An honest mistake? KERITH GABRIEL

S

o I’m a part of this community Facebook forum that I will not name because I don’t want to lose my access and also because I think I might go into a mini-depression if I didn’t have access to the stupidity that people post on these things, namely the story I’m about to tell you in particular. On Sunday, a local store owner in an emerging section of the city left merchandise out on the sidewalk as it’s alleged the store was closed. A person came by thinking the items were left as trash and took them. The classic tale of trash becoming treasure. The store owner took to the forum to alert neighbors that the merchandise, in this case three potted plants, went missing right out in front of the store. Within a few hours of the post, the person who took them responded to the post, apologizing and even vowing to return what they assumed was left out as trash – again, we’re talking about three plants here, not a BMW – as soon as possible. She later in fact did, claiming to place them exactly where she found them, which by the images depicted were literally in a place you’d put trash out for pickup. Again, honest mistake. I’ve even had to learn the hard way a few times on actually trash days to shred everything as I’ve emerged from my home on a few occasions to people riing through my recycle bin. Believe it or not, but taking trash left on the sidewalk technically isn’t a crime, but it sure feels like one when some weirdo is ipping through discarded mail with your name and address on it. The issue I have here is not with the person who took the plants. Believe it or not, the issue here is the owner, who has taken it upon herself to shame the person who took her plants in perhaps the most passive-aggressive manner I’ve ever seen. Even her initial post describing the would-be thief right down to her awful hairstyle reeks of elitism. However since, the shop owner has threatened to ďŹ le charges (man, how I would love to listen to

that call to the cops) but even sadder is that she refuses to take down her initial post despite repeated requests from both the thief and even others following the thread. It’s honestly become popcorn-worthy reading, in part for the thread commentary, but also in part for just how sad this makes me feel about the neighborhood. Real talk? This reeks of yuppie shop owner feels violated, doesn’t understand the makeup of the neighborhood she’s decided to open a store that’d better suit the Main Line than the Avenue it’s on and is surprised when she gets “victimized.â€? It’s a growing problem in many sections of our city where the people moving in aren’t taking any time to meet, talk to and get to know the people who have always been there. This closet elitist mentality of people thinking they’re better than because they are able to afford a six-ďŹ gure, cookie-cutter new construction home in a gentrifying neighborhood – or in this case, storefront space to house wares that don’t ďŹ t the neighborhood – is something I witness nearly every day. So to those confused about moving into rapidly gentrifying neighborhoods in Philadelphia, allow me to offer the following so moving forward it comes as no surprise: At some point, your property will be stolen or defaced. You will have to deal with the likes of people who aren’t in your tax bracket and maybe even speak to them at some point. But it’s OK, despite how they may look, most of them are actually very nice people. It’s OK to vent your frustration with the shit that goes down on social media, sometimes it can actually offer some good advice. It’s never OK to publicly shame someone who returned to the scene of the crime to do the right thing. Perhaps the most ironic part of this whole story though is how it ends. After the woman returned the goods back to the store where she left them, they were taken again by someone else – who most likely again assumed they were trash. I mean, Philly, you really can’t make this shit up. Listen, with all the serious that’s gone down in Philly over the past week with people still occupying City Hall, Broad Street getting shut down with folks in the street dressed like Little Red Riding Hood, and our own mayor getting into a beef with Jay-Z, thought we all could use a good laugh – or cry – depending on your point of view. White privilege Jay-Z vs. Mayor Kenney at its richest Charles Hallinan, the 77-year-old Main Line man dubbed the “godfather of payday lending,� was convicted last year of federal racketeering, but has yet to serve a day of his sentence as lawyers continue to appeal while Hallinan, who reportedly was the mastermind behind a billion dollar enterprise is suffering from two forms of cancer. Last week came to a head between the hip-hop music mogul Jay-Z and Philly Mayor Jim Kenney when it was reported the annual and revenue-generating Made in America festival would not be taking place at Benjamin Franklin Parkway next year. The awkward part? Kenney failed to mention this to Jay-Z or his company, Roc Nation. After the music icon took to ink, blasting the mayor in an op-ed for the Inquirer and Daily News, City of Philadelphia Spokesperson Deana Gamble shared the following public statement: “The City of Philadelphia supports the Made in America festival and is greatly appreciative of all that it has done for Philadelphia. We are committed to its continued success and thank them for their partnership. We hope to be able to resolve what has been an unfortunate misunderstanding. We are working with Roc Nation and Live Nation to resolve this issue and we are committed to continuing our partnership with the Made in America festival.� Q

