The undersigned affiant, being duly sworn, deposes and says:

1. The affiant, Detective Karen Apicella, being duly sworn, does depose and state that I am a member of the Southington Police Department, has been a police officer for approximately fifteen (15) years prior to this date and currently holds the rank of Detective assigned to the Detective Division. At all times mentioned herein, I was acting as a member of said department. The following facts and circumstances are stated from personal knowledge and observations, as well as information received from other police officers acting in their official capacity, and from official police reports and statements made by prudent and credible witnesses.

2. On Sunday, November 16, 2008 at about 0814 hours, the Southington Police Department received a call from Judy Eureka an employee of the Public Storage located at 113 and 100 Spring Street. Eureka reported a number of storage units had been broken into during the previous overnight hours. Officers responded to this location. Upon seeing the multiple amount of units that had been breached, it was requested that members of the Detective Division also respond to this location.

AFFIDAVIT The undersigned affiant, being duly sworn, deposes and says

The following was noted from Officers/Detectives on scene, that unknown persons entered the property (located on the south side of Spring Street) by cutting through a chain link fence on the east side of the property (near the railroad tracks). They drove an unknown type truck onto the property though the fence they had breached. Once on the property, a number of padlocks were cut off of individual units. Seven storage buildings (buildings F, H, J, K, L, M, and N) on the Public Storage property located at 100 Spring Street, appeared to have been either entered or tampered with. Padlocks were cut or damaged from a total of 131 storage units. All the padlocks had similar cut marks on the locking section appearing they were cut with bolt-cutters. All of the padlocks that had been cut off, that were located by investigators, were seized as evidence, transported back to the Southington Police Department and secured within an evidence facility.

4. Each unit was inspected and photographed as it was found. Public Storage management notified the tenants of the units that were broken into or tampered with. Each of those tenants was provided with a form to complete and send to the Southington Police Department listing any missing property. Most of the tenants reported nothing missing or disturbed from their respective units.

Inventory sheE?ts of missing property were turned in to the Soutl)ington Police for Units H403, H409, H417, H422, J446, J447, K481 , L500, L505, M520, M521, M524, M539, M541, M550, N560, N555, N571, N580 and N581. The missing items consisted of mostly hand and power tools including a Linde mig welder, a Stihl backpack leaf blower, tool boxes full of tools, SawZalls, plumbing tools, a collector Chevrolet wrench set in tin box, a Lincoln welder. Also reported missing were two shotguns, a Master Torpedo heater, two snowblowers, fishing equipment, a Horton Hunter crossbow with scope, a gas-powered skate board, a television and car stereos. One victim reported a Craftsman 2 gallon air compressor with nail gun but later provided a copy of the user manual showing the brand name was actually Campbell Hausfeld. Some other items reported missing included diecast NASCAR cars, NASCAR tee-shirts, television, car stereos, numerous police and fire supplies which included various strobe lights, flashers, lens covers, switches, mounts, handcuffs, handcuff keys, police shirts, Police/Fire patches, hats, flashlights and sirens among other items.

Checks of pawn sheets and the NESPIN pawn shop data base were done for the missing property several times with negative results. There were at the very least 142 items listed as stolen with a total value exceeding $15,000.00.

On 04/26/09 Officer Atterrato of the Southington Police Department spoke with Timothy Libby at Southington Police Headquarters about a Linde Welder ( Serial Number# 114811) that was stolen on 11/16/08 from his storage unit ( Unit # M521) on Spring Street. Libby said he received a phone call from a gentlemen named Ron (unknown last name) inquiring about a Linde welder he once owned. Ron told Libby he retrieved his phone number off a service repair tag that was left on the welder when it was serviced. Ron asked Libby if he had any spare parts to the welder and if he had the original paper work. Libby said he did not inform Ron the welder was stolen from his storage unit. Ron told Libby he found the welder for sale on the web site "Craig's List" and purchased this welder from a "Charlie" on East St. in Plainville near Parsons Buick Dealership.

6. On 4/27109 this AFFIANT spoke with Timothy Libby. Libby said he recalled having left a service tag with his name and telephone number attached to his Linde Welder when he last had some repair work done. Libby said the caller, "Ron," was looking for some spare parts for the welder.

