T

he start of the new year always means busy days and nights for the Arizona Multihousing Association. The government affairs team begins a new session, the AMA team starts work on the annual Tributes event and we are celebrating the success of the Big Hearts for Little Hands campaign. More than ever, members of the Arizona Multihousing Association are working together to accomplish great things for our industry and for community.

Looking forward to an election year Although the start of this legislature has seemed a bit rocky with national press focused on some early legislation, we are expecting that this year’s session will be shorter.

This fall, we are looking forward to statewide elections where we will choose a new governor, new congressional representation, and many other important offices. Candidates are eager to begin their campaigns and our government affairs committees will be interviewing these candidates to understand their positions on issues that are important to our industry. Stay tuned for lots of news around upcoming elections.

Celebrating Big Hearts for Little Hands Our members come together each year to support the Arizona Multihousing Community Foundation and the Big Hearts for Little Hands programs. Onsite fundraisers that engage our residents and our employees, raffles, 5K events and a host of other activities raised tens of thousands of dollars to support local programs that help families secure

safe, sustainable housing. We understand how critical secure housing is to the success of families, and of children in particular. Our members are involved in a number of programs to support these efforts but BHLH is our signature fundraising program of the year. During our January dinner meeting, we celebrated the success of management companies’ efforts and presented UMOM and Our Family Services/New Beginnings with checks totaling over $90,000.

Recognizing our best January and February brings together hundreds of Tributes nominees in metro Phoenix, Tucson and Flagstaff. Judging panels review nominations and meet with finalists to select the best employees of our industry. More than 400 nominations were reviewed and interviewed by these dedicated panelists and I’m grateful for their support and investment of time. Tributes celebrates the best of our industry and our teams deserve these honors for their work. I’ve chaired this event in the past, and I can tell you firsthand how inspiring these individuals and teams are. As an executive, it’s a great way to learn more about the wonderful people who work in our companies. I even gained new ideas from these outstanding employees to make my company better.

Learning from each other and appreciating our talented teams is what Tributes is all about.

This year we have some exciting programs to roll out to our member companies. We are pushing this association to the next level and providing real value for members, and our residents, which will be an exciting addition. Stay tuned for more news on AMA programs. And plan to join us this spring for all of our exciting programs!

Smith appointed to NAA National Task Force

The National Apartment Association recently selected Amy Smith, managing partner of Bella Investments and AMA Executive Committee member, for its newly formed Next Generation Task Force.

The group will be developing recommendations for programming and events to attract the next generation of leaders for the NAA. This forward looking task force will be working on promoting Amy Smith the engagement and retention of NextGen employees in the industry to promote their attendance at NAA meetings.

WINN RESIDENTIAL ADDS ARIZONA COMMUNITIES TO ITS PORTFOLIO WinnResidential, the property management arm of WinnCompanies, announced that it has assumed management responsibilities for Highridge Costa Investors, a leading developer and asset manager, at six of their multifamily communities in Arizona.

WinnResidential will take over the property management, maintenance and leasing for all six communities. The portfolio includes: Casa Bonita and Valle del Sur Condominiums in Tucson; Florence Park Apartments, Florence; Quail Run Apartments, Peoria; Sonora Vista Apartments, Douglas; Village Square Apartments, Phoenix. These six properties offer senior housing, affordable housing, market-rate housing and some properties were designed specifically for special needs residents.

WinnResidential is the nation’s sixth largest firm in residential property management, with apartment communities ranging from 17 units to 5,000 units. The company manages over 95,000 apartments and condominiums in more than 20 states. Also in Arizona, WinnMilitary currently manages housing on Davis Monthan Air Force Base.

Many hands made a difference More than $65,000 raised for families in need

By Rob Schmitz, AMA January’s AMA dinner meeting celebrated the outstanding accomplishments of the 2013 Big Hearts for Little Hands fundraising campaign. The AMA honored management companies who dedicated their time to collect funds and raise awareness on housing and homelessness in our communities.

Annual events like the bowl-a-thon, silent auction and car raffle brought in thousands of dollars to support families in need.

51st Legislature opens Second Regular Session AMA pursues legislative priorities

T

he 51st Legislature, 2nd Regular Session officially commenced Jan. 13, 2014. A total of 1,186 bills were introduced by the legislature and of those, 300 or so should arrive on Governor Jan Brewer’s desk in order to be signed into law.

During her State of the State address, Governor Brewer announced her policy priorities for the year, including a complete overhaul of the State’s defunct child protective services and new incentives for manufacturers to set up shop in Arizona. Based on last year’s Medicaid fiasco and her willingness to take full advantage of her veto power, the Legislature has made a concerted effort to advance her policy priorities.

The Senate Appropriations Committee approved roughly $8.57 million in spending that will allow the State to hire 192 new child welfare workers for the newly created Child Safety and Family Services in an effort to resolve the backlog of 6,554 uninvestigated cases.