wo summers ago, during the Democratic National Convention in Philadelphia, the Democratic Socialists of America gathered at the William Way LGBT Community Center in Center City and took a look at their accounts. Bernie Sanders had lost the nomination. That was bad. He was their candidate. Hillary Clinton was probably going to win the presidency. That was OK. Certainly better than letting the White House fall to Donald Trump. And as for the DSA, it had two years to capitalize on the Sanders momentum and organize a wave of left-wing Congressional midterm candidates who would challenge what they saw as the status quo embodied by Clinton: a Democratic Party hopelessly beholden to wealthy interests over those of the poor and working class. Now that wave is very much cresting. Candidates endorsed by the DSA have begun to pick up high-proďŹ le primary wins, most notably that of Alexandria Ocasio-Cortez, a 28-year-old Democratic Socialist from the Bronx who beat the nearly 20-year incumbent Congressman Joe Crowley in June. But Clinton is not the president, and the political environment looks starkly different than many imagined it would just two years prior. “There’s a Revolution on the Left. Demo-

But really, there’s a lot of revolutions on the left. And as the Democratic Socialists of America becomes a more prominent name in the ďŹ ght for socialism, groups with even further-left politics are gearing up for a longrange struggle for political power. Here at home, the Philly Socialists, a local group that rejects the Democratic Party outright – in fact a group that has adopted a blanket moratorium on political endorsements of any kind, and embraces a mission of building a revolutionary socialist party in the United States over the course of several decades – is wrapping up an annual fundraiser that brought in nearly $25,000. The group also helped support a coalition of protestors who set up an “Occupy ICEâ€? encampment outside of Philadelphia’s Immigration and Customs Enforcement ofďŹ ce in July, which later moved to City Hall after a police raid. With no plans on letting up, later this summer, Philly Socialists is taking its show on the road for a 10-city speaking tour with other socialist groups. “There's a couple goals with it,â€? says Ariel Diliberto, co-chair of the Philly Socialists and the group’s delegate for the speaking tour. “Part of it is to get our politics out there, because we don't get a lot of media attention. To start to reach people directly in other cities around the country and to speak to people who are maybe a little further to the right than us

FEATURE on how we do what we do, and kind of seed this idea, and spread it, and get more people interested in following our model.â€? Philly Socialists, which formed in 2011, has already done quite a bit of organizing in the city. They have offered free ESL and GED classes. They print a quarterly journal called The Philadelphia Partisan. They run a community garden near Norris Square. They helped launch the Philadelphia Tenants Union, which intervenes in tenant-landlord disputes and has pushed City Council to pass a bill requiring landlords to show “good causeâ€? before evicting tenants. (The bill was introduced this spring, but hasn’t come up for a vote.) For a while, they even offered free Internet, paying for business-grade Fios at a few members’ houses and broadcasting the connection to their neighbors under the banner of Free Socialist Internet. They later dropped the Internet project because, while it was providing a service that capitalism wasn’t, Diliberto says, it wasn’t helping them build their organization. And the group is laser-focused on a strategy of “base-buildingâ€? – helping to organize people around speciďŹ c issues with an ultimate goal of bringing them into the socialist fold. “The goal is to have an actual socialist party in the United States,â€? Diliberto says. “We say, kind of abstractly, but to give people a sense of the time range, 40 years is what we're building for. And I guess we're seven years in now. So every single thing we do, we decide whether we're going to do it based on, is this going to meet our goal? In order to build a new party, you have to build a mass base. So are we building a mass base? And are we demonstrating and putting our politics into action along the way?â€? As of today, Philly Socialists has 130 duespaying members and about 100 other people who volunteer regularly for its programs, according to Diliberto. Tim Horras, one of the co-founders of Philly Socialists, says he’d been very active in anti-war movements during the George W. Bush administration before he considered himself a socialist. But during the ďŹ nancial crisis of 2008, he had a sense that “it was going to open up political space in a totally different way.â€? Socialism became the unifying worldview that could bring anti-war, anti-poverty, anti-racist, and anti-capitalist movements together. And while Philly Socialists works with groups like DSA – one of DSA’s members is joining the speaking tour – it doesn’t ultimately believe that socialism can take hold through the current electoral structure. “Philly DSA and just the DSA in general have a longstanding orientation toward trying to elect more progressive Democrats as kind of its main focus,â€? Horras says. “And for us that wasn't really sufďŹ cient. Our orientation was, ďŹ rstly, we’re revolutionary socialists. And, secondly, we think the center of gravity of politics has to do with mass action

