Welcome to this week’s Reno News & Review.

You know what tomorrow is? Tomorrow, Friday, July 19, at 3 p.m., is the explosive moment when we start counting the responses to our popularity poll, the Biggest Little Best of Northern Nevada.

Even though we made some technical changes this year, things appear to be climaxing relatively smoothly. My fingers are crossed. I did hear a few comments about competitors buying votes with promises of prizes or such, but as I’ve said more times than I can count, all’s fair except using technology to game our system. This is a popularity contest. It’s not a scientific poll. Its overall accuracy (or not) comes from the fact that thousands of people join in.

Still, there are always some weird results, but we let the coins fall heads or tails, and we don’t second-guess how our readers voted. If Keystone Cue & Cushion wins Best Billiards Parlor, well, we’ll make them a plaque. If Tad Dunbar wins Best News Hair, I’ll be glad to shake his hand and buy him a Bloody Mary.

I’m excited this year. I mean it’s always exciting to see who wins, and I love seeing what our artists do every year to try to top the previous year, but this year feels special. Maybe it’s this whole innovation section. Maybe it’s because we’re trying an innovation of our own that’ll drop your jaw. If it works.

There’s the excitement.

What if it doesn’t? I’ve seen great ideas monumentally fail before. Shoot, I’ve found myself standing with my pants around my ankles more times than I can count. Not that you should let that scare you.

Another great part of this is always the Biggest Little Best of Northern Nevada winners ball. We hold these gigantic, invitation-only parties that are invariably recognized as the best party of the year. They’re so good, we should probably hold them more than once a year. They’re even better when everyone gets to come.

And that brings it all back to you.

Re “Trash talk” (Feature story, June 20): Waste Management’s new “going green” plan means grabbing all the bucks they can. My wife and I are conscientious about recycling, but we can fit all bottles, cans, newspapers, etc., in the smallest new bin. But because we need a 96 gallon toter for yard waste, WM says we have to have, and pay for, the largest recycling bin. One size fits all at Waste Management, as long as it’s the most expensive.

This little piggy went to market without inspection Re “A Market Solution to Food Problems” (The Liberty Belle, July 3): Accountability in performance and quality of products and services is an easy concept. Standardization and recognition of performance level is also an easy concept. Even the simplest among us can recognize, as the columnist so compellingly observes: “We believe that without big government regulation, there is a higher risk of negative consequences when it comes to our food consumption.”

The reasons for this are nearly too obvious for words. Safety standards as they pertain to food address health consequences that are profound and immediate. Substandard processes in that area of endeavor would reach beyond the simple dictates of trading in non-perishable tangible commodities. Commerce involving ingestible materials understandably must answer, without compromise, to scientifically valid health guidelines. On that perfectly simple aspect of the marketplace, there is no acceptable substitute for enforcement of high standards.

The columnist made oblique reference to this point, in the rhetorical passage: “The question, then, is why does food get its own unique treatment, and why do even the most conservative people want its

regulation? Is there an alternative to big government when it comes to food?”

Having directed our attention successfully to the unambiguous necessity for intense regulation, the columnist adds variety to a simple reminder of the obvious, by throwing in some recent lore about product ratings systems administered by those products’ own industries.

Specifically, “If we look to the voluntary certification and rating systems, then we can see the favorable business relationships and market interactions that occur as a result of their institution. For example, Home Depot gives preferential treatment (i.e. purchasing power) to wood products that have been sustainably harvested.

Walmart, Game Stop and other major retailers won’t supply video games that have an AO (aged 18+) rating from the ESRB, which de-incentivizes the production of electronic entertainment that contains strong sexual content and strong violence. ... Then the politics of food would be taken out of the equation because food companies could volunteer for their own labels of certification, and power would be put back in the hands of consumers and private food retailers instead of government.”

The columnist’s approach is to: 1: break away temporarily from the topic of health regulations, and to relate some brief stories about industry self-regulation in areas completely unrelated to food.

2: escort this thesis into the mix: “It could be argued that more successful regulation would occur without government intervention.”

3: magically transfer the magical thesis, across all boundaries of propriety and ethical limitations and common sense, and pronounce that—trumping all of these mere by-products of science and judicious reasoning—it is now magically applicable to the arena of health inspection and food safety.

Do you find it unlikely that anybody could be both that depraved and that shallow? Then make note of the strained and disjointed statement that had been tacked on, as if in summary of the prior collage of statements: “If we want to find the solution

Really and truly I am a fan of optimism. I could watch Tantalus and Sisyphus all day, but the time and place for blind optimism and experimentation is where and when those things do not directly entail lethal consequences. The lethal payoff from the decades of self-regulation in the building codes of Haiti alone should be sufficient example for anybody. A few other very good examples of public administration of high standards paying off would be .... well, recorded history.

One need not know or care what size of government the columnist would find ideal; a much more impactive query would be finding what size interweb the columnist has on her computer. Her collection of very sloppily conjoined sentences even included the claim: “Not much is known about the long-term effects of consuming food that contains GMOs.” OK, just let that sink in, while you look up just how many different countries have banned them completely, and for what particular reasons.

Our esteemed author continues along, with the admission: “But there are other concerns to take into consideration such as the reduction of genetic diversity—which makes plants more susceptible to outside forces such as invasive species, drought and insects—and the over-use of pesticides and herbicides.”

I’m at a loss for sufficient fluency to adroitly summarize the lesson which Chanelle Bessette has so very clearly supplied to us, so I’ll leave that singular honor in the dominion of a paraphrase from a popular local columnist: “Perhaps it’s time that some of us abandoned the belief that shilling for Monsanto is the answer.” flombaye krishnabob ellison Reno

But, have you noticed the garbage lately? I’m not blaming Bob—he just calls them the way he sees them. It’s Hollywood that is at fault for giving us movies like The Internship, White House Down and now The Lone Ranger.

Yes, there are still a few good movies, like The Bling Ring. I loved that one, but Hollywood is not doing its best. I’m so glad that I have a nice collection of videos that I can watch anytime I like. Films like Butch Cassidy and the Sundance Kid, The Wizard of Oz, One Flew over the Cuckoo’s Nest, Singin’ in the Rain, Young Frankenstein, Crocodile Dundee, The Good, the Bad and the Ugly, and From Russia with Love.

Come on, Hollywood, get with it!

The truth hurts Re “The Awful Awful truth” (Arts&Culture, June 27): Funny that the online commenting instructions say to “be nice.” Dennis Myers seems annoyed by his assignment to offer “an investigative look” at Awful Awfuls and wasn’t exactly nice about any of them. Really, Mr. Myers? Awful Awfuls don’t deserve all the fuss the “publicists” have stirred up? Do you think there is some sort of conspiracy? That Awful Awfuls have publicists? Awful Awfuls are an icon. They remain an icon because of what they are. People don’t show up day after day, decade after decade to eat them because they are bad. Yes, they differ from one restaurant to the next, but that seems to add to their mystery and appeal. And, no, they are not like other hamburgers—that’s why they are Awful Awfuls. Mr. Myers’ final comment recommending two nonAwful Awful establishments does not add to the investigative look. It’s just more whining. Also, why do we need three pictures of Mr. Myers in this article? I’d far prefer three pictures of the food he is complaining about.

Give ’em hell, Jenny Jenny Brekhus is a breath of fresh air on a Reno City Council that is seeing some much needed new blood due to term limits.

Her claim to fame? Asking lots of questions about agenda items, large and small, and quesby tioning time-honored privileges Sheila Leslie of the good ol’ boys who have run the Council like a fiefdom for many years, and who see any challenge to their positions as an insulting personal attack.

During the Legislative session, the councilwoman was in hot water with the mayor and most members of the Council because she refused to endorse the fight against ward voting, and in fact, was quite open about her reasons for believing council members should be elected by a specific ward, not city-wide.

The latest scrape between the councilwoman and the mayor was over the mayor’s authority to issue proclamations, a privilege he has used at times to advance his own views despite the City Charter’s direction that he is to issue them when there’s an emergency or for ceremonial purposes only.

The Reno Gazette-Journal posted the entire discussion in the Reno Memo blog under the helpful title “The interpersonal state of the Reno City Council in one discussion.” It’s a fascinating and revealing glimpse into the dynamics of our current City Council.

