n November 2017, new advertising and business name regulations for real estate license holders were adopted during the 85th legislative session. Advertising, which includes marketing and publicizing your real estate services, is something that most license holders deal with on a daily basis, but surprisingly, some REALTORS have managed to miss the news. The new rules, which are upheld and ex-
plained by the Texas Real Estate Commission (TREC), may require you to order new business cards, update your website or even change your print ads. One of the statutes requires license holders to register a new business name with TREC. There’s less than a month to go before the deadline.
Here’s what you need to know: Senate Bill 2212 has been in development for two years. It details new rules regarding business name registration and advertising guidelines for brokers and real estate agents. Justin Landon, vice president of government affairs at San Antonio Board of REALTORS (SABoR), says “It’s like a [TREC] housekeeping bill that addresses a lot of little issues that people are facing.” The first part of the rule, regarding your business name and registration, includes these provisions: • Alternate names, associated broker, DBAs, and team names must be defined in ads • Business name must be registered with TREC before it can be used in advertising • DBAs and team names are registered by the broker; alternate names are registered by individual license holders • Team name can not be a broker’s DBA; and it must end with “group” or “team”

Here are the rules regarding advertising: • Name of the license holder or team name must be easily noticeable in all ads • The broker’s name must be in all ads and must appear no less than half the font size of the largest contact information for the agent, team name or associate broker. (There is leeway regarding social media advertising.) For social media ads, text messages, emails
and other online marketing outreach, the required information can be located on a separate page. The only condition is that the public must be able to easily access the name of the broker or brokerage on another page (via hotlink or URL). To comply with the new rules, Shawn Rooker, an agent with Realty Austin, added this information on all of his electronic correspondence and social media advertising: “Texas law requires all license holders to provide the Information About Brokerage Services form to prospective clients.”
He includes a hotlink that takes consumers to a TREC-approved document with the name, license number and contact information for the brokerage, designated broker, licensed agent supervisor and the agent’s name. By passing new naming rules and advertising guidelines, as well as amending some older rules, TREC is aiming to prevent the public from being “misled or deceived,” according to

pring temperatures in Austin are on the rise, and the same goes for ways to get involved and stay plugged-in with ABoR and other Central Texas REALTORS this spring. Here’s the latest in around your REALTOR Association:
Need to Know: TREC Advertising Rule Changes In February, TREC passed advertising rule changes that impact the way a brokerages’ teams or groups can market themselves. Effective May 15, a team or group must clearly communicate their affiliation with their broker in all advertisements and marketing materials to avoid the implication that the team is offering brokerage services independent of the broker. In addition, TREC also removed the word “realty” from the list of terms that are prohibited in team or group names. Advertising rules in our industry can change quickly, and it’s up to agents and brokers to stay on top of such changes to ensure they’re in compliance. Get the details on these new

Tell Your Clients: City of Austin Carbon Monoxide Ordinance As of April 1, a majority of homeowners within Austin’s city limits will be required to install and maintain carbon monoxide alarms. More than 1,500 accidental deaths and 10,000 carbon monoxide related-injuries are reported in the U.S. each year. Point of sale is a great time to mention this new ordinance and if you’re representing buyers, underline your value by advising them to look for operational detectors during the inspection and option period. Be a professional!
P
rofessionalism comes in many different forms. By definition, professionalism marks the difference between an amateur and a pro (pro being short for professional). Anyone can call themselves a professional, but what does it really take to be able to call yourself a professional? Own it! The use of the word REALTOR should immediately inspire confidence in your clients. By being a REALTOR, you’re more than just a licensed real estate agent. You are a proud member of the National Association of REALTORS. The term REALTOR has one meaning only. It is a membership mark used to identify a member of NAR. Members of the National Association of REALTORS subscribe to a Code of Ethics. NAR updated your code of ethics for 2018. If you haven’t read them in a while, I suggest a review of them and make sure you’re adhering to the Code! Failure to uphold the Code of Ethics can land you in a Professional Standards hearing! Stay out of trouble and be a professional by visiting nar. realtor/com.
Know it! Your clients expect you to be the expert, that is why they hired you and why they’re paying you! Being a professional for your client is more than knowing about the property. Anyone can read off an MLS tear sheet. It is knowing about the community (or communities) which you sell. What is the tax rate? How are the schools rated? Is it located in a MUD? What is the crime rate? What is the lifestyle like in this area? What future developments are coming? These are important things to know. Professionals attend more than the required number of course hours each year. A true professional sees education as an investment in themselves and not just an expense of being a REALTOR. By belonging to WCREALTORS, you get discounts on education classes. Why not get your dues worth and stay educated! The Association also hosts training opportunities on “hot topics” throughout the year. Attend trainings and learn what is going on in your community as well as your industry! It will make you a better real estate agent, and a

