Family’s tragedy will repeat without change Alan Campbell ACAMPBELL@RICHMOND-NEWS.COM
They knew that no severity of sentence would bring her back or even dull the pain of their loss. Family and friends of Christy Mahy had fought in her memory for seven years, waiting patiently for the day the reckless driver, who caused her death at a Richmond intersection in 2014, faced justice. On Monday, they finally got their chance, when Erjon Kashari — an Albanian refugee claimant who entered Canada in 2010 with a serious criminal record — was sentenced in a Richmond court to just over two years for criminal negligence causing Christy’s death. (See full story on page 8.) Numb from several days of listening to how tough Kashari’s life had been and licking the salt from their collective emotional wounds, Christy’s family and friends left the courtroom and headed straight to the spot near Russ Baker Way and the Dinsmore Bridge where she died on the sidewalk, waiting for the lights to change.

While sitting on Christy’s memorial bench near the accident site, they questioned how the man that robbed them of their beloved daughter, sister and close friend could only get sentenced to time already served in prison, allowing him to jump back on a Canada-paid flight to his native Albania.
Why was he allowed to revoke his refugee claim, apparently without cause, a month after causing Christy’s death, triggering a deportation order to Albania?
An hour or so later, while talking to the Richmond News from the nearby pub where Christy used to work, her sister Joni — fighting back her anger and tears — highlighted a catalogue of bigger question marks that continue to haunt the handling of the entire case.
Did the CBSA make more than one call to the RCMP to ask if there was any reason Kashari should not be deported?
A simple tracing of Kashari’s footsteps, from when he entered Canada in 2010 to his extradition from Albania in 2020, appears to reveal a series of errors or shortcomings in a system that has clearly let Christy and her family down. Why was Kashari allowed to enter Canada and apply for refugee status when he had been deported a year earlier from the U.K., on the back of seven years building up a criminal record for assaults, burglary, theft, holding his wife hostage and beating her up?
Why did the RCMP not prevent the CBSA from deporting Kashari while the investigation into Christy’s death was ongoing?
Why did it take the RCMP more than two years to complete the investigation and file its report and recommendation with the BC Prosecution Service (BCPS)? (BCPS told the News this week it didn’t receive the file from the RCMP until August 2016.) Why have 16 court dates in nine months for Kashari from the day he was extradited back to Canada in 2020, with family and friends taking time off work to attend? Do any of the above spell justice for Christy and her family? The News has followed this tragedy from the outset, reporting each and every year how Christy’s father, Ron, organized a motorbike parade on the anniversary of his
daughter’s death.
Every year, myself and several colleagues have picked up the phone to Ron and listened intently to his anguish and raw emotion as he relived the agony once more. Until Kashari was charged in his absence in 2018, Ron fought hard, in vain, to get answers from authorities to many of the questions, as did the News. Two days after the case finally closed, we are still waiting to hear the answers. One has to also ponder whether this day would have even come to pass if Ron had, understandably, wanted to get on with his life and accept the tragedy as an accident. In the end, it all comes down to what we, as a society, deem acceptable. Is it acceptable that those questions still hang over this sad, seven-year episode? At some point there has to be accountability and, indeed, change, likely via pressure from our elected MLAs or MPs. Otherwise, there’s a good chance another family is going to experience the deep-seated pain of what the Mahys have endured for the last seven years.

LETTERS Fines could pay off Dear Editor, For years I have requested the City of Richmond address speeding on Steveston Highway, to absolutely no avail. It is officially 50 km/hr, yet well over 80 per cent of all drivers go 80 to 90 km/hr. I have repeatedly requested our RCMP position one or two cruisers to slow it down — no can do. If a ticket is $80 per infraction, that would make it $128,000/ day, or $47 million/year (give or take). Let’s say two officers make $200,000 combined. Thus, outlay would be $200,000 with a return of $46-47 million. Seems to be a very good return on investment.

