Dog, sing-along sweeten hospital stay Eve Edmonds

When my mother called the other day, she announced it was “on business,” which is usually code for she has a story idea for me. And indeed she did. She had just gotten off the phone with her friend, Maggie McLean, who had just gotten out of Richmond Hospital. McLean had been there for a week with extreme back pain, but what she was telling my mom about (and urging my mom to tell me about) was the dog and the young man with the piano. Huh? Okay, I’ll call her. “I was quite delighted and totally surprised when this lovely lady, Maureen, and her little dog came in. He just came up and put his nose on my bed and I got to cuddle him,” explained McLean. And then there was the guy in scrubs who came into her four-bed ward with a

piano and started a sing-along. “There I was propped up in bed with my back killing me, and I’m singing Save the Last Dance for Me and the Tennessee Waltz,” McLean recalls with a laugh. “I was so delighted. It just lifted my heart, and my spirits.” Yet another time, “a sweet little girl came in with her guitar and we sang Edelweiss.” “Hospitals are not the happiest of places, but they are doing so much to make you happy and comfortable. People should know that,” she said. And this is to say nothing of the excellent care she felt she got from the doctors and nurses. It’s quite astonishing — given the workload health-care workers and the system as a whole are under right now — that anyone is thinking about cheerful little add-ons like support dogs and singalongs. But here’s the thing, these aren’t add-ons.

I’m no medical expert, but I would argue patting a friendly dog’s snout or joining in a sing-along can be as essential to recovery as medication and surgery. We all know that getting well makes you feel well, but the reverse is also true: feeling well can help you get well. The thing that has scared me most about this pandemic is not that my parents might get COVID and die, but that they would die alone. At one point, my parents were telling me they didn’t think they should get the vaccine, not because they’re anti-vaxxers or even vaccine hesitant. Rather because a vaccine shouldn’t be wasted on them. They’ve lived good, long lives. The vaccines should go to those with more years ahead of them, they said at the time. I would agree if we were talking about an organ transplant. But the thought of them dying scared and alone, hooked up to a ventilator, touched only by strangers in space suits, is too heartbreaking.

What’s more, that isolation may be what kills them — at least in part. In the early stages of this pandemic, it seemed to make sense to quarantine people and impose strict isolation protocols, but some are giving that a re-think. Last month, the medical journal the Lancet argued we need to put greater weight on damage done (psychological and physical) from isolation when we balance it against the risk of greater infection. There was a touching story on CBC the other night of a man who was extremely ill with COVID, but feels it was the sight of his wife through a window that enabled him to climb back to life. Who knows whether that friendly dog and happy sing-along at Richmond Hospital sped up McLean’s recovery. She thinks so, but even if it didn’t, that attention to her emotional health put her in a wonderful space of joy and gratitude. Given we’re facing a second epidemic in the form of mental illness, that kind of support is a kind of vaccine in itself.

No answers for recovery Fence around DND lands benefit ‘debacle’ sends wrong message Dear Editor,

It has now been more than a month since I applied for the B.C. Recovery Benefit, and almost as long since I submitted the additional information which the government for some reason requested. There is no indication if/when I may receive the benefit and only silence on the matter from our government. When the NDP promised this benefit to eligible residents it was presented as a quick and easy process to “get money into the hands of deserving people in time for Christmas.” What it appears to have been, unsurprisingly, was a crass and politically calculated attempt to buy votes by offering voters some of their own money back. Also, not surprisingly, the plot worked to perfection.

Henry Yao, to ask for his comments about this debacle but have not received a response, let alone a simple acknowledgement of receipt of my inquiry.

It seems that even rookie MLAs are quick to learn the lesson that it is more important to serve party leadership through silence than to be responsive to the electors. The Vancouver Sun published an article last month by Jonathan Manthorpe in which he outlined some of the dangers to democracy that we are now facing. One of those is the ever greater power that resides with the premier and his close circle of advisors, effectively sidelining MLAs who nominally are in the Legislative Assembly to represent the wishes and needs of their constituents.

