Don't panic: Drop in Valley sales just a blip

Home sales in metro Phoenix plunged during November. But before anyone starts talking about a serious slowdown or using the dreaded crash word:. The drop in sales is likely only temporary and not due to a big decline in buyers.

New federal mortgage rules created to protect consumers are slowing down the home sale process. And it’s a temporary slowdown, as many housing experts expected, they say.

In November, 6,064 homes sold Valleywide, down more than 1,000 from October, according to Arizona State University’s W.P. Carey School. The region’s median home price was flat at $225,000.

One Arizona housing expert thinks the new rules known as TRID delayed a lot of home sales in November. TRID has become the well-known and sometimes cursed acronym in the housing market for the Truth in Lending Act and RESPA Integrated Disclosure rules that went into effect in early October. “The data in November points out a temporary disruption in volume and the median sales price,� said housing expert Tom Ruff of the Information Market, which is owned by the Arizona Regional Multiple Listing Service. “We believe TRID has pushed back several hundred closings causing lower than expected sales volume as well as a decline in the median sales price.�

The new mortgage rules were created to give borrowers more mortgage information before they close on a house. Borrowers must now receive a loan estimate form three days after they apply. An appraisal can’t be ordered until a borrowers gets the estimate.

Also, a home closing can be delayed if a borrower doesn’t get a cost-disclosure form three days before they are expected to sign the mortgage and close the deal.

Sales are bound to take longer until lenders, title agencies and borrowers get used to the new rules.

Most of the slowdown in home sales is the result of TRID, but not all of it.

Qu es t i o n : We bought our Mesa home 10 years ago. The purchase price was $320,000. Our mortgage was $300,000, interest only, payments for 10 years, and then amortized over the next fifteen years. Our home is only worth $240,000 today. Although we have been able to make the mortgage payments for the last ten years, our new mortgage payments will now almost double. We cannot afford to make these new mortgage payments. Our real estate agent is trying to help us with a short sale but, if we can’t do a short sale, we will lose our home to foreclosure. Whether there is a short sale or a foreclosure, our real estate agent says that we will have to pay income tax on any money that our mortgage lender loses. Is our real estate agent correct?

An s w er : Your real estate agent may have been correct at the time that he talked to you, but a recent change in the federal tax law should eliminate any income tax on a short sale or a foreclosure of your home occurring before Dec. 31. By way of background, debt forgiveness by a lender is generally taxable income to the borrower. In response to the housing crash, however, the Mortgage Forgiveness Debt Relief Act of 2007 was passed. This 2007 Act provided that any “loss,� i.e., deficiency, by a mortgage lender after a foreclosure or short sale on a mortgage used to purchase a home was not taxable income to the homeowner. This 2007 Act expired Dec. 31, 2014. On Dec. 18, 2015, however, this 2007 Act was extended until Dec. 31, 2016. In other words, for both the years 2015 and 2016 there will be no income tax owed by a homeowner on any “loss� by a mortgage lender after a short sale or foreclosure. Therefore, you should not have any tax liability for a “loss� by the mortgage lender after a foreclosure or short sale that occurs prior to Dec. 31.

me the drop in demand for luxury homes in the Phoenix area continues.

"Demand at the higher end of the luxury market is the softest we’ve seen in a long time,” he said.

Also, many Millennial and boomerang buyers looking for houses priced below $250,000 in metro Phoenix can’t find them.

Orr said there just aren’t enough of those homes on the market now, so many people who want to buy can’t.

Many houses that would sell for $250,000 or less are now rental homes that investors snatched up during the foreclosure crisis. Investors aren’t selling because they are doing so well on rents.

Orr said considering the issues the Valley’s housing market dealt with in November, home sales during the month were actually pretty strong.

“December's sales number is not finalized but I already know it will be strong, especially for new homes,” he said. “I think the backlog created by TRID was largely processed during December.”

Ruff’s forecast for December is for Phoenix-area home sales to jump by more than 1,000, and the median home price to climb by $5,000.