and with organized workers as well.â€? It’s true that DSA is becoming more of a mainstream political institution, says Dustin Guastella, a member of DSA’s Philly Steering Committee. Locally, the group endorsed Elizabeth Fiedler, a Democratic candidate for the state House of Representatives, and it is backing State House candidates Summer Lee, Kristin Seale, and Sara Innamorato as well. DSA is becoming “something like a pre-party organization,â€? Guastella says. “We’re a little bit too big to nimbly and quickly intervene in a lot of different protest activities ...â€? he continues. “I think [Philly Socialists] are more capable than we are of mobilizing in a quick way and doing militant activity and getting in the newspapers about that stuff, and I think that kind of moral clarion call is necessary.â€? But while he views their mission as an important one, Guastella doesn’t necessarily see their rejection of electoral politics as a successful way of making concrete political gains in the short term. Nevertheless, the groups are joining forces for this summer speaking tour. R.L. Stephens, a member of DSA’s National Political Committee who is joining the tour, says the goal is to build solidarity among socialist groups and talk about what it means to create socialist political power. Even when candidates can win elections running on socialist ideas, Stephens says, it doesn’t mean those ideas will take hold. “How do you break that deadlock?â€? said Stephens. “That’s what this tour is about exploring. It’s about going to the people in any of these areas, the people that are active in trying to ďŹ ght for a better future, and saying to have that better future, we have to establish people’s governance.â€? Also joining the tour is Kali Akuno, a cofounder of Cooperation Jackson, a workers’ co-op in Jackson, Mississippi, whose mayor, supported by the group, has vowed to make Jackson “the most radical city on the planet.â€? (Akuno was not available for an interview.) Stops include Austin, Houston, Dallas, Louisville, Lexington, Kentucky, Richmond, Virginia, Charlottesville, Blacksburg, Virginia, Mobile, Alabama and New Orleans. “I hope that people are inspired,â€? says Diliberto. “I've been thinking about this a lot lately, the fact that Philly Socialists started from dust – no national infrastructure to lean on, not even someone with a rich parent. It started as two people with an idea – it sounds like an ad for Microsoft or something – but two people with an idea, and it's been completely funded by our members’ dues and by the annual fundraiser we do. No grants, no government funding. And now we have an ofďŹ ce. We are able to print a journal. We have 10,000 Facebook followers. It's crazy. And I want to tell that story.â€? Q

Philly City Controller lays out plan to fix broken sexual harassment system The city’s botched handling of sexual harassment complaints was the subject of a recent Philadelphia Weekly investigation BY MAX MARIN

P

hiladelphia City Controller Rebecca Rhynhart released a new audit that paints a damning portrait of the city government’s failure to track sexual misconduct complaints, properly train supervisors, and ultimately protect victims of sexual violence in the workplace. On Thursday, Rhynhart published the results of a probe into the city’s sexual harassment policies for its 28,000-employee workforce – the second-largest in Pennsylvania – over a six-year period. The ďŹ ndings include

In tandem with the audit’s release, Mayor Jim Kenney’s ofďŹ ce outlined reforms to the city’s beleaguered processes. These reforms include an online submission system for complaints and a central reporting database for human resources departments, which will be overseen by the Mayor’s OfďŹ ce of Labor Relations. But Rhynhart says more substantive change is needed – namely a well-staffed, independent agency to investigate complaints of sexual nature across all city agencies and enforce consistent discipline. “What has been proposed [by the mayor] is an initial step,â€? Rhynhart said. “Over the

next few months, I expect full implementation of the recommendations.â€? The city’s troubled record with handling sexual misconduct in the workplace was the subject of a recent Philadelphia Weekly investigation. Records showed less than a quarter of city departments were able to produce any internal HR complaints. Even large, scandalprone agencies like the 500-employee District Attorney’s OfďŹ ce admitted they had kept no records of complaints at all. Rhynhart’s audit conďŹ rmed not only the existence of widespread dubious and decentralized record-keeping practices, but also a mystifying process for lodging complaints that varies widely from department to department – and which yields uneven punishment. The Controller’s audit, which spans April 2012 to June 2018, offers a litany of troubling details:

The next chapter Meet the Temple professor using academia and journalism to impact people all over the world BY TOM BECK

emple University students think George Miller is easy. According to ratemyprofessors.com, a self-explanatory and hardly scientiďŹ c wiki-style website used universally by virtually every 21st century college student ever, Miller has a “level of difďŹ cultyâ€? rating of 2.1 out of 5. How does he feel about that? “Uh, I don’t give a shit,â€? the Temple journalism professor quipped. Which is not a surprising answer. Miller, the soon-to-be-former Northern Liberties resident and Temple journalism professor (more on that “formerâ€? bit in a sec), is notorious for swearing during classes and making students laugh. The anonymous user reviews on ratemyprofessor.com range from “really funnyâ€? to “relatively funnyâ€? to “everyone loves Geo because he's so funny blah blah blah and he makes people laugh sometimes and he says curse

words.â€? Another reviewer called him “the Ted Mosby of journalism except maybe a little less emotionalâ€? – whatever that means. “I mean, the vast majority of people who comment on there have probably taken Journalism and Society, which is a pretty easy class,â€? Miller said, referring to the introductory journalism course all journalism majors are required to take. “So I got no problems with that.â€? Miller is right. The overwhelming majority of reviews come from students who say they only took JRN1111, which is the course number for Journalism and Society – a class in which Miller proselytizes students into becoming reporters. But at this point the reviews are useless. Miller, who is currently the associate professor and assistant chair of Temple’s journalism department, won’t be teaching at Temple’s North Philly main campus any longer. In fact, he won’t even be in the country. On Monday, Miller is scheduled to y to Tokyo.

Temple professor George Miller and his infamous shih tzu, who often attends Miller’s classes, Mookie. The next day he’ll start his new job as the associate dean for academic affairs at Temple University’s Tokyo campus. Save for three or four scheduled trips back to Philly a year, Miller will be moving to the Tokyo Metropolis permanently. “It's a pretty amazing ďŹ t,â€? he said of the opportunity. “Everything about this job is almost ideal. My family is in Japan so I wanted to go to Japan. I've been wanting to get over there and work over there for a while. Knowing that we had a campus in Japan has always been appealing to me and so this is a way for me to go back home and be with my family, but also not leave Temple.â€? Miller is half Japanese. His father was in the United States Navy and was stationed at the U.S. Naval base in Sasebo, Japan, during the Vietnam War, which is where he met Miller’s mother. Miller was born at a naval base in San Diego and grew up in Wilmington, Delaware. At a young age he was inspired to take up journalism when somebody in high school told him he was a good writer. “I was a dumbass impressionable kid,â€? he said. “So I was like OK I'll be a writer.â€? He got his BA in communications

from Loyola University in 1993, then meandered his way through the Ivies. He graduated from Columbia’s Graduate School in Journalism in 1997, and then earned a second master’s – this time from the University of Pennsylvania – in creative writing in 2003. He’s bounced around Philadelphia writing, reporting and photographing for a number of media outlets around the Philadelphia greater metropolitan area, including the Daily News and Philadelphia Weekly. Nowadays, he’s most wellknown for being the founder of JUMP, the city’s quarterly music magazine, which only features artists from Philadelphia. The minutiae of JUMP’s future are still under wraps, but Miller intimated that JUMP will continue to rock on. “You can say that a friend of mine who also works in the industry is going to take over the magazine and give it a run and try and make it a business,� Miller said of JUMP, which was always more of a hobby and a less of a business venture for him. On Saturday night, former students and cohorts from the Philadelphia music scene gathered at Everybody Hits, the batting cages-turned-DIY-space for up-and-coming Philly bands, for a goodbye party for Miller. The night featured a DJ, a live band (Conversations performed, a surf rock quartet featuring Jessica and Josh Craft of Kensington-based after-school music program Rock to the Future) and free booze and kegs of Kenzinger. Miller did some shots and joined in on the fun. It’s just another example of the brotherly love he’s come to expect living in Philadelphia. “The greatest thing in the world is to bike around Philly and just see people,� he said. “I remember last year sometime I was biking home from the gym, and I went past the criminal justice center and all the media were standing outside. I was like ‘look at that! There's a couple of my friends and people I used to