Brekhus states the Council has received a confidential attorneyclient memo from the city attorney on the issue, which is not available to the public. She says she’s not allowed to reference the memo’s content, effectively shutting down her ability to have a productive public discussion.

Setting aside the question of what on earth could be so confidential about issuing proclamations that a secret memo from the Council’s attorney would be needed, the discussion quickly detours into a lecture from Councilman Dortch who says, “It’s amazing that this is really this big of a deal … it’s a little ridiculous.” Others chirp in the background, egging on his rude behavior, denigrating Brekhus for even raising the concern.

Even Deputy City Attorney Tracy Chase manages a disdainful tone, as if she’s patiently explaining the family rules to a recalcitrant child for the 10th time.

Brekhus tries valiantly to get her colleagues back on track, repeatedly assuring the mayor her intent is not to challenge any particular proclamation, but rather the mayor’s unwritten authority to unilaterally use them to promote his public policy priorities. She suggests the Council should codify the unwritten practice in its rules or charter to clarify how and why proclamations are issued.

Everyone ignores this suggestion, and the mayor explodes as he insists she is personally attacking him, whining it’s because “You don’t like what I do.”

In a final petulant display of animosity, Councilwoman Zadra who doesn’t engage in the discussion at all, is recognized by the mayor. She tells Brekhus in a disrespectful and snippy tone of voice: “If you have a motion, we’ll see if you have a second.”

Hang in there, Councilwoman Brekhus. There’s another election soon, and Reno voters will have a chance to elect a new mayor and replacements for Dortch and Zadra.

Let’s get some more like Jenny Brekhus. Ω

Invest your privacy in drones Economic recovery meets governmental opportunism in a developing twist on one aspect of the Nevada job market. While the military bases in Nevada have hosted drone operators for quite some time now, there’s a strong possiby Chanelle Bessette bility that drones—unmanned aerial units—will become more and more popular, and this puts Nevada in a unique position. In a June workshop in Las Vegas that involved the Nevada System of Higher Education, there was a surprising item on the agenda: the possibility of a drone degree program at both the University of Nevada, Las Vegas and the University of Nevada, Reno.

Growing interest in an expanded military and governmental drone industry in Nevada has sparked controversy over the ethics of drone use. On one hand, drones require less manpower to operate and therefore save money. In addition, military drone used overseas can limit the number of overall casualties and American troop deaths while still being strategically effective.

On the other hand, however, drone usage is a coldly impersonal method of killing that can result in large numbers of civilian casualties as well as unjust murder. Domestic drone use, while reportedly only used in cases of hunting down criminals, can ultimately be an infringement on the privacy of honest U.S. citizens as well. Who’s to say that Edward Snowden won’t be deemed an enemy of the state and murdered in an overseas drone strike? Who, besides military and government authorities, has a voice in the “justice” that drones provide?

Clearly, drones do not provide the checks and balances of a fair trial that U.S. citizens are guaranteed in the Constitution, and, indeed, there seems to be a certain amount of information suppression about the process of ordering drone strikes. Such a devil-may-care method of eliminating enemies of the U.S. is dangerous and sets terrifying precedents for governmentordained punishment.

Drone legislation will become increasingly important and complex. Much legislation will involve the following issues: the necessity of search warrants for drone surveillance, laws limiting or prohibiting weaponized drones, legal retaliation for private individuals who have been aggrieved by drone law transgressions and laws that allow the use of drones in emergencies. There’s no denying that the technology and skill that goes into the use of drones is amazing, but, like most tools of warfare and spying, there is not enough transparency from those who control it.

Sen. Rand Paul’s filibuster about drones in March of this year brought the issue into national limelight, but it’s the American people who have kept it there. Drone usage, in conjunction with the revelation of intensive National Security Agency surveillance programs, has people abuzz with concern about the violation of basic rights and privileges. In light of these issues, this year’s Independence Day was slightly sobering. In an increasingly advanced technological and globalized world, threats to life and liberty are ever-present if we do not keep vigilant. Ω

the calls. After several days of this, she received a message on her answering machine from Techhart, saying that she needed to call them back regarding an urgent matter.

So I called them. A man with a thick accent answered.

“Hi, my name’s Jimmy Boegle, and I’m calling on behalf of my mom. You left her a message earlier today.”

“Oh, yes,” the man responded.

“We’re her computer techs, and we want to make sure that her computer’s OK.” When I informed the man that Mom did not need a computer tech, and that they’d lied to her about all sorts of things, he hung up. I tried calling back a couple of times from the same phone; there was no response. Therefore, I called from a different phone (my business line), and he answered.

“Hi. This is Jimmy Boegle. I think we were just cut off …”

One of the jobs of the state attorney general is to protect Nevadans from fraud, and warn them of fraud attempts. Well, at least it used to be.

While my mom seems to have escaped unscathed—I had a couple of tech-savy friends check my mom’s PC, and it appears OK—not everyone has been so lucky, as those aforementioned Google searches suggest. Therefore, my mom and I decided to file a complaint with the state Attorney General. After all, one of the jobs of the state AG is to protect Nevadans from fraud, and warn them of fraud attempts.

Well, at least it used to be.

I called the Secretary of State’s Bureau of Consumer Protection Hotline ((702) 486-3132)—and was stunned by what I heard. An automated phonesystem recording asks callers to press “0” regarding mortgage fraud, and to press “1” to file a complaint about other fraud cases. So I pressed “1.”

This is what I heard: With regard to fraud, other than a mortgage-related or foreclosure rescue issue, please be advised that due to budget constraints and limited resources, we are no longer able to reply to and investigate every submission to our division. Moreover, the attorney general cannot act as your private attorney. Therefore, we encourage you to proceed through other avenues, such as the Better Business Bureau … or small claims court …

Let me repeat that: The state AG’s office encouraged me to call the Better Business Bureau, a nonprofit with no legal power, and/or file a suit in small claims court. The recording contained no information about how I could even try to file a complaint with the AG’s office.

The recording did go on to recommend that people look for help at the fightfraud.nv.gov website. I checked out the site, and it predominantly consists of links to various news stories about fraud. There was a contact phone number, so I called, and a polite woman said that since the AG’s office only pursues mortgage or foreclosure cases these days, the only thing I could do was file a complaint with the Federal Trade Commission.

So I did. The FTC rep didn’t ask about anything beyond the most basic details of the case; basically, he took my information and my mom’s information before giving me a case number.

Oh, and one more thing: He gave me the number for the Nevada attorney general’s office—the number with the aforementioned automated phonesystem recording—and encouraged me to file a state complaint, too.

I really would like to file that complaint, so I could help the government spread the word about a possibly dishonest company. But I apparently can’t.

It’s open season on Nevada’s vulnerable citizens, and the Nevada Attorney General’s office says it’s too broke to give a shit. Ω

If you or someone you love has been the possible victim of fraud in the state of Nevada, by the state Attorney General’s office is Jimmy Boegle too broke to care.

That’s the unfortunate lesson I learned after my mother—a lifetime resident of Northern Nevada—was the victim of an attempted scam.

Mom was checking email at her computer on Tuesday, June 25, when she received a phone call. A man who said he was calling on behalf of Microsoft, via a company called Techhart Solutions, gave her bad news: Her computer was sending error messages, apparently as a result of a malicious computer virus. To “prove” this, he directed my mother to a log that, she says, seemed to show that her computer was indeed sending error messages. Angle vs. Reid redux Sharron Angle, the Republican candidate against U.S. Sen. Harry Reid in 2010, has not given up pressing some of her losing issues from that campaign.

In a recent online essay headlined “Does Harry Reid’s fortune come from illegal activity[?],” she recalls that in a 2010 campaign debate she asked Reid, “You came from Searchlight to the Senate with very little. Now you’re one of the richest men in the U.S. Senate. And on behalf of Nevada taxpayers, we’d like to know, how did you become so wealthy on a government payroll?”