By-election not needed Dear Editor,
We can save over $700,000 with no by-election, especially in this COVID-19 climate when I expect the turnout would be abysmal. Let’s operate with the councillors we have now. If we need another, then why not choose the one who came in closest in the 2018 election. If necessary, press provincial government to allow the city to operate with the present number of councillors until the October 2022 election. I understand juries have standbys, why not the same for councillors?

Don’t fight the river Dear Editor, Now, as dike-rebuilding season is nearly upon us, I am writing to draw attention to our historically unwholesome relationship to the Fraser River. Past practices have been enacted with the attitude that we must fight the river, training and coaxing its flows for the benefit of industry and shipping, at the expense of natural life forms and more cooperative approaches. As rising seas threaten civilization, we have not changed our tactics. The combative approach to the unbeatable forces of nature will always lose, eventually. The Sturgeon Banks (west) dike is unlikely to fail because beyond it is a big sponge, absorbing excess water. Luckily, that area did not become a deep sea port, as proposed in the middle of the last century by old school politicians, engineers and industrialists. Our situation, now that the old ditches have mostly been filled in, is there are fewer places for excess water to go. In addition to all

our new pump station upgrades, would it not be less expensive (and less invasive) to create new and expand old waterways for the river to flow during king tides? The sloughs off the south arm are quite stagnant and dry, with water only flowing in when the pump stations allow. How about an attractive canal leading from the river up through (very wide) Railway Street, and an expansion of the Woodward Slough, which had a cosmetic (but mostly dry) expansion two years ago, extend it through the golf course (Richmond Country Club.) Horseshoe Slough is also an underutilized overflow asset. If we cannot beat the river and the rising ocean, why not make Richmond a city of canals. The pump stations are already in place to facilitate that. The river is not our enemy. It is our (sometimes) unruly friend.

Double homicide victims Torched trucks City suspends business license brothers known to police suspicious
A badminton facility has been temporarily shut down by the City of Richmond for defying COVID-19 public heath orders.
City council has also instructed staff to immediately suspend businesses found to be in non-compliance with health orders.
Ace Badminton — at 9151 Van Horne Way near the Bridgeport Canada Line Station — was found to be allowing too many people on each court and throughout the facility, said Clay Adams, city spokesperson. The business was also not enforcing mandatory mask rules.
“The city has been clear that businesses that ignore public health and safety orders aimed at preventing the spread of COVID-19 will not be tolerated,” said Adams. “Continued non-compliance by Ace Badminton will result in a further suspension plus ticketing and even prosecution in provincial court.”
The city has suspended the facility’s business license for two weeks, as of March 19. The suspension follows a closure order by Vancouver Coastal Health for a similar health order violation, Adams said.
In addition to the license suspension, city staff will be working with regulators from WorkSafe BC and VCH to ensure the business complies with health orders. —Kirsten Clarke/News

Garden plots planned in City Centre Kirsten Clarke KCLARKE@RICHMOND-NEWS.COM
The City of Richmond is hoping to offer 200 plots to gardeners on the Garden City Lands this summer. The garden plots would take pressure off waitlists for other community gardens around the city and allow residents who don’t have their own space to grow food. Currently, there are 575 people on these waitlists. If approved by the Agricultural Land Commission (ALC), the garden would be built on an existing gravel area near Garden City and Lansdowne roads for the time being, with a permanent location elsewhere on the property later.
Five hundred cubic metres of agriculturally viable soil would need to be brought in to fill the aboveground, self-contained plots. The community garden would also include common areas for informal gatherings and socializing, composting areas, secure tool storage sheds and temporary, portable toilets. Ian Lai, executive director of the Richmond Food Security Society, said having garden plots at the Garden City Lands would help reduce social isolation and provide a sense of community. “It’s a great place for people to gather and learn together,” he told Richmond’s parks, recreation and cultural committee on Tuesday.

