LETTERS New tunnel plans drive me mad
We should be driving over a new bridge the Liberals started to replace the Massey Tunnel next year. Instead, government fumbling means we have another eight years with ridiculous traffic delays until a replacement (which offers no improvement) is built. With three lanes in rush hour at the Massey Tunnel now, in eight years the new tunnel will still have three lanes. With one million new people expected south of the Fraser, in what universe do you think that works?

Dear Editor,
Dear Editor,
A3
It takes someone prepared to study before acting, to seek the facts before writing, to realize the impact before hitting “send.” She jumps to the role of executioner, finding hypocrisy in Mr. Chiu’s positive post about Pride week, because he voted against the recent bill to ban conversion therapy. Mr. Chiu — gasp — used to work in a Christian organization. Terrifying! We all know THOSE people aren’t tolerant, right? Ms. Reid organized a team to write colourful slogans on signs, placed them on Mr. Chiu’s office premises, and highlighted that “they were immediately taken down the next day.” So dramatic.
I was curious, so I Googled his MP website. There it was, clear as day, titled “My Positions” and this on LGBT+ Canadians, where he clearly stated that he was “firmly against” conversion therapy and was in support of banning it on the first vote but couldn’t on the final vote due to the “Liberals refusal to provide adequate safeguards...” And the kicker, at the end: “A Conservative government, with the support of (MP Chiu), will ban all forms of...conversion therapy.” Acting as an adult, our MP recognized that challenging badly written laws is his job. Having no law, and taking time to get it right, is always better than rushing through a piece with gaping holes in it. In the world of the woke warrior and Ms. Reid, inclusiveness isn’t for all — people of certain faith or mature thought needn’t apply.

Dear Editor,
It’s true that people’s behaviour has not changed during COVID. Something about our flawed human nature makes us immune to change, it seems. There are many who strut around with a sense of entitlement and behave in a manner unbecoming of Canadians. However, we should recognize that there are kind, courteous and thoughtful people making positive contributions to society.

Mixed reactions to new tunnel plan
Reactions to last week’s announcement to replace the Massey Tunnel with another tunnel was met with relief from the business community and concerns from environmentalists.
Richmond Chamber of Commerce CEO Dan Baxter said, while the chamber would have preferred a bridge as it would have been completed faster, an eight-lane tunnel was, nevertheless, a “step in the right direc-
tion.”
“Obviously the people in Richmond and people in the region need to have expanded capacity on that route because it is such a bottleneck for business and people,” Baxter added. The province was weighing two options — an eight-lane bridge or an eight-lane immersed tube tunnel, landing on the latter. The bridge would have been
completed by 2028, while the tunnel, with a longer environmental assessment period, is expected to be built by 2030.
more forward, future looking in terms of... capacity to grow,” Baxter said.
A previous BC Liberal plan for a larger bridge, scrapped by the NDP in 2017, would have been the ideal option, Baxter added.
Baxter is concerned the new tunnel might not meet the needs of a growing region and that we might be “in this boat again sooner rather than later.”
“The 10-lane bridge would have been the ultimate preferred choice just because that version of the bridge would have been
The current plan includes more than doubling the Steveston overpass, often congested during rush hour.

Steveston targeted by brazen thieves Steveston business owners are on alert after a rash of brazen thefts at their stores. Among those hit were Bon Retour on Moncton Street and Anar on Third Avenue. At Bon Retour, a man and a woman used