Libby told him that he had some spare parts and the manual. He did not inform him that the welder was stolen. Ron gave Libby his telephone number and they agreed to speak to each other the following day.

7. On 4/28/09 this AFFIANT contacted "Ron" at the telephone number provided. Ron informed me that his name was Ron Friedman and he had purchased a Linde mig welder from a man named, "Charlie," in Plainville off Craig's List. He saw the service tag with Libby's name and telephone number on it so he called to find out if there was anything wrong with it. Friedman said he was under the assumption that "Charlie" bought the welder from Libby. Friedman agreed to provide a written statement.

8. Officer G. Triano and this AFFIANT met with Friedman in West Hartford, CT where he provided a written statement. Friedman said on or about April 14, 2009, he saw an ad posted on Craig's List for a plasma cutter. Friedman called the phone number on the ad (860-980-4708) and spoke to a man who said his name was "Charlie", Charlie drove to Friedman's house in West Hartford and showed Friedman the plasma cutter. Upon viewing the plasma cutter, described as a Lincoln or a Miller, three-phase, color red with a lifting hook on the top, Friedman changed his mind. Charlie saw Friedman's 1946 Dodge and offered to trade a 1983 Ford Mustang Convertible for it. Friedman agreed. Charlie gave Friedman an address of 164 East Street in Plainville, Friedman drove to the house which he described as a "scrappy-looking" house across from Parsons Buick with a tent (This is page

garage to the right of the house. Charlie pulled back the flaps of the garage to show him items stored inside. Friedman saw a large yellow snowblower, a spa hot tub, two motorcycles, a Linde mig welder, a Coleman generator, a red two-wheel drive quad and a large compressor. The larger items blocked his view of smaller items stored in the back of the garage but said the garage was full of various items. Friedman traded a Craftsman Compressor and a Honda four-wheel drive quad for the Linde mig welder and a Coleman Powermate Pro-Gen 5000 generator. Friedman also traded his Dodge for the Ford Mustang. Friedman provided a copy of the transfer of ownership form which listed the seller as Charlie Soto of 164 East St., Plainville, CT. Friedman described the Linde mig welder as light green in color with wheels and a red Argon tank attached. Friedman was shown a photograph of the welder that was stolen (Libby had included this photograph with his list of stolen items). Friedman said the welder he obtained from Charlie looked like the welder in the photograph.

9. When this AFFIANT spoke with Ron Friedman, he said that Charlie, the same person that he obtained the Linde mig welder from, had a car for sale on Craig's List and he described the actual posting. Lieutenant Shanley searched the Connecticut Cars and Trucks Section of Craig's List and located the posting. The po.sting read in part "92 Mits 3000GT and ended wit~ CHARLI E 860-980­ 4708". Lieutenant Shanley then searched different areas of Craig's List for the phone number 860­ 980-4708 and found the following results: a listing posted 04-27-2009 for an Ariens Snow Blower with a 42 inch cut, electric start; four (4) BMW wheels that was also posted on 04-27-2009; a top of the line plasma cutter for sale or barter that was posted 04-14-2009. Each ad used the same phone number for prospective buyers to call, that being 860-980-4708.

10. On April 29, 2009 this AFFIANT showed Timothy Libby the Linde mig welder at the Southington Police Department. Libby verified the serial number of 114811 and positively identified the welder as the same welder stolen from his storage unit (M521 ) in November of 2008. A written statement was obtained.

11. On April 28, 2009, based upon the information that had been received to include the general location and description of the residence where the Linde mig welder and Coleman generator were purchased from, Lieutenant Shanley of the Southington Police Department drove to the area of East Street, Plainville. CT. Located just across the street from Parson's Buick is a residence at 164 East Street with a green portable garage. Also in the driveway was a green quad, four-wheeler. There (ThiS is page

appeared to be some type of electric saw, similar to a miter saw lying on the ground just in front of the "portable" garage.

12. On April 28, 2009, Lieutenant Shanley contacted Detective Sergeant Blake of the Plainville Police Department looking for information on the residents at 164 East Street, Plainville, CT. Sergeant Blake stated that he personally was familiar with this address as well as the occupants from criminal investigations that he investigated and or was made aware of. Sergeant Blake stated that Negist and Charles SOTO live at 164 East Street, Plainville, Connecticut. Sergeant Blake stated that Negist is the wife of Charles, and that Charles SOTO's date of birth is March 7, 1973. He further stated that several years ago, he executed a search and seizure warrant at this same location while Charles SOTO was living there, and that the search warrant was to locate and seize a wrecker that was on the property.