Grieving family still has questions after sentencing not to be angry and blame anyone but” there are still questions to be answered.
Alan Campbell ACAMPBELL@RICHMOND-NEWS.COM
Before passing sentence, Judge Chen spoke of the “many difficulties” faced by Kashari while growing up in poverty in Albania, then a Communist dictatorship.
“I still don’t even believe she’s gone…but nothing will ever bring her back.”
According to Chen, when Kashari was 13, his father was killed in a hit and run and his mother is paralysed. When he was 14, he apparently walked for five days to Greece to seek refuge, but was forced, age 18, to head to England.
Joni Mahy was reflecting moments after the sentence was passed down Monday morning on the reckless driver who caused the death of her sister, Christy, in July 2014 at a busy Richmond intersection. Albanian native Erjon Kashari was sentenced at Richmond Provincial Court to time already served, after pleading guilty to criminal negligence causing Mahy’s death at Russ Baker Way and the Dinsmore Bridge. He was also banned from driving in Canada for five years. Judge Patrick Chen said credit had to be given to Kashari — a refugee claimant with a Canadian work permit and long criminal history from the U.K. at the time of the accident — for his time spent in an Albanian jail awaiting extradition and in a Canadian prison, awaiting today’s sentencing. Chen sentenced Kashari to a total of 25 and three-quarter months after he drove dangerously and lost control of his SUV as it raced towards the intersection where Christy was standing on the sidewalk, waiting for the pedestrian crossing light. Kashari’s vehicle swerved into 34-yearold Mahy, causing horrific injuries. The court heard last week that, a month after the tragic accident, Kashari withdrew his refugee claim with the CBSA, triggering a deportation order. Three months later, in November 2014, the CBSA — which didn’t get a reply from the RCMP after asking if there was any reason he shouldn’t be allowed to leave Canada — paid for his flight back to Albania. Mahy’s family fought for years to keep the case in the public eye and maintain the pressure to bring Kashari to justice.
In the U.K., he apparently struggled with substance abuse and committed a number of offences between 2002 and 2007, including two assaults, burglary, theft, holding his wife hostage and beating her up. Family and friends of Christy Mahy headed to her memorial bench near YVR after Monday’s sentencing of the driver who killed her in 2014. Charges were eventually laid in 2018 and he was extradited back to Canada in the summer of 2020. “I’m glad he was brought back to face the charge though. But I do feel if my dad hadn’t had those (memorial) rides every year and kept it in the spotlight (with the Richmond News), then this day would never have come,” said Joni about Kashari’s sentence.
Joni had hoped for a lengthier sentence for Kashari, but said she was “happy” with the way the judge handled the sentencing. “He was very thorough and it was clear

The News understands from Kashari’s lawyer, Jordan Allingham, that he is being deported back to Albania at the earliest opportunity. However, for Christy’s family and the many friends who turned up for multiple court appearances since Kashari was extradited to Canada last year, several big questions still remain.
Why was convicted criminal Kashari allowed to enter Canada and why was he allowed to leave by the RCMP and the CBSA a few months after causing Mahy’s death? “We’ve had to wait all this time and we still don’t have those answers,” added Joni. “I would love to hear from them, with some kind of explanation and apology. I’m trying
The latter of which saw him jailed for a year before being deported in 2009. Kashari somehow made his way to Montreal in August 2010, where he made a refugee claim before receiving a work permit in early 2014. According to the judge, Kashari was “making a great effort to live his life in Canada crime-free” until causing Mahy’s death in July 2014. But after pulling his refugee claim a month after the fatal accident — and subsequently being deported — Kashari made his way to Norway, where he committed further offences, including fraud and receiving proceeds of crime and domestic violence. Judge Chen said he took into account Kashari’s past troubles and the fact that he has expressed remorse immediately after the accident and at the sentencing hearing. The News reached out Monday to the RCMP and the CBSA to explain why Kashari was allowed to enter Canada with a serious criminal record and why he was allowed to leave while the investigation was ongoing. We have yet to receive a reply.

