A preview of what’s coming

T

he National Apartment Association’s annual Education Conference and Exposition in Denver was a huge success. The walkable neighborhoods of Denver, where families have moved in to adaptive reuse buildings and businesses inhabit unique buildings, give us a glimpse of what is coming to Phoenix with good planning and a strong economy.

Multi-family communities are being developed at a record pace in our suburban cities like Chandler, Mesa, and Gilbert to meet the growing demand of the market. People want to live in a dynamic area where services, business, and recreation all come together. Many of our AMAmember communities currently in the construction pipeline will reshape those communities for generations to come.

In central Phoenix, we are seeing many years of planning bear fruit with the addition of apartments, student housing and more bringing thousands of residents into the downtown. The effect is significant. New businesses, large and small, have located in downtown Phoenix (as has the AMA!).

Crime has decreased in part due to the strong presence of students and active policing. More special events are held downtown keeping the weekends activated as well. Our industry has been a major contributor to these positive changes.

Earlier this month, the Apartment Industry’s Government Roundtable was held in Phoenix. We are fortunate to have the dynamic and effective team of Capitol Consulting representing our members at the State, county and city levels. This meeting annually brings together associations and lobbyists from around the nation to look ahead at issues that are affecting the multifamily industry at the national level and to see how we can share best practices in managing regulation and in our communities. Advocacy and government affairs represent a key pillar of our association’s work on your behalf and I’m eager to learn where we can be doing more.

We will have more news coming for you from this meeting, and I know we will be discussing the music licensing issue that affects so many of our members. Stay tuned for next steps on how to address this issue in your communities.

Greystar Acquired Riverstone Residential Increasing Western US Operations Greystar Real Estate Partners recently acquired Riverstone Residential Group from London-based CAS Capital Limited, a wholly owned subsidiary of Regis Group PLC. Following this acquisition, Greystar’s portfolio includes more than 385,000 apartment units in the US and abroad.

Court upholds property owner rights in Medical Marijuana Case

n June 10, 2013, an eviction action was filed in the McDowell Mountain Justice Court against two tenants in a Scottsdale Apartment Complex. The complaint alleged the defendants committed a material and irreparable breach of the lease agreement by possessing and using marijuana in the apartment. A bench trial was held on June 20, 2013, before a Justice of the Peace Pro Tem in the McDowell Mountain Justice Court.

At trial, the defendants admitted there was marijuana and drug paraphernalia in the unit, and that the defendants used marijuana in the unit.

However, the defendants claimed that because they had been issued a Medical Marijuana Card, they were protected under the Arizona Medical Marijuana Act (AMMA), and could not be evicted.

There was no dispute that the lease agreement prohibited “manufacturing, delivering, possessing

with intent to deliver, or otherwise possessing controlled substance or drug paraphernalia.” Both residents signed the lease agreeing to those terms.

The plaintiff argued (1) a medical marijuana card did not give defendants the right to use marijuana on the property; (2) marijuana is a controlled substance under federal law; and (3) the Arizona Attorney General issued an opinion that a landlord cannot be required to allow marijuana use on the property. Plaintiff also argued that federal law prohibited the use of marijuana, to which the trial court responded: “Federal law? Federal law doesn’t control the State of Arizona.” The trial court also asked plaintiff’s counsel if he wanted the trial court to ignore a law passed by the voters of the state of Arizona, to which plaintiff responded by arguing that the trial court cannot force a landlord to violate federal law. Additionally, plaintiff argued

LEGISLATIVE UPDATE the property rights of the property owner must prevail and, if the property owner did not want to have marijuana used on his property, he had that right.

The trial court ruled in favor of the defendants and dismissed the case. The plaintiff appealed the trial court’s ruling.

There were two main questions on appeal: (1) Did the Trial Court abuse its discretion in finding the tenant had a right to possess marijuana in the apartment? and (2) Did the trial court abuse its discretion in finding a tenant had a right to possess marijuana despite a Crime Free Provision in the Lease?