Dear Editor, Like many in Richmond, I am surprised and disheartened by the decision of the Department of National Defence (DND) to surround the property across from the neighbouring Garden City lands with steel and barbed wire fencing. The decision confirms what many already suspect, that bureaucrats (federal and municipal) make decisions in their own bubble with no regard for public input or consideration of the consequences or ramifications for the general community.

been consistent with the federal government’s tree planting program and promise to spend $3 billion to manage, conserve and restore the country’s forests, grasslands and wetlands). DND should be transforming that land into something comparable to what is across the street. I hope municipal leaders can work with local and federal DND officials to revisit this incongruous decision and that DND will act like good citizens and neighbours rather than foreign invaders with a fortress mentality.

Transforming the property into a prison-like concentration camp speaks to their insensitivity to local conditions and shows a total lack of awareness of the fact they are creating a blight on the landscape not in keeping with the surrounding parkland and open environment.

The fencing sends all the wrong signals to the community and exhibits no respect for Richmond as a peaceful and civil community: the Child of the Fraser and Island City by Nature.

It would have been far wiser and better for DND to have used their collective brains, and the spare change clinking in their pockets, to clear out the dead and rotting birch and introduce disease and pest resistant trees and shrubs to capture carbon (which would have

COVID karaoke Search for missing bar shut down man ends in tragedy A Richmond karaoke bar which was busted by police for breaking COVID public health orders has been shut down by the city.

The Richmond News reported last week how Mounties pounced on the bar at Aberdeen Square — at the corner of No. 3 and Cambie roads — in the early hours of Feb. 13. Inside, they found 34 people, including staff and one manager, violating the Provincial Protective Measures Order and fined each of them $230, with the manager being hit for $2,300. However, the News has learned that the city has subsequently stripped the Deco Nova Lounge and Eatery of its operating licence for two weeks for “continued noncompliance with public health orders.” According to the city, prior to the police incident, the bar had been warned by several agencies with regard to its failure to adhere to the orders.

The suspension, said city spokesperson Clay Adams, was issued by the chief licence inspector, following instructions from city council to immediately suspend any business found to be in ongoing noncompliance with the health orders.

“While the city always tries to educate businesses and others who may violate health orders, repeated infractions and disregard for the orders will not be tolerated,” Adams told the News.

The body of a man found in Richmond on Saturday evening is missing 34-year-old Daryl Warcup, according to his family. The Richmond News asked the RCMP for confirmation and more details but was only told that Warcup had “been located.”

An online post by a relative said his body was discovered on Saturday by a police ground search team.

“Continued non-compliance by Deco Nova Lounge and Eatery will result in a further suspension plus ticketing and prosecution in provincial court.”

According to the Facebook post by Kay Warcup, his body was found not far from an unconfirmed sighting last Sunday, Feb. 14 on the train tracks in the Shell Road and Alderbridge Way area.

The city has also notified WorkSafe BC and Vancouver Coastal Health about the bar’s non-compliance. Anyone with information on similar gatherings is asked to call the RCMP at 604-278-1212 or anonymously at 1-800-222-8477.

City council approves $716,500 for by-election Maria Rantanen

The budget for Richmond’s by-election to elect one councillor was determined in a 5-3 vote at council, but a date for general voting suggested by city staff — May 29 — was discounted by the mayor who reiterated the date would be set by council. “May 29 is just a date — there is nothing certain or definite about that,” said Mayor Malcolm Brodie after the city clerk said that was the day being targetted. “The timing for the actual by-election will be set by council once the chief election officer is appointed,” Brodie said. “I don’t want anyone to take anything from that May 29th suggestion — that is simply one date. Council will determine that in due course.” A report on the by-election is expected at the March 15 committee meeting, with confirmation at the following council

meeting — March 22 — of the chief election officer, setting in motion the election period. The by-election has to be held within 80 days of the chief election officer being named. At Monday’s meeting, council approved $716,500 for the by-election, which will allow for 10 advance polls, 10 polls on voting day and mail-in voting for all voters (normally limited to those with disabilities or those who are travelling). Coun. Carol Day wanted to ask city staff to re-examine the cost to see if the by-election could be done with a smaller budget. She pointed out Victoria spent $430,000 on a recent by-election. Brodie, however, called the comparison “misleading” because Victoria is a third the size of Richmond. Day’s referral was only supported by Couns. Day, Harold Steves and Michael Wolfe. The full $716,500 budget was approved, with Day, Steves and Wolfe opposed.