fees issued by the think tank, uses data collected from licensed full-day child-care centres, as well as home or family child-care providers in 37 cities across the country. Five B.C. cities were included in the survey, conducted between September and November 2020: Richmond, Vancouver, Burnaby, Surrey and Kelowna. Richmond families with infants also pay a median monthly fee of $1,300, making the city the 10th most expensive for such families. Fees for preschoolers, meanwhile, also rose by eight per cent, costing parents a median monthly fee of $1,028. The fee increases include B.C.’s fee-reduction program of $100 a month per preschool-aged child in a child-care centre and $60 a month in family child care. The childcare fee reduction program, introduced in 2018, does not set a maximum fee, but it limits how much participating providers can increase fees by.
File photo
In comparison, in Quebec — where child care is heavily subsidized and there are set fees — infant to preschool child care costs a median monthly fee of $181. Across the country, fees are higher in the for-profit sector than in the not-for-profit sector. In Richmond, for-profit fees are 28 per cent higher than not-for-profit fees for three to five year olds. That same difference is seen in Vancouver, Burnaby and Kelowna, while Surrey’s forprofit centres cost 60 per cent more than non-profit ones. Enrolment also dropped by 32 per cent in Richmond last year, which could be due to COVID-19 or parents choosing to not send their children to child care for various reasons, including high fees. The child-care report is based on data from a survey involving 11,000 phone calls between Sept. 22, 2020 and Nov. 13, 2020, representing a sample of 53 per cent of regulated full-time centre-based and regulated family child care in 37 Canadian cities. The survey tracked costs for infant, toddler and preschool aged children in centre or family-based, full-time regulated child care.

Transit users might have already noticed the new artwork displayed at Aberdeen and Lansdowne Canada Line stations. Richmond artist Fanny Bok Yin Tang is one of three artists currently being featured as part of the city’s No. 3 Road Art Column Public Art Program. The focus of the exhibit is work created “in response to the theme of hope, resilience and strength,” according to the city’s website. “The pandemic has affected everyone’s life in some way, from homeschooling to working from home, which have become the new norm. But it hasn’t stopped and will never stop artists from creating,” said Tang. Prior to the pandemic, Tang was busy teaching students in her own art studio. The subsequent shut down has provided her with more time to focus on the small, yet poignant things in life, such as the seagull that greets her every morning on her balcony, the swan she sees on her walk and the flowers blooming in her neighbourhood. These little things Tang encountered in her daily life have become inspiration for her artwork. “We are isolated and un-
Fanny Bok Yin Tang certain, but we can still see the hope growing strongly and beautifully,” said Tang. “Where flowers bloom, so does hope.” One of her paintings, “Crazy Yellow Daisy,” pictures a plant growing out of a rock. The flower looks so fragile and crushable yet is strong and resilient enough to grow out of a stone, explained Tang. The other artists featured in the exhibit include Keely O’Brien, whose work “Dearest” is comprised of a series of postcards that celebrate kindness, interconnection and community. Glen Andersen’s work, “The Old Normal — a storyboard for simple pleasures,” features a joyful illustration of children playing on monkey bars. The exhibition will run from March 12 to Aug. 15.

In the wake of the deadly mass shootings in Atlanta and increased violence against Asians in the past year, a number of Richmondites are joining thousands of others across B.C. to attend a “Stop Asian Hate” rally in Vancouver on March 28. Jessica Yan and James Wu have been busy making protest signs for the upcoming demonstration, which will take place at the Vancouver Art Gallery North Plaza on Sunday at 2 p.m. The rally is in reaction to a deadly shooting in Atlanta, Ga., where a White gunman shot and killed eight people, including six Asian-American women at three massage parlours.
these uncertain times, let’s empower each other and strengthen resilience through joining rallies like this,” said Yan. In the meantime, a memorial for the Atlanta shooting victims will be held at Brighouse Park on Saturday at 6 p.m., organized by Maple Leafs Anti-Racism Actions Association (MLARA). The not-for-profit’s president Ivan Pak is asking attendees to wear black or white and bring flowers and candles.
Yan, who immigrated to Richmond in 2005, told the Richmond News she was devastated after hearing eight innocent souls were murdered in Georgia. “For those who might feel scared during