On April 28, 2014, Judge Myra Harris, with the Superior Court Appellate Division, issued its ruling on the appeal, finding that the Trial Court abused its discretion on all of the appellate issues, and reversed the judgment of the

McDowell Mountain Justice Court.

The 25-page, well-reasoned opinion stated that case law indicates federal authorities have the ability to prosecute for violations of the Controlled Substances Act (CSA) even where state law allows the use of medical marijuana and that the CSA takes precedence over the AMMA. The decision further stated that the CSA preempts the field of marijuana regulation under the Supremacy clause of the U.S. Constitution. Thus, there still remains the potential for federal prosecution of the medical marijuana user and, because marijuana falls within the category of a controlled substance, a property owner has the right to distance himself from any possible allegation of federal criminal misconduct and avoid any possible seizure of his real property.

The Appellate Court concluded that

“[b]ecause (1) federal law preempts this field and allows for the potential for prosecution; and (2) the lease agreement included a provision precluding controlled substances at the premises; the trial court erred in dismissing Plaintiff’s case based on the trial court’s belief that (1) there was protection from federal prosecution by virtue of the [Arizona Medical Marijuana Act]; and (2) the [Americans with Disabilities Act] supported Defendants’ position.�

With this ruling, landlords and tenants now have some guidance on the effects, and the reach, of the Arizona Medical Marijuana Act. 1 The Justice of the Peace of the McDowell Mountain Justice Court, the Honorable Michael Reagan, did not hear this case. The case was decided by a Pro Tem Judge.

: A tenant has moved out, and is refusing to return my calls to discuss their negative account balance and multiple breaches of their lease.

Can I use abandonment to retake the dwelling unit?

: That depends. Under ARS §33-1370 abandonment is defined one of only two ways: #1 Tenant has been absent for 7 days, rent is 10 days past due and there is no evidence tenant is occupying the residence save that his / her personal property is still there. #2 Tenant has been absent for 5 days, the rent is 5 days past due, and the dwelling unit is devoid of Tenant’s property.

The status of the property inside the dwelling unit in question can be established by utilizing a 48-hour Notice of Entry for inspection. This letter will likely have to be sent certified mail.

If either of situations #1 or #2 are present, then you may use abandonment to retake the dwelling unit. Please consult §33-1370 for the specific process, which dictates the manner, which notice is given, the security deposit is handled, and the tenant’s remaining property (if any) is disposed of. As with most cases, the landlord must attempt to mitigate damages.

Of course, depending on the facts of each case, at times it will likely be easier to institute a Forcible Detainer proceeding for non-payment of rent or other relevant issue.

Month-to-month tenancy

Q

: My question deals with monthto-month tenancy and notice to vacation the premises. My original lease expired May 2013 and the landlord had written in the original lease that he must be given a 60 day notice to vacate the premises.

Currently I’m renting on a month-tomonth basis but I plan on moving in the fall. Am I still obligated to give 60 days notice? According to ARS 33-1375 the notice to vacate on a month-to-month is 30 days. I want to be in compliance with the law, but my landlord has brought this up on several occasions and not in a nice way. What are my legal rights?

A

: Generally speaking, when you are a month-to-month tenant, you only need to provide a 30 day notice to terminate the month-to-month tenancy. However, it appears from your question that you had signed a lease that contains the 60 day notice requirement. It is quite possible that a Court would hold you to the 60 day notice requirement since you signed the lease with this provision in it. You are correct that ARS 33-1375 only contemplates a 30 day notice in a month-to-month tenancy but you can alter this as was done. You could go back to your landlord and explain the situation you are in and ask him to reconsider requiring the 60 day notice. If you have been a good tenant to date, it would seem like a reasonable request.

More recently, a steadily growing economy and increased demand for more centrally located housing near these nodes has continued to fuel Phoenix’s multifamily real estate market.

The competition in many submarkets now is with single family homes that are rentals,” said TeKampe. “If there’s an upward trend of pricing of single family homes … [it’s] more likely the owner can command higher rents.”

