Looking to the future Summers in most of Arizona used to be a time of catching up in the slower season. Not this year!

I’m sure you have seen the exciting news that Tom Simplot, our President and CEO for the past nine years, was recruited to Washington, D.C. for an executive position with a federal agency. Under Tom’s tenure, the AMA has become stronger than ever.

Our membership has grown, we are financially stable, and our industry’s impact on the community through supporting programs such as Raising a Reader, Our Family Services, Tucson Homeless Connect and UMOM has become something we never dreamed we could do.

Courtney Gilstrap LeVinus, our longtime partner and leader of our advocacy team, has stepped in as interim President and CEO as the board charts a course for the future. Courtney’s worked with our members for nearly two decades and we couldn’t ask for a more capable interim leader. She knows our work, and has worked with Tom to ensure a smooth transition.

Last August, we set a goal to grow to 2,000 members statewide and to more than 250,000 units by 2019 and thanks to your efforts, we are on track to achieve this. Our board will gather in August for our annual retreat and we are looking forward to a robust discussion about how we will continue to serve our members and keep our industry healthy for the long-term future. New opportunities ahead For nearly all of my professional life, I have been advocating for the Arizona Multihousing Association. It’s been nearly 20 years and you could say that the AMA is in my blood. Many members may even remember that my mother, Suzanne, worked with the AMA starting in 1988.

This summer, I’m taking on the challenge of leading the AMA as the interim President and CEO. I’m proud to take the reins from my friend Tom Simplot, as he pursues an important opportunity in Washington, D.C. Under his leadership, our association has become one of the largest and most influential advocacy groups in the state, and our members stay more connected than ever through our networking and education opportunities. Tom expressed sincere thanks and appreciation for our professional staff at the AMA and I echo his sentiment.

I’m grateful for this opportunity to continue to work alongside committed leaders and I’m looking forward to a building on Tom’s legacy.

In this issue, we are sharing some of the important research conducted by the NAA about the demand for rental housing for the next 15 years. The numbers are impressive and I see this as an opportunity for the AMA to continue to educate both legislators and residents about the benefits of our industry.

Nelson competes for HSL at National Maintenance Mania HSL and the AMA family came out in force to cheer on Jesse Nelson of Catalina Canyon for the national Maintenance Mania competition. Nelson earned this top slot for his outstanding performance in Arizona’s event. Since his local win, Nelson has been honing his skills in HSL’s special training space. The HSL team was especially proud of Nelson’s achievement as he was the only competitor from Arizona.

THE SEARCH IS ON With the recruitment of Tom Simplot to an executive position in Washington D.C., the Arizona Multihousing Association began a search for a new president and CEO. The search process will be governed by the Association By-laws and the recently board-approved Succession Plan. According to the plan, Amy Smith Montoya appointed a search committee chair, Chris Evans, AMA past board chair and executive vice president of HSL Properties.

Evans presented a slate of committee members to the executive board for approval. The 10 search committee members represents a wide cross section of AMA members, including regular and associate members, large and small companies, and a diverse geographic region, all having held leadership positions within the AMA. The search committee will begin to investigate search firms to aid in the process, as well as collect

resumes from interested candidates within the existing multifamily and association network. A recommendation to proceed with or without a search firm will be presented to the board of directors at their annual retreat in early August. Once a decision is made, the candidate vetting process will begin.

“We hope the process will take no more than three to four months,” Evans said. “We are a strong association and Tom has left us in a place of influence and financial stability that should be attractive to any association executive applicant.”

The associations contract with interim president and CEO, Courtney Gilstrap LeVinus, is in effect through December 2017, with an included option to extend as needed.

Keeping the peace Discrimination based on familial status and understanding your rights under the Fair Housing Act

A

t one time or another, we’ve all come across individuals who do not particularly enjoy the presence of young children. Unfortunately for landlords, when this individual happens to be a tenant living in a community with young families, it can spell disaster.

