The suit from Sign Pro, owned by Pete Rappoccio, alleges that the town has been enforcing zoning rules against his sign company but not against its competitors, among other instances of uneven treatment. Such targeted enforcement is a violation of the Constitution’s equal protection and due process clauses, according to the lawsuit.
When filed in April, the town and the chief building official Jeffrey Pooler were named as defendants. Lawyers for Sign Pro tried to amend their suit last month to include Town Manager Mark Sciota and Town Council Chairwoman Victoria Triano. The case moved to federal court in June. A federal judge denied the amendment last month, saying Sign Pro hadn’t included a statement that the company’s lawyers had reached or tried to reach the additional defendants.
