Goals for 2017 As we finish out this year, I am proud of all that we have accomplished together. It’s been an amazing year of growth for the AMA. Today, we have 236,000 units around Arizona in membership, and we are close to recapturing our goal of 2,000 members! Our membership mantra for 2017 is 250,000 units in membership and 2,000 members – and we are nearly there!

Just a few days ago, we welcomed a number of new leaders to our board at the annual meeting and I am eager to collaborate with them as we work on initiatives from the strategic planning and our legislative priorities.

Christine Shipley of Dunlap & Magee has rolled off the AMA Executive Committee this year, but she will remain on the board and very active with all we do.

We are excited to have Amy Smith Montoya of Bella Investment Group ascend as our board chair for 2017. Her tenure marks our first board chair from Flagstaff. We are looking forward to her leadership, and we already have plans to start expanding our presence into the northern Arizona market with new membership events there this year.

Most importantly, we know that we cannot achieve our goals without you, our wonderful, passionate, committed members! Thank you for all that you do to support our industry and our mission!

Season of Gratitude November and December bring so many great gatherings for us as families and as companies. From Thanksgiving to all of the Maintenance Mania events with the AMA, I’m surrounded by people who inspire me. This year’s Tucson Maintenance Mania brought together talented team members for the competitions. Looking around the convention center, at an event that gets bigger and better every year, I took time to enjoy the friends and colleagues who joined us to cheer on their teams.

This is a big part of what the AMA’s programming is about – building stronger teams, growing talent for the future of our companies, learning from each other! (It’s about winning too and I want to congratulate all of this year’s winners!)

Toward the end of the year, we host our annual board of directors meeting where we thank our outgoing board members and welcome new leaders into this important work. Serving as the Board Chair this year, I have learned so much from these diverse leaders and I look forward to building on our work in the future. Amy Smith, my successor, has led nearly every committee in our Association and gives her time at the national level too. She brings an energy and perspective that we all respect and admire.

I want to express my personal thanks to every board member and the committee members that help to create our Association’s statewide impact. The AMA staff makes our jobs as board members enjoyable and we are fortunate to have their support of our work. The app is a quick and easy way to access the important functions of the association, whether in the office, at home or on the go. With a few simple clicks from the main menu, members can register for events, see what is coming up in the way of education and events, check out pictures from recent events, and even contact the specific departments at the AMA or pay bills.

It is integrated with the AMA website so members can even access directions to an event quickly from anywhere on any Apple or Android device.

officials can have the most direct impact on AMA members, perhaps more so than that of our national leaders.

For the November elections, the AMA’s Political Action Committee (AMAPAC) endorsed 73 candidates, all of which the PAC determined to be receptive to the issues of the apartment industry. All but two of those candidates were elected.

W

hile many across the country focused on the presidential election, for the AMA, the November elections were all about the local, downballot races.

It should be safe to say that everyone, by now, is well aware that Republicans not only took the top office, but also swept both the U.S. Senate and the U.S. House of Representatives.

But what is just as surprising and consequential is the fact that Republicans continued their upward trend of controlling state governments, including in Arizona.

To that point, Republicans retained their commanding

control of 68 out of 99 legislative chambers across the country (Nebraska has a nonpartisan single-chamber legislature), the highest number in the history of the party. The GOP will also have full control of 33 out of 50 legislatures, up from 31, after Republicans gained two governorships; Democrats will fully control only 13 states.

Local wins State and local elections are critically important to the apartment industry since many important issues — property taxes, utility rates, landlord-tenant laws, licensure requirements, building codes etc. — are all decided by the legislature and local city councils.

This is precisely why the AMA places such an emphasis on supporting candidates that are receptive to the needs of the apartment industry. The decisions made by local elected

Arizona has a long-standing history of electing GOP-controlled legislatures and governors. In fact, one would need to go back to 1966 to find the last time Democrats held control of the state legislature.

However, several factors led many to predict that Arizona would become a swing state in November causing a ripple effect to the rest of the down-ballot candidates. The presidential election, and ballot initiatives to legalize recreational marijuana and to raise the minimum wage in the state were all expected to increase voter turnout for Democrats.