As noted in our Newsview blog at the time (http://tinyurl.com/ p24nrvw), Reid was wealthy as an attorney before he went to D.C. Angle revived this matter in order to try to link Reid to Harvey Whittemore, recently convicted for making illegal campaign contributions to Reid. But she offered no actual information to make her case. Like the 2010 debate and the title to her essay, she uses questions filled with emotionally loaded terms to suggest things she does not otherwise substantiate: “Was the $150,000 a payback? ... Does ‘the fix’ go deeper? ...

Who else owes Reid? Would candidate campaign reports containing the name ‘Whittemore’ be revealing?”

Paradoxically, she also asks a question that attacks Reid for asking questions: “Does Reid pass the smell test or just raise more questions?”

Sandoval ranked by jobs

Nevada Gov. Brian Sandoval has been ranked so-so by a business magazine for his job creation record.

Business Journals said the state had 970,600 jobs when Sandoval took office on Jan. 3, 2011 and now has 1,007,600.

The publication thus places Sandoval at number 25 out of 45 governors. Five new governors who took office this year were not ranked.

The magazine reports that the other 49 states have created private sector jobs at a 1.98 percent rate since Sandoval took office, but Nevada has done so at a 1.62 percent rate. For public sector jobs, the magazine used raw numbers instead of percentages and they show Nevada lagging behind SANDOVAL other states in creating public employee positions by minus-8,400. However, the magazine said the “overall rankings for this study are based on the difference in private-sector employment growth rates.”

Atkinson added, “We need more long-term strategies to create the environment for economic development. The legislature’s hands are tied when it comes to tax policy. They can’t do anthing except cut taxes.”

College president leaves, but first has her say Western Nevada College president Carol Lucey fired a shot heard around the state and even the nation last by week, resigning with a denunciaDennis Myers tion of Nevada public policies that have ravaged higher education.

Lucey, a physicist and mathematician who has run the community college serving seven Nevada counties since 1999, said political leaders failed to keep their promise to do no further harm to the two northern community colleges at the Nevada Legislature this year.

“We’re doing things I don’t feel good about and we shouldn’t have to do,” she said in an interview with Swift Newspapers.

“But I just don’t see a good future.”

Carol Lucey, Western Nevada College president This year’s legislature cut her campus by 5 percent in the first year of the biennium, followed by 7 percent in the second year.

That comes on top of cuts by the 2007 and 2011 legislatures. A new funding formula shifted money to southern campuses.

“You know what the last straw was?” Lucey told Swift’ Geoff Dornan. “Them saying there’s no money left and then Nic Cage getting what he got.”

Actor Nicolas Cage won enactment from the legislature of a tax break for moviemakers on a claim that the subsidy would generate economic activity, a claim challenged by Carole Vilardo of the Nevada Taxpayers Association.

At a legislative hearing earlier this year, Lucey said that one of the reasons she took the post of WNC president was because of the role of higher education in economic development and—in Nevada—economic diversification beyond gambling. She said she has worked hard on it.

“I’ve been president at WNC for 14 years,” she said. “When I came to the state, I was very excited by the desire to be part of diversification of the Nevada economy.”

WNC works with outfits like the Northern Nevada Development Authority and Churchill Economic Development Authority.

But the Legislature has been cutting higher education budgets deeply since 2007, with the result that other small states have leaped ahead of Nevada in attracting new companies. Lucey’s comments have been widely published in

national forums like the Chronicle of Higher Education.

Lucey’s resignation and comments are likely to fuel an effort that had already been developing to shift policymaking for community colleges from the state level to the communities they serve. The practice of governing community colleges with a state board, as in Nevada, is not the practice in all states.

In addition, some educators and businesspeople hope that local communities will be more financially supportive of the colleges than the state has been.

In an interview with the RN&R, Lucey said she supports that notion. A stronger local base for the state’s community colleges would be more in keeping with what other states do, she said, and if current statewide policies prevail, the colleges won’t survive.

“I hope [that the colleges will be decentralized], because otherwise there won’t be colleges outside the urban areas,” she said. “Unless the funding process changes the colleges won’t survive, and I don’t think the funding process will change unless the governing process changes.”

Western Nevada College serves counties in western and central Nevada—Carson, Douglas, Churchill, Lyon, Storey, Mineral and Pershing. It is based in Carson City and also has campuses in Fallon and Minden. The Minden campus is on land provided by the high tech firm GE Bently and is adjacent to that corporation’s plant. (Great Basin College in Elko serves counties in the eastern region.)

“We also have [or] had rural centers in all the smaller communities of our service area, where we offered classes in person, via interactive video from the campuses, and online,” according to WNC spokesperson Anne Hansen. “Those rural centers have been closed or nearly closed due to the budget cuts, leaving multiple communities with little or no access to higher education. Even online learning can be difficult from these areas as not all communities have high speed internet required for course delivery, and many homes don’t have computer capabilities at all.”

program at WNC. Amazing, but certainly not something most people can manage. We also are the college that serves Lyon County, which has had the highest level unemployment for much of the economic downturn, along with a very low college-going rate.”

Though campus funding was not Lucey’s only reason for resigning, her comments are unusual.

Compared to other nations, the United States does not have a strong tradition of protest resignations.

In their book Resignation in Protest, Edward Weisband and Thomas M. Franck wrote that for high level appointees, to speak out is to breach an elite loyalty code.

After two U.S. officials resigned in 1996 to protest the Clinton administration’s welfare policies, Weisband said the “public would be well served if our system would allow officials to resign and go public more often when they felt deep disagreement on principle.”

In Nevada such actions have also been rare.

In 1953, Walter Van Tilburg Clark resigned as a University of Nevada lecturer to protest policies of campus President Minard Stout.

In 1956, 14 members of the North Las Vegas Police Department resigned in protest over the firing of the police chief and a captain.

In 1960, Reno Police Department night matron Pat Fladager resigned in protest against the firing of chief Bill Gregory and said several officers wanted to do the same but could not financially afford to leave.

In 1965, after he requested 44 new positions and the Nevada Legislature gave him none, highway patrol chief Robert Stenovich resigned.

She went on, “It’s a lovely, lovely college. Students succeed here. We’re doing a good job with our businesses to get them good jobs. But I just don’t see a good future.” Ω

W H AT H A P P E N E D T O T H E M ?

by Dennis Myers Story ideas can come from the most unusual places. I don’t remember why exactly, but one day I was reading the Nevada enabling acts—the language enacted by Congress to make Nevada a state—and there it was, toward the end in section 7 (see above), a land allocation that, a little digging told me, meant that Nevada was given a 4 million acre land trust to pay for schools in perpetuity.

Wha—?

Why had I never heard of this? How many legislative budget hearings have I sat through? And if the state has 4 million acres generating revenue for schools, why are the schools perpetually starved for money?

As it turned out, the answers were not as simple as the questions. And it’s not a happy tale. In a century, Nevada’s 4 million acres became slightly fewer than 3,000.

The idea The custom of land trusts for schools goes back to the early days of the republic and before. It was a practice imported from Europe and ancient times. It began in the United States during the Confederation and continued under the Constitution. The

former British colonies created their own school lands trusts, and some states were not included for various reasons (several states were spin-offs from existing states, Hawaii entered the union with all its unallocated land already in state hands). But 30 states received school trust lands until 1959 when the 50th state was admitted, by which time 134 million acres of federal and state lands had been placed in trust for schoolchildren.

New states received land that would be held in trust and used to generate funds to pay for schools. The Land Ordinance of 1785 and the Northwest Ordinance of 1787—which provided procedures for admitting new states in the Ohio River and Great Lakes region—made it U.S. policy. Although Nevada’s lands inventory calls them “grant lands,” in fact, they were not granted to Nevada. Nevada does not own them. It is the trustee for them.

States can sell the land, and Nevada has done a good deal of that, but the money earned from the sales does not belong to the states. It must go into the states’ permanent school funds forever, held in trust for the state’s schoolchildren. In Nevada, that trust was upheld by the Nevada Supreme Court in 1875.

The model was influential, and some states even used their own resources to increase the lands that fed into the school funds. When northern Mexicans revolted and created the

Republic of Texas, they set up a school lands trust of their own.

Sell-offs, incidentally, were not particularly successful when compared with states holding onto the land. “In no instance have Permanent School Funds outperformed the growth in the value of the original land grants,” according to a report issued in February by Utah’s Center for the School of the Future.

