The Valley is filled with midprice new and resale houses — those $250,000$400,000 — that have kitchen islands, stainless-steel appliances and wood flooring. How much the houses are upgraded often depends on location and price.

eople thinking about renting out their houses in late January to Super Bowl XLIX fans have a lot more to do than making an extra key.

In most cities that host Super Bowls, home rentals and rates shoot up during the week of the event. Thousands of Phoenix-area houses are listed for rent at prices of $500 or more a night.

For example, visitors can rent the former Paradise Valley home of retired Arizona Cardinals quarterback Kurt Warner for $16,000 a week; a twobedroom condominium in Scottsdale’s Optima Camelview for $2,000 a night; a five-bedroom Phoenix house near North Mountain for $1,500 a night; or a three-bedroom house in Glendale for $1,200 a night.

Arizona’s top real-estate regulator and attorneys caution homeowners to do their homework and protect themselves before turning over their house to a renter. “We have had problems in the past with rentals when a big international event comes to the state,� said Judy Lowe, Arizona Real Estate commissioner. “Homeowners with short-term rentals need to do everything from checking out the backgrounds of potential tenants to figuring out how they will get a deposit and be paid.�

Homeowners can legally lease out their own house. If you do so, here’s a checklist: Âť Review your house’s insurance policy. Does it cover renters? “A renter could leave the stove on and burn down your house,â€? said Gary Smith, a partner at Scottsdale-based law firm Smith Paknejad PLC. “If you aren’t covered to have renters, then it’s likely that damage won’t be covered by the typical homeowner insurance policy.â€? Âť If hiring a real-estate agent, check out licenses and complaints at azre.gov. Âť If working with a website listing properties for rent, check to see if it has a real-estate license. Âť Consider a background check.

Question: Eight years ago we bought a home in a new subdivision of Queen Creek. Since that time we have been using a dirt driveway from the main road to our garage.

In order to get a building permit for a swimming pool in our backyard, we recently got a survey of our property. The survey showed that our dirt driveway is located on our neighbor’s property.

Our neighbor is very nice and said that he is willing to give us a deed for this driveway. Do we now need to get a survey of just this dirt driveway?

Also, our neighbor inherited his home from his parents, whose names are still on the deed. What do we do? Help!

Answer: One, you will need a survey to get the legal description of the dirt driveway on your neighbor’s property. This legal description of the driveway should be attached as an exhibit to the deed to you from your neighbor.

Two, you will need a title report from a title-insurance company to confirm that this title-insurance company will insure your ownership of the driveway when you sell your home.

The title company may have requirements. For example, a title-insurance company may require a probate of the estate of your neighbor’s parents and may also require the consent to the deed from the mortgage lender that financed the purchase of your neighbor’s home.

When looking at midprice houses, keep in mind that it’s a hot market for homebuyers and that the houses with the most appointments are likely to go quickly, Jones said.

Here’s a look at some of the typical features found in midprice houses: Appliances Stainless-steel appliances are popular in this price range. Look for goodsize refrigerators.

Countertops and kitchen upgrades Many homes will be upgraded with slab granite counters, kitchen islands and walk-in pantries.

Clearing the air about smoking in apartment communities Heading to the balcony to smoke a cigarette may not be enough anymore. More and more we are seeing apartment-management companies and individual owners banning or restricting smoking.

The reasons for these bans start with a respect for neighbors and the health and welfare of all residents.

The rationale for banning/limiting smoking can be financial as well. The smell of smoke can linger long after the

butt is out. It clings to carpets and upholstery and can even permeate wallpaper and blinds. Cleaning these units for a new tenant can be expensive and timeconsuming. Many operators also reported additional housekeeping in common areas where smokers would leave ashes and cigarette butts. And we have all seen how smoking can be a fire hazard.

Owners and managers today can enforce smoking rules and impose fines.

As always, itâ&#x20AC;&#x2122;s important to check your lease. Management must also enforce

Smoke Free Arizona rules (www.smoke freearizona.org/residential-area.asp). Âť Individual units: In apartment communities, each individual housing unit is considered a private residence, and so smoking may be allowed within the home unless expressly stated in the lease. If your apartment home or condo is privately owned, your owner/manager may have rules about smoking. Âť Common areas: According to Smoke-Free Arizona, smoking is prohibited inside and within 20 feet of en-

trances of buildings and inside enclosed common areas. Âť Outdoor common areas: Smoking may be permitted in outdoor common areas such as the courtyards, walkways and play areas. Be aware if there are restrictions around the pool areas. Âť Neighborly courtesy: Non-smokers need to be respectful of their neighbors who smoke in permitted areas.

Question: I gave management a 30-day notice and moved out on the last day of the month. I was somewhat hurried in my moveout and did not have time to clean everything. Now, the landlord wants to charge me for nine days of rent for the next month, claiming it took nine days to complete all of the cleaning and repairs to the property. Do I have to pay for the nine extra days?

Answer: If it really took nine days to repair and/or cleaning property as a result of you leaving it in bad condition, then yes the landlord can charge you for the nine days. In fact, if the landlord lost a renter as a result of the landlord not being able to deliver the property in good and clean condition on the first day of the new month, you could be charged for the actual damages resulting from your failure to leave the premises in good and clean condition. Always move out on time and leave the premises clean. Take pictures or video of the condition when you move out.