The last time Arizona picked a Democrat for president was exactly 20 years ago when voters re-elected Bill Clinton in 1996. Before that it was Harry Truman in 1948. Since statehood, Arizonans have elected nineteen Republican presidents and eight Democratic presidents.

In other words, Arizonans electing a Democratic president is rare.

That swing-state prediction led many to also speculate that the Arizona Senate would

split with an even number of Democrats and Republicans, another rare phenomenon that hasn’t occurred in Arizona since 2000. A 15-15 split senate would have drastically change the dynamic of Arizona politics, and possibly damper certain legislative agendas.

Staying the course However, despite what some of the polls were indicating, voters kept the status quo maintaining the Republican majority in the Arizona Senate at 17-13.

In the House, Democrats picked up one seat, but Republicans still hold a strong majority with a 35-25 split.

Legislative District 17 has become perhaps the most powerful district in the state after Senator Steve Yarbrough (R-Chandler) was elected as the new Senate President and Representative J.D. Mesnard (R-Chandler) was elected as the new Speaker of the House. The two leaders bring nearly twenty years of combined experience to the Capitol.

With the elections finally behind us, the AMA Board of Directors approved a robust State and Local policy agenda at their annual meeting on December 8th.

I

n this modern era nearly everywhere we go our image will, to a certain degree, be captured by a surveillance camera. Whether it be the camera at the intersection you are waiting to proceed through or the camera in your local grocery store, surveillance is a major part of our lives. It serves many legitimate business purposes and often times works to prevent criminal activity.

Certainly no one can reasonably argue against the need of cameras in places like banks and department stores. But what about the use of surveillance

Landlords/property managers may have ample reason for wanting to protect their assets from criminal activity and/or losses. However, there may be other reasons landlords and property managers may want their properties under surveillance. While vacancies are never desirable, they are a reality and when a property is vacant, there is a greater risk that the property will be damaged by some sort of criminal activity or that persons not authorized to reside in the proper improperly and unlawfully assume possession. A landlord/property manager may not be available at all times and may want to have some other way of monitoring the comings and goings on the property. All of these reasons are a sound basis for the use of cameras.

So, property owners and managers have reason to install cameras to protect their assets but, are they required to do so by law? The answer is not as clear as one would hope and often times revolves around the nature of the property, its location, and any known or discoverable hazards or dangers in the area which might reasonably be anticipated to cause a tenant, their guest, or any other persons lawfully on community grounds some form of injury.

As a landlord, one has a defined legal duty to provide reasonable security when the landlord is aware of certain conditions on or near the community which may place its residents, guests, or others at risk of harm. This duty is codified in the Restatement (Second) of Property. Section 17.3, Restatement (Second) of Property, states: A landlord who leases a part of his property and retains in his own control any other part the tenant is entitled to use as appurtenant to the part leased to him, is subject to liability to his tenant and others lawfully upon the leased property with the consent of the tenant or a subtenant for physical harm caused by a dangerous condition upon that part of the leased property retained in the landlordâ&#x20AC;&#x2122;s control, if the landlord by the exercise of reasonable care could have: (1) discovered the condition and the unreasonable risk involved therein; and (2) made the condition safe.

Criminal intrusions The restatement identifies criminal intrusions as a hazard for which, if reasonable foreseeable, the landlord is required to address by taking reasonable precaution to avoid injury to residents, guests, or others lawfully on community grounds.

If a property owner determines there is a business need to use cameras at his or her community, the owner is free to do so. Common locations for cameras would be inside the leasing office, fitness center,

exterior of the leasing office, common area pathways, and parking lots, all public areas of the community. Under Arizona law, there is no expectation of privacy in public areas. For this reason, landlords are permitted to install cameras and record activities that transpire in common areas of the community. However, landlords should make sure that no camera is pointed in a direction that will cause any tenant’s privacy to be invaded. For example, landlords should make sure that any installed camera does not point towards the doorway or window of a residence. While the exterior of the door or window is in public view tenant’s private life may be exposed and recorded on camera, thereby leading to a claim of invasion of privacy.

Once the decision to use cameras at the community is made and the equipment installed, landlords must be aware of the legal consequences of such an action. One who assumes a duty is then required to perform that duty in a reasonable manner.

