Seiko Epson Files New 337 Complaint Regarding Certain Ink Cartridges On December 23, 2014, Epson Portland Inc. of Hillsboro, Oregon, Epson America, Inc. of Long Beach, California, and Seiko Epson Corp. of Japan (collectively, " Seiko Epson") filed a complaint requesting that the ITC commence an investigation pursuant to Section 337. The complaint alleges that the following entities (collectively, the "Proposed Respondents") unlawfully import into the U.S., sell for importation, and/or sell within the U.S. after importation certain unauthorized, aftermarket ink cartridges and components thereof that infringe one or more claims of U.S. Patent Nos. 8,366,233 (the '233 patent), 8,454,116 (the '116 patent), 8,794,749 (the '749 patent), 8,801,163 (the '163 patent), and 8,882,513 (the '513 patent) (collectively, the "asserted patents"): • • • • • • • • • • • • • • • • • • •

According to the complaint, the asserted patents generally relate to a printing material container and a board mounted on a printing material container. In particular, the '233 patent relates to a plurality of terminals adapted and positioned to contact printer-side contact forming members so that electrical communication is enabled with the printer. The '116 patent relates to placing the high-voltage contact portions at the outermost ends of the overall contact portion arrangement and including a short detection contact portion that is placed between one of the high-voltage contact portions and all other contact portions. The '749 patent relates to arranging the contact portions in two rows, and placing the high-voltage contact portions at the outermost ends of the lower (deeper) row. The '163 patent relates to placing the high-voltage contact portions at the outermost ends of a row and of the overall contact portion arrangement and including a short detection contact portion that is placed between one of the high-voltage contact portions and all other contact portions. Lastly, the '513 patent relates to arranging the contact portions in two rows and placing the high-voltage contact portions at the outermost ends of one of the rows and including a short detection contact portion.

In the complaint, Seiko Epson states that the Proposed Respondents import and sell products that infringe the asserted patents. The complaint specifically refers to various ink cartridge products associated with the Proposed Respondents as infringing products. Regarding domestic industry, Seiko Epson states that it currently manufactures ink cartridges that practice all of the asserted patents in the U.S. Seiko Epson further states that a subsidiary packages and performs quality control inspections in the U.S. on ink cartridges that practice the asserted patents. Seiko Epson specifically refers to its facility in Hillsboro, Oregon and states that a significant portion of that facility is dedicated to manufacturing ink cartridges that exploit the asserted patents. With respect to potential remedy, Seiko Epson requests that the Commission issue a permanent general exclusion order, a limited exclusion order, and permanent cease and desist orders directed at the Proposed Respondents. Seiko Epson states that a general exclusion order is warranted given the numerous sources abroad of allegedly infringing ink cartridges and components thereof and the available channels of distribution.

HP Announces New Legal Actions to Protect Printing Supplies Technology New legal actions expand the fight against patent infringing inkjet supplies PALO ALTO, Calif.— HP recently announced a series of worldwide legal actions in its ongoing fight to combat the sale of infringing inkjet cartridges. In the Netherlands, HP has initiated three separate litigation cases against Digital Revolution B.V. of Nederhorst den Berg. Digital Revolution operates the online printing supplies shop 123inkt.nl in the Netherlands, and under different names in other countries in Europe. Two claims allege infringement of two HP patents in the sale of newly manufactured ink tank cartridges compatible with HP 364 and HP 920 ink supplies. These cases will be conducted under the accelerated regime for patent matters. Trials dates have been set for October 2015. The second complaint alleges unfair competition for the act of selling newly manufactured toner cartridges as “totally rebuilt”, intentionally misleading consumers that the product is recycled and remanufactured. This case is in summary proceedings with the oral hearing set for February 2015. All cases have been filed before District Court in The Hague, a specialized patent court that also handles a significant amount of unfair advertising claims. In Spain, HP has filed patent litigation cases against eleven different entities alleging infringement of two HP patents. The two main entities involved are Tintas y Toner Shop Ink, S.L.U. which previously traded as Ink Prime High Quality S.L.U., and Vasco Informática, S.L., both of Malaga. The claims allege infringement of two HP patents in the sale of newly manufactured inkjet printhead cartridges compatible with various HP print cartridges, including the HP 21, HP 22, HP 56 and HP 57 ink supplies. The complaint has been filed in the Commercial Court Nº 5 in Barcelona. In Poland, HP has continued its patent enforcement efforts by closing settlements with several companies regarding the sale of various ink tank and inkjet printhead cartridges that infringe HP patents. Those companies are: • • • •

