AMA working to prevent drowning Seeks clarification on municipal pool code

very year, the AMA considers issues to be addressed at the state level at the direction of the Tucson and Phoenix Government Affairs Committees. The committees, comprised of property management, attorney and developer members, set the AMA’s legislative priorities and provide their invaluable expertise.

Every so often an issue arises in a local jurisdiction that requires legislative action. Though the AMA is cognizant of taking away local control, the AMA also realizes the importance of preemptive legislation when matters are of statewide concern.

The regulation of swimming pools is an example of such.

Early last year, the Tucson Fire Department began systematic inspections of all apartment communities within the city. Initially the fire department requested that managers allow inspectors into all occupied units.

After meeting with the AMA and acknowledging the statutory prohibition against interior rental inspections and the potential Constitutional violations for the residents, the department instead focused their efforts on vacant units and common areas.

During their swimming pool inspections, the fire department interpreted the fire code in a manner that required the removal of all existing “dual-key” lock mechanisms from the pool access gates. Apartment owners were then ordered to replace the dual-key locks with a “thumb-latch” on the egress (exit) side of the gate.

This interpretation of the code prompted the AMA to once again meet with the fire officials.

Q&A: Knowing the law

Q: One of our residents was deep frying a turkey for their holiday meal. The turkey caught on fire and almost caught our building on fire.

The tenants, not knowing what to do, threw the burning turkey into our swimming pool. What type of notice can we give?

A: You can definitely serve an immediate eviction notice because of the treatment of property damage and also to a potential fire, but also the damage caused to the pool from all the oil. Your only other option would be a five day health and safety notice not to do this again; also to assess the damages to the tenant.

Q: We recently evicted a tenant. He has come into the office after the eviction order was signed against him and has all his money that is due and owing the property. He wants to pay and continue residing. We do not want him to live at the property any longer. Can we refuse his money?

A: Yes. Once a judgement has been signed by a judge, it is at the landlord’s discretion if they want to reinstate the lease and allow the tenant to continue residing there, or simply require the tenant to vacate.

If the tenant puts money through the night drop or delivers rent, the landlord should send a letter that they cannot accept the payment as reinstating the lease and they will apply it to the debt, and the tenant must vacate according to the court order.

Q&A: Corporate Suites

new “thumb latch” requirement could put the community at risk of increased occurrences of unsupervised children or uninvited adults entering a pool area since access to the pool area could be achieved by simply reaching through or over the gate and releasing the “thumb latch.” The AMA also insisted that the use of dual-key locks was an industry standard that has been in place for most apartment communities in Tucson and throughout the state.

What clouds the issue even further is the fact that the current State Pool Code, which already sets minimum standards for every pool in Arizona, seemingly contradicts the local fire code on this issue.

This is notwithstanding the fact that all of the pools in Tucson, including the access gates, were initially inspected and approved by city and county officials during the construction process.

Q: Should landlords enter into a written agreement when leasing corporate suites?

A: Yes. A corporate suite is typically a fully furnished apartment, which is leased for short periods of time (typically from one week to one month). Any agreement for a corporate suite should, at a minimum, provide: 1) the parties to the agreement; 2) the length of the term of the agreement; 3) any costs related to enforcement of the agreement; 4) any associated late fees or attorneys’ fees for breaching the agreement; and 5) the landlord’s legal remedies for nonpayment of rent, and/or failure to timely vacate the

the AMA could not achieve a reasonable compromise with city officials. Thus the decision was made by the AMA government affairs committees to seek clarification from the legislature.

In January, Senator Gail Griffin (R-Hereford) agreed to introduce the legislation that would simply clarify in the State Pool Code that the “use” of dualkey locking mechanisms was permissible and could not be prohibited by a local

corporate suite. Of course, the more detailed the agreement the better. A clearly written agreement can save significant legal fees and costs if things do not go according to plan with your corporate suite tenant, but please note you still may need to take legal action to enforce the agreement. Additionally, by providing clear guidelines, each party is on equal footing as they are aware of the terms and conditions of the agreement, and the ramifications for failing to abide by it.

imberly Fitch, the incoming AMA board chair, sees many opportunities for the AMA and its members in 2014.