professional that your clients and your peers trust and respect! REALTOR Magazine has an amazing selection of toolkits for every agent. Professionals don’t keep their knowledge bottled up inside them, they share it with the world. Marketing experts still say that having a blog updated at least once a week is one of the smartest marketing opportuni-
ties for a REALTOR. Take the knowledge you learn and share it with your sphere of influence – you never know who you might impress – real estate is a referral business after all. Join a committee at the local, state or national Association; get involved, network, get to know the movers and shakers in the industry. Find a leader you respect in the industry, see if they would be willing to help mentor you. These are all things professionals do. You’ll be amazed at how little changes within your business and your professionalism can pay off big in your business. RL

he HBA is pleased to announce that the 2018 Parade of Homes builders have been revealed. Last month, in partnership with Travisso and Platinum Top 50 REALTORS, the HBA hosted a special Big Reveal event at the new Fairmont Hotel in Austin where the four builders were introduced to more than 200 REALTORS and HBA members. Aluxa Homes, Glazier Homes, Hill Country Artisan Homes and Vogel Builders will showcase ultra-luxurious homes all priced above $1 million that range from 4,000 to over 6,000 square feet. Each builder is approaching their Parade home with a different vision in style — from Hill Country Modern to Scandinavian Farm House, visitors will be delighted to visit four very different homes featuring the latest in architectural style, interior design, landscape design and home technology. The 2018 Parade of Homes will be hosted at Travisso in Leander, a beautiful luxury home community with Italian-style homes overlooking some of the region’s most picturesque Hill Country views. With Lake Travis’ north shore just two miles away and its proximity to
shopping, schools and area attractions, Travisso is perfectly positioned to be at the epicenter of one of the fastest growing counties in the country. The 2018 Parade of Homes will have new features that have not been offered before, including informational seminars and workshops on Saturdays and Sundays as well as select special events that promise to bring the Parade of Homes to a whole new level. Slated to open this fall, the 2018 Parade of Homes will kick off with a VIP Preview Party on Wednesday, Oct. 17 followed by a grand opening to the general public on Friday, Oct. 19. The Parade will be open Fridays through Sundays, 11 a.m. to 7 p.m. until Nov. 4. Earlybird tickets are on sale now for $13 each. For the first time, all-access passes are also available for $25. An all-access pass will allow the user to come and go as often as they’d like (during operating hours of course) as well as access to special events. REALTORS are invited to attend exclusive REALTOR Days on from 2-7 p.m. on Thursday, Oct. 25 and Thursday, Nov. 1 when the Parade will be closed to