‘Loyal’ man remembered

Karly Tanner said she can’t believe her friend,

Tristan Coatta, is gone. At the age of 25, the Richmond man died at home of an accidental overdose on Jan. 25.

Tanner met Tristan at a therapy group in Vancouver and as it turned out they were the only participants from Richmond. Although Tanner was five years older, they became close friends. “It’s shocking — I can’t believe he’s gone,” Tanner said. The BC Coroners Service recently released its statistics on overdose deaths from 2020 of which there were 18 in Richmond, up from 10 in 2019. When Marie Ratcliffe, a Richmond school district administrator, heard that a kindergarten student told her teacher, “learning takes patience and time,” she knew the Indigenous perspective on learning was getting through to kids in the Richmond School District. This principle is Ratcliffe’s favourite of the nine First People’s learning principles that guide the Indigenous focus that is woven into all aspects of the new curriculum. “That one always kind of stands out for me because I know as a learner, I learn best when I take my time and I’m patient,” Ratcliffe said. The nine principles were developed by the First Nations Education Steering Committee based on learning principles common to all nations across B.C. This week is Richmond School District’s Education Week, and Thursday’s theme is Indigenous perspectives. When the Ministry of Education revamped the curriculum about two years ago, the focus shifted from details to big ideas, with an Indigenous perspective woven into all areas of the curriculum from English, social studies to science — even math. To bring an Indigenous focus to math, a teacher might talk about patterns in First Nations technology, architecture and art, linking it to place, story and cultural practises relevant to local First Nations, Ratcliffe explained. To support teachers and school districts, the ministry has examples on its website on how Indigenous perspectives can be woven into the curriculum. “We spent a lot of time making sure the resources we used in this area are authentic — making sure they’re good quality, that they’re written by Indigenous people… making sure they’re respectful and well chosen,” she said. Students are also learning about First Nations in Richmond, for example, about the history and geography of the Fraser River delta. Ratcliffe hopes, through this new learning lens, students will come out as “thoughtful, educated citizens who understand the history of our place.” Search Indigenous for full story at Richmond-News.com