manufactured ink tank cartridges, and related electrical storage devices, compatible with printers that use a wide range of HP ink tank cartridges, including models compatible with the HP 564, HP 932, HP 933, HP 950, HP 951 and HP 970 ink supplies. The complaint alleges that defendants willfully infringe two of the three asserted patents, and demands up to treble damages for infringement of those patents. The complaint has been filed in the United States District Court for the Northern District of California. In China, HP has filed patent litigation actions against Speed Infotech Ltd. of Shanghai and Jingying Technology of Shenzhen. Speed Infotech is allegedly the authorized distributor of compatible inkjet cartridges in China for Microjet Technology Co. of Taiwan. Jingying Technology is allegedly the manufacturing entity responsible for the domestic assembly and sale of compatible cartridge components manufactured by 3-Ink Technology Co., Ltd of Taiwan. The claims against Speed Infotech involve infringement of three different HP patents in the distribution and sale of inkjet printhead cartridges compatible with the HP 816, HP 817, HP 860XL, HP 861XL and HP 818XL (black and color) ink supplies. The claims against Jingying Technology involve patent infringement of the same three HP patents in the manufacturing, distribution and sale of inkjet printhead cartridges compatible with the H 816, H 817, H 860, H 861XL, H 818KXL (black), H818XL(colour) ink supplies. In addition, the company has the marketing network and global reach that would help it take a leading position in the 3D printing field. Also, the speed that HP boasts is a considerable improvement on the current machines, as could possibly be the price. HP has not revealed a price yet but Caffrey speculated that it may have something disruptive to offer in that department as well.

HP is also working to expand its offering in IT services: demand for cloud is growing globally, and the company is not sitting on its hands. According to Trefis, cloud services will in fact be the main revenue driver for HP this year, based on it already booking doubledigit growth in revenues from them. Lastly, the long-awaited foray into 3D looks very promising. Being the market leader in 2D printing, where the market has been stagnating for a while now, expanding into 3D printing has been logical and is bound to pay off, although Trefis believes the main source of revenues in 3D printing won't be sales of printers themselves but rather sales of printing materials.

HP Showcases Desktops, Printer, Ultrabook at CES 2015 HP has showcased an extensive range of new products at the latest edition of the Consumer E le c t ro n ic s S h o w, a mo n g t h e m t w o new desktops, an ultrabook, a virtual workstation, and a printer, along with the Sprout and the company’s very own 3D printer. In the desktop category, HP presented the Pavilion Mini and the Stream Mini, two palmsized desktops, the first featuring 1TB of storage space and 8GB of expanded memory, and the second with a 32GB drive plus 200 GB of storage space via Microsoft’s OneDrive for a period of two years. In the notebook class, HP showcased the ZBook 14 and 15, ultrathin and ultralight, with 14-inch and 15.6-inch displays, and a memory capacity of up to 16GB.

Canon's new multifunctional peripheral i-SENSYS MF8580Cdw is a quite large color laser device that can print, scan, copy and fax. It supports both wired and wireless networks, it has Google Cloud Print and Apple iPrint, plus print and scanning apps for Android and iOS. The i-SENSYS MF8580Cdw has a stated print speed of 20 pages per minute but tests have revealed average speeds of 16.5 ppm for simple text and 14.7 ppm for a complex color graphic. What's more, this Canon printer cannot scan while printing. Still, scanning is easy with it, even remotely, from a mobile device. Aside from these capabilities, the i-SENSYS MF8580Cdw features a 50page automatic feed, black and white toner that lasts for 1,200 pages, and color toner for 1,400 pages. Maximum print resolution stands at 600x600dpi, and maximum scan resolution is the same. It retails for £407 in the UK.