13. On April 28, 2009, Lieutenant Shanley conducted a DMV License check for a Charles SOTO, date of birth of March 7, 1973. According to DMV files, Charles SOTO has a Connecticut Driver's License and his address is listed as 164 East Street, Plainville, CT. That Lieutenant Shanley then conducted a State Police Records Check. This records check shows that Charles SOTO, date of birth of March 7, 1973 was arrested 06/11/2006 by Waterbury Police and charged with Larceny Second, that information was substituted and he was found guilty of Use of a Motor Vehicle Without Permission; that on 09/24/1991 he was arrested by the Southington Police Department and convicted on the charge of Larceny Second Degree; that on 08/09/1991 he was arrested by the Cromwell Police Department and convicted on the charge of Larceny Second Degree; that on 10/25/1989 he was arrested by the New Britain Police Department on the charge of Larceny First Degree for which he was later convicted.

14. On April 29, 2009 Officer Porter received a DVD recording from Price Chopper Supermarket, 410 Queen Street, exterior surveillance cameras. The recording dated November 16, 2009 at 1:06 AM depicted a dark colored, extended-cab pickup truck with several occupants. The truck enters the main driveway, drives around to the North West corner of the building to a gate behind the Price Chopper property. One occupant exits the truck on the driver's side and goes over the gate into the wooded area heading in the North West direction of Public Storage located a short distance away behind the Price Chopper property. It appears that there is a front seat passenger in addition to the driver. The truck then drives away heading back toward Queen Street.

AFFIDAVIT The undersigned affiant. being duly sworn. deposes and says:

15. A Search and Seizure Warrant was obtained for the search of the property of Charles SOTO at 164 East Street in Plainville, CT. The Search and Seizure Warrant was executed on May 1,2009 with the assistance of Plainville Police. Numerous items believed to have been stolen were seized from the residence. Items seized included a Dale Earnhardt Jr. die cast car, assorted !\lASCAR tee shirts, a Master Torpedo heater, a Horton Hunter camouflage crossbow with scope, a Stihl backpack leaf blower, numerous police strobe lights, switches, mounts, lens covers and flashers, tactical handcuff keys, assorted cell phone cases, chargers and hands-free car kits, a Craftsman air compressor, a Chevrolet wrench set in collector tin box, Craftsman tool boxes with tools, Campbell Hausfeld compressor with nail gun and several other items. The tenants of ten storage units positively identified the recovered items reported stolen from their respective units.

16. Two long guns were found on SOTO's property, one gun was located in the back seat of SOTO's Ford F250 extended cab truck. This truck resembles the truck recorded on the Price Chopper surveillance video. SOTO is a convicted felon, currently on probation and was prohibited from possessing or having access to any firearm. Neither of the two firearms were weapons reported missing from one of the Public :Storage Units. Plainville Police seized the firearm~, placed SOTO under arrest and he was taken into police custody. Detective J. Suski and Officer G. Triano later went to the Plainville Police Department to meet with SOTO. SOTO was advised of his rights in writing. SOTO waived his rights and agreed to speak with them. Soto provided a signed, sworn statement regarding the burglary to Public Storage on Spring Street. SOTO stated the following: "Approx. 6 months ago my brother Rick Soto and a friend of his Ted Bishop of Terryville, Ct. came over to my house and wanted me to help them move heavy tools. They told me to drive my 1999 Ford F250 pick up truck to the public storage located on Spring Street to pull down the railroad tracks and pull to the rear of the storage units. I then pulled the truck into the storage area and we then started entering the storage units. Some of the units were unlocked and others were locked.

The locked units were opened by my brother Rick and Ted using a bolt cutter. They entered a lot of units and removed a lot of large equipment, snowblowers, gas power skate board, gas compressor's, large amount of power tools. One of the units there was a large amount of NASCAR diecast cars and t-shirts. There was one unit with a large amount of police supply equipment. We made two trips from public storage on Spring Street, Southington, Ct to my house on 164 East Street, Plainville, Ct. A lot of tools that were taken were moved to a different location by (my) brother Rich and Ted Bishop. I didn't know (where) they took the tools. They (Rich and Ted) gave me $500.00 cash for helping them."