Trudeau rolls Greens name Richmond federal runners into town The Green Party now has candidates for both Richmond ridings.
Francoise Raunet, who ran in Richmond Centre in the last federal election, runs in Steveston Richmond-East.
Justin Trudeau meets a young resident.
Liberal leader Justin Trudeau breezed into Steveston Wednesday afternoon to meet local candidates, their supporters and some residents. During his brief visit, Trudeau wasn’t taking any questions from reporters. However, employees from Prawns on the Spot at Fisherman’s Wharf could be heard telling Trudeau
to look after the small fishers, not the fish farms. “Get the Atlantic salmon out of the water, Justin, out of B.C. waters… Chinook need your support, multinational companies do not,” said Lynette Kershaw with Prawns on the Spot, a local fishing company. —Maria Rantanen *More photos at Richmond-News.com
Raunet, of South Vancouver, joins Laura Gillanders in Richmond Centre as the Greens’ federal candidates. The election will take place on Sept. 20, just 22 months after the Liberals formed a minority government. Raunet is up against incumbent Tory MP Kenny Chiu, the NDP’s Jack Trovato and the Liberal’s Parm Bains. Gillanders, who has been involved
with the group Richmond FarmWatch, will be running against Alice Wong, five-term Conservative MP. Other candidates in Richmond Centre are the Liberal’s Wilson Miao and the NDP’s Sandra Nixon, who’s also Richmond School Board chair.
Raunet said it seems like nothing has gotten better since she first started in politics in 2011. “We need to radically shift our economy,” Raunet said. “Our economy is based on the over-consumption of natural resources — the unsustainability is baked into the whole of GDP.” The way economic success is mea-
sured “only works for the top echelons of society today and everyone else is struggling even to keep a roof over their heads,” she added. Gillanders said she’s running because she wants to keep Canadians focused on the climate crisis.
“The climate and health of the planet is the number one issue we all face today,” Gillanders said in an email to the Richmond News. “We see it clearly in B.C. with the catastrophic forest fires...” —Maria Rantanen/Richmond News Search Raunet for full story at Richmond-News.com
Tory candidate avoids abortion question
Richmond’s two Conservative candidates had very different answers on the question of abortion rights — which their party leader Erin O’Toole reiterated this week he stands behind. Incumbent MP Kenny Chiu said he supports a
woman’s right to choose abortion, and emphasized, if his party was elected, they wouldn’t re-open the debate.
Five-term MP Alice Wong, however, wouldn’t answer whether or not she was pro-choice, saying only that
her voting record speaks for itself. “…unlike the other parties, our Conservative Party allows MPs… the freedom to vote with their conscience on these issues.” Wong voted against a ban on conversion therapy – her reasoning being the defini-
tion and details weren’t satisfactory – and she voted earlier this year to ban sexselective abortions. —Maria Rantanen Search Chiu for full story at RichmondNews.com

Mandatory masks at schools, bars as COVID cases rise
B.C. students, from Grade 4 to post secondary, will return to in-class learning next month, where masks will be mandatory. Education Minister Jennifer Whiteside said Tuesday there will be a requirement for all staff and students in Grade 4 and up to wear masks within the school setting, including in classrooms and while taking school transportation. Masks will be strongly recommended for students in Kindergarten to Grade 3. Provincial Health Officer Dr. Bonnie Henry said while many younger children under the age of 12 have become used to wearing masks, she indicated the best way to protect those who are not able to get immunized is for adults around those children to get vaccinated themselves. The province is also not mandating school staff get vaccinated, although Henry said employees are being encouraged. She said there has been an uptick in vaccinations among those working within the school system, adding school transmission rates do tend to mirror those transmission rates within the community.
It was also announced Tuesday that proof of vaccination will be required for some activities on post-secondary campuses. Masks needed for stores, bars Henry also announced Tuesday that B.C. is once again implementing a mask requirement province-wide. The provincial health order went into effect Wednesday, Aug. 25 and mandates anyone in B.C. 12 and older must wear a face mask in indoor public settings. “This measure is needed to ensure these indoor settings are as safe as they can be for all of us,” said Henry, noting the impending arrival of fall and the likelihood of people in B.C. needing to spend more time inside. The indoor public settings include places like retail and grocery stores, libraries and recreation centres, on public transit and in taxis or rideshare vehicles, and at restaurants, pubs, and bars when not seated. Henry said the order is temporary and will be re-evaluated once the province’s new “vaccine passport” program is fully operational this fall.
Vaccination passports welcomed B.C.’s plan to roll out vaccination passports in September has received praise from the Richmond restaurant industry. However, William Tse, director of the Richmond-based BC Asian Restaurant Café Owners Association, said more work still needs to be done at both the provincial and industry levels to help customers understand how to get proof of vaccination. “Most employees I spoke to from the restaurant industry are positive (about) this new implementation, which is considered as a symbol of safety assurance for them,” said Tse. “However, we also don’t want to see clients get refused entry to the restaurants that they have been looking forward to for quite a long time because they just show up without any vaccination proof.”
Bonnie Henry said the proof of vaccination will most likely be provided “through phone or by showing a paper copy” along with personal identification. Richmond COVID numbers rising Richmond COVID-19 numbers have been on an upward curve for the past few weeks. BC Centre for Disease Control (BCCDC) data shows 57 new cases in the past week (Aug. 8 to 14) in Richmond, up from 47 the previous week. Just two weeks ago, BCCDC data showed 21 new cases in Richmond. This mirrors growing numbers across the province. On Tuesday, the provincial government reported there were 641 new cases of COVID-19 in B.C. in the past 24 hours. This past weekend, there were 1,711 new cases over three days.
Tse added that, given the fact Richmond has a diverse community, it might take more from the provincial government to successfully deliver the message to people from different cultural backgrounds.
There were 138 people in hospital with COVID-19 as of Tuesday with 78 in intensive care.
Meanwhile, Provincial Health Officer Dr.