HP also presented its new Sprout computer system, featuring a scanner, a camera and a projector. This is the first member of HP’s Blended Reality ecosystem, allowing for more than one user to manipulate 3D objects in real time. Another member of the ecosystem is the Multi Jet Fusion 3D printer, based on HP’s proprietary Thermal Inkjet technology that is claimed to be able to print 10 times faster than any currently available technology. In the 2D printing department HP released the Officejet 8040 with Neat e-All-in-One. The device features a 1TB hard drive plus the company’s Smart Organization System, which offers document management and printing from mobile devices. HP also released a ninth-generation virtual workstation and Remote Graphics Software 7.1. Simpler Software, Shift to Small Businesses to Shape 3D Printing in 2015 The 3D printing pavilion at the CES 2015 has outlined five main trends to follow this year, all of them proving that the technology is moving closer to the end consumer, becoming cheaper and increasingly more versatile in terms of applications and printing materials. First of all, 3D printer makers are putting effort into simplifying the software their machines use. So far it has been CAD software, and that’s pretty tough to grasp by non-engineers. But now things are getting simpler, with scanners that can turn any item and transform it into a 3D printing design. Next, there is the growing range of materials used in 3D printing. Nylon, wood composites, stone, metal, ceramics are all food for 3D printers now, making the machines more appealing for household consumers as they would allow them to actually print something they could use, not just experiment with shapes and sizes for the fun of it. Thirdly, the technology is becoming more affordable in order to reach more market segments and not just large manufacturing companies that have the money to buy a huge 3D printer for prototyping. 3D Printing Market Matures, to Grow at 22% Thru 2025 3D printing is starting to mature, according to analytical firm IDTechEx. It expects the industry to expand at a compound annual growth rate of 22% over the next ten years, with the oil and gas sector joining the ranks of the industries where 3D printing is most used. The overall reach of the technology is vast – from medicine to aerospace – but challenges remain. One of these is the price of the machines, where there has been little change so far at the high end of the market. While consumer printers have been getting cheaper, industrial machines have seen almost no change in price. Geographically, the US is still leader in the technology, followed by Europe, and Asia still lagging behind but starting to gain on the other two through government initiatives aiming to stimulate 3D printing development.

Awareness of 3D Printing Growing but not Fast Enough More than one industry expert has insisted that 3D printing needs more people to be aware of it so it can fully come into its own. And it looks like things are moving in the right direction but slowly, says one such expert, Steve Heller. According to him, the discourse on the topic is not so much about what 3D printing is but how it can be used and why. This is a promising development but it's limited to the industries that actually employ the tech. One of the problems with this general awareness is that the 3D printing industry has still not succeeded in putting its finger on what exactly would drive consumer demand for its products. Ease of use and affordability have been oft repeated as major factors but there's no consensus on this issue. However, there seems to be agreement that new materials could be another big driver for general adoption of the technology among consumers. And what about innovation? Apparently, the industry itself is not the only one driving innovation in 3D printing. Universities and colleges are also working on expanding the horizons for 3D printing. This, among other things such as HP's entry into the playing field, makes 3D printing susceptible to serious disruption in the near future. Given the growth forecasts for the business, it's no wonder that many new hopefuls are likely to test their strength against the current leaders. As for trends, one big one is the growing appeal of metal 3D printing, which will drive the use of the technology in finished products, and not just prototypes. In fact, General Electric plans to 3D print 45,000 mission-critical jet engine fuel nozzles every year until 2020, a impressive plan by all means and an indicator that 3D printing is moving to finished products.

The Next Stage in 3D Printing: Self-Making Shapes It may sound like science fiction but researchers are already looking into objects that, once 3D printed, can reshape themselves over and over again. This is made possible by the combination of materials with different physical properties. For instance, if an object is made of two materials, one hard and rigid and the other capable of expanding four times, it would be possible for this object to deform itself into different Printing: under the influence of an external agent such as water. The potential applications for such items are endless – from home appliances, to baby care products that react to moisture and heat, to clothes and shoes that are capable of adjusting themselves to a changing environment in order to remain optimally comfortable.

