Did you know that up until around thirty years ago real estate agents did not represent buyers, they only represented sellers, and buyers were all just customers, not clients? I am so thankful that things have changed. As a buyer, today, you can choose to be represented by a real estate licensee and be a client. As a Buyer Client your agent owes you fiduciary responsibilities. This means they negotiate on your behalf, keep everything you discuss confidential, must be lawfully obedient to you, amongst other things. Since January 1, 1992 all real estate licensees in New York state have been required, by law to provide written disclosure to any potential buyer, seller, landlord, or tenant at first substantive contact (before any confidential information should be shared). This disclosure is known as the New York State Disclosure Form, or Agency Disclosure Form. This disclosure form was created to protect you, the consumer.
My tip to you this month, make sure that anytime you engage a real estate licensee that they make it very clear to you who they work for.