I think Dr. Bonnie Henry would approve of this Judgment. Introduction In March of last year, when practically everything around us came to a halt, Lawyers and Judges (and the rest of the legal system here) were not exempt. Trials had to be halted. Preliminary applications (done in Chambers) were halted as well. Meetings with people also had to be stopped, unless by telephone. Many Lawyers worked remotely because offices were shut. It took some time before meetings took place via zoom. As a result, I suppose it was inevitable that a case involving an unsigned Will would come before the Court. Earlier this month, reasons were released in a case called Bishop Estate v. Sheardown. In this case, a Will was prepared and completed, ready for signing. But because of the shutdown, it could not be signed. What makes this case interesting is not only its unique set of Pandemic facts but how the Court applied our more modern law to those facts. Facts The deceased died in July, 2020. Her husband predeceased and they had no children. In 2014, the deceased and her husband made Wills, naming each other as beneficiary and, when both were passed, the Kelowna General Hospital Foundation was sole beneficiary of the Estate. The husband died in 2016. After, their nephew and his family moved close to where the deceased lived. They looked after the deceased as her health deteriorated. In early 2020, the deceased sought to make a new Will. She went in early March to the office of the same Lawyer who made the 2014 Wills of the deceased and her late husband. She instructed the Lawyer to make a new Will. The terms were changed, to exclude the Hospital Foundation, in favor of the Nephew. The deceased told her Lawyer that she did not have the same attachment to the Foundation as did her late husband. The words she used were “no charities at this time”. An appointment was set for March 20th, 2020 to meet and sign the Will. But then, of course, the Pandemic broke and, as the deceased was by then in a care facility (due to declining health), she was unable to leave the facility except for medical appointments. The Will was never signed before the deceased died. Legal considerations Section 58 of the Wills Estates and Succession Act governed this situation. Under this section, the Court is authorized to declare a Will effective in a situation where it does not comply with all the formalities of signing normally required in a Will. The Hospital Foundation argued, in part, that the Will was substantially invalid and the section does not allow a Court to declare that kind of document effective or valid. The Court disagreed and said that section 58 does not specify a minimal level of execution or other formal requirement for a testamentary document to be found fully effective. What the Court had to ascertain is whether the document expressed the deceased’s fixed and final intentions. Court’s decision The Court held that it could conclude the deceased’s intentions from the document. The document was, doubtless, a Will. It was in writing. It was prepared by a Lawyer on instruction. It was reviewed by the deceased and minor corrections were made. There was also no doubt about the deceased’s capacity when meeting with the Lawyer. There was no undue influence. Only the Pandemic prevented the signing. The Will was held to be valid. The Nephew inherited the Estate. Conclusion The Pandemic has changed all our lives. We don’t know yet what our “new normal” (if I can put it that way) will look like. But it is not far fetched to expect that many things we used to do will be done differently in the coming months and years. Today, a Will can be signed using zoom. The people do not have to be physically in the same room at the same time. This case was, in my opinion, under our present law, rightly decided. I am confident Dr. Henry would, if asked, felt that it was appropriate for the deceased not to have left her care facility at the time, in 2020. One of the lessons to learn from this case is that Executors should, in looking through a deceased person’s records and documents (and computers, if applicable), keep everything. Anyy document can be testamentary in nature and so should be held. If there is doubt about any record or document, or computer record, ask a Lawyer but do not delete or discard!

A Burkeville property owner whose 1940s duplex burned down three years ago can’t rebuild the same building even though he was fully insured. George Francis owned a duplex on Wellington Crescent, built by Boeing in the 1940s, that straddled two lots. But the two lots are zoned for single-family homes, and rezoning them to allow a duplex requires significant utility upgrades that could cost $100,000. Francis could build a house on each lot without rezoning, but he doesn’t want a larger footprint on the property, he just wants to rebuild what was there. There is extensive shrubbery and trees around the property that he also wants to keep. “Two houses take a lot