work with. There's some TV people I know.’â€? Then he realized “about half those peopleâ€? were his former students, so he stopped and mingled. “It was like a little reunion, and I'm going to miss that,â€? he said. Does he think he’ll feel just as at home in Tokyo? “Man, I don't know,â€? he said as his voice increasingly escalated in pitch toward the end. “I don't know,â€? he repeated. “That's a concern. I mean, one of my favorite things in Philly is I ride my bike and everywhere I go, I run into friends and former students and people I know so it's a pretty great thing. Tokyo is so massive and so sprawling. And I know maybe like a dozen or so people there [author’s note: a dozen people out of the Tokyo metropolitan area’s total population of more than 38 million people, according to the United Nations, which is the largest metro area in the world]. It's deďŹ nitely not going to be the same at all. Philly is an easy place to feel at home, and I really enjoy it here. I don't know if Tokyo will get that way. It's just so massive and so full of people. But I'm going to try.â€? Miller has been ingrained in Philadelphia for the past 24 years, and he’s made the most of it meeting people through journalism, which he endearingly refers to as “an excuse to take advantage of everybody else’s lives.â€? The move will be made easier by the fact that his girlfriend, Michelle, and his shih tzu, Mookie, will be coming along with him for the ride. The word “moveâ€? likely is a bit reductive, however. “Life-changing migration to likely the most culturally advanced and modern city in the worldâ€? is perhaps a more appropriate substitute. Your stand-up routine is called The Symphony of Chaos Tour. What’s the inspiration? My house is a “symphony of chaos.â€? I've got ďŹ ve kids. So there's seven people living there, and we've got three dogs. So, it's just noise. It's noise on noise. Just loud.

What's a normal day for you like then? I don't know that I have one. But we're usually up by 6:30am to get somebody moving or something. Like even during the summer, there's summer camps or jobs or other school things to go to. So, we try to keep all the kids busy, otherwise you don't want them just sitting at home on their devices. They'll have summer camps of one type or another. And those change week to week‌So yeah, everyone's busy.

The orchestrator of this impromptu singalong? None other than actor-comedian David Koechner, playing on one of his many memorable scenes from the 2004 blockbuster ďŹ lm, “Anchorman.â€? Prepping for a comedy special this Fall, the accomplished actor, who has a recurring role on the Jenkintown-based ABC sitcom “The Goldbergs,â€? brought his Symphony of Chaos Tour to Helium for weekend for three nights on July 19-21. Koechner stuck mainly to material about his wife, ďŹ ve kids, and three dogs, but midway through the set, he gave his fans a bone and asked, “Should we just get this over with?â€? followed by a string of one-liners from his two most iconic screen characters: Champ Kind from the “Anchormanâ€? ďŹ lms and his hilarious role as Todd Packer from

“The OfďŹ ce.â€? After appeasing the crowd, Koechner cut right back to where he left off about his household amusements and woes. A smartly constructed — albeit at times disorienting — set, The Second City alum feverishly recreated his daily life in LA. Arguably more impressive in terms of perspective, Koechner delved into his childhood growing up in small-town Tipton, Missouri, complete with its cast of characters and the population surge due to the increased number of prisoners in the city’s correctional facility. Koechner ended the night and his set on a high as he maneuvered through the audience, including the back of the house, to prove that women are better looking than their partners. Before his set, PW caught up with Koechner to ďŹ nd out more about his life and career.

How do you like being in Philly? What's your go-to thing to do while you're here? Well, I'm a huge history buff, so anytime I can research something I haven't seen before is always fun for me. This is where liberty began. Right?

How do your kids feel about being the basis of your material? Each one of them gets a joke. I tell each one of them, and they'll say, "oh, that's not true, dad." But it is, everything in my show is true or based on fact.

That seems like a good punishment tool. It's funny, it's all in good fun. They're amusing. It's relatable. When I do meet and greets after the show and people come up and go "we've got ďŹ ve kidsâ€? or “we've got four kidsâ€? or “we know just what that's like to go through life and have to listen to the [kids playing the] recorder again." Then the people that don't have kids go, "Yeah, well that was my childhood as well."