Villa, Multi-story Building 3D Printed in China The Suzhou industrial park in China's Jiangsu province boasts 3D printed buildings such as a villa and a six-story apartment building. Interestingly enough, the materials used by the giant printers that did the job, were made from construction waste, which adds a whole new perspective to the benefits of this technology. Though the walls of the 3D printed buildings do not look as solid as brick and mortar, they do look solid enough -- after all, the waste they're made of is concrete, and when finished, the building will likely look like any other house built using traditional means. The company behind this is WinSun, the same company that last year revealed ten small houses that were 3D printed. The machines it used for the printing of the two buildings are literally huge: 20 feet tall, 33 feet wide and 132 feet long, but then you'd need something like this to print out a whole wall, wouldn't you? The walls, by the way, are reinforced with steel rebar plus beam columns, and the company says they are earthquake-resistant and uniquely flexible. Another benefit of this process is that it uses up to 60% less construction material and the time it takes to build something is equal to just 30% of the time needed for conventional construction. In addition, it needs 80% less labor, meaning less injury risks and much more affordable housing.

New Materials Expand the Horizons of 3D Printing 3D printing has been around for three decades now and despite the huge advancements, it has retained some shortcomings such as the materials used, which are still mainly plastic filaments. But companies are innovating and now things like paper, ceramics, rubber, wood and metals are starting to be used successfully in 3D printing. One company, for instance, Other Machine, is making it possible to literally carve a 3D object from a piece of any material you put in the machine. That’s the exact opposite to what we usually associate with 3D printing: adding layer after layer of filament. Instead, here we have the shape being carved out of a lump of material. Another company, Mcor Technologies, uses paper as its printing material. What’s good about this is that it’s much, much cheaper than plastic filaments, and it’s also faster. Color is added with ink, like with traditional 2D printers. Formlabs, on the other hand, makes stereolitography printers, one of the oldest 3D technologies, which involves a laser sintering melted resins in the shape wanted by the user. This allows for great versatility in the objects printed. One other advantage of laser sintering is that it provides for much higher resolution than other technologies, and it also prints very quickly.

Investors, Beware 3D Printing 3D printing is a hot industry right now and it's attracting investor attention, but is that wise? The way the industry is growing may very soon put profits under strain, according to sector analysts. Here is what's happening in 3D printing. First, patents are expiring, which is stimulating growing competition. This growing competition is pulling down prices and, consequently, squeezing profit margins but stimulating overall growth of the market. Lastly, there is a significant risk of disruption in the sector, meaning that with all the research and development work going into 3D printing, it's not impossible for a whole new sort of technology to emerge and render all the existing ones obsolete in a matter of years. The conclusion from these trends is that investors looking for longterm returns in 3D printing may do well to keep a close eye on industry developments.

SLS, FDM, SLA, and MJF -- Who’s the Fairest of Them All? Looking at the world of 3D printing, if you don’t have any close contact with it, might leave you with the impression that every company out there uses a different technology to print 3D objects. That is largely because the focus of the 3D printing discourse has been on the versatility of the process and its many actual and potential uses. But there are actually just three technologies on the market; that is, there were three before HP released its very own 3D printer using a proprietary tech: Multi Jet Fusion. The three were: selective laser sintering, the oldest one, fused deposition modeling, and stereolitography. Selective laser sintering, or SLS, uses as printing material powders of various things such as metal, glass, and plastic, and a high-power laser. The laser scans the object to be printed in layers and then fuses the powder into the object, layer by layer. This happens hidden from the eye, so it’s not a very spectacular process (if a spectacle is what you want). The level of precision is not the best when it comes to very fine details and it’s a slow process, but it’s an economical technology because all the powder that’s left after the printing of an object can be left where it is and used in another printing job. This eliminates the need for special support for the print object, unlike in fused deposition modeling. When it comes to materials, SLS is diverse -- all it needs is the powder, and many firms are working on newer, stronger, cooler powders. There is even one company, Puris, that makes titanium powder that could be used for 3D printing. Titanium powder, which is actually titanium oxide, is known in the industry but it also used to be very costly. According to Puris, however, its powder is now both affordable and high-quality, so we can expect a whole new kind of prototype done in titanium.