We all know the story; a young family moves in next door and before long, their elderly neighbor becomes agitated by the children’s constant playing and commotion. The situation continues to worsen over time, and the angry neighbor inevitably comes to the landlord demanding that something be done. This creates a tricky situation. It is a landlord’s duty to keep tenants satisfied with their living experience by

maintaining peace and quiet in the community.

But what if you could avoid this type of conflict entirely?

For some landlords, the simple solution to this problem would be to identify tenants who have expressed their desire for peace and quiet, and to avoid placing families with young children in units next to or directly above them.

Unfortunately, while this may alleviate ongoing complaints and disputes between residents, a recent 2016 decision in the New York district courts has made it clear that this type of strategy could be considered discriminatory under Fair Housing law.

Case study In Thurmond v. Bowman, a prospective tenant contacted a leasing manager to inquire about renting an apartment unit advertised in a local newspaper.

The apartment manager confirmed the unit was available, but quickly changed his tone upon learning the prospect would be moving in with her young daughters. More specifically, when the prospect indicated her daughters were ages seven and one, the manager stated, “I will not be able to rent to you because of your two small children. There is a disabled person living in the unit below and children that age will drive him nuts.”

Believing she had been the victim of discrimination, the prospect sought help from a local fair housing organization which ran tests on the apartment complex by posing as prospective tenants in an attempt to substantiate the prospect’s

belief. When the organization called the leasing office posed as a single mother of two young children, the manager allegedly expressed similar sentiment, indicating he would not rent the unit to tenants with small children. However, when posed as a married person without kids, the manager indicated the unit was available.

Armed with this support, the prospect filed a complaint with her local fair housing agency, and subsequently sued the manager and owner of the property for violating fair housing law by discriminating on the basis of familial status. While the manager and property owner initially moved to dismiss the case by presenting evidence that the prospect had a criminal history, which would justify them in denying her tenancy, the court held that the manager did not know about the criminal history at the time he talked to the prospect, and therefore could not use that information to justify his actions.

Intentional discrimination The court ultimately decided that the statements made by the manager to the prospect over the phone constituted discrimination under the Fair Housing Act (FHA) on the basis of familial status. In coming to this decision, the court held that the prospect had made her claim under a theory of disparate treatment, also known as intentional discrimination.

analysis where the plaintiff must provide indirect evidence tending to show the actions taken by the defendant were motivated by discrimination.

The defendant is then given a chance to provide a legitimate nondiscriminatory reason justifying his actions.

However, in the current case, the manager’s statement to the prospect that he “w[ould] not be able to rent to [her] because of [her] two small children” was so explicitly discriminatory that it constituted direct evidence (i.e. the “smoking gun”) linking his decision to deny her tenancy with discriminatory intent against her children.

When such direct evidence is presented, the burden shifting

analysis is not required.

Despite the managers attempt to justify his statements based on a legitimate concern for the safety of the children and the peace and quiet enjoyment of the elderly resident, the court held that these concerns did not excuse his discrimination.

The court cited regulations passed by HUD which prohibit all landlords from assigning people to a particular floor of a building based on their familial status. Those same regulations also prohibit communication to prospective purchasers that they would not be comfortable

or compatible with existing residents of a community due to their familial status.

Exercise caution While neither party raised the issue, it is also worth noting that the court held the owner of the apartment complex liable for the discrimination by the manager under a theory of vicarious liability. Under this theory, an owner that hires an employee to represent his/her business is held responsible for the actions taken by that employee if those actions fall within the scope of the employee’s duties. Though not expressly provided for

in the FHA, the court cited precedent supporting that real estate owners can be held vicariously liable for discriminatory acts by their employees.

The lesson for landlords is this: Use great caution when making statements to prospective tenants. Despite landlord’s best intentions, Fair Housing law prohibits any and all types of statements that have a discriminatory effect on a protected class by showing preference for one group of people over another.

In the event that property owners rely on managers or other employees to handle day to day operations, it is critical for owners to educate these employees on potential liability issues under the FHA.
