or a ÿre, the physical damages to the building are covered by the management company or owner, but the renter’s losses are not covered.

Liability claims: When you have guests in your rental home, you carry some responsibility for their safety. If someone is injured from a fall or other kind of accident in your home, you may be liable and renters insurance can help to protect you. The insurance may help to cover some of the costs if there are legal fees or a claim against you.

Temporary housing: Victims of a ÿre or water damage may have to temporarily relocate while the apartment or home is being repaired.

Renters insurance can help to cover some of these costs, so the renter isn’t out-ofpocket on housing.

The costs for rental insurance can be very reasonable. Many insurance companies can add this to your other auto or additional insurance coverage you and your family already have.