Introduction

In the last few years, personal relationships have become more complex in B.C., from a legal perspective. For example, from a Matrimonial perspective, the Family Law Act is now about 5 years old and in the coming week, new Federal Divorce Act changes will come into force. Overall, the changes will prove important. Meanwhile, from an Estate perspective, new legislation has changed the legal status of personal relationships as well. Perhaps most significant here is the change of the legal meaning of “spouse”. The effect on inheritances is marked. In my opinion, the definition of “spouse” has expanded. It is no longer simple to legally determine the nature and status of any particular relationship. It would not occur to most of us to think that a married couple could not be spouses. However, last month, reasons for judgment were released by the B.C. Supreme Court in a case called Lee v. Chau. For anyone thinking of entering a relationship or already in a relationship, this case is worth knowing about. Facts The deceased (who died in 2014) had been in a lengthy marriage but his Wife (the Mother of the defendants) died fairly young, in 1994. The deceased, in 1995 at age 65, met and married the Plaintiff. Their marriage was never consummated. Not long after the wedding, the Plaintiff applied for Landed Immigrant status in Canada. The deceased, around that time, made a new Will, leaving his Estate in equal shares to the Plaintiff and his two (adult) children. A year later, in 1996, the deceased made another Will, this time leaving his entire Estate in equal shares to his two children. The day after, he launched legal action, seeking a divorce from the Plaintiff. Seven months later, in April, 1997 the deceased discontinued the Divorce action, because there was a reconciliation with the Plaintiff. It was important that the Plaintiff, during the years of her marriage with the deceased, rarely lived with him. After the marriage, she was regularly in Taiwan. She was in B.C. in 2002 when she became a Canadian citizen but a month later, she returned to Taiwan. She returned to Vancouver later in 2002 but only stayed 4 months. This travel pattern continued in the years following. In 2010 the deceased was diagnosed with Pancreatic Cancer. His adult daughter then moved into the house and was his primary caregiver. In 2014, the deceased transferred his interest in his residence to and became joint tenants with his children. A year after the deceased died, the Plaintiff launched this action, seeking to set aside the transfer and to vary the deceased’s Will. She told the Court that she did not know her husband had become ill and did not know he died. She was very slow in advancing her case. Trial started 5 years after she launched this action. Courts decision The Plaintiff ’s evidence was generally weak and inconsistent. It does not seem that the Court gave it, much weight, on the whole. In addition, the couple lived separate and apart for 3 years before the deceased died. The Court found that they were estranged. The Court also found that the deceased did intend to gift his residence to his children. The Plaintiff ’s effort to set that transfer aside, failed. The Court’s finding on the question whether the Plaintiff and the deceased were “spouses” is most interesting. The Plaintiff and the deceased were indeed married. That did not change over time. There was no divorce. However, Section 2 of the Wills Estates and Succession Act defines “spouse” and in essence allows for the possibility that a couple, though “married” can stop being “spouses”. A separated spouse under the legislation is no longer a spouse for Estate purposes and has no right to seek a variation of a Will of their husband or wife. Whether a couple is “separated” depends on several factors. In this case, the Court had no difficulty concluding that the couple were separated. The Plaintiff argued that she was legally married to the deceased and so that should have qualified her as his “spouse”. The Court disagreed. The Court stated that the couple lived separate lives for years before the deceased died. The Plaintiff ’s claim was dismissed. Conclusions Subject to this case being successfully appealed, it is plain that a couple may be married but that does not automatically mean that they are spouses for the purpose of claims against the deceased person’s Estate. The Court will examine several factors to determine the status of a surviving person and whether that person is then eligible to seek a variation of the Will. It is also clear, in my opinion, that we have in B.C. reached the stage where it is the nature of the relationship that will determine whether a person is a “spouse” of another. There is no longer any automatic assumption as to status. It has already been shown in numerous cases the significance of a “spousal” status and now, with this case, we have perhaps taken a step further, to conclude that even marriage does not automatically make a person a “spouse”.

Dr. Bonnie Henry, B.C.’s provincial health officer, said seniors aged 80 and older who

aren’t immunized will be contacted over the next two weeks about a COVID-19 vaccine as the province starts Phase 2 of the vaccination program. In addition to seniors over 80, Phase 2 will include Indigenous

seniors aged 65 and older, hospital staff, GPs and medical specialists who haven’t been vaccinated yet, and “vulnerable people living and working in congregated settings,” as well as home support staff and nursing services for seniors.

Phase 3 and 4 will be to vaccinate the general population, expected to run from April to September, starting with those aged 75 to 79.

Terry Crowe stood and watched with pride as a bald eagle he helped saved from a deadly fight a month ago was released back into a Richmond field by wildlife rehabilitation volunteers. Crowe was out for his usual bike ride on Jan. 22, down near the foot of No. 3 Road — close to Dyke Road — when he spotted something moving in a nearby field. Upon closer examination, he realized it was a pair of bald eagles, tangled together, bloodied, exhausted and apparently struggling for life. Through a few coincidental phone calls, about 15 minutes later a Steveston-based volunteer from the Delta-based non-profit OWL (Orphaned Wildlife Rehabilitation Society) arrived at the scene.

“At this time of year, this kind of thing tends to happen more because it’s the start of breeding season and it can be a territorial battle or a food battle.