The Senate has also introduced legislation to eliminate the sales tax that manufacturers pay on energy usage and lower property taxes on manufacturing equipment in foreign trade zones — federally designated areas where commerce is considered to be outside the boundaries of the United States.

Much like the Governor, the AMA entered the Session with two priorities as well; both focusing on issues brought forth in the Phoenix and Tucson Government Affairs committees.

AMA’s Priorities The AMA’s first proactive bill, Senate Bill1305 (semipublic swimming pool barrier gates, Sen.

Gail Griffin), will grandfather all existing semipublic pool access gates and will allow property managers to choose the type of locking mechanism for the gate, whether it be a dual-key locking mechanism or a ‘thumb latch.’ Starting Jan. 1, 2015, new pool access gates (for semipublic pools) will be subject to the local city code or ordinance. This bill was developed after the city of Tucson began systematic inspections of all apartments and the pool areas and subsequently required the removal of all ‘dualkey’ locks on the pool gates.

The AMA’s second proactive bill, Senate Bill1213 (real estate advisory board; membership, Sen. Gail Griffin,) will expand the Arizona Department of Real Estate Advisory Board to ten members to include one representative from the multi-family property management industry.

Since the Advisory Board makes recommendations to the Real Estate Commissioner on all real estate related matters, including matters related to multi-family property management, it is only fitting that the Board be represented by a multifamily property manager. www.azama.org

LEGISLATIVE UPDATE

Both bills have been approved in the Senate and are working their way through the House of Representatives.

No different than any other year, the AMA has also faced legislation that, if enacted, would be damaging to the industry.

Most notably, Senate Bill 1062 (exercise of religion; state action Sen. Steve Yarbrough) made significant headlines in both the national and local media outlets. The bill would have allowed a person to assert a free ‘exercise of religion’ claim or defense in a judicial proceeding. After taking the entire business community by surprise and actually landing on the Governor’s desk, the AMA sent a letter to Governor Brewer urging her veto.

Aside from the general concern that Senate Bill1062 would have cast a

negative light on Arizona, the AMA was concerned that SB1062 directly conflicted with the provisions set forth in the state and federal Fair Housing Acts and several local ordinances.

The Fair Housing Act, as amended, prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on race, color, national origin, religion, sex, familial status and disability. The cities of Phoenix, Tucson, Tempe and Flagstaff have further expanded their anti-discrimination ordinances to include sexual orientation, gender identity and expression. In addition, housing providers that receive U.S. Housing and Urban Development (HUD) funding, have loans insured by the Federal Housing Administration (FHA), as well as lenders insured by

FHA, may be subject to HUD program regulations intended to ensure equal access of LGBT persons.

Requiring the housing provider to choose, or otherwise ignore, conflicting federal and state requirements was an unreasonable burden that SB1062 would have seemingly created. The bill was ultimately vetoed by Governor Brewer.

There are a number of other bills that the AMA is currently monitoring. The AMA’s “Hot List,” bills that have been identified as having a direct or indirect impact on the industry, can be viewed on the AMA’s website. AMA recognizes top talent, performance for the year

taff members in an apartment community encounter the best and the worst of the multifamily operations. They assist prospective residents in finding the right home, help them get signed and settled and they mitigate tough issues with residents when necessary. Through their efforts and creativity, management companies raise dollars to support charity, they host special resident retention events and so much more to make companies stronger and more profitable.

Training, skills pay off Their ability to problem-solve, lead, follow, engage and more supports the professional operations in Arizona apartment communities. The investment in training and management skills pays off for owners when vacancy rates are low and retention is high.

New communities, redevelopment and a tighter housing market puts the resident in a more favorable position so the front line and back of house teams can often be a deciding factor for residents. In addition, Arizona’s talent market has become more competitive over the past few years as the real estate market has recovered and great employees are in high demand.

teams that run these multifamily communities. From the housekeepers to the maintenance teams to leasing to management, every level of these skilled teams deserves the spotlight during Tributes.

This annual awards event, hosted by the Arizona Multihousing Association along with Cox Communications, has become more competitive over the years. This year, there were 440 nominations in 23 categories. Judges visited 35 properties in the Developer’s Award, Affordable Community, and Renovated Community Categories.

Once these nominees were initially interviewed, the judging panels narrowed the field in each category to a smaller group of finalists who were each interviewed again during February and March.

Thousands of volunteer hours have been dedicated to this undertaking and on May 8, the Tributes winners will be announced at the Downtown Sheraton Hotel in Phoenix.

Rate change

T

he Arizona Department of Insurance has approved the National Council on Compensation Insurance’s (NCCI) recommendation to the Arizona Department of Insurance for an overall average rate hike of 3.2 percent, beginning Jan. 1.