Chinese immigrants were taught in school to not draw attention and to tolerate hardships, explained Yan. It’s a belief she also clung to while growing up. However, Yan said it’s now time to break the silence. “Although the tragedy didn’t happen in my hometown of Richmond, I still think it’s time for us to stand up and speak out. Otherwise, we will become transparent, and our voices won’t be heard,” said Yan. Wu agrees that “to be heard and to be seen is a significant step towards combatting racism.” Three years ago, Wu was walking on a trail in Burnaby when he was confronted by a sign that read, “No Asians on trail.” Wu immediately wrote emails to Burnaby city councillors and the sign was removed. “We hope more people know that we are here and we want to live in a place without any forms of racism. Diversity should be our greatest strength,” said Wu.

Richmond South Centre NDP MLA Henry Yao said it truly warmed his heart to witness a collective condemnation of racism in the legislature.
Yao noted that it’s not only important to address the observable racism but also acknowledge the existence of hidden racism.
Yao was responding in the B.C. legislature to a motion brought forward by Vancouver-Hastings MLA Niki Sharma on March 22 — one day after the International Day for the Elimination of Racial Discrimination.
“Together we need to shatter the invisible glass ceiling often too easily felt by Indigenous, Black and people of colour. We can do better and we need to do better,” said Yao.
The motion in full reads: “Be it resolved that this House recognize the historic and present-day acts of structural, systemic and institutional racism perpetuated against racialized people and reaffirm our commitment to combating racism in all forms.”

Last year at this time, Richmond City Coun. Harold Steves was “clobbered” on Twitter with anti-China racism over COVID-19, he explained to council on Monday. People were saying the new virus came from China, through Richmond and spread throughout the region.
Richmond North Centre BC Liberal MLA Teresa Wat said the COVID-19 pandemic has revealed how racism and intolerance can spread throughout the community, and it’s important to speak out and continue the conversations.
At that time, health authorities were trying not to point out the origin of infections, Steves said.

Local massage parlours ‘cautious’ in light of shooting Maria Rantanen & Nono Shen MRANTANEN@RICHMOND-NEWS.COM
At least one Richmond massage parlour is being “more cautious and alert” since hearing about the murder of six Asian women as well as two other people at massage parlours in Atlanta, Ga., according to Swan, a non-profit that advocates for migrant sex workers. Alison Clancey, executive director of Swan, said it’s telling that much of the discussion about the killings has been about
racism against Asians, despite the fact the man charged with the murders has been reported to say he was seeking revenge on woman who work in massage parlours, blaming them for his sex addiction. That the focus has been primarily on the fact most of the women were Asian says something about that line of work. “In reality, given the violence they experience, it’s just another day on the job,” Clancey said. Meanwhile, the issue of race has resonated with the Richmond community. Ivan
Pak,
president