“Taking over the leadership of the AMA board of directors is an exciting challenge and an opportunity to leave a legacy in our industry. I’m honored to work with the talented professionals on the executive committee and engage with our board of directors as we map out how to grow the association. And I am excited for the launch of this new look for our publication. I know you will enjoy this new format and I think it will be more engaging and informative.

The investments we make today in the future of our Association and our corporate leaders will pay dividends for years to come. Developing the next generation of leaders for the AMA is a top priority for me. The AMA will launch our own version of the NAA's Lyceum program

here in Arizona in February. This program identifies emerging leaders and trains them to support the mission of the association and move our multifamily industry forward in the coming years. The attendees will participate in three days of interactive training, field trips, and leadership development skills. They will graduate as our Alpha Class at this year’s Holiday Party in December.

Vested volunteer leaders in an association need to be cultivated and trained. The Lyceum program educates participants on local issues and the inner workings of the AMA, and supports their professional development. As leaders within our own companies, we have a responsibility here too. It’s critical that executives of our companies support their employees’ involvement in the AMA. The time invested in the Association helps protect our businesses through this time and financial commitment. We must be internal advocates of this training for our team members. In turn, those employees will be stronger leaders within our organizations.”

Learn more about Lyceum Leadership Program The Greek Lyceum was a school of philosophy founded by Aristotle near the city of Athens in 335 B.C. Its purpose was to serve as a center for discussion, debate, reflection and study.

The Lyceum works to identify and develop a well-informed and highly motivated group of

emerging multifamily housing leaders; people with a broadbased vision for, and strong commitment to, the mission and strategic objectives of the AMA. A common challenge facing the industry is the ability to identify association volunteers who are trained and motivated to move

the association forward, and who have the time to volunteer and have the support of their employers.

The AMA is launching the Lyceum Leadership program in Arizona for its members this year.

The first session of our Alpha Class will be held in February.

Nicolosi & Fitch As the Owner and Chief Financial Officer of Nicolosi & Fitch for the past nine years, Kimberly Fitch and her business partner manage more than 5,000 apartments in Arizona. Over the past 30 years, she’s built a proven track record managing conventional properties as well as HUD insured and Low Income Housing Tax Credit buildings.

In addition to her professional responsibilities, Fitch has continued her service to the industry as the 2003 President of Tucson's IREM Chapter, and has served on the Board of Directors of the Arizona Multihousing Association (AMA) since 2004. Fitch completed the National Apartment Association's (NAA) Lyceum program that grooms future leaders for the NAA. She is a Certified Property Manager (CPM) and was voted Southern Arizona's CPM of the Year in 1997.

Fitch's interest in the quality of life beyond her profession includes serving on the Tucson Homeless Connect Board of Directors and chairs the Resources Committee. Their committee hosts events to connect homeless individuals with necessary services like housing, healthcare and more. They also put together backpacks for attendees with personal care items. Fitch earned her degree in English Education at Bowling Green State University and has two children in college - Chuck and Kelly.

Dunlap & Magee Christine Shipley, CPM is Vice President of Dunlap & Magee Property Management, AMO, responsible for the property management operations.

Shipley joined the Dunlap & Magee team in 1990 and has more than 25 years experience in Real Estate management.

A licensed Associate Broker in Arizona and New Mexico and the designated Executive CPM for Dunlap & Magee, she currently serves as chair elect on the Arizona Multihousing Association board and secretary on the Constable Ethics Standards & Training board.

Born and raised in Arizona, Shipley is committed to giving back to the community through volunteer time with St. Vincent de Paul, Girl Scouts of America, and Special Olympics. In her off time, she can usually be found camping with her husband and two teenage daughters.

HSL Asset Management, LLC Christopher L. Evans is a US Navy Veteran and is the Designated Broker of HSL Asset Management, LLC. He joined HSL Asset Management when it was established in 2002 and is the Executive Vice President. He has had the unique opportunity to work hand in hand with five of the top third-party, apartment management companies in Tucson. Using this knowledge and prior management expertise, he created an owner/investor benefit method of managing multifamily properties. These efforts allowed HSL Asset Management to grow from the ground to over 10,000 units today.