Thus, where a landlord installs cameras at the community or takes other security related measures designed to instill a sense of security will create a duty to provide that reasonable measure of protection. Landlords may limit their liability by posting signs conspicuously throughout the community which clearly delineate the purpose of the cameras.

If the placement of the cameras was done to protect the financial interest of the property owner, advising tenants of the true use and limitations of the surveillance equipment would be important if an incident occurs.

USE CAUTION WITH COMMUNITY ‘RENT DROPS’

Understanding the risks

By Andrew M. Hull, Esq. s a courtesy to their residents, many communities have “rent drops” or “night slots” for renters to use to deliver their rental payments.

Landlords should be aware of the risks involved in providing this service.

A rent drop or night slot is usually a slot in the door at the rental office where a renter can pay his or her rent after hours.

The resident simply slides the rent payment through the door slot and assumes the property received it.

This procedure becomes a problem when the rental payment is lost, misplaced, stolen, or somehow not received by the landlord.

This scenario creates the question: “Who is responsible: landlord or resident?”

A

Factoring your decision This ultimately may become a question for the judge, and he or she may make the decision based on a variety of factors.

If a landlord uses an after-hours drop box, it is advisable that he or she informs residents in writing that the rent drop is for their convenience, but it is their responsibility to make sure management actually receives the rent. Have them sign or acknowledge this.

Problems can still arise, however. Some courts will say a property that offers a drop box receives rent payment once the renter places it in the box, regardless of whether management actually receives it.

If a renter pays by check, it is very easy to simply tell the resident to put a stop payment

on it and reissues a new one. However, if he or she pays with a money order or certified funds, it can take quite a while to trace the money and have them reissued. Whether a landlord wishes to wait for the renter to complete the trace is up to his or her discretion. Additionally, if the renter says he or she paid the rent by cash through the rent drop, it may come down to whom a judge believes.

Renters’ obligation Management should clearly state in the lease that residents should not pay rent by cash when using the drop box. The lease should also state that it is in the renter’s obligation to follow up with the rental office that they received the payment and that he or she uses the rent box at his or her own risk.

For example: Burr Bank and Sam Andreas rent an apartment at the Sunshine State Apartments. Manager Holly Wood tells them they can pay rent during business hours or through the night drop.

Holly Wood doesn’t receive the monthly rent payment from Burr Bank and Sam Andreas, and serves the two a five-day non-payment notice. Burr Bank says he put cash in an envelope and put it in the rent drop. He adds that his friend, Cal E. Fornia, watched him do it.

At the eviction hearing, the judge rules in favor of Burr Bank and Sam Andreas because the community did not have any restrictions on either the use of the rent drop box or the manager payment.

The longer it takes to file, the more likely accident details could be forgotten or omitted and witnesses may not recall what

Sense of security We are asked often if it would be permissible to put up fake or “dummy” cameras on the property. While that may seem like a cost effective way to create a sense of security and reduce criminal activity, the liability facing such an owner for the installation of fake cameras substantially outweighs the cost savings on the front end. As indicated above, once the landlord creates a sense of security by undertaking action to secure the property, the landlord must continue to execute its duty to protect residents in a reasonable manner. Placing fake or inoperable cameras at the community would be considered to be unreasonable conduct, thereby exposing the landlord to liability for a tenant’s or guest’s injury in a negligence action.

he celebration of 50 years of the Arizona Multihousing Association gave our board and members a platform for the year to think about where our greatest successes have been and where we want to lead moving forward. Itâ&#x20AC;&#x2122;s been my privilege to serve on this board for 10 years. This experiences,

as well as working with the NAA as a Region 7 regional vice president, will inform my work as your board chair in 2017.

Our board, working closely with Tom Amy Smith Montoya Simplot and the staff of the AMA, is charting a course to build on what we have accomplished over the past years and grow

the impact that we have at the national level. Thanks to the vision of our recent board chairs in creating training and leadership development opportunities for our members, we have started to deepen the leadership bench for our future. Dale Phillips, vice chair and strategic plan monitor, will begin to help us monitor our progress on the strategic goals set out for the next three years. In addition, Iâ&#x20AC;&#x2122;m looking forward

to working with chairs of the committees charged with the various areas of implementation.