Do you prefer stand up or acting? Oh, I like all of it. I don't mind airports, I don't mind travel, and I don't mind hotels. I love meeting people, so that's all good for me. But I'm very fortunate, in that I get to work with a lot of great people in a lot of different projects. Something that's debuting this week is called "MisďŹ ts and Monsters" with the great Bobcat Goldthwait. It's an anthology series he came up with, and he wrote a part for me. I mean, life can't get much better. I get to play a guy that turns into a werewolf. Dana Gould, another amazing comic, wrote a show called "Stan Against Evil," and earlier this summer I shot an episode of his series. I don't how much I can tell you about it, but I turn into a creature and ďŹ ght a guerrilla. So that's a pretty good life when you've got friends that are brilliant, that write things for you, you're just beyond attered.

You've done an extensive number of projects. What's something that you have really treasured?

I always think "Cheap Thrills," which is a movie that didn't get enough attention. It's on Netix now, but it's a dark thriller that has some comedic undertones. But man, I enjoyed making that movie. It was like doing a play and everyone was so good in it. Pat Healey, Ethan Embry, just fantastic cast and we had a blast doing it, and the movie turned out really, really well. And so I'm really proud of that. I guess another other one that I love the character I got to play is in "Extract." It was a Mike Judge ďŹ lm, which right there, I'm already happy, but then I got to play this annoying nudge of a neighbor. And that was just a treat, because I would crack up Jason Bateman and Kristen Wiig and we had to do another take. So when that happens, it feels pretty good.

You were recently in the "Twin Peaks." Filmmaker David Lynch just got another Emmy nomination for that. How about that, right. Lynch has been in the news quite a bit lately for his comment that Trump “could go down as one of the greatest presidents in history because he has disrupted the thing so much.� You wish you could just say he misspoke.

What’s your take on what he said? Well, I love David Lynch and I loved working with him. We, in this country, need to have a more civil discussion about whether we agree or disagree. I disagree with his point of view on that particular political statement. But he's got the right to his own opinion. Everybody hopes everybody's on your side, right? But there are different points of view, and that's what makes this country great. What doesn't make it great is saying it's not great, because it is. And when we say these code words of "make it great again" to me sound like dog whistles for racism and that's what we have seen a lot of. That's not making the country great again.

From your experiences, what advice would you give local comics who hope to attain similar successes? Just get up as much as you can. There's no secret other than getting up, getting up and getting up, and the audience will tell you if you're funny or not. And if you're never getting laughs, maybe this isn't for you. But if you have a joke you love, rewrite it, just keep writing, just keep doing it. Get up there. And the other thing I say is read "Outliers" by Malcolm Gladwell. It's literally called “The Story of Success.�

What about “Outliers� has stuck with you? He basically talks about the "10,000 hours theory," and so for me I'm like, "Oh yeah, I put my 10,000 hours in." So, I felt pretty good about it. Q TWITTER: @ANDREAJCANTOR

It’s clear that protestors outside City Hall, many of which have camped out for nearly three weeks, don’t plan on leaving until true change is made.

What are we fighting for? D

efying the 24-hour news cycle, the ongoing Philly protest that is Occupy City Hall is still raging on for nearly three weeks. The protest against immigration enforcement and policy, on both a local and national level, migrated from the city OfďŹ ce of Immigration and Customs Enforcement on 8th and Cherry streets, after Mayor Kenney ordered the shutdown of what was Occupy ICE. The protesters’ demands “have pretty much stayed the same since ‌ the occupation at the ICE ofďŹ ce started,â€? said Liberty Britton, a 26-year-old activist with Socialist Alternative. “They have been local, state and federal. In the local, end PARS data-sharing. In the state, close Berks Family Detention Center. And federally, abolish ICE – it is no longer a needed institution, it never really was.â€? Gaining a lot of traction among the demands is PARS, or the Preliminary Arraignment Reporting System. So what exactly is this collective ďŹ ght that doesn’t seem to be going anywhere? The Major Players

PARS is the City of Philadelphia’s live-time criminal database, which includes arrests and bail information.

As previously mentioned, the PARS agreement is set to expire on Aug. 31. A renewal would require the vote of two of the three major stakeholders: the city (e.g Mayor Jim Kenney), district attorney’s ofďŹ ce (a.k.a DA Larry Krasner) and/ or the First Judicial District. As opposed to past renewals, the OfďŹ ce of the Mayor stated this will be the ďŹ rst time the PARS agreement will have a formal vote.