Evans is also on the AMA’s Tucson Government Affairs Committee and serves as Treasurer of the AMAPAC.

Time to Stand Up

A

s I wrapped up my term as the AMA Board Chair, I was reflecting on the past 4-5 years of work that we have accomplished to weather the recession and bring members back to active engagement with their association. Today, I’m happy to report that participation continues to increase, Tributes was a soldout event, P&P grew again, and trainings are back on the rise. It’s an exciting time at the AMA and I am proud to have moved the conversation to a longer vision of the future.

It’s imperative that the AMA begin the succession planning for the board leadership of this organization.

Perhaps beginning with volunteer committees and events, we need to develop the skills and interest of strong associate and regular members so they can transition to board governance in the future. New companies in the market and growing companies need to identify up and comers and encourage them to dedicate their time to association engagement to protect and enhance their own businesses.

It’s easy to say that the AMA offers the best networking and social events for members to grow their businesses. Our mission is really to be a watchdog for development and regulation on the legislative levels, city and state. Taxation of new developments will affect a growing market and the existing communities.

We must raise significant dollars for a defense fund for the multihousing industry. Compared to other associations like ours, we are behind. Those groups have raised upwards of $500,000 or even a million dollars to fund education and advocacy campaigns. It’s got to be a top priority for every AMA member to be engaged donors to the PAC. After all, it’s a trickle-down effect in our business. If owners/operators are affected by new taxes, we have to slow down and cut back, and then our vendors are impacted too.

We are fortunate to have some of Arizona’s top leaders governing the AMA. This executive committee, from diverse backgrounds and representing different areas of our great state, have committed their time and talent to growing this organization. Even at the pinnacle of their careers, they recognize and prioritize the work of the AMA. This stands as an inspiration to all of us and a challenge to the next generation of leaders.

Preventing deadly electrical shocks The best insurance against accidents is knowledge

lectrical shock can happen in an instant, causing serious injuries and death. Workers who accidentally touch a live wire or energized metal components become part of a closed-circuit path and can suffer the ravages of electric shock.

According to OSHA, an average of one worker is electrocuted on the job every day.

This statistic could be prevented largely through basic work safety procedures and protective devices.

Industry best practices for workers who may be exposed to electrical shock include:

Use proper lockout/tag-out safety procedures so all workers in the area can stay safe around machinery. > Being aware of overhead power lines when

working near these live, non-insulated wires. > Use appropriate personal protective equipment (PPE), suitable for the task.

Employees working under or near overhead power lines should maintain a safe distance and ground any equipment. Some general tips include: > Stay at least 10 feet away from overhead power lines. > Assume all power lines are energized. > De-energize ground lines when working near power lines and/or use other preventive measures such as guarding or insulating the lines. > Use non-conductive wood or fiberglass ladders when working near power lines.

Also look for buried power line indicators and post warning signs; contact utilities for buried power line locations.

Q. How has Synergy Painting been engaged with the AMA and its committees?

A. When I started with Synergy, I was new to the AMA so I joined the community relations committee that works with UMOM and the golf tournament committee. It’s a great way to meet new people.

A. Networking is so important!

It always makes me feel good calling a fellow AMA vendor for a great referral. I believe in positive karma — what goes around comes around!

Q. What has been your best success with the AMA so far?

A. This was my first year participating in the AMC Golf lottery. Synergy has always been a

golf hole sponsor and we wanted to win a hole!

With 150 people competing for seven holes, we had our fingers crossed. We got the hole and we won the lunch with Riverstone Residential.

This was a great icebreaker for us as we had just started bidding some of their properties.

Q. In a competitive business, what advice would you give new members about how to leverage their AMA membership?

A. I have learned to take every chance given to me not only to market Synergy Painting but to try to build relationships with everyone from vendors to company presidents.

Go to as many AMA events as possible and get familiar with faces and meet everyone!