The pipeline ahead During the downturn, many of the planned multifamily developments were shelved and few new units came on to the market. In 2014, Phoenix’s market will see more than 4,500 new apartment units delivered to the market. The development pipeline for next year appears to be even stronger, yet more steady.

So far the outlook on these new developments seems to be bright with many of the newly opened communities in Phoenix reporting early leasing and rents above original expectations.

Interpreting the metrics that his team monitors, TeKampe believes that there could be a systemic slowdown or leveling out of the rate of effective rent growth in the Phoenix market in the near term.

“This of course does not apply to every asset or submarket in the metro area but there are certain submarkets which have risk exposure,” he added.

The national Axiometrics Inc., a real estate market data company, recently reported on the Phoenix market. Their report summarized, “Developers might see justification in building more in Phoenix, especially as both effective rent and occupancy continue growing. The current annual effective rent growth of 4.4% outpaced that reported in April 2013 (3.2%) and is well above the national average of 3.4%.

Occupancy did take a slight dip from March 2014, which is to be expected with more supply being delivered.”

Anyone going through what is called a “qualifying life event:” i.e., marriage; divorce; moving to a new state; the birth of a child; loss of coverage through an employer; changing jobs or leaving a parent’s healthcare coverage can open that window of eligibility for the Affordable Care Act.

Reaching the right people

“Life Happens” reaches people who often are overlooked in the dialogue about health insurance – and they are often the people who need this information most.

An insured resident is more financially stable in the event of a major health issue, and is more likely to remain a paying resident than an uninsured resident who is caught without health insurance.

And Federal Tax reporting next year will require proof of insurance, or there are penalties.

There are benefits to the property as well, both direct and indirect. The AMA is offering marketing fees to all participating properties in return for marketing assistance.

This is another great way to offset the cost of AMA membership. If your property or management company is not participating at this time, all you have to do is call the AMA and ask how to participate.

he Arizona Multihousing Charitable Foundation, Tucson’s Big Hearts committee, chaired

by Lisa Rosenfeld, HSL Properties, and Sue Campbell, Redi Carpet-Tucson, have been busy this summer!

Thanks to Mister CarWash’s fundraising campaign for AMCF. Our members’ purchases helped to raise more than $1,000!

The grand finale summer fund raiser is scheduled for August 19th at the Gaslight Theatre in Tucson which will be showing GHOSTBLASTERS! Tickets are on sale now through the AMA Tucson office. This is the major fund raiser of the year for the committee and is anticipated to provide a net of several thousand dollars. Plan to attend and purchase your tickets right away!

AMCF Tucson is kicking off the management company and property level fund raising campaign with a goal of raising $35,000! The goal of AMCF is to broaden its support to additional local programs and charities. Since 2006, more than $185,000 has been contributed to Our Family-New Beginnings program thanks to all Tucson committee members.

athered in the clubhouse of MEB Management Services’ Arcadia Cove, the Associate Member Council guests were treated to an unforgettable evening. The MEB hosts included their senior leadership team including Jodi Sheahan, Mark Schilling, Gaylan Hanson, Charlene Wooters, Susan Kauffman, Dalia Bureker and Arcadia’s property manager Pam Stulkin.

MEB took over the management of this 18 year old property just a year ago and started a major transformation of the community.

Throughout the renovations, the community has maintained an impressive 95% occupancy.

The evening began with the presentation of the flags by a color guard and Cub Scouts troop #263 adding a personal touch to the event.

Phoenix’s most popular food trucks, created an incredible array of fun food for the guests.

Community investment stands at the core of MEB’s team. In support of the 100 Club, MEB is selling tickets to an Arizona Diamondbacks game to support of the families of police officers. For every ticket sold, MEB will donate $4 to the 100 Club.

Mark Schilling spoke to the AMC group about MEB’s vision and core values. Their commitment to enriching the lives of their clients, residents and team members by creating value was evidenced in their hospitality.

The winner of the AMC lunch raffle with MEB’s Mark Schilling and Gaylan Hanson was Dustin Kerby of Smart Pest Solutions. All five of the golf holes that were in the AMA lottery were secured by AMC members and the golf tournament hole sponsorships are sold out.