Next is fused deposition modeling, or FDM, both terms patented by Stratasys. Here we have a nozzle, or several nozzles, through which you feed a plastic filament or a metal wire. The nozzle gets heated to melt the filament or wire and “draws” horizontally and vertically, layer by layer, until the object is complete. While the nozzle or nozzles print, the platform on which the object is being printed moves down, or the nozzles move up to make space for the growing object. Experts say that FDM can reproduce tiny details with great precision, which is why it’s often used for rapid prototyping. Its main limitations are the speed of printing, an issue that all technologies have in common, and the not too great variety of print materials. But 3D printing companies are working on this. Just recently, MakerBot, one of the main players in this field, announced it was releasing a new polylactic acid filament that has the properties of materials like limestone, iron, and maplewood. Imitation it may, be but the company says the filament feels and behaves pretty realistically. The third main tech that 3D printer makers employ is stereolitography. This posh-sounding word refers to a process by which a laser sinters, i.e., cures, liquid resin into the desired shape, again layer by layer, following the 3D model developed by the software program. Basically, imagine the same process as with SLS, only not with powder, but with a liquid. According to SLA machine producers, the technology provides greater precision in the details than the other technologies and it’s also quicker. Yes, of course, they’d say this but lasers are lasers and, if you think about it, they are supposed to be precise. Last on the list, at least for now, is HP’s Multi Jet Fusion technology that’s based on its thermal inkjet 2D printing

technology. Ther mal inkjet basically involves a series of nozzles equipped with a heating agent that gets the ink hot until it expands and literally bursts through the nozzle, ensuring quick turnaround time for the print job. Now HP claims that its MJF technology can bring the advantage of speed into the 3D printing industry. Of course, accompanied by precision in details and smooth sur faces and affordability. In the materials department, HP is ambitious to make filaments involving stuff like ceramics and metals, and biodegradable materials. Admirable ambition, we’ll have to wait and see how it turns out. So, which one is the fairest of them all? It’s really hard to give a universal answer to this one, so I’d go with “Depends on what you need it for”. If you want to have a 3D printer at home to experiment with the technology and get your kids to know it, then a small FDM printer is perhaps your best bet, not least because you can actually see with your own eyes how it prints, and that’s cool. But if we’re talking about a car manufacturer, they’d probably be more willing to use an SLS or SLA machine for the strength and precision. The future looks bright for all of these technologies, by the way, and that’s because of one thing: their flexibility and adaptability. One company, for instance, uses a process similar to SLS to 3D print stuff from paper, simple office paper. FDM, for its part, is moving in the direction of using more and more colors, making it possible to print multi-colored prototypes, like Nike does already, and from different materials as well. It’s a safe bet that in the near future, the focus will be on the new materials, and not so much on the technology itself, so prepare for some more stunning news from the 3D printing field.

Epson Diversifies into Mobile POS Solutions At the beginning of this month, Epson announced it had joined forces with US company Touch Dynamic for the development of point-of-sale solutions for shops and hotels. Earlier than that, it also showcased a range of POS solutions, including peripheral device control systems and tabletbased POS support solutions. In this area, Epson has applied for two new patents in the US. One is for a method that adds marketing value to a printed receipt. The added value consists in bonus point coupons, company logos and adverts. The second patent application is for a double-sided receipt printer. What's new about this printer is that it prints on both sides of the paper without reversing the feed, thus avoiding jams, and also reduces paper waste in the form of white space. But Epson is not just active in POS solutions, it's also researching and developing robotic products. One new patent application in this field is for a set of systems that can guide robots around obstacles and help them avoid clashes that can damage them. Another application features a robotic controller of a manufacturing robot, and yet a third one focuses on making biological information detectors more accurate. In addition, Epson has developed an electronic wristwatch featuring a solar cell that powers the mechanism, and a new method for DNA testing. Of course, the company has not ignored its printer business, as evidenced in another patent application for the improvement of ink recovery mechanisms. A couple of other applications deal with impact detection in portable and touch-sensitive ones to ensure the smooth function of the devices, and with the more economical use of expensive inks.