In new eastern states, the land was usually relatively flat, and they received one parcel of land per township, but as the nation’s boundaries moved west into desert and high mountain terrain, the usable land from that formula was more limited. As a result, in 1850 the land entrusted to upcoming new states was doubled.

In some places the school lands were treated with respect and managed with care. But though the U.S. government then was more restrained in imposing strings and conditions on the land trusts than is the case with current federal aid to education, there were some precautions taken in anticipation of trouble. Early on, there were concerns about land speculators and such problems, so language was written into most state enabling “WHAT HAPPENED acts governing management of the lands. enabling act read, “But said lands may, under such regulations as the legislatures shall prescribe, be leased for periods of not more than five years, in quantities not exceeding one section to any one person or company; and such land shall not be subject to pre-emption, homestead entry, or any other entry under the land laws of the United States, whether surveyed or unsurveyed, but shall be reserved for school purposes only.” The Washington Act also put conditions on the sales of trust lands.

Fatefully, no such language was included in the Nevada enabling act.

Nevada’s ploys The way the system worked when Nevada entered the union was that a state received parcels 16 and 36 in every township as school trust lands.

A township is six miles by six miles and contains 36 sections. In Nevada, according to Columbia University education scholar Fletcher Harper Swift, that worked out to 3,992,000 acres. (Arizona, New Mexico and Utah, because of their arid climates, received four sections each. It is not known why Nevada was not included in this group.) These lands, when used to generate revenue for schools, were tax free—that is, federal fees and royalties were not collected on the lands.

The second Nevada constitutional convention included language in the Nevada Constitution providing for a permanent school fund to receive the earnings from the trust lands, as well as to receive money from several other sources (criminal fines, estates escheated to the state, a percent of certain additional land sales, 2 percent of toll charges).

The first thing that reduced Nevada’s share of trust lands, other

than straight sales that were small in number, was dissatisfaction by state leaders with the designated lands. The state sought to exchange them for better lands, though they were not actually well informed on what the existing lands were because so little of the state had yet been surveyed. In other words, they didn’t know everything they were giving away. And Nevada was seeking a remedy for a problem that, from the federal point of view, had already been remedied by doubling the amount of land given to western states. So Nevada officials agreed to accept 2 million acres of federal lands of their choice. If this arrangement was allowed, Nevada—and only Nevada—would be getting a deal no other state was given, and there was objection to it on the floor of Congress. Nevada, after all, was trying to circumvent the planned randomness of the township program that every other state complied with. But by that time Nevada had sold 70,000 acres and realized little if any income from the rest, and Congress approved the exchange. No other state ever got a similar deal It wasn’t a terrible idea, exactly, but Nevada officials had not planned well or anticipated what lands would be available. They wanted land that could be used for agricultural reclamation, but the exchange legislation was not enacted until 1880.

“One problem was that the best land—land you could irrigate along the Truckee River or the Carson River—was already gone by that time,” said historian James Hulse last week. “So Nevada made a bargain that didn’t really do it much good.”

In addition, reclamation in desert states like Nevada was never a success, in the sense that it never performed up to predictions and expectations. It used more water

than expected to create less fertile land than expected. Nevada’s Newlands Project never reached its planned size and production.

As the years passed, state officials—who soon rued their decision and had a habit of carrying grudges against the feds (such as unreimbursed costs of attacking Nevada tribes)—began to grumble about the 2 million acres lost (1,992,000, to be exact). And buyers of the 2 million acres held by the state had a habit of defaulting on their purchases. That made some state officials say that the trust lands—the ones actually chosen by themselves or their predecessors— were deficient.

Yet in 1926 Congress went along again, allowing Nevada another exchange, this one of 30,000 acres for supposedly choicer lands.

It’s not clear whether members of Congress realized that Nevada was planning to use the 30,000 acres for non-school purposes, but that was the case. A plan to create state parks and other non-school related facilities with the new acreage was torpedoed

by Nevada’s attorney general.

For years the state kept trying to get more land to replace the 2 million acres it had given up, but after the 1926 exchange of 30,000 acres, Congress was finished trying to satisfy the nuisance state, though Nevada officials continued making appeals to Congress at least into the 1980s. (It apparently did not occur to Nevada officials until much later to try the more sound tactic of trying to qualify with the other three states as an arid region entitled to four sections per township.)

Sticky fingers The post-colonial concern about misuse of the school trust lands was not unfounded. Officials in a number of states missed, winked at, or themselves engaged in, improper activities involving the lands.

In Nevada, state legislators were among those who used inside information to buy trust lands. Within a $106,000 embezzlement discovered after his death, State Treasurer Eben Rhodes stole $30,000 from school land trust funds generated.

After the attorney general disallowed the use of the 30,000-acre allotment for state parks, officials quietly went ahead with the plan, anyway. No one knows how much money was lost to the Permanent School Fund.

On at least two occasions, including following the Eben Rhodes scandal, the state balanced the state budget by borrowing from the school fund and then repaid the money with tax-backed bonds. Columbia’s Swift wrote, “To use the moneys belonging to the principal of the permanent school fund and then tax the people for the interest is a direct violation of one of the purposes for which the permanent school fund was

established, namely, the lessening of taxation.” It also violated the Nevada Constitution, which pledged that none of the trust lands or income derived would be used for any other than school purposes.

The problem of shaky management was well enough known that the elected office of Nevada surveyor general was in poor repute, and there were attempts to shut it down. The surveyor general administered state lands. In 1937, Churchill County Assemblymember Claude Smith’s legislation to abolish the office, endorsed by Gov. Richard Kirman, nearly passed. In 1954 Nevada voters approved a measure changing the office of surveyor general from a constitutional to a statutory office, making it easier for the legislature to eliminate the office.

That should have telegraphed a message to incumbent Surveyor General Louis Ferrari, but another experience that reduced Nevada’s acreage followed—a 1955-1957 scandal when Ferrari was the target of a grand jury investigation into sweetheart sales of land, particularly in the state’s new growth area of Las Vegas, in collaboration with state legislators. The Legislative Commission, with the assistance of Ormsby County District Attorney Cameron Batjer and grand jury foreperson E.H. Hiller, prepared for impeachment (recommended by the jury) of Ferrari by the 1957 Nevada Legislature. In the end the lawmakers stopped short of impeaching Ferrari, settling for finally abolishing his job, which went out of existence on July 1. The legislature then shifted administration of the trust lands to

the Nevada Division of State Lands, where it remains today, and management of the income is handled by the state treasurer with accountancy by the state controller. In addition, the lawmakers beefed up the protections involved in the sale of state school trust lands.

During the Richard Bryan administration, state lands division director Pam Wilcox and her aide Bob Stewart discovered, according to one official, what had been kept out of public view for five decades—that someone had eventually gone forward with the illegal 1920s plan to use school trust lands for state parks and for some other purposes, such as the Nevada dump for chemical and low-level nuclear wastes at Beatty, definitely a revenue-generating property. Once it was discovered the legislature approved the sale of some of these properties. The funds realized were placed in the Permanent School Fund. A state spokesperson said the full amount lost has been made good to the fund. Wilcox could not be reached for comment.

Legacy In 1911, Fletcher Harper Swift found that that only a third of the trust lands remained in state hands. “In many states the permanent funds and the proceeds which should have been added to them have been so carelessly diverted, squandered, wasted and embezzled so shamefully, that what ought to be a magnificent endowment ... has dwindled to an almost negligible sum,” he wrote.

Few states have as poor a record as Nevada. What remains of

Nevada’s schools trust lands is 2,914 acres. According to state lands division official Charles Donohue, “The principal revenue which is generated from these lands is in the form of land leases and land use fees that have generated approximately $19,000 annually over the past two fiscal years.”

Most counties no longer have any trust lands (see box, facing page). Washoe County has most of the remaining acreage.

Most of Nevada’s land was sold off, and the money realized was supposed to go into the Permanent School Fund. We have not been able to identify what percentage of that fund, which last month was $320 million, originated with those sales.

“That cash is in our investment pool with which we purchase securities,” said Catherine Eyrne, an accountant in the state controller’s office. “It becomes part of that pool. We don’t really distinguish between land sales and any other sources.” And because the state is engaged in land sales that do not involve trust lands, the picture becomes even more difficult to make clear.