17. On May 1, 2009 this AFFIANT was contacted by Negist Soto, the wife of CHARLES SOTO, regarding the items seized from their home. Negist Soto informed me that her brother-in-law, RICH SOTO was storing a lot of items at her house she believed were stolen. She said CHARLES and RICH hung out with a guy she only knew by the name of "Stretch". She said she will try to find out more about who he is and where he could be located. Negist called me on May 4, 2009 informing me that "Stretch" is Ted BISHOP and he lives at 66 Briarwood Rd in Bristol and drives a red Chevrolet pickup truck. She called back on May 5, 2009 informing me that BISHOP is now driving a black GMC or Chevrolet pickup truck.

18. This AFFIANT spoke with BISHOP on June 9, 2009. BISHOP agreed to meet with this AFFIANT at BISHOP's apartment at 66 Briarwood Road in Bristol on June 11, 2009. Officer Triano and this AFFIANT met with BISHOP and discussed his alleged involvement in the burglary of the Public Storage units in Southington. BISHOP said he knew exactly what this AFFIANT was talking about but he denied that he took any part in the burglary. He said sometime later after the burglary, Charlie (SOTO) contacted him and asked him to move some items. BISHOP agreed to help him out. When they met, Charlie (SOTO) informed .him that the "Storage Place in Southington is a "gQld mine" and that he had hit it before. Charlie (SOTO) told BISHOP about "hitting" the storage place several years ago with his brother where they stole a large tool chest. BISHOP said he knew the stuff he helped move with Charlie (SOTO) was stolen from a storage place near train tracks but he did not know exactly where and was not familiar with the Town of Southington. He said he was never there (referring to Public Storage) and did not break into any of the units. BISHOP told this AFFIANT that he had knowledge of at least five other burglaries Charlie (SOTO) and his brother, Rich (SOTO) had committed. This AFFIANT asked BISHOP if he knew anything about the plasma cutter. BISHOP said several months ago he was behind the GE building in Plainville looking for scrap metal when he saw a bunch of "cop cars". He later found out they were investigating a burglary. Charlie (SOTO) later told BISHOP how he and his brother, Rich (SOTO), went into either the GE building or a building next door where they "cleaned the place out" and also took a $10,000 plasma cutter that they've been trying to unload ever since. He said after the storage burglary he saw Rich (SOTO) had a case of police sweatshirts and that Rich (SOTO) was wearing some of those sweatshirts with police-type insignias and embroidery. They also had cases of NASCAR model cars and cell phone supplies. BISHOP said he knows that Rich (SOTO) donated the model cars to Toys-4-Tots around Christmas time. Rich (SOTO) took some metal to scrap yards in New Britain. He said that Rich (SOTO) also stole a pile of aluminum bars from "somewhere" and buried (ThiS is page

The undersigned affiant, being duly sworn, deposes and says:

them in Charlie's (SOTO) car port under a tarp. He said Plainville Police executed a search warrant at Charlie's (SOTO) home and property looking for them but did not find them. Rich (SOTO) was later arrested for the crime but the bars were still hidden in Charlie's yard. BISHOP was reluctant to provide any further information claiming that Charlie (SOTO) is a member of the "Solids" in Hartford and has access to a lot of guns. BISHOP was fearful that harm would come to his wife and kids if SOTO knew if he said anything to police.

19. BISHOP contacted this AFFIANT again on June 12,2009 wishing to provide further information.

He expressed concern over the safety of his wife and kids saying that he has seen Charlie (SOTO) get into some bad stuff in Hartford with the "Solids" and he runs with extremely dangerous gang members in Hartford. He said he believes that the gang members put up the bond money to get Charlie (SOTO) out of jail. Charlie (SOTO) often bragged about serving time for murdering someone. BISHOP told this AFFIANT that Charlie bragged about how he hit the storage place and got a lot of tools and that he unloads the stolen items through bardering. BISHOP again insisted that he had nothing to do with the burglary, that he was home with his wife, kids and his nephew who was staying with them for awhile around that time. BISHOP said Charlie (SOTO) bragged about hitting the storage place in Southington with his brother, Rich (SOTO), several years ago where they stole a large tool chest.