HP’s 3D Printer Will Work with Intel Processors HP has selected Intel’s Core i7 processors for its Multi Jet Fusion 3D printer, which the company says will revolutionize the industry, providing for much faster printing speeds than any available technology at the moment. The printer will be officially released in 2016. This is not the first partnership between the two companies: HP is also using the Core i7 processors in its new Sprout computer, which, along with the 3D printer, make up the company’s growing Blended Reality ecosystem, an initiative aimed at integrating the digital and the physical to provide a more comprehensive, seamless experience. This year the processors will be tested in HP’s Open Customer Collaboration Program before the launch of the 3D printer.

With this acquisition, Perceptive Software expands its offering to healthcare providers by enabling referring physicians and clinicians to access, view and collaborate on patient information and medical images that reside outside the electronic medical records (EMR) systems, while concurrently image-enabling the EMR and providing easy Web-based access via desktop and mobile devices. Claron and Lexmark's other healthcare technology acquisitions are enabling Perceptive Software to further expand its medical content management strategy. The combination of Perceptive

Software's content and process management platform; industry-leading VNA functionality to enable centralized storage, management and medical imaging sharing; and the universal viewer, will enable Perceptive Software to offer unique, interoperable solutions with vendor neutrality that help eliminate silos that exist today within, and between, healthcare organizations. The result is improved access to content and better patient care. The acquisition of Claron demonstrates the consistent execution of Lexmark's capital allocation framework, which is to pursue acquisitions that support growth and increase software and solutions capabilities, while returning more than 50 percent of free cash flow to shareholders, on average, through quarterly dividends and share repurchases. As part of this transaction, the surgical navigation portion of Claron will not transfer to Lexmark and will operate under the name Claronav.

Ricoh Announces ADR Ratio Change Ricoh Co, Ltd. resolved on a ratio change of its American Depositary Receipts (ADRs). As a result, one American Depositary Share (ADS), which currently represents five underlying shares of Ricoh Co, Ltd, will represent one underlying share. New ratio will be effective January 13, 2015 (U.S. EST). The ratio change will result in a distribution of 4 additional ADSs for every one held. Re-manufacturing the HP Enterprise Flow MFP M880 and M855 Toner Cartridges By Mike Josiah, Technical Director of UniNet Imaging

Mike Josiah Mike Josiah is the Technical Director at UniNet’s East Coast office, a global distributor of toner, Smartchips, OPC drums, and other toner remanufacturing components. Mr. Josiah is an industry veteran since 1987, and a member of ASTM committee F.05, the STMC Technician Certification committee, as well as an STMC trainer. He and his support team at UniNet contribute with technical articles to industry trade magazines, and conduct seminars at association meetings and tradeshows worldwide.

The HP M880 and M855 printers were introduced in October of 2013 and are based on a 46ppm, 1200 DPI laser engine. The processor is rated at 800MHz, and the memory is for the M855 is fixed at 1Gb, the M880 is fixed at 2.5Gb but also has a 320Gb hard drive.

The Drum units used are: The engines for both machines are very similar as are the cartridges but they are NOT interchangeable. There are Physical differences that prevent using cores across the machines plus different chips. Figure A shows the main physical difference between the two toner cartridges. It’s interesting to note that both machine groups share the same drum units. (See Below) Both series of these p r i n t e r s a re v e r y large and very expensive. The cartridges are also large and expensive. This is good news for us as the margins are high and they are high use machines. They have separate Figure A toner and drum units and the toner cartridges are very easy to remanufacture. All cartridges use chips that need to be replaced each cycle. The two groups of machines are the: Color LaserJet Enterprise M855dn, M855xh (826A toner series) Color LaserJet Enterprise M880z, M880z+, M880z+NFC/Wireless Direct (828A toner series)

Re-manufacturing the HP Enterprise Flow MFP M880 and M855 Toner Cartridges 1) The toner cartridge does not have a fill plug or an opening large enough to clean or refill it through. Because of this, the cartridge needs to have a hole cut. This is best done with a soldering iron with a screw in tip and a ½â€? copper plumbing end cap drilled, filed and screwed on the iron. You can also drill the hole, but you must be very careful not to get plastic shavings inside the cartridge. See Figure 1. The soldering iron was bought at Radio Shack. The tip is not a common thread size, but a #8 screw can be forced in. If the screw is too long, use lock washer to take up the space.