If that happens, and it’s likely to because Ruff and Orr have access to pending sales data, November’s slowdown was just a blip for metro Phoenix’s housing market.

So no one panic, please.

Davin believes in celebrating winter even after the holidays are over. She removes red poinsettias, but keeps white ones and white cyclamen around her fireplace. And she continues lighting white and gold candles on the mantel.

She also encourages clients to keep tiny white lights in their living space for a warm glow throughout January.

Cole agrees: White lights “can absolutely stay up all winter long,” she says.

“They yell, ‘Warm and festive! Come on inside! Get out of the cold!’ ”

L a y e r y o u r f a v o rit e s A clean, classic mantel with just a pair of vases or hurricane lamps flanking one large painting can look lovely year-round. It’s the perfect way to highlight a piece of art, and this sparse approach can be a nice break after busy holiday decorations.

Another approach “is to layer pieces on a mantel by propping up different sizes of art, mirrors and objects” in an asymmetrical arrangement, Mathison says.

This casual look is a great way to display a collection of items — perhaps small, framed prints in various sizes, Mathison says, or a collection of tea cups. This vibrant approach can make a post-holiday mantel seem a little less stark and empty.

layered mantel, Cole suggests using a collection of small animal figurines like deer and other woodland animals.

Your mantel is the perfect place to get creative. Davin suggests exploring Pinterest for DIY mantel decorations.

You’ll also find ideas on Cole’s Youtube channel.

One favorite of hers: Buy inexpensive cardboard cones that look like little mountains, then spray paint them in a mix of pastels with a bit of gold or white. Cluster them together with white lights, and then top them with a glass dome.

“A glass dome over anything screams design,” Cole says, and it can cost as little as $10 at a craft store.

Cole also suggests seeking out craft projects that use votive candles (she offers some ideas at hgtv.com).

L o o k in s id e If you’re not using your fireplace for a fire, use that space decoratively by filling it with candles or other items.

Just remember to keep things looking reasonably natural.

“The ‘go-to’ is a bundle of clean, pretty birch logs that are arranged as if they are waiting to be lit,” Mathison says. “I love to use andirons and then stack the birch logs in a pyramid.”

Some designers fill the firebox area with small bookshelves or other unexpected items. Mathison prefers not to: She thinks using decorative items that aren’t made to be in a fireplace can “feel forced and contrived.”

Although it’s not always the case, this type of move is also oUeninto a smaller space than where a homeowner previously lived — meaning that eScien t upfront downsizing and the implementation of creative aUer-move storage solutions becomes much more important to achieving a calm and clutter-free lifestyle.

We recently reached out to some savvy local entrepreneurs who oWered their advice for how best to downsize as well as how best to get — and just as importantly, stay — organized when living in a smaller-thanused-to space. Here’s what they had to say:

What are the most important things a downsizer needs to do?

Take inventory. Xe ÿ rst thing you need to do is get a handle on all your stuW.Taking inventory prepares you emotionally to consider the possibility of letting go of those things that are not necessary.

Decide what to keep. X is is the most diSc ult part of downsizing — what to keep and what to get rid of. If you focus on what you love and absolutely want to keep, the rest will need to be eliminated one way or another. Deciding on what to keep also keeps you positive on what you want in your new place.

Simplify. One important thing to remember when downsizing is that letting go of the things you don’t regularly use can truly set you free. Follow the rule ‘if you don’t love it or use it, lose it’. Focus on what’s important and what really matters and let go of the rest. You will be happy you did.

Her e is very little they will want as they move away and start their own collection.

Start one closet at a time. Pick your most dreaded closet and empty the items into an extra room. Divide the contents into â&#x20AC;&#x2DC;give to grown children and family membersâ&#x20AC;&#x2122;, â&#x20AC;&#x2DC;donateâ&#x20AC;&#x2122;, â&#x20AC;&#x2DC;storageâ&#x20AC;&#x2122; and â&#x20AC;&#x2DC;trashâ&#x20AC;&#x2122;.