The change in rates varies depending on the specific classification code. Each classification belongs to one of five industry groups. The average changes proposed for each of these groups are:

If an employee of one of your members is injured at work and treated by the company’s first-aid kit, then the injury is not severe enough to warrant a workers compensation claim.

Cuts, scrapes, small wounds or even a single headache are insufficient reason to file a claim.

If, on the other hand, a worker is exposed to a chemical that causes routine headaches, this could be considered an “occupational disease” that could prompt a workers compensation claim.

Your members also should be reminded not to pay the claims costs for their injured workers.

The reasons?

They may be paying for non-compensable claims.

They may end up paying more than what SCF would have paid based on the contracted fees from its Preferred Connection Network or the Industrial Commission’s Medical Fee Schedule.

What might start as a minor injury could become worse, and the costs for treatment could increase.

: We need help. We moved into our apartment over 5 months ago. It really looked nice. Then the problems started. Both bathroom sinks and the kitchen sink started leaking. Mold has started growing. The wall in our front room has the paint peeling off. The woodwork has turned orange and the carpet stays wet. It stinks so bad. As soon as we started using the air conditioner, dirt poured out of the vents. The black dust has gotten into our scalps and onto our skin, forcing us to see a doctor about it.

I have complained to management for months, but management has done nothing. I know we can’t force them to clean the vents, but I’m worried if our health can last another 6 months until the lease is up. Where can we go to for help?

: If I have served a resident a 10-day notice for non-compliance such as loud noise or unauthorized occupant, if the rental due date occurs after the 10-day was served, can I accept the rent that is tendered at that time?

A

:No. If you accept the rent payment, you run the risk that it will be found to have waived your right to proceed on the 10-day notice. You could accept the

payment only if the resident signs a non-waiver agreement, which would explain that if the 10-day is violated, the eviction could proceed even though rent was paid.

Q

: What procedure should I follow to get my resident to pay for damages caused by the resident, such as broken window, when they have ignored my requests for payment?

A

: You should begin by serving a 14-day notice pursuant to ARS 33-1369. If the resident fails to pay within the notice period, it becomes due as additional rent the following rental due date. If at the rental due date the resident tenders only rent without reimbursement for the damages, the tendered rent can be rejected. — Scott M. Clark

A conversation with Fairfield’s Greg Morehead

G

reg Morehead is a regional supervisor with Fairfield Residential with responsibilities over the Las Vegas and Phoenix portfolios. Over the past 18 years, Morehead has served in a variety of roles with Fairfield starting with leasing and then moving into acquisitions, and then regional supervisor. A Tributes judge for the AMA for the past few years, Morehead shares some of the lessons from those interviews with finalists from properties around the state.

Q: What have you learned being one of the judges AMA’s Annual Tributes?

A: It’s amazing to see how diverse our industry really is.

From property to property, company to company and person to person. It’s great how we all come together as an industry, all for the same goal, to provide exceptional living experiences for our customers.

Q: What impressed you in the Tributes nominees as you interviewed them?

A: It’s fun to see how much they enjoy the business and how dedicated they are to their teams and to the residents. The interviewees love their jobs, love the industry. The energy and positivity is enlightening and makes you proud to be in the business.

Q: Did you learn any specific best practices from the nominees that you might take back to your own company?

A: I saw a lot about how we all have worked to improve our resident events in the Tributes interviews. When times were

hard, a free pizza party brought people out but they weren’t engaged. Today, these teams get resident feedback and buy-in.

The events are more successful and residents have built strong relationships with the teams and one another, because they have a feeling of ownership within the community and provide feedback to improve future events.

Carrying this forward, the team members are happier. It’s reciprocal – residents are happier and that makes our jobs easier. We saw this in our own Tempe community when a new bar opened on Mill.

They invited our community and 50 residents attended this special event.

Q: Did you see any specific leadership/management programs that inspired or impressed you?

A: We heard about some really interesting mentoring programs where people were assigned to mentor people on specific tasks or positions. For example: a mentor would be assigned to help teach a newly hired team member, oneon-one versus sitting them in front of a computer or throwing them in without

guidance and direction. You see some that offer mentoring teams by position whereas some programs go as deep as specific mentoring for individual tasks, such as budget or marketing-survey mentoring. These programs keep people engaged. We aren’t just throwing people in; instead a mentoring program gives them someone to reach out to.

Q: What do you think is special about how Fairfield engages their employees?

A: It’s the culture of Fairfield, which promotes empowerment to our team members. Our managers and teams are responsible for their communities. They run their properties, from the budget, to daily activities and our corporate team relies on them to make the decisions for their properties, in the best interest of company and the ownership entities.

My philosophy is that they have the hard job and I’m there to support them.

Q: What kinds of training or management development do you see as a need in the industry?

A: I can see how important more personal management training is for employees. We are seeing a lot of web based training which can be really good, but the in-person training is still key.

People should look into the training offered by the AMA. It can help develop their skills and help them networking within the industry.
