Surrogacy and its legal aspects
There are two types of surrogacy traditional surrogacy and gestational surrogacy. Traditional surrogacy gets completed through IUI treatment where the surrogate mother donates her eggs for fertilization. And apart from this gestational surrogacy gets completed through IVF treatment where the couple provides the embryo to the surrogate mother and the pregnancy procedure starts.
The surrogate mother is the biological mother in traditional surrogacy but in gestational surrogacy, the couple will be a biological parent of a baby as the embryo is getting ready through the couple's egg and sperm.

Process of both surrogacies are different as the process of traditional surrogacy is simple where the sperm will be transferred into the surrogate mother’s uterus and in gestational surrogacy, the sperm and eggs will be fertilized in the laboratory and then will be transferred into the uterus of surrogate mother at the stage of the blastocyst. There are two legal aspects following commercial surrogacy and altruistic surrogacy, commercial surrogacy is banned in india as the surrogate mother can not charge money in exchange for giving surrogacy services.
Altruistic surrogacy is legal in india where the couple will carry all the expenses that will happen meanwhile the treatment. the couple must be married and have completed 5 years of marriage.