20. This AFFIANT viewed Charlie's (SOTO) Criminal Record and found no charges of murder, manslaughter or serious assault charge. His record consisted of mostly larceny and drug related offenses. This AFFIANT recalled having investigated a burglary several years ago to a Public Storage unit in which a tool chest loaded with tools was stolen (SPD case #04-29310). This AFFIANT later received intelligence information that both Charles SOTO and Rich SOTO were listed as members of Los Solidos in Hartford, CT that Charles (SOTO), known as "C Rock," is still listed as a Solido threat but neither appears to be involved in any recent active gang activity. Also that Rich SOTO is currently listed by the name of "Richard Niedzwiecki" in Department of Correction (DOC) files.

21. On June 25,2009, Ted BISHOP went to the Southington Police Department where he provided a signed, sworn, written statement regarding his knowledge of the Public Storage burglaries.

BISHOP's statement is as follows: "I met Rich Soto Jr. in 2007. I know him as Junior. Through him I met "C Rock", the infamous street name of his brother Charlie Soto. He told me he heard' have a (ThiS is page

reputation for keeping my mouth shut and thought (I) was okay. I was in the business of working on cars, everyone wanted tools. Charlie would start having me sell tools for him. He used to let me use his quads, he had two of them. Whenever I stopped by to go on the quads, he would show me stuff and ask me to help him get rid of them. I would make phone calls and help him sell stuff. In exchange he would give me money or a tool or something I wanted that he had. At first he would say he "got blessed" with this stuff. Then he said something about a place being a "gold mine" then he later said it was a storage place. He mentioned that he hit it once before several years ago and got a lot of tools, a big tool box filled with tools and some other tools, he said it was about $15,000.00 worth. He said there were no cameras and they won't catch him. He never mentioned the name of the place only "storage" that it's the only way to go because it's everyone's belongings and it's insured. In early November of 2008 he put up a tarp covered car port up next to his house.

He had asked me to help him put it up but I didn't. A week went by and he ended up with a red quad and a hot tub. He said he got it for free with a "snicker", a laugh. Almost a month went by and then it was completely full. At this point in time Junior was staying there with a broad. He said the stuff came from the gold mine and how he hit it before. I remember seeing several sets of identical BMW rims. I had wanted them for my truck but he wouldn't ~ive them to me, he said they wouldn't fit my truck and he wanted $600 for them. I remember seeing boxes of a lot of flat lights, a lot of power tools, fishing equipment, guns, a big air compressor, a big heater, a yellow one, boxes of NASCAR cars, t-shirts, bags of blue fleece sweatshirts. Junior kept them and I saw him wearing them, they had a pOlice-type emblem on the left side with a quarter zip. A large saw for cutting pavement or cement, it was a big wet saw, with large cutting blades. There was a roof rack with police-type lights that he said were for towing. Sometimes he would try to sell me the stuff. I saw boxes of cell phone car chargers and cases. I remember seeing hid lights, that's what Charlie called them. He traded a welder for a quad. I remember seeing a crossbow with a scope, he said he had that for a while. He had a 30 odd six with a scope."

21 a. BISHOP's statement continues: "Originally I'm from Middletown. I'm not familiar with Southington and never heard of Public Storage. I did not break into Public Storage with Charlie and Junior. I did not use my truck or let them use my truck to do this. I had a red Chevy S 10 with an extended cab at the time. I saw the photo of the truck caught on surveillance at Price Chopper. I know for a fact that it is not Charlie's Ford F250. His truck always has a cap on the back, it's missing the passenger side step side and the window was broken on that side. truck belongs to. Junior does not have a truck. Charlie and Junior have two other brothers. They both have trucks but not a truck that looks like the one in the photo. They have a lot of contacts.

The night of the burglary, my wife was nine months pregnant. I never left the house at night. I never left my wife by herself at night. I was always home at night during the time my wife was between seven and nine months pregnant. The stuff Charlie had in the car port, I was interested in, and I would have kept those items if I had stolen them. I tried to buy them off Charlie but I didn't have the funds to buy any of it. I never stole any of those items."