Keeping up with technology Our board understands more about our members and how they are using technology to connect with the AMA. Our communications committee, the AMA staff, and key supplier partners are developing technology to allow members

members into the AMA. Key sectors of our industry like student housing have not typically been active members in our association at either the local or national levels.

We are seeing the NAA also look to further engage with these potential members and provide more resources for them to grow and impact their business.

The AMA has been fortunate that most of the largest operators in Arizona have brought their portfolios fully into membership giving us the opportunity to expand our offerings and share the benefits with other emerging multifamily sectors.

Growing outreach to operators, companies around the state

to sign up for programs and trainings and connect to each other. We have recently launched the AMA app and soon you will see the launch of an AMA YouTube channel.

My work in the Flagstaff market has given me a different perspective on this association and its benefits. Over the years, I have developed a personal network of people throughout the state that I can call on. And I have a national network of peers who can help me when I need to talk with operators in similar markets to mine and get best practices and creative solutions. We are in a unique position being in northern Arizona.

As Flagstaff grows I’ve learned that many in my market simply aren’t “joiners.” Our association has struggled to bring industry networking to Flagstaff. Given the increased number of AMA members in Northern Arizona, I’m hoping

to start small and offer some combination networking/ trainings event this year to build bridges here. Our community is coming into its own and I want the camaraderie felt in the Phoenix area and Tucson to come into this market too.

Leadership development and taking it national Thanks to Kimberly Fitch’s dream of a local Lyceum program to develop the next level of association leaders, the AMA is graduating our third Lyceum class. We have a great pool of people to choose from as we develop local leadership and we have a growing bench for executive positions too. When I started working on appointing chairs and vice chairs for our committees, I looked for those that had graduated Lyceum.

The leadership program is working and 2017 will be a reflection of intentionally reaching out to those people.

With my connection to national association, I’m also looking for talent that can get involved with the NAA. We could have a stronger voice at the national level. Arizona’s engagement has been focused on the Capitol Conference and some attendance at the Education Conference. We are in a position to build on this to include service to the association. Arizona delegates will be coached and networked into greater NAA participation with the goal of making our state and region voice stronger on the national stage.

AMA kicks off the next 50 New logo for association The new year will bring the AMA a new brand and logo.

Following the celebration of the Association’s 50-year anniversary, the Board of Directors decided to launch a new look to reflect the diverse voices that the association represents.

The board’s task force, led

by Amy Smith Montoya, consisted of a cross section of leadership from large and small regular members who work in both urban and suburban communities.

The task force held an online contest through 99 Designs. As outlined in the strategic plan, the board wanted a more modern look that showed visually the diverse housing types represented across Arizona and worked to tie the new logo to the NAA’s branding as well. The fresh design represents high-rise living, garden communities, student housing and more.

Feedback from the larger board informed the final new logo that will be available for members to use.

ore than 1,000 attendees cheered on 400 competitors in this yearâ&#x20AC;&#x2122;s Phoenix Maintenance Mania, sponsored by HD Supply.

The day started with the educational classes, including a safety course presented by James Ashley, Director of the Industrial Commission of Arizona (ICA), and ICA Deputy Director Jessie Atencio.

Attendees also had opportunities to stay current with training on dealing with an active shooter situation, diffusing angry resident situations, legal pitfalls for maintenance, and the new changes dealing with plumbing and R-22.

The convention center echoed with teams cheering on their coworkers and maintenance experts tried their hand at a variety of tasks in timed trials.

An interview with Jen Ambrosius, Regional Sales Director, RentPath

Q: How has RentPath changed or evolved over the past few years in response to technology?

RentPath’s evolution over the past 3 years has been massive and largely driven by the mobile revolution. Our goal is to be where the renters are, hence in late 2013 we printed our last renter publication and offered a fully digital renter experience.

At that time, in the state of Arizona, 25 percent of all leads delivered to apartment communities where coming from a mobile device. As of June 2016, 69 percent of all RentPath’s visitors come from mobile devices. Almost triple in a 3-year time span.