Among small Western states, none has a worse record than Nevada for holding onto its original trust lands. The trust lands held by Arizona, Montana, New Mexico, Utah, Wyoming and Idaho are all in the millions of acres.

As already noted, those states that cashed out their trust lands did not earn greater dividends, and in addition, Utah’s Center for the School of the Future reported, “Many of the states that have made this conversion have used the funds for short-term needs, thereby losing the trust’s potential to benefit future generations. … However, turning back the clock would be difficult.

Those lands, of course, would lack one important feature—no additions to the state funds would enjoy the tax-free status of the original trust lands. Nevada can never regain that advantage. Its trust survives only in its 3,000 original acres.

The school lands trust stands out among federal initiatives on education. Not until the post-Sputnik enactment of the National Defense Education Act of 1958—and never since then—would the feds be so generous with states schools, and never with so few strings attached.

In many states—particularly the early, eastern states—the trust lands and funds were often treated with high regard and even reverence.

The record in Nevada was spotty.

There is no missing the message in the numbers showing Montana retaining 4.6 million acres of its trust lands and Wyoming 3 million and Idaho 2.1 million, while Nevada has 3,000. The Nevada trust lands were treated as something less than a trust. Ω

But protecting the current holdings and looking to build for the future is something we can and must do.”

Rebuilding the trusts in various states usually means doing better with the remaining land and then providing other income streams for the permanent school funds.

The Utah Center has a full strategy for states to follow. As already mentioned, some states have added lands to the lands they received

If you haven’t seen them live, there’s a good chance you’ve stood in front of one of their fliers on a telephone pole trying to figure out how to pronounce their name (ky-zer soh-zay).

“We’ve been around since ’98,” said vocalist and saxophone player Jammal Tarkington on the patio of a downtown bar.

That 15 years makes them one of Reno’s most established bands.

For those unfamiliar with them, Keyser Soze is a ska band with strong hip hop and soul undercurrents.

They’re known for their catchy, hornladen songs, seasoned by many of the members’ background in jazz groups.

Despite the nearly 15 years under their belts, Tarkington said it was a slow beginning—mostly because they went through several drummers in the first six or seven years.

After they locked down a solid drummer, they really took off.

They’ve since spent a lot of time playing both local shows and touring the U.S. But this May, they branched out.

Keyser Soze toured Europe for the first time.

The band members said the shows were great. Vocalist and trombone player Rodney Teague said the band was regularly playing in front of crowds between 100 and 200 people.

And, he added, even the smaller crowds were great.

They played in Lodz, Poland, to a small but enthusiastic crowd that was overwhelmingly supportive. The crowd not only danced during the show, but bought T-shirts and, more importantly, hung out afterward.

“That’s what it’s all about, making connections with people,” said Tarkington said, citing another night when the band hit it off with an Italian promoter. “He set us up with a show in Vienna. It’s incredible to play in a city with such musical history. And so when he told me he wanted to go surfing in California, I told him I’d take a few days off and bring him down.”

To Tarkington, making friends with fans and promoters also reminded him of the parallels between cities half way around the world.

“What the kids were doing in Poland was a lot like what kids are doing here. We have a friend out there who reminds me a lot of my friends here at the Reno Bike Project or the Holland Project … A bunch of kids just trying to get involved in their own scene and it’s cool to see them doing the same things.”

A band abroad In short, Tarkington said the tour was going great.

“We were riding it. Having the times of our lives over there.”

But it wasn’t all good.

When the band returned to Reno, they only had homemade versions of their new CD with “Keyser Soze, The Remedy” written in Sharpee.

“Sorry,” he explained, “We don’t have any of the hard copies anymore.”

The band was robbed in Kosice, Slovakia.

“It was super late at night.

Between like 4 and 6 a.m. … somebody woke me up and was like, ‘Man, there’s a hole broken in your van window.’”

Somebody had stolen all of their merchandise.

This was a big blow, considering the band’s large dependence on merchandise sales for gas money. It was toward the end of tour, so they were able to keep going without anything to sell.

But not only merch was taken—the thief had also grabbed Tarkington’s personal record collection, which he was carrying on the road with him. As DJ Stax of Wax, he spins records, sometimes doing so between sets at Keyser Soze gigs.

“It was such a bummer,” he says.

“A lot of those records I had spent 10 years looking for, and had just found them.”

Forage: A Roaming Gallery At the risk of lapsing into the sort of boosterism that we here at the RN&R despise, we’d like to by reiterate one of our favorite things about the Brad Bynum Reno community: the spirit of collaboration that exists among the city’s creative class. bradb@ newsre view.c om There’s lots of evidence of this: the collaborative art spaces, like Reno Art Works, the Generator and Valley Arts Research Facility, and events like Nada Dada and, yes, Artown.

This is the fourth year of the event organized primarily by the Holland Project, a nonprofit all-ages arts organization.

This year, Forage spans five locations: the Holland Project, Lost City Farm, Idlewild Pool, Hub Coffee and the Nevada Museum of Art. The locations are linked by a bicycle route through the city.

“We call it Forage: A Roaming Gallery or Forage: A Celebration of Bikes, Art, Music and Film,” says Holland Project director Britt Curtis.

And oddly appropriate for an event held in the desert at the height of summer: This year, the event has a nautical theme.

(Because art is fantasy, and who hasn’t fantasized about jumping into the ocean during some of the triple digit days this summer?)

The event is so sprawling and multifaceted that what follows is an incomplete picture, but it’s at least a sketch of the general idea.

It starts at the Holland Project, 140 Vesta. St., at 4:15 p.m. on July 20. The building itself will be decked out to look like a ship. Inside will be a coral reefthemed art installation made primarily of wood and acrylic yarn by local artist Kelly Ogilvie. She says that working with the grant-required coral reef theme was creatively inspiring.

“I find it’s much easier to come up with ideas once you have some kind of parameters already laid out, some kind of boundary, or some kind of need to fulfill,” she says.

At Holland, there will also be a Pyramid Lake-inspired sound sculpture, and a nautical knot-tying workshop.

At Lost City Farms, there will be a shipwreck sculpture made by the Generator artists using elements from the similar piece they built for last year’s Burning Man festival. There will also be what Curtis describes as a “last man on the island lemonade stand.”

At Idlewild Pool, 1805 Idlewild Drive, there will be, obviously, a swimming pool—all too important for a nautical themed bicycle art event in the middle of the summer. Photographers Lindsey Hemphill and Dane Haman will be shooting

underwater photography.

There will be an amateur group of synchronized swimmers, and a Ramones cover band featuring members of the local group the Pelvis Wrestlies. There will also be cardboard boat sculptures designed by local artists.

At Hub Coffee, 727 Riverside Drive, there will be sea shanty stands, run by different local artists, with fake pirate tattoos and cosmic messages in the bottles.

Finally, the tour wraps up on the roof at the Nevada Museum of Art, 160 W. Liberty St., around 7 p.m. There will be food trucks, bike valet by the Reno Bike Project, a DJ, and a cash bar. Artists Michelle Lassaline and Nate Clark will do a performance piece.

After dark, there’ll be a screening of the film Godzilla vs. the Sea Monster, with an original score performed by the Reno Video Game Symphony Orchestra and members of local bands like Spitting Image, Prescription and Actors Killed Lincoln.

So, it’s a big event with a lot of people involved. Be careful not to get lost at sea. Ω

I’m a big fan of seafood and getting it fresh, especially raw, is always a challenge in Reno. Pearl goes to a great extent to make sure fresh is a certainty. I started with the seafood melody ($14.50), consisting of a four each of jumbo shrimp, crab claws and shucked oysters. A cocktail sauce, good, straight horseradish, and a jalapeño tomato salsa were for dipping. Very fresh, not overcooked crab or shrimp, and the sauces were spot-on adding whatever kind of “spicy” lift I wanted to the trio.