22. On July 1, 2009, this AFFIANT received information regarding the Public Storage burglaries from Detective St. Onge of the Plymouth Police Department. Detective St. Onge interviewed Rich SOTO on June 29,2009 in regard to an investigation in Plymouth and obtained a signed, sworn, statement from Rich SOTO. Rich SOTO stated in part: "That sometime before Christmas 2008, Teddy Bishop, 27 or 28 years old, came to my house ... Teddy is a white male, about 6'9", tall, skinny, brown hair with tattoos on his arms and neck. Teddy came to my house and told me he had some material to scrap ... Teddy also said he broke into some storage trailers in the some industrial park. Teddy did not say what he took. Teddy also said he broke into some tractor trailers that were parked. Teddy also told me about things he has done in Plainville" and Southington ... Teddy told me he took shit out of Southington, like guns, more tools, some snowblowers, out of storage garages.

One time he came over with handcuff keys and a police cap. He also had boxes of NASCAR race memorabilia cars. One time he came over and he had what looked like a set of rims off a BMW. The rims looked new and had no tires on them." SOTO told Detective St. Onge that he knows BISHOP sold a lot of the stolen items to a guy in Middletown at a house with replica silhouettes of the Blue's Brothers and how "this guy in Middletown will buy anything from anyone."

23. On July 1, 2009 this AFFIANT contacted Staff Sergeant Leonard of the Marine Corps Reserve Toys for Tots. Sgt. Leonard said sometime in December, they received two boxes containing approximately 100 small NASCAR diecast cars. He recalled that each box contained identical diecast cars of one or two NASCAR drivers. He couldn't recall any other detail. The boxes were picked up from one of 100 Toys for Tots drop-off boxes around the Hartford County area but there was no record of which one.

24. On July 1, 2009, Detective St. Onge faxed to the Detective Division copy of a written statement Detective St. Onge obtained from Rich SOTO on June 29,2009 regarding an investigation in Plymouth. Within the statement, SOTO reveals how Ted BISHOP told him (Rich SOTO) how he stole items in Southington such as guns, snow blowers and tools out of storage garages. That BISHOP has boxes of NASCAR replica race cars and a set of new BMW rims that he said were stolen in Southington, handcuff keys and a police cap. SOTO said sold some of the items to a guy in Middletown with Blues Brother silhouettes in front of the house and that this guy would buy anything from anyone.

25. In Rich SOTO's statement, he provided many specific details not known to Det. St. Onge at the time. The information was regarding specific items stolen from Public Storage units mentioned in the prior statements obtained from Charles SOTO and Ted BISHOP. 26. This AFFIANT learned through other officers that the house described in Rich SOTO's statement is in Middlefield on Route 66, next door to the Red Dog Saloon and is owned by Jimmy DiCaprio, a Southington resident. Detective Beal and this AFFIANT went to the described location and located Jimmy D's Antiques at 228 Meriden Avenue in Middlefield, CT with silhouettes of the Blues Brothers as described in the yard. As soon as we pulled up, we were greeted by Jimmy DiCaprio who agreed to cooperate with us. This AFFIANT showed DiCaprio pictures of TED BISHOP, RICH SOTO and CHARLIE SOTO. DiCaprio did not recognize the SOTO brothers but did recognize Ted BISHOP as a regular customer and also knew him by name. DiCaprio said sometime at the end of November or beginning of December of 2008, BISHOP showed up with another tall male slightly shorter than Bishop. BISHOP sold him several power tools. DiCaprio recalled that there was a DeWalt drill, a Sawzall, a sander and a few other power tools. DiCaprio said that he recalled paying BISHOP about $30 to $35 for each item and has since sold those items.

DiCaprio refused to provide a written statement. DiCaprio said BISHOP has come to see him repeatedly since that time trying to sell items but DiCaprio said he suspected the items were stolen and refused to buy them.

27. On July 20,2009 this AFFIANT received a voice mail message from Nicole Bishop, the wife of Ted BISHOP. The message was dated 11 :20 AM on July 19,2009 from 860-329-4400. My husband was lying to you. He was involved in it, so was Charlie, they're all involved in it so I really need to speak with you. I can't live like this anymore. I'm really sick of all this. Thank you and have a great day." This AFFIANT spoke with Nicole Bishop on July 20,2009.

Nicole said she apologized for the inconvenience but said she made that phone call after an argument with Ted. She said she was no longer willing to give a statement.