6) Clean all the remaining toner, and fill with toner for use in the M855 and M880 printers. See Figure 7 7) Cover the hole with a good quality label seal Check for leaks. See Figure 8

Figure 1 2) The best place to do this is under the end cap. This way there is no chance the sealing label will be pulled off. Carefully peel off the label on the end cap. The label is easily torn to take some care in removing it. See Figures 2 & 3

10) Slice the melted plastic off and if using screws to re-attach the cover, drill 4 small holes in the areas indicated on the seal cover. The preferred and easier method is to use a hot glue gun to secure the cover when re-attaching it.

Collection of Significant Events about Patents in 2014 2014 年耗材行业形势风起云涌,原装厂商 在多个国家掀起对再生耗材企业的起诉,专利 案件叠起,原装厂商在全球各地,如:美国、 韩国、俄罗斯、英国等国家区域,掀起对再生 企业的侵权起诉,环保再生行业路在何方?如 何面对专利产权的挑战,出路是积极申请自己 的专利,做强再生耗材产业。 1. { 惠普、佳能、爱普生在美国专利案件 } 2014 年 1 月惠普向通用耗材发出第三版白 皮书。敦促通用耗材商调整芯片产品,使用惠 普最新版本的固件,固件在惠普网站下载。 2013 年 10 月惠普在珠海产业峰会上首次 发布技术白皮书,敦促通用市场对用于惠普激 光打印机的通用芯片做出必要调整。同年 12 月, 惠普又发出第二版白皮书,要求通用耗材业对 相关芯片进一步做出其它必要调整。 { 佳能 ( 美国 ) 向纽约南区联邦法院起诉 } 1 月 29 日 , 佳能 ( 美国 ) 向纽约南区联邦 法院提出起诉 18 家耗材再生企业。这些公司涉 及侵犯了硒鼓中感光鼓齿轮的相关专利,该专 利齿轮用于佳能和惠普 50 多款激光打印机中。 佳 能 提 出 的 这 个 诉 讼 案 涉 及“ 加 密 齿 轮”(dongle gear) 中的 9 项专利,而所涉及的 打印机虽然发布于 2004 年,但仍存在着巨大的 通用耗材市场空间。 天 威 发 表 声 明, 称 他 们 4 家 公 司( 天 威 控股有限公司、天威北美分公司 (Print-RiteN. 据悉,这是国内第一起 3D 打印机专利侵权案例,西通与天 威的侵权纠纷始于天威于 2014 年 5 月在淘宝和京东启动销售的 首款桌面级 3D 打印机。珠海西通在起诉书中说,早在 2013 年 11 月, 珠 海 西 通 就 申 请 了 专 利 号 为 ZL201320463657.2 《3D 打印机挤送装置实用新型专利》。这项专利描述了 FDM 3D 打 印机打印喷头独有的 ABS 线材融溶挤出设计,属于市场流行 桌 面 FDM 3D 打 印 机 生 产 厂 家 绕 不 开 的 核 心 专 利。 目 前 包 括 MAKERBOT、CUBE、REPRAP 在内的十几家 3D 打印厂商都在 生产销售此类机器,西通希望已经在使用此技术的其他国内外企 业能够尊重其专利。 根据判决书,在挤出装置和外观专利两项侵权起诉中,西通 最初向天威索赔 40 万元,而中级法院裁定的赔偿金额不到这一 数额的一半。 一不愿具名的专家透露,根据法院判决的结果以及西通对于 此次诉讼的态度,16 万元还不是天威经济赔偿的全部。包括西通 递交法院诉讼之日起,天威所销售的 3D 打印机产品利润按照法 律规定都要归西通,并在判决生效之日起必须停止制造、销售侵 权产品。而天威作为桌面机的的终端厂家之一,多款产品销售恐 将受波及,这对于天威雄心勃勃启动的 3D 打印机市场的销售来 说,可能是个不小的打击。 珠海西通执行董事杨晓婷近日表示:“天威侵权 3D 打印机 产品的销售量在数千台以上,并且目前该产品仍在市场上销售, 而由于西通起诉时间在 2014 年中,因此这个赔偿金额只涉及到