And for the last four weeks, the other bald eagle has been nursed back to health at OWL, before being released Thursday morning in the same field. Accompanied by Palichuk and Palichuk’s daughter, Crowe looked on as the eagle immediately took off, before attracting the attention of two other eagles, one of which it flew off into the distance with. “It felt satisfying that, through several coincidences, helpful and watchful environmentally minded strangers and the OWL, two eagles were saved,” Crowe told the Richmond News. “I really wasn’t sure what to do when I saw the eagles in the field. And now he’s putting that love on display for all the country to see as one of the bakers in CBC’s Great Canadian Baking Show. “My whole heart and soul goes into what I bake and I try to challenge myself in baking … and all of that love and care goes to my friends and family. It was 1 a.m. on March 14, 2019, and her husband, Edmund, was gasping for air, his face “turning a burgundy colour,” Hsiah recalled to the Richmond News. “I was asking him what was wrong and when he couldn’t respond, I knew it was serious so I called 911.” Hsiah said the medical call taker asked “all the right questions” and guided her in the exact steps to help her husband. “(The call taker) was calm and told me how to do (CPR) and I remember saying to her that everything was too fast, but I still caught up to her instructions.” Because her phone didn’t have a speaker option, Hsiah had the medical responder yell over the phone as she performed CPR while trying to stay calm. OBITUARIES YEO, Nellie June 1923 - February 20, 2021 Nellie was born in Singapore. She will be missed by her four children; Elaine, Melvyn (Diana), Victor (Jane), Katherine, her 3 grandsons and 4 greatgrandchildren. She was predeceased by her husband. She died peacefully on February 20th, 2021, in Richmond.

A private memorial service will be held at St. Alban’s Anglican Church. Special thanks to Dr. Patricia Wong and the staff of Fraserview Retirement Community for their care over the years. Donations may be made in her memory, to the St. Alban’s Memorial Fund or the St. Alban’s Community Meal.

Marlene quietly passed away in Nanaimo, BC during a beautiful snowstorm, in the early morning of February 14th, at the age of 86. Born in Vancouver and raised in Steveston, BC, she was predeceased by her parents, Stella and Cecil Fisher and her sisters Velma and Shirley. Marlene is survived by her loving husband, John (62 yrs of marriage), her children, Sandy (Doug), Robert and Susie (Kirby), her 5 adored grandchildren, Dougie, Danny, Natalie, Nathan and Noah, her sister Mickey, her brother George (Sylvia) and many nieces and nephews. Marlene graduated from Richmond High in 1952 and carried her strong athletic abilities with her all through her life. She became an inspiring Elementary school teacher at the age of 20 years. and started her career in Victoria, BC. After a few years, she and John moved back to Richmond, BC where she taught until 1992. Marlene was passionate about teaching and truly touched all those who she taught or worked alongside with. She loved to organize staff lunches and parties and was always the first to celebrate a special occasion for a friend and colleague. She had a heart of gold. Marlene enjoyed travelling and cruising the world with John at her side, and together with family and friends they explored many beautiful countries. Throughout her entire life, Marlene loved to spend time outdoors, whether it was gardening, camping, waterskiing, golfing, skiing at Manning Park, swimming in the ocean and in her younger days… taking part in long distance road rallies. Marlene loved to entertain and was a very talented cook. Together with John they hosted many wonderful parties that usually involved a martini or two! Special memories run deep for those summers spent on the beach in Lantzville where family and friends gathered yearly to enjoy fishing, swimming, boating, clam and oyster digging and cliff diving at Maude Island. Throughout it all, Marlene had an incredible “zest for life” and truly carried an inner “joy” and “fun spirit” with her, wherever she went. Marlene was incredibly proud of all her children and grandchildren and always took a great interest in all their accomplishments. She will be dearly missed and forever in our hearts. (Mom loved the snow so it is with special significance that she quietly passed while her entire family had snow falling around them.) The family will be holding a private Celebration of Life.