To ensure our customers also dominate their individual mobile experiences with Jen Ambrosius renters, RentPath has expanded our product offering to assist communities with text message communication, mobile responsive email communication, online social media and reputation management. All of which go beyond just driving leads, but help in converting leads to leases and retaining current residents.

Q: How do you stay ahead of the curve and meet the needs of your customers?

Our “customers” are not just our clients, but the renters using our product to find their new home. There are 8 types of renter personas that each have different drivers in choosing their new home. For example, “The Elevated/23 percent of renters” care more about what the inside of the apartment looks like specifically the kitchen, where as “The Scenester/21 percent of renters” care more about the location of the community so they can walk to the best dining and coffee shops.

Understanding each renter persona and allowing them to customize their search to fit their desires has been key to RentPath’s growth.

In August, RentPath completed its first company-wide hackathon, were six teams looked at the various renter persona segments and how we could customize the search experience to “delight” each of the various customer types. This hackathon has birthed an exciting map of product enhancements and new product development that will begin releasing as early as December 2016 and throughout 2017.

Q: What are some of the newer technologies or products that you offer that some may not be aware of?

Community Reputation PRO: RentPath will monitor AND respond to all reviews with an average response time of 20 minutes. In addition, RentPath will actively manage and post to your communities Facebook, Google+ and Twitter pages.

How has your work with the AMA helped you grow your business?

At RentPath, we strongly believe in supporting the associations that make our industry stronger. The AMA’s ability to monitor and influence legislation that ensures consistent and steady growth of the multifamily industry in Arizona has a trickle-down positive impact on all its regular and associate members.

Q: What’s been the program or experience with the AMA that has helped you professionally or personally?

There are have been many, but I would say my favorite was being one of the AMA’s first Lyceum graduates. Spending a year developing my volunteer and leadership skills with some of the industry’s top future leaders was time well spent and helped shape the direction of my career.

Welcome to The Stetson AMC enjoys a little bit country, little bit Rock & Roll

By Adam Greco, Burns Pest Elimination and Phoenix Chairman of the AMC ifestyle leads at Alliance’s newest Broadstone community in the heart of downtown Scottsdale, the Stetson. Building on downtown Scottsdale’s historic western theme, the community’s personality appears modern, with a tip of the cowboy hat.

AMC members visited this new community and every detail of the evening wowed our members. Guests were escorted to the private elevator that opened on to the second-floor Pool Club where Alliance hosted a professionally catered buffet with a bartender. More than 70 attendees got to experience their “cowboy cool” lifestyle.

Robert Hicks, executive vice president and former AMA board chair, shared the vision of the Alliance brand and for The Stetson. The company remains focused on the family and their employees and he talked about how Alliance is raising the bar on upscale living in the Valley. The Stetson speaks to that commitment in every detail.

Museums and shopping anchor this neighborhood and it’s easy to see why young professionals choose The Stetson!

Alliance brought their key Arizona leaders to this gathering to mingle with our members. Hicks, Keri Conyers, Heather Knudson, Brandon Corn, Jasmine Greene, Tina Schreiber, Angie Bell, Kelly Larson and Kenny Fitzgerald were on hand as members enjoyed tours and the program. Each attendee received an Alliance portfolio contact flyer, with contact info of their managers for all of their properties. For our AMC members, this is a huge value and so appreciated.

New opportunities Hicks highlighted a few other properties opening and planned for the near future including their newest Broadstone Fashion Center in Chandler and the Broadstone Arch District, slated to open in early 2017. According to Hicks, Alliance remains focused on these developments; but they are always open to new opportunities and innovative ideas for the company.

Each month, AMC raises funds for the AMA’s Julie Hurst Scholarship Fund through a raffle where the winner gets a lunch with a company leader. To build on this tradition, the Alliance team offered two lunches, one with their operations team and one with their services team.

Blue Steel Security Services president Michelle Howland won the lunch with Keri Conyers and John Krause, WASH Laundry won lunch with Jim Hansen and Pete Parham.

Heather Knudson, Alliance’s southwest regional manager, led a trivia raffle where the company rewarded winners with gift cards. Every attendee went home a winner with a gift bag that included sunglasses, cozies and other items to make us wish we lived there!
