The Town of Wallingford contests the Citation and Penalty as follows: 1. CONN-OSHA has not promulgated any regulation, rule or pronouncement specifically requiring and defining a mandatory wear policy for police body armor; 2. The Town of Wallingford Police Department implemented a mandatory wear policy for "high-risk tactical operations"; 3. The Police Department provides all of its officers with body armor and mandates its use during those operations; 4. The Town of Wallingford objects to being cited and fined for a violation of an unarticulated requirement. CONN-OSHA should first advise agencies of the requirement, provide the parameters of the requirement and provide agencies with notice and an opportunity to come into compliance before being cited and fined;

5. CONN-OSHA has not, in accordance with Connecticut General Statutes ยง31371 (a), adopted any regulations relating to a mandatory-wear policy for body armor; 6. The Wallingford Police Department is accredited by the Accreditation Division of Police Officers and Standards and Training Council (POST) and its current policy regarding mandatory wear is compliant with POST Standard 1.73; and 7. The failure to provide a clear directive regarding this issue directly impacts the collective bargaining agreements and, without a definitive standard, will result in conflicts between management and its employees.

Please commence the review process by the Connecticut Occupational Health and Safety Review Commission.