more room than a duplex and also sacrifices more than a thousand square feet of greenspace, destroys all my ornamental hedge and all my vegetation that I’ve spent 50 years doing — gone out the window,” he said. About a half a dozen such duplexes were built in Burkeville in the 1940s, straddling two properties, and by today’s standards are considered “non-conforming.” Cary Combs, owner of Cartessa Construction, who’s been working with Francis on this project, has torn down two of these duplexes in Burkeville and built two single-family homes on them.
Entering a rezoning process is more complex than just building what a property is already zoned for, Combs said, and that adds cost to the project. In the end, the property with two single fam-
ily homes with secondary suites would have the same number of households as a duplex with two suites on both sides, which is what Francis wants to build. Francis said the amount of work he’s being asked to do, including sewer and water upgrades, to rebuild what was already there, is equivalent to what large developers have to do when they build hundreds of units of housing. “I’m not in that league — I’m not even in the minor leagues,” Francis said. If a house partially burns down, it can be rebuilt, even if the zoning has changed, explained city spokesperson Clay Adams. But if a building is completely destroyed, like Francis’ duplex is, the new building has to conform to today’s zoning, he added. Search Burkeville property for full story at Richmond-News.com

Canadians struggled in the pandemic, but the ultra-rich pocketed $78 billion in excess profits.
Jagmeet Singh and I are fighting for you – and it gets results. In the pandemic, Justin Trudeau had to be forced by the NDP to provide real supports for people: Double the emergency benefit for workers and the self-employed
Erin O’Toole’s plan also protects the rich. He’s no friend of working families.
Make sure university and college students received emergency benefits
Save people’s jobs and small businesses with a higher pandemic wage subsidy

OBITUARIES
KAY, Norma On August 20, our family lost a true force of nature when Norma, beloved wife of almost 58 years to David, and mum to Tracey (Jonathan), passed away in Richmond BC, at the age of 78 after a short illness. Also survived by her brother, David, and sister-in-law, Val. Norma loved her gardens - transforming every home into an oasis of plants and flowers - almost as much as she loved to talk, to family, friends, and even complete strangers. We will all miss her immensely. No service by request. Donations in Norma’s memory, may be made to the BC Cancer Society. Richmond Funeral Home • (604) 273-3748

APPLEGARTH, Derek A. July 5, 1937 − July 28, 2021 Ph.D, FCCMG, UBC Professor Emeritus Derek never forgot his Geordie roots and was grateful for the educational opportunities in post− war Britain which made possible his journey from Boldon Colliery Primary School to the UBC Emeritus College, with degrees from the Universities of Durham and Newcastle. He emigrated to Canada in 1961 with his first wife Doreen, holding a post−doctoral fellowship in the UBC Chemistry Department, then as Clinical Chemist at the Health Centre for Children, Vancouver General Hospital. In 1969, he founded the Biochemical Diseases (later Biochemical Genetics) Laboratory at Children’s Hospital. In this emerging discipline, he collaborated with scientific and clinical colleagues across Canada and around the world to diagnose and investigate children with rare metabolic diseases, teaching and publishing extensively and receiving many awards. He was a member of the Faculty of Medicine with appointments in Pediatrics, Medical Genetics and Pathology, serving on Boards and Committees, including parent support societies. He was a past President of the Garrod Association of Canada and past President of the Canadian College of Medical Genetics, and he was involved in developing training programs for Biochemical Genetic Fellows. As a CUSO volunteer, he was a consultant at the New Mulago Hospital in Kampala, Uganda. Derek brought energy, enthusiasm and curiosity to all that he did. He was a teacher, mentor, hiker, cyclist, avid concert−goer and proud Dad and Grandad. He was passionate about photography from childhood, generous in sharing his knowledge and eager to continue learning. He was a past President of the Richmond Photo Club, founder of the Emeritus College Photo Club and member of the Pender Island Photo Club. Another passion for early history and archaeology led to travel to ancient sites around the world. Retirement on Pender Island brought new friendships, photography shows and the spirited discussions at Socrates. He was a life−long learner and community volunteer, most recently involved with Third Age Learning at Kwantlen University. Derek died, as he wished, at home with family, after a short illness. He is survived by his wife Jenny Toone, his daughter Rebecca, sons Oliver and Neil, their wives Christine and AnneLaure, grandchildren Katie, Justin and Owen and by his ex−wife Doreen McEwan. Messages of condolence can be left at his memorial page at www.amherstcremation.com. Please donate to a charity of your choice in his memory. A Celebration of Life will be held at a future date.

Sudoku puzzles are formatted as a 9x9 grid, broken into nine 3x3 boxes. To solve a Sudoku, the numbers 1 through 9 must fill each row, column and box. Each number can appear only once in each row, column and box. You can figure out the order in which the numbers will appear by using the numeric clues already provided in the boxes.