PARS and Immigration

Don’t Count Your Chickens

In the quest for immigration reform, it’s important to know what many Philadelphians protesting BY ANDREA CANTOR

they or their loved ones will be deported. Quite frankly, cooperating with ICE at this time makes our city less safe because it makes undocumented individuals fearful of coming forward to report crimes or testify in criminal cases.â€? Director Simona L. Flores of the ICE ďŹ eld ofďŹ ce responded to Pratt in a letter on July 16 that read: “The suggestion that ICE is speciďŹ cally going after known victims and witnesses to crimes, and utilizing PARS for that purpose, is entirely baseless.â€? In the letter, Flores denied allegations of “racial proďŹ lingâ€? but noted the arrestee’s country of origin is considered “as part of its investigatory efforts.â€? She also asserted that ICE is not under a breach of contract if agents use PARS to locate an immigrant who committed a crime, and by way of that investigation, discovered and arrested noncriminal undocumented immigrants. Just by looking at the numbers, immigration activists as well as City ofďŹ cials have reason to be wary of how ICE uses PARS. Sixty-four percent of Philly ICE’s “at-largeâ€? arrests were without criminal convictions, as co-reported by ProPublica and the Inquirer. This rate is higher than any other city-state in country.

What is PARS?

Under the current database-sharing agreement with the City that is up for renewal on Aug. 31, ICE has access to PARS to help detain and deport criminal undocumented immigrants. City Solicitor Marcel S. Pratt wrote a letter on July 12, calling for a meeting between ICE and local administration to review the immigration bureau’s use of the system. Pratt argued ICE may be liable for a breach of contract by using the centralized information for the unintended purpose of targeting noncriminal undocumented immigrants, such as those still under investigation without conviction as well as witnesses and victims of crimes. Philadelphia District Attorney Larry Krasner recently explained the problems with using PARS to arrest lawabiding undocumented immigrants in a written statement: “Many immigrants are scared to participate in our criminal justice system because they are fearful that

Mayor Kenney and DA Krasner – two of the three stakeholders in the renewal of the PARS agreement – may be Democrats who both ran on platforms of immigration reform, but the Aug. 31 vote is not clear-cut. While DA Krasner is “crystal clear,� as described in his written statement, that he will “absolutely be a 'no' vote to provide [ICE] additional access to PARS...,� Mayor Kenney has yet to put his stake in the ground. City spokesperson Deana Gamble offered the following public statement:

The Administration was happy to have the opportunity to meet with representatives of the Philadelphia area ICE ďŹ eld ofďŹ ce this week and share information with them. We are not going to discuss the substance of our conversation with them through the press, but the meeting was very productive and there may be some follow-up exchanges. The City has not made any decisions about renewal, but will do so in advance of the August 31 deadline.

Why the cold feet, Mayor Kenney? The mayor’s uncertainty is in direct contrast to 2011, when thenCouncilman Kenney and Councilwoman MarĂ­a QuiĂąones-SĂĄnchez introduced and unanimously passed a resolution to stand against PARS data-sharing with ICE. No one can say for sure why Kenney has wavered on this issue, especially given his direct hand in the agreement’s survival or demise. But a clue may be his fear of retaliation of federal funding if the City discontinues the data-sharing with ICE. The mayor is no stranger to this type of political pressure, having spent the past year in litigation over U.S. Attorney General Jeff Sessions’ attempt to withhold $1.5 million in law enforcement grant money from the City for its “Sanctuaryâ€? status, an ambiguous title given to states that do not cooperate with ICE in some form or function. However Sessions’ retaliation never came to fruition, because a U.S. district judge ruled it unconstitutional, siding in favor of Philadelphia on June 6. Whatever the mayor’s reasoning, protesters have not let him off the hook. “I think Mayor Kenney is trying to hide behind good words but not really do what it takes to put his campaign promises of sanctuary city in place,â€? said 25-year-old Adam, last name omitted for privacy, at Occupy City Hall. Pointing to a larger issue of inaction on the part of Democratic leaders, Adam continued: “This is something that the Democratic Party has been doing for a long time. It's top local elected ofďŹ cials. Sometimes you get a local city council-person trying to ďŹ ght the powers or something, but even in Philly our city council people are often saying one thing, showing up to protests ‌ but being extremely weak on legislation.â€?Q TWITTER: @ANDREAJCANTOR