Identify three â&#x20AC;&#x2DC;canâ&#x20AC;&#x2122;t live withoutâ&#x20AC;&#x2122; items. For example, decide what furniture pieces are a must-Ăżt for your new home.

Donâ&#x20AC;&#x2122;t linger too long over one item. Put it aside and keep momentum going.

I have an issue with a renter in my complex who lives below me. My lease specifically states no smoking, yet this renter smokes in his apartment without any regard to other tenants. Iâ&#x20AC;&#x2122;ve brought this matter repeatedly to management over the last 6 months without any solid result.

I have pursued this question with the landlord/tenant agency for the City of Phoenix and a non-profit organization. The non-profit made several attempts to speak with the owners of the property without success. The apartment manager will not allow the non-profit a way to discuss making this multi-housing facility a non-smoking complex with the owners.

The complex advertises they have a â&#x20AC;&#x153;non-smokingâ&#x20AC;? policy on their leasing office and supposedly does not allow renters to smoke in their apartments.

I am at a dead end. I cannot find any other source to talk with the owners of this property. Obviously, I will be the one that will have to move.

Answer:

Smoking in multi-housing communities has created a long-standing issue regarding the rights of non-smoking tenants versus the rights of smoking tenants. Matters are further complicated regarding a landlordâ&#x20AC;&#x2122;s role in dealing with the competing rights of smoking versus non-smoking tenants.

The law requires a tenant â&#x20AC;&#x153;to conduct himself and require other persons on the premises with his consent to conduct themselves in a manner that will not disturb his neighborsâ&#x20AC;&#x2122; peaceful enjoyment of the premises.â&#x20AC;? A.R.S. 33-1341(7).

If smoke is causing a unreasonable disturbance to your peaceful enjoyment, the landlord may be obligated to take action against the offending tenant to protect your rights or face legal consequences for the failure to act.

If smoking is prohibited under the terms of the lease as you indicate, the landlord would be obligated to deliver the offending tenant a notice of noncompliance. If the breach is not cured within the appropriate time, a landlord has a right to evict. The landlord has an obligation to provide and keep the premises in a â&#x20AC;&#x153;fit and habitable condition.â&#x20AC;? See A.R.S. 33-1324(2).

The failure of the landlord to meet their obligations to provide fit and habitable premises may entitle the tenant to terminate their lease and move based on the landlordâ&#x20AC;&#x2122;s breach under the Arizona Residential Landlord & Tenant Act or even under a theory of â&#x20AC;&#x153;constructive evictionâ&#x20AC;? which occurs when a landlord does something or fails to do something which renders the premises untenable. If you lawfully terminate the lease and vacate, there will be no further obligations for rent and you may have a claim for damages against the landlord. See an attorney to discuss your case first and to make sure you act in accordance with the law.

Get the facts before trying to sublet your apartment Visitors from around the country started to descend on Arizona these past few weeks, and this is just the start of the season. Sports, concerts and other special events bring millions of dollars in revenue to our economy. It can be tempting to open your home to visitors looking for a convenient or discounted place to stay.

Using online services like Airbnb,

VRBO and Craigslist, some renters may try to make a little extra money during this high tourist season. Before you decide to do this, get the facts about your rights and responsibilities.

The dangers of doing this can be many and varied. There are certainly safety concerns to consider. This could affect not only your own home, but your neighbors. Even an accident by a short-term visitor could be your responsibility.

Second, it’s important to know the rules that govern your rental home. Your apartment lease may prohibit the subletting of a room in your home. If you are caught renting a room to a visitor, you may give your landlord reason to evict you. Nationally, our multifamily industry leaders are examining this issue to understand how to address it safely and fairly. Apartment owners want their residents to enjoy their homes, but they are

duty bound to provide a safe and habitable place. With short-term renters who are not vetted in the same way residents are, they are at a disadvantage.

Apartment residents should be wary of getting involved in these contracts.

It’s best to err on the side of keeping your home and neighbors’ homes safe.