28. This AFFIANT received a phone call from Adult Probation Officer Ben Redding informing me that he currently supervises Ted BISHOP and that recently BISHOP has been making repeated requests to transfer to Florida. Redding learned of my ongoing investigation and denied the request. Redding was concerned that Ted BISHOP was preparing to flee the state in violation of his probation and added that BISHOP's wife's family has a home in Florida.

29. On July 27,2009 Detective Beal and this AFFIANT went to Connecticut Pawn, LLC located in Bristol, CT and viewed the pawn activity of Ted BISHOP. Between December i, 2008 and June 2, 2009 BISHOP has pawned numerous power tools and electronics, however most of these items have since been sold. On April 3, 2009 BISHOP's wife, Nicole Bishop, pawned a Sony CDX-GT310 car stereo. This AFFIANT contacted Ray Rexinger, who had two Sony car stereos stolen from his storage unit (M524). Rexinger said he received the stereos as gifts and was unable to provide any further details other that they were new in the box and that the boxes were red in color. The Connecticut Pawn employees could not recall if the stereo pawned by Nicole Bishop was in a box or not.

30. On July 23, 2009 this AFFIANT made arrangements through Rich Soto's attorney, Benita Lee, to speak with Rich SOTO at Osborn Correctional Institution.

31. On July 24,2009 Detective Beal and this AFFIANT went to Osborn Correctional Institution and met with Rich SOTO. Rich SOTO clarified that his name was incorrectly listed as "Richard Niedzwiecki" because he gave that false name many years ago during an previous arrest and although he has told DOC many times that the name is wrong, they've neglected to correct it. Soto, lives at 164 East St. in Plainville. I was over visiting in the afternoon. Bishop drove up in his red Chevy S10 pickup. It had a decal on the hood and window tints. He had a tarp over the bed of the truck. He lifted up the tarp and he had all this stuff under it. There were 3 or 4 big boxes of NASCAR memorabilia, 8 - 10 long guns, a snowblower that was either red or orange, and tools, power tools, Sawzalls, a compressor and maybe a generator, it was big, I think it was black. Bishop tried to sell this stuff to me and my brother. I asked Bishop where he got this stuff. He said, "Don't worry about it" that it came from Southington. He never said anything more about where it came from. I told Bishop I wanted nothing to do with it. I told my brother not to get involved. I left and went home. Bishop was still there. Bishop did say something about the stuff coming from a storage garage in Southington ... A couple days later, I was at Charlie's house when Bishop showed up in the same truck. This time he had his brother-in-law with him. I don't know his name but he has dark curly hair and lives in Middlefield across from Wendy's on the comer of a side street. Bishop had all different stuff in the back of his truck. He had more power tools, a big heater like a torpedo in a box.

He had two Sony stereos with speakers, brand new in the box. He tried to sell me one but I told him no. He mentioned new car rims for a "beamer". He was wearing a Dale Earnhardt hat. He had Police shirts in packaging, police hats (some said "NYPD" and others said "POLICE", others that said "EMTff), handcuff keys (the long ones in the packaging). He showed me a standing powered skateboard, it had a wire up to the handgrips. He said he was going to give it to his son. I know he kept stuff in the basement of his house in Bristol. I saw this whenever I was at Bishop's house. He lives in a 3-family house on the corner but I don't know the street name. He kept computers, tools, car stereo speakers and other stuff in there. Afterward there were times I was at my brother's house with Bishop and helped move stuff from Bishop's truck to my brother's truck. I don't remember what it was, I tried not to pay attention. Bishop told me he would sell this stuff to some guy in Middlefield.

I did not have anything to do with the burglaries at the Public Storage in Southington. My brother, Charlie, never said anything about being involved. If anything I told Charlie to stay away from Bishop. I have no idea where Bishop got the stuff from other than he said it came from a storage garage in Southington."

32. Rich SOTO denied having any involvement in any burglaries at Public Storage in Southington, CT. When confronted with information implicating him in the burglaries along with Bishop and Charlie SOTO, Rich continued to insist that he had nothing to do with the burglaries but was aware that his brother had acquired a lot of stuff that he stored in his tarp garage.

33. On July 27, 2009 Detective Beal and this AFFIANT drove by the residence of Ted BISHOP located at 66 Briarwood Road in Bristol, CT. Clearly visible from the roadway, we could see several lawn mowers, tool boxes and other items piled up at the top of the driveway.