A dungeness crab cake ($13.75) was next, and this was a hunk of crab the size of a burger. Simple seasonings, chives, a little Old Bay—a widely used seafood seasoning with mustard, paprika, celery salt, bay leaf, black pepper, crushed red pepper flakes, mace, cloves, allspice, nutmeg, cardamom and ginger—then naturally coated with Panko, then pan-fried to golden brown. It was served atop a bed of Asian ginger slaw with wasabi aioli and sweet, hot vinaigrette.

This was easily a light meal in itself. The crab meat was very generous and moist, and the vinaigrette was light, made with rice vinegar and featured flavors of soy, sesame and ginger. The slaw was a great bed, with tart, crispy oriental flavor.

I had to experience a pan roast since that’s one of my all-time favorite seafood delights. I usually prefer something so rich and heavy in colder weather, but I carried on. There are six on the menu. I had the ultimate combination pan roast ($18.50), with crab, scallops, mussels, clams, oysters and shrimp.

The sauce—butter, white wine, paprika, celery seed, clam juice, a squeeze of lemon, Worcestershire, Tabasco, cocktail sauce and, the kicker, heavy cream. This liquid velvet drenched and coated the seafood adding just enough bang to the many textures. The rich flavor had a bit of salty-tartness that was quickly displaced with the creamy butter theme. Extraordinary, but an occasional treat because it is so rich and has calories in the six digit range.

A congenial staff dressed in the traditional oyster bar white, mid-waist coats. There are high top and standard tables set with proper linen napkins. There’s a full bar with seven signature cocktails ($5.50-$7.75), a half-dozen craft beers ($7-$18), a half-dozen oyster shooters with assorted, infused vodkas, and a modest, but well thought out, list of a dozen wines.

All but one were available by-theglass ($5.25-$16).

My eyes went right for the Ferrari-Carano 2010 Bella Luce ($6.75), a unique, white wine blend of Chardonnay, Sauvignon Blanc and Muscat Canelli. This fragrant and light white wine has refreshing acidity that is made from varieties that complement one another in aromas, flavors and texture. Bella Luce has delicious layers of Muscat, honeydew, orange, lychee, pineapple, peach and apple, along with lingering cream, vanilla, lemon and a floral finish. It holds up to all this assortment of seafood.

At the end of the day, what Pearl has done is present some very decent shore food that has connected the diner with the chef, the oyster grower, winemaker and fisherman, making it a true dining gem. Ω

Pacific Rim Gigantic alien beasts get their asses handed to them by robots that don’t turn into trucks or cars in Guillermo del Toro’s alternately exhilarating and stale Pacific Rim. This movie is full-on crazy in the head in an often very good, very fun way. This is del Toro’s first directorial project after abandoning The Hobbit, and I’m going on by record as saying del Toro made a good call.

Bob Grimm I had a hard time staying awake during the first Hobbit movie. Such was not the case b g ri m m @ ne w s re v i e w . c o m with this bad boy when the big fights were going on.

It’s the near future, and some freaky beasts called kaiju are rising from the ocean depths and tearing cities to shreds. Do we nuke them? No. That would be too easy.

of hardcore robots that are driven by pilots melding their minds together. It makes absolutely no sense, and I don’t care because it’s fun.

Nearly all of these battles take place in the dark, in the rain or in the ocean. Normally, I would scream “cop-out!” because this is a technique used by directors to cheat a bit on the CGI. It’s a lot harder to create computergenerated monsters for broad daylight than the dark. Even if this is del Toro cheating, it works. Having the battles go down in the dark makes them scarier.

As for the people inside the robots, watching them throw their fists and move their legs as a means of controlling the robots results in something immersive. I felt like I was throwing punches and wielding swords watching them do it. Del Toro puts you in the battles.

Some of those same people throwing

punches at monsters via big robots are a little dull outside of their massive steel shells. Charlie Hunnam, who plays the main protagonist, Raleigh, has one of those movie trailer voices. Every time he spoke, I thought he was going to say something like “In a world where robots beat monsters ...” as if delivering a commercial line. He fails to really distinguish himself in this film. Rinko Kikuchi is fine as Mako Mori, a wannabe pilot with a secret past keeping her from her robot dreams.

Speaking of Mako Mori’s past, it provides perhaps the film’s greatest moment. Del Toro takes us into Mako Mori’s memory as she is running away from a monster in a city street. Experiencing the horror of one of the monsters from the vantage point of a child is powerful stuff, and del Toro makes it an amazing sequence.

For comic relief, there’s Charlie Day as a hyperactive scientist who collects kaiju tattoos. The bespectacled Day is 2013’s answer to Rick Moranis, with his presence here being much like the nerdy Louis in Ghostbusters.

Ron Perlman gets perhaps the film’s biggest laughs as Hannibal Chau, a monster collector who sells their crap for fertilizer. Idris Elba lends his formidable presence as Stacker, leader of the robot guys and deliverer of huge, rousing “Cancel the Apocalypse!” speeches.

Admittedly, when the movie isn’t dealing with roboton-monster smackdowns, it’s a little boring, perhaps even tedious. For those of you looking for a summer blockbuster that delivers the action goods, you won’t mind sifting through the sleepy passages to get to the good stuff.

The kaiju make for great movie monsters because they come in many incarnations.

They look like everything ranging from a rhino to the devil, they spit some sort of plasma lasers that act like acid, and the bastards even fly on occasion.

Pacific Rim isn’t the all-time classic I was hoping for, but it’s good, and in a summer where many blockbusters have faltered, I’m glad to get one that is at least good. If you can catch it in 3-D, do yourself a favor and spend the couple extra bucks. Del Toro shot in 3-D, and it looks great. Ω

Grown Ups 2

Adam Sandler has done it again. He has made the worst movie of his career, yet again, as his films just keep topping themselves in horribleness. This one, a sequel to the Dennis Dugan disaster that joined forces with David Spade, Chris Rock and Kevin James, is twice as bad as the original. Considering how awful the original was, I didn’t think such a feat was possible, but Sandler has done it. The plot involves Sandler moving back to his hometown, where a deer enters his house and promptly urinates on him. Then he goes shopping with his friends who fart and burp a lot. Then he has a big ‘80s party where everybody dresses up as people from the ‘80s (Pat Benatar, Bruce Springsteen, The Terminator). Then somebody farts again, and then the movie is over. I sat in a theater where people were laughing their asses off every time somebody farted. It was one of the more depressing experiences of the movie going summer, and I had to sit through The Purge, so that’s pretty bad. I have officially given up on Sandler. This is a talented, funny guy who can’t seem to say goodbye to some of the people who drag him down. Given the box office performance of this piece of crap, he probably will be giving Dugan plenty of directing jobs in the future. This is our loss.

The Heat

Sandra Bullock might get top billing, and she’s pretty funny in the latest from Bridesmaids director Paul Feig, but, and there’s no doubt about it, this is Melissa McCarthy’s movie. McCarthy plays a vulgar Boston police detective whose world is turned upside down when an FBI Agent (Bullock) starts sniffing around her precinct and meddling in her cases. McCarthy and Bullock are good together, with Bullock taking the obvious, tightly wound route while McCarthy just unloads expletive after expletive. McCarthy is so natural when she delivers put downs in this movie, it’s a wonder she gets along with anybody in real life. The movie does succumb to some of those buddy cop film clichés, and it sags a bit in the middle, but when it’s on, it’s really on. I got a few good laugh-out-loud moments, a lot of chuckles, and a lot of smiles out of this silliness. Considering some of the big budget garbage coming your way this summer, McCarthy and Bullock provide one of the season’s more pleasant movie experiences.

The Lone Ranger

First of all, the movie should’ve been called Tonto, because Johnny Depp’s Tonto is the one being positioned as the main focus of the movie. Second of all, they should’ve never, ever made this movie. Depp reteams with his Pirates of the Caribbean director Gore Verbinski for a weak take on the masked man saga that parodies Westerns without officially announcing itself as a parody.

Depp puts a bunch of crap all over his face to hide the fact he isn’t a Native American, and he plays the role of Tonto for laughs that never come. Armie Hammer steps into the title role, sporting an inconsistent Western movie accent and an annoying goofiness that renders him useless. William Fichtner plays Butch Cavendish, a bad guy that eats people’s hearts, something that doesn’t play well in a PG-13 film. Between Depp’s mugging and Verbinski’s exaggerated directorial style, the movie is as abrasive as sandpaper with broken glass sprinkled on it. Disney had pulled the plug on this one a couple of years ago, thinking that most people wouldn’t be interested in a big budget Western with Depp masquerading as Tonto. Well, they should’ve stuck to their guns, because they were right.