Richmond’s
Maple Leafs Anti-Racism Action Association (MLARA), a local not-for-profit that fights against racism in Canada, said many people he has spoken to feel a bit scared to be Asian-Canadian, especially during times like these. Vancouver Police recently reported antiAsian hate crimes went up by 717 per cent from 2019 to 2020 in that city. Pak pointed to recent data from Fight COVID Racism, an online platform, that shows there has been an increase in hate crimes against Asian-Canadians since the start of the pandemic.
“Conversations and discussions between people from different cultural backgrounds are more needed than ever... ,” said Pak. Anne Brandt, who moved to Richmond from Taiwan in 1974, said she’s experienced her share of racism in the community. “I walked by Richmond Centre last March and was told to go back to China, even though I don’t come from there and have lived in Canada almost 50 years,” Brandt told the Richmond News in an email. The Disappointed Beneficiary; Another reason planning is useful Introduction There are a few types of assets you can own, that allow the designation of a beneficiary. An RRSP (or RRIF if you are over age 71), TFSA and Insurance policy allow designation. With these assets, the person or persons designated will receive these assets on the owner’s death. They do not fall into the owner’s Estate. Probate fees are avoided. In addition, the transfer of the assets tends to happen quickly. This is important to know, simply because so many of us own these assets or some of them. Where it becomes complicated is when something changes in life, which would prompt the owner to want to change the designation but in the turbulent circumstances, it is forgotten or overlooked. For example, when a marriage ends, each former spouse should make a new Will. They surely will also want to change the designation of their assets. If indeed it does not happen, then when the owner dies, there can be a dispute over who should receive the asset (the designated party, a new spouse, or perhaps a child). Earlier this month, reasons for judgment were released in a case called Knowles v. LeBlanc. This case is significant because this kind of thing happens more often than we might think and so it is useful to see how the Court handled the case. It’s a great lesson in planning. Facts The deceased, who died in 2019, owned a life insurance policy. He purchased it in 1987 when he was married to his first wife. He designated his first wife as the beneficiary. Not long after, they separated. They divorced in 1991. The deceased then entered a marriage like (or “common law”) relationship around 1993. He lived with his new spouse and they carried on their lives as a couple until the deceased died, at age 68. The deceased had made the monthly premium payments under the life insurance policy. Payments came, automatically, from a Bank account the deceased shared with his new spouse. The death benefit under the policy was $100,000. The deceased did not change the designation under the life insurance policy. His first wife remained the designated beneficiary. The second spouse was surprised the designation had not been changed. She challenged. Court’s decision Predictably, the positions of the two competing persons were opposite. The divorced spouse relied on the actual designation, which had not been changed. The second spouse (whom the Court referred to, legally speaking, as The Disappointed Beneficiary) argued that the divorced spouse held the funds in Trust for her, and she also relied on the legal principle of Unjust Enrichment. The Court first examined the intention of the deceased. As “intention” has become more prominent in modern law, it was important for the Court to determine that. The Court held that the deceased did intend to benefit his second spouse and not the divorced spouse but he forgot or neglected to change the designation in his insurance policy. The Court also found that there was a lack of evidence the deceased actually changed or sought to change the designation on the life insurance policy. The Court also held that although the first spouse and the deceased made a Separation Agreement and a Consent Court Order when they divorced, the Order and Agreement did not go far enough in the terms, to change the designation away from the first spouse. The most important issue the Court examined was the Unjust Enrichment. For this, the Court considers 3 tests. The first two involve finding an enrichment of one person and a corresponding deprivation of the other. The Court found that these first 2 tests were met. The first spouse was to be enriched and the second spouse, most definitely deprived. The third test, for the Court to determine whether an unjust enrichment exists, is whether there is an absence of a “juristic reason” for the enrichment. That means that the Court needs to determine whether the enrichment and deprivation happen without a reason in law or justice. An example of a juristic reason for an enrichment is the existence of a contract that allows an enrichment. In this case, the second spouse’s “deprivation” came from the fact that payments of the policy premiums came from a Bank account she held with the deceased. Was there an absence of a juristic reason for the first spouse’s enrichment? The Court found there was an absence. There was no reason to deny recovery for the second spouse. The deceased and his first spouse, by their Agreement, each retained their own property when they divorced. The first spouse was not involved in the lives of the deceased and his new spouse. Payments of the policy premiums came from the second spouse and deceased. So the second spouse, despite the designation in the life insurance policy, recovered all the life insurance proceeds. Conclusions In my opinion, the Court’s judgment was thorough and correct. It would have been unjust for the first spouse to collect the benefit of an asset she never paid for. However, on a practical level, the deceased should have changed the designation in his policy when the parties divorced. Though it is not unusual to overlook these sorts of things in the midst of a divorce, I advise anyone in this type of matrimonial situation to review all their assets and attempt to update their status, especially where a separation agreement is to be made. Making a new Will is important as well. Though the Court was right, here, the cost of getting to Court is high and could have been avoided with reasonable planning.