34. On July 30,2009 Ted BISHOP contacted this AFFIANT inquiring about the status of the investigation. During the course of the conversation, BISHOP stated that he was still residing at 66 Briarwood Road in Bristol, CT. 35. The residence of 66 Briarwood Road in Bristol, CT is listed in Bristol Property records as owned

by Ernest N. DuHaime of 66 Briarwood Road, Apartment 3, Bristol, CT however Ernest N. DuHaime is deceased. Bristol Probate Court records show the fiduciaries are Ernest C. DuHaime of California and Alex DuHaime of 31 Robert Street of Bristol, CT. This AFFIANT spoke with Alex DuHaime on August 4, 2009. DuHaime said the house has three apartments. Apartment #3 is rented by a male he only knows as "Mike", apartment #2 is rented by Ted BISHOP and his family and apartment #1 is vacant. There are no other occupants.

36. A Search and Seizure warrant for the" residence of Ted BISHOP was granted for Bishop's apartment, the basement and curtilage located at 66 Briarwood Road in Bristol, CT. The Search and Seizure warrant was executed by members of Southington Police Department on August 7, 2009 with the assistance of the Bristol Police. However upon our arrival, it was discovered that BISHOP was in the process of vacating his apartment. BISHOP was not present. We entered the unlocked apartment and found it was empty with the remainder of their belongings in cardboard boxes stacked up outside the house. I contacted BISHOP, advised him I had a Search Warrant for his house. BISHOP informed me that he was in Niantic and unable to respond. BISHOP's wife, Nicole contacted me from Middletown, informed me that the bank foreclosed on the house and they were forced to move. She was also unable to respond. Nicole informed me that all of the items stacked outside belonged to her and Ted. All of the boxes were opened, inspected and resealed.

None of the items listed on the warrant were located. I spoke with BISHOP's probation officer, Ben Redding, who informed me that Nicole had established residency in Florida and had already moved.

She had returned for a couple days to retrieve the remaining property.

In conclusion, a search warrant executed on May 1, 2009 at the residence of Charles SOTO, five months after the burglary resulted in the recovery of numerous items positively identified as items stolen from Public Storage. Charles SOTO stated to investigators that he committed the burglary with Ted BISHOP and Rich SOTO. After the burglary, they brought the items to his house in Plainville and then later Ted BISHOP and Rich SOTO took their shares of the stolen property. For the past several months BISHOP has sold or attempted to sell numerous power tools and other items, to Connecticut Pawn and Jimmy D's Antiques that fit descriptions of items that have not been recovered. According to the statement of Rich SOTO, BISHOP went to Charlie SOTO's house sometime before Christmas of 2008 and told them about how he broke into a storage place in Southington where he took guns, snowblowers, tools, NASCAR die cast cars, handcuff keys, police caps and BMW rims. Rich SOTO said Bishop sold some of these items to Jimmy D's Antiques in Middlefield, CT. The owner of Jimmy D's antiques confirmed that Ted BISHOP did sell some assorted power tools to him sometime around the end of November or beginning of December of 2008. Rich SOTO said he saw BISHOP with a powered skateboard BISHOP said was stolen from a "storage garage" that matches the description of a gas-powered skateboard stolen from unit M524 and that BISHOP intended to keep this skateboard.

BISHOP denied any involvement in the burglary but said in November of 2008, Charlie SOTO set up a . tarp car port in his driveway and then later packed it with a hot tUb, jet ski, a large saw for pavement cutter (plasma cutter) and other stuff and how both Rich and Charlie SOTO told him how they "hit" a storage place in Southington they referred to as the "gold mine." BISHOP said Charlie SOTO had BISHOP help him sell the stolen tools in exchange for money or tools. All three suspects provided very specific information concerning their involvement and knowledge of property stolen from a "storage place in Southington" around the time frame of the burglary of Public Storage including detailed descriptions of items not yet recovered.

38. Based on the facts and circumstances of this investigation, this AFFIANT has probable cause to believe that Charlie SOTO did commit violations of Connecticut General Statutes: 53a-122 Larceny 1st Degree, 53a-117 Criminal Mischief 3rd Degree (131 counts) and 53a-103 Burglary 3rd Degree (131 counts). It is respectfully requested that a warrant be issued for the arrest of Charlie SOTO (date of birth 03/07/73).