Man of Steel

Director Zack Snyder and co-producer Christopher Nolan reboot Superman, and the result is a little disappointing. Henry Cavill puts on the tights—minus the red underwear—and does little else, giving us the dullest Superman to date. The whole endeavor is an effort to take Superman to darker Batman-like territories, and that’s a big mistake. Superman can be in a dark flick, but he must rise above the darkness, not whine about his mom all of the time. There’s a lot of whizbang in this film, and some of it is impressive, but lots of it is just noise and things smacking into one another. Michael Shannon provides a terrific villain in Zod, while Russell Crowe and Kevin Costner do well as Superman’s two dads. I just couldn’t get into the depiction of

Superman as a joyless, humorless stud. As for Amy Adams as Lois Lane, she isn’t given much of anything to do. This is going to make tons of money, and Snyder is lined up for a sequel already. I hope he gets it right the next time.

Now You See Me

For those of you hankering for another magician movie after The Incredible Burt Wonderstone … here it is! A Vegas magician act called the Four Horseman (Jesse Eisenberg, Isla Fisher, Woody Harrelson and Dave Franco) concludes their show by seemingly robbing a bank in France through teleportation. An FBI agent (Mark Ruffalo) and an Interpol detective (Melanie Laurent) investigate, and we snore. Morgan Freeman is on hand as a man who makes a living debunking magic, as is Michael Caine as a millionaire bankrolling the Horseman. It all amounts to nonsense, with a lot of swirling cameras and stupid fights involving playing cards and paper cuts. The big reveals are silly, and much of what happens on the magic side is never explained. Eisenberg delivers one of the year’s more annoying performances.

This Is the End

Seth Rogen and writing partner Evan Goldberg make a strong directorial debut with this crazed stoner comedy in which Rogen and a bunch of his pals play themselves as the world faces the biblical apocalypse.

When Jay Baruchel comes to LA to hang with Rogen, he finds himself reluctantly attending a party at James Franco’s new house. The Rapture happens, the ground opens up, and a bunch of celebrities go to Hell, leaving Rogen, Franco, Baruchel, Craig Robinson, Jonah Hill and Danny McBride to fight for the leftover Milky Way candy bar. All of the participants are in top form, with the laughs never slowing down. The movie is also a pretty good horror film in its own right, with lots of gore for those of you who like that sort of thing. Among the oddities are Michael Cera as a coke-snorting pervert, Hill getting possessed after a romantic evening with Satan, and Danny McBride eating people. The film is as crazy as anything to come out of mainstream Hollywood in a long time, and a welcomed return to form for Rogen and Franco.

White House Down

Director Roland Emmerich has made watchable, fun trash before (Independence Day, The Day After Tomorrow, 2012).

He’s the new Irwin Allen (producer of The Towering Inferno), and I often get a kick out of his silly disaster movies. This one, starring Channing Tatum as a lawman who happens to be touring the White House when terrorists take over, is a complete bust. It’s too stupid to be fun, and it doesn’t offer enough cool special effects devastation to offset the moronic storytelling. (The Capitol getting destroyed is the only memorable moment of carnage.)

Jamie Foxx plays the President, an Obama clone, taken hostage in a homeland terrorist scheme that’s beyond impossible. Throw in a precocious daughter (Joey King) and James Woods doing his James Woods routine and you have a movie full to the brim with useless clichés. Tatum, so much fun in 21 Jump Street, is left stranded in a movie that couldn’t be dumber if it tried, and Emmerich has given us one of the summer’s worst movies and likely biggest bombs.

World War Z

With this, we get two-thirds of a decent movie. The movie has a helluva start, and an even better middle, making it seem like it’s going to deliver the big summer goods.

Then, in its final act, it totally craps out. Too bad, because I was looking to Brad Pitt’s zombie movie as relief from the mediocre big budget blockbusters we’ve gotten this summer (with the blessed exceptions of Iron Man 3 and Star Trek Into Darkness). The much troubled production shows every one of its scars, especially in its bungled, positively ridiculous finale. The opening sequence in Philadelphia is a winner, and the zombies attacking Israel and going nuts on an airplane score good thrills.

The movie doesn’t know where it’s going in the end, and it just sort of putters out. Pitt gives it his best, but the movie seems afraid of itself. A zombie movie with no blood and no ending does not a good blockbuster make.

She books out-of-town acts and tries to pair them with appropriate local groups in an effort to help build connections between local and touring bands. The shows often originate with a touring act contacting her.

“I let them know, yeah, I’ll book you a show, but can you get Reno bands a show in your town?” she says.

“Otherwise, I’m really not interested in helping you.”

She was born in Santa Barbara, grew up in the Tahoe area, and got into music promotion while living in San Diego.

“I liked doing down there because I could see that it was making a difference,” she says. “The bands I was working with would get San Diego music awards. I’d get them on the radio, on television spots, because that’s what they do in Southern California. The community really gets behind the local music scene.”

She moved to Reno five and a half years ago.

“I noticed there’s a lot of really good bands here,” she says. “I didn’t really know if they knew how to do things. It’s a lot smaller than San Diego obviously. The way they go about promotion and booking is completely different. I didn’t have any intention of getting involved and doing music out here, and then I was like, maybe I should. ... Maybe I can make some sort of difference in Reno.”

She says one of the biggest issues discussed at the meetings so far has been the issue of overbooking—bands that play so often locally that they cut into their own drawing power.

“When bands are just playing with each other, they’re wasting time when they could be playing with touring acts,” she says. “There’s bands out there in Reno that just want to play. ... They don’t have goals. They don’t want to leave town [to tour]. Nothing like that. They just want to play, and that’s totally fine. But the bands that actually want to leave Reno [to tour], you have to make contacts to do that.

You can’t just leave. You have to build relationships. So that’s what I’m trying to do, to bring in out-of-town bands to help Reno bands.”

Meyer says that though there are some groups she knows she can rely on, she tries to promote a diversity of local bands.

“I try not to just book the same bands over and over again,” she says.

“Get some other bands some exposure and see what they can do.” Ω

However, both sides can be learned. Sometimes a lesson or class is in order. Sometimes all it takes is a little open communication. With that in mind, two local music promoters, Josh Lease and Heather Meyer, have started monthly “Bands and Promoters” meetings. These meetings provide new bands with some insight into the basics of booking and promoting shows, veteran groups a chance to air some civilized grievances, and everybody a chance to do some networking. “[It’s for] basically anybody that’s involved with the scene,” says Meyer.

“We’re just opening the communication lines, because there seems to be a lot of lack of communication.”

According to Meyer, the first couple of meetings attracted a lot of attention. Not just members of punk, metal and hardcore bands, but also acoustic performers and rappers. The next meeting will be held on July 26.

New Conservation Landscape Designs for Friends of Black Rock - High Rock How did a mountain lion become the new iconic logo for Friends of Black Rock - High Rock? The organization began its search for an artist to create fresh iconic imagery to fully represent the unique landscape they have stewarded since 1999. The wildlife, cultural history and natural resources is the backdrop for outdoor enthusiasts, hunters, ohv riders, campers, hikers, rock climbers, rocketeers and Burning Man attendees which makes up the active users and Friends membership list. As the organization is getting ready for it’s fifteenth anniversary year, it was ready for new branding.

Friends of Black Rock’s Executive Director, Karen Dallett, contacted longtime friend Michael Schwab, an internationally known graphic artist to consider the project. Being devoted to Schwab’s style which focuses on the interplay of positive and negative space, she knew had always been drawn to his strong and simple style. Dallett says, “Michael has the unique ability to stop time and engage audiences with his resonant images. He offers up a quiet pause that is thoughtful, lasting, and sustainable. He was perfect for this project.”