Value and variety are on the menu every day at L.A. Grill
A
re you trying to decide on lunch or dinner plans?
Simply pick a day of the week, and L.A. Grill and Bistro at Blundell Centre has a daily special that will suit your tastes and budget.
“Variety and value are certainly on the menu, and it’s keeping our customers coming back,” says L.A. Grill’s Steve Chan, who adds that the chicken souvlaki is one of the most popular dishes drawing customers.
“The chicken is tender, flavourful and comes with rice pilaf, potato, pita bread and tzatziki sauce,” he says. For the lunchtime special, all of that is only $7 when you purchase a beverage. In fact, all of L.A. Grill’s lunchtime specials are $7. “We are able to keep our prices competitive for top quality dishes because of the volume of business we do,” Chan says.
If you are looking for dinner (Monday to Saturday from 4 p.m. - 10 p.m.) or a late-night meal (dine-in only Monday to Saturday from 8:30 p.m. -10:30 p.m.), the list of options keeps on coming at L.A. Grill and Bistro. On Mondays, a six-ounce New York steak with rice, green salad and garlic toast is just $10 - again, with the purchase of a beverage. For $14, you can also enjoy souvlaki and garlic prawns. On Tuesdays, garlic prawns ($10) and salmon and prawns ($14) are on the list. Wednesdays feature chicken souvlaki ($10) and salmon and prawns ($14). On Thursdays there’s grilled salmon ($10), and souvlaki and prawns ($14). And from Monday to Saturday, you can indulge with steak and prawns ($16). If you are looking for a meal later in the evening, L.A. Grill and Bistro has a selection of smaller, lighter options; all served Monday to Saturday. For just $4, there’s tzatziki and pita, or salsa and chips. Delicious melted mozzarella and cheddar is on the cheese garlic bread for $5. Just $6 gets you freshly breaded zucchini sticks.

Get educated on how to be a healthier new you
H
ow’s your overall health? It’s a question many people are focusing on more than ever these days as we enter a period following widespread health advisories and restrictions due to the COVID-19 pandemic.
“We educate our customers on the difference between a whole foods multivitamin versus a conventional one,” Crescenzo says. “Then there’s the difference in multivitamins for men and women, for what age you are, and what type of lifestyle you lead.
And the staff at 12 Baskets Nutrition and Health Co. in Blundell Centre are, as always, ready to help customers find what can help them boost their wellbeing to guard against future problems.
“We can also go into depth in all categories, whether if it’s problems with your bones, joints, or immune system.”
“We are starting to see a lot of people looking for products to look after their overall health, as opposed to taking something because they are symptomatic,” says Christina Crescenzo, purchasing manager for 12 Baskets.
For example, a customer experiencing a skin rash may not require a natural remedy specifically for that condition - their problem could be linked to a gut issue that can be treated with a change to their diet.
“They can consult with us about where they are at in their life and what their diet is like,” she adds. “From that, we can make suggestions on what they can add or eliminate and what products can help them live a healthier life.” A big part of what 12 Baskets offers over the often dizzying array of products found at big box stores is education.
Also on the lunch special list Monday to Friday from 11 a.m. to 4 p.m. are the chicken strips, chicken wrap, cheeseburger, a daily soup with and BLT sandwich or Caesar salad, fettuccine Alfredo, curry penne, and spicy tomato linguine.
And for $6.50, you can be enjoying chicken strips with house-made honey mustard sauce or calamari with tzatziki sauce.
“We have ongoing training for staff on products and health issues to help you make the best choice,” Crescenzo says.
“For about what you’d pay for a traditional fast-food meal, you get a proper, sit-down, fully licensed restaurant experience,” Chan says.
The choice of specials goes on. For a complete list, visit L.A. Grill’s website at www.lag grillandbistro.com.
One example is how to select a multivitamin that bests suits your condition.

All said, 12 Baskets can help you make an informed decision.
“Choosing what is right for you can be overwhelming,” Crescenzo says. “There’s so much information out there; it can be challenging to filter it. “Our staff can provide suggestions from our high-quality range of products - some of which are usually only available through naturopathic doctors - that are competitively priced. “And we cover everything from nutrition to blue light-blocking glasses,” she says. “So, just about whatever you need, we can be there to help.” For more information about how 12 Baskets Nutrition and Health Co. can play a role in improving your health, visit their website at 12baskets.com.