The Board of Directors agreed that Schwab was the man to freshly brand the conservation work of Friends in northern Nevada’s challenging landscape. Born and raised in Ardmore, Oklahoma, Schwab worked cattle on horseback at his grandfather’s ranch, and spent many youthful days fishing, and hunting. Establishing an early appreciation and respect for the land, he embraces his heritage through heroic and meaningful portrayals of the people and places that typify the American West. Committed to recording and recounting a shared American experience he agreed that this particular Nevada landscape held something within it that he wanted to discover. He set to work creating the first of three images.

Schwab skillfully captured something exciting out of the Black Rock Desert - High Rock Canyon in the mountain lion. This highly populated species in the NCA represented something mysterious, spoke to American freedom, the unknown and cautious exploration.

Using the mountain lion against a dark sky and full moon marks the mystery of the area and was the perfect first image for the series.

Schwab created the acclaimed prints for the Golden Gate National Parks Conservancy and his award-winning posters, logos, and advertising images include: Nike, Polo, Mondavi, Wells Fargo, Amtrak, Sundance, Pebble Beach, the San Francisco Opera, Muhammad Ali, and Turner Classic Movies. Now, Friends of Black Rock - High Rock strengthens its brand for generations to come. The second poster will be unveiled in the winter of 2013.

The jaws of ex-wife I have had a huge crush on a man for several months and finally asked him out for drinks. During our “date,” he mentioned his friend he wanted to set me up with, and I told him that he is the person I’m interested in.

He laughed nervously and seemed a little shocked. We went back to his place and spent hours just talking.

He revealed that he’s dating his ex-wife. She lives four hours away, and he visits her a couple of times a month.

We’ve since hung out at the pool and had drinks, but he again mentioned that he’s dating his ex-wife. I’ve never been this attracted to a man, and I can’t stop fantasizing about meeting him for much more than drinks! Do I lie low, waiting for him to drop his ex-wife, or do I make a move?

There was a reason the guy wasn’t asking you out, and it wasn’t because a cartoon witch put a spell on him, and he was unable to say,“How about a drink on Friday night?” until three animated teapots and several woodland animals broke the evil curse.

The wisdom of grandmas remains wise: If you want to catch a boy, don’t run after him. As I explain with some frequency, women evolved to be the harder-to-get sex because having sex meant they could end up a single mother dragging a kid around the Sahara. Men co-evolved to expect women to be choosier and to suspect that something’s wrong with a woman when she’s doing the chasing. This evolution and coevolution got burned into human psychology over millions of years—as contrasted by the drop in the bucket of human existence that is the women’s movement in the past 50-some years. So, even if a man’s ego is saying “Well, how groovy that she’s pursuing me!” his genes are probably starting a betting pool for whether you are seriously loose, are seriously needy, or will soon be frying up his pet koi and feeding it to him in a little lemon butter sauce.

Assuming some guy isn’t too fragile a flower to lay his ego on the line—in which case he’s lame partner material anyway—if he isn’t asking you out, he either isn’t interested enough or isn’t available enough.

You’re now making this guy out to be the greatest thing since the four-slice toaster, probably to justify hanging around like a dog waiting for a scrap of food to get knocked off the counter. (In the wake of making a mistake, we have an unfortunate ego-coddling tendency to come up with reasons it wasn’t a mistake instead of admitting that, in fact, it was, which would allow us to move on.)

Any further date-flavored get-togethers with this man are a bad idea. By continuing to throw yourself at him, you’ll turn your self-respect into a chew toy.

And even if he eventually detached himself from his ex-wife, there’s a good chance that, by chasing him, you’ve already screwed up the equilibrium for any relationship. A more productive deployment of your time and ego would be dating that man he offered up as a decoy or finding men on your own—the available kind—and flirting with them, which alerts them that you’re there for the chasing and interested in being chased. Flirting actually allows a woman to to make the first move—but far more alluringly than by yelling, “Can’t you see I want you, you moron?!” while clubbing a man over the head with the poolside clue phone.

Zero thumb game Do you text a guy after getting home from a fabulous date to hint that you want to see him again? Maybe to tell him how awesome he is or hint at your schedule?

My girlfriend says no, but I think a guy should know you liked him so he feels he can ask for a second date.

There are times when a guy knows better than to ask a woman for a second date, like when she ended the first one by throwing herself out of his car while it was still moving. Otherwise, a man doesn’t need hand-holding and encouragement in the form of texts: “Here are all the dates I’m free through 2015. Also, I’m doublejointed. Pick me! Pick me!” When you like a guy, you tell him so during your date by seeming happy and engaged and thanking him for a great time at the end, which suggests you’d be amenable to another date without also suggesting that you’re controlling and desperate. Just because we have all these fabulous high-tech ways of communicating doesn’t mean we should always be quick to use them, tempting as it can be to help a man along to the thought, “Wow, what a wonderful helicopter mom she’ll make someday.”

Roamed. I had been documenting abandoned ranches and the cowboy landscape of the Great Basin and Nevada. And I discovered just by chance that a lot of these what I thought were abandoned ranches, are not. And I discovered that a lot of times these corrals are used once a year in the spring, and they gather and brand. And we happened to just run across this happening, and this couple, really nice couple that we met down at the Green Springs Ranch, invited us to come to their branding. And that kind of landslid into quite a few ranchers inviting us out for their brandings and gatherings and cowboy events. So now I call it Where Cowboys Roam.

Deon Reynolds With his wife, Trish, Deon Reynolds owns and operates the Eureka Gallery, an unlikely art gallery in the rural Nevada town Eureka. He also recently became vice chair of the Nevada Arts Council. Where the Cowboys Roam, an exhibition of his panaromic photographs, is on display at the Metro Gallery in Reno City Hall, 1 E. First St., through July 26. A closing reception will be held in the gallery on Thursday, July 25, from 5:30 to 7:30 p.m.

Tell me about the work at the Metro Gallery. What’s the format of the photos?

It’s a two-element plastic lens, and it’s a 125th of a second fixed and F12 with 125 millimeter lens. That’s why it has that depth to it.

I’m using a Kodak Fun Saver Panoramic 35 disposable camera. And I reload it with Kodak Tri-X black and white film over and over again. It doesn’t last that long. The cameras are disposable so I can usually only get 100 or so rolls to run through it before they break.

So they’re just like the little disposable cameras?

Yeah, like those little yellow cardboard boxes you saw at the grocery checkout lines? That’s where I found them first, and I thought, oh panorama, that’d be fun. … It’s 35 millimeter film, and it just crops the top and bottom off the film internally within the camera.

It’s kind of funny that these locations look abandoned when they’re not in use.

Literally, a lot of them are 100 years old.

They’ve gone through generations of family ownership, most of them. They simply don’t need most of those corrals most of the year because they put the cattle out to range.

Those cameras are getting hard to find now, aren’t they?

Yeah, they quit making them in 1999. They made them from 1992 to 1999, and I actually was running out of them and kind of panicking, and I posted that I was looking for these cameras on my blog, and I got this anonymous email through my blog saying, check out this guy’s eBay. And he had 100 of them for sale. So by the time I got to them, he had 60 left, and I bought them all for $1.49 each.

How are things out there in Eureka? You’re trying to sell the gallery?

That is correct. We’re looking to move closer to the Reno area but still stay rural. We’ve been looking at Virginia City Highlands, Dayton, Silver City—the Comstock area. We love it out here, don’t get me wrong, but trying to deal with the art scene is difficult when it takes four and a half hours to get to Reno and $100 in diesel. Ω

What draws you to that subject matter?

It actually started with a show that I had at the Western Folklife Center about three years ago called Where The Cowboys Once

for Beelzebub, but hot enough to weird out even the most hard-boiled Palmoid. I knew I was heading into a serious heat wave at the time. (It was 105 up here.) I tried to get out of it, asking the rental agency if I could bail and use the deposit later, when it was, you know, 108 or something. They said, politely enough, nope. You bail, you eat the dough. So I said, OK, screw it, I’m on my way. And the bloody AC better damned well work!

Well, the AC worked. All weekend.

And the pool stayed cool, amazingly enough. We had a blast! You’d jump in the pool, stroll into the 82 degree house, and be freezing! Goose bumps, man! Which, in the end, just goes to show ya—air conditioning is a beautiful thing.

But it had to be a downright rotten weekend to be an AC repairman in that town. Ω