Don’t forget to include checking your e-mail and business website. “Remember if or when a complaint is filed against you, enforcement will look at everything. This includes the broker's name and size in all your advertising including your e-mail. Information about brokerage services above signature...everything," says Avis Wukasch, Texas Real Estate Commission chairperson. If you have taken the most current Legal Update in 2018 you most likely are already familiar with these rules. If not, be sure to educate yourself by attending a class or watch the one-hour online town hall event from Feb. 22, 2018. Doug Oldmixon, executive director of TREC explains everything you need to know on the Youtube video or read the advertising rules on the TREC’s website at www.trec.texas.gov/article/ trecs-advertising-rules-what-you-need-know. There is an excellent article that gives ex-
amples of advertising which is acceptable in the January/February 2018 Texas REALTOR Magazine. Some of the highlights include: TREC requires you to provide a link to the Consumer Protection Notice and a completed Information About Brokerage Services notice in a readily noticeable place on the homepage of your business websites. The term “business website” means a website, including social media, that is accessible to the public, has content controlled by the license holder and has information about the license holder’s real estate business. For social media accounts, the links may be in the account’s profile or on a separate page or website through a direct link from the social media platform or profile. Just remember your broker will be responsible for making sure your advertisements are complying. If you have any questions, know that they are a valuable resource to you. et me introduce myself….. My name is Ms. Adver Tisingrules. Yes, I go through changes every now and again – a little nip here, tuck there, updates are needed! The main reason is so you and the general public know me completely and clearly. Yes, I’m a bit vain, but I am very important! You do not want to get on my bad side! The Texas Real Estate Commission (TREC), my dearest associate, and I go way back. We have collaborated with my main focus being clarity for consumers with the least restrictions on license holders. I just hate being restricted, don’t you? It’s so uncomfortable, but sometimes necessary. My updates, revisions and interpretations balance requirements that support free commerce and business competition with those protecting the consumer from misleading advertisements. And we don’t want anyone to be misled! I have kept the ability to use my other names such as “Broker”, “Agent”, “Licensed By The Texas Real Estate Commission” and other terms of endearment, so that’s good. There are actually chapters written about me. Check out Chapter 1101.652(b)(23); it describes how a license holder cannot be misleading or imply that they are the responsible party (wait, did someone say party? Wrong kind.) and the name of the Broker must be included. Oh, here’s another: Chapter 1101.156(b); so this one limits TREC from regulating certain forms, size or duration of me, personal appearance (which I can be pretty spectacular!) or voice or even the use of registered assumed business names. There is more on this chapter, so you’ll want to read it. So, that’s just a little background on me! Now, my friends at TREC and I decided that more clarification was needed - back to re-
vamping who? Me! I needed this to separate the requirements regarding names and their registration from my requirements (meaning advertising requirements). So, to get more specific, TREC’s rule §535.154 REGISTRATION AND USE OF NAMES (the number for me), defines alternate name, associated broker, assumed business name and team name. So to use one of these in me, you have to have them registered with TREC, which hasn’t changed. But the most significant change concerns team names. Looky here: “A team name is not an assumed business name of the broker and cannot contain terms that imply that the team is offering brokerage services independent of the broker. Team names must end with the terms “team” or “group.” Don’t believe me? This is taken straight from TREC’s site (https://www. trec.texas.gov/article/trecs-advertising-ruleswhat-you-need-know ) Here’s another one, TREC’s rule §535.155 ADVERTISEMENTS (That is me me me me me!) I will also quote here: “All license holders’ advertisements must include the license holder’s name or team name. It also must include the broker’s name in at least half the size of the largest contact information for any sales agent, associated broker or team name contained in the advertisement. Understanding that advertisements take many different forms today, the Commission revised the exception for social media to allow more flexibility. An advertisement on social media will comply with the rule as long as the license holder has linked to the required information in the account profile or the information is readily accessible by a direct link in the advertisement.” Again, straight from TREC’s site (see above). I
There are many ways to help a family member buy a home
’ve seen it reported that anywhere between 10-20 percent of parents with children ages 18-35 anticipate assisting them in the home buying process within the next five years. More often than not the parents are volunteering to help but some are greeted with an “I need to ask a favor; would you mind co-signing this loan for me?” request. If they are able, almost all are willing to help under either circumstance. Whether that willingness to help is motivated by wanting them out of the house or just to help them in their journey, it is left for you to contemplate. Helping someone out is a great thing, but planning and understanding the risks before you decide how to help is good advice. Let’s take a look at three general ways you might assist with their mortgage loan: (1) helping with their credit, (2) assisting with the down payment or (3) supplementing their ability to qualify for the monthly mortgage payment. The first option is the simplest and carries little risk for the donor. Imagine your 18-35 year old’s credit report shows they pay their bills on time, but they don’t have that many active accounts, and those accounts that are reporting
haven’t been opened for very long. You can actually “share” your good credit history by making them an “authorized user” on one of your revolving payment accounts. It may take a couple of months before it is reported as part of their credit history, but they will likely benefit from your good record of payment. This is acceptable, so long as both parties have an actual relationship – in other words, you aren’t doing this for strangers for a profit or something similarly deceptive. While there’s a chance your history will not appear on their account, your credit history will normally help their FICO score if your credit history is better than theirs. This can help them buy a car or even a home. A higher investment than the previous suggestion, but also low risk to the donor, is to assist by contributing “gift funds” for a down payment. Gift fund donors cannot be just anyone. Painting with a broad brush, most “acceptable” donors are immediate family members or those who can document a relationship comparable to an immediate family member, but can not be friends, associates or parties to the transaction. If you
are contemplating a gift, be prepared to provide a gift letter signed by both the donor and recipient which discloses the relationship of donor to recipient, address of donor, amount of gift, source of funds, declaration of no expectation for repayment, and address of the property being purchased. Any funds disclosed or used for the purchase transaction must be sourced and documented or “seasoned” funds. Seasoned funds are those assets that have been in the borrowers control for at least 60 days. This is another reason to plan ahead. If you planned months or years ahead, you could set up a down payment savings account for each child, putting money in regularly just as you do for their college expenses. With the account in both names, you can then simply let them use it for their down payment. Don’t forget to consider income tax implications for everyone involved. The third category is to accept an obligation to repay the mortgage as a non-occupying co-
borrower. Co-borrowers for primary residence properties will either occupy the home with the borrower (occupying co-borrowers are typically spouses) or they never intend to occupy the home (family members assisting the borrower). As with gift funds, there are relationship requirement guidelines relative to qualifying for nonoccupying co-borrower status. As co-borrower you have an interest in the property, a responsibility to repay the debt and the payment history on that loan does count on your credit history – their problems become your problems. With good payment history and documentation evidencing the borrower has been making the monthly payments, the debt should not count against your debt load when applying for a new mortgage. You can help your family members with their home purchase in more ways than one. As is typical with any mortgage transaction, planning ahead and knowing what you can and can’t do can make the process easier. RL

One way the public might assume that you have an ownership stake in a brokerage is if your name also happens to be part of the broker’s name. For example, if you’re Michelle Smith and the brokerage is called Smith Sisters Brokerage, consumers may believe that you’re a broker or operate the business in some way. TREC suggests registering your business under an alternative name (or DBA, doing business as) for marketing and advertising purposes. These new name registration and advertising rules take effect on May 15. By this date, your alternate name, DBA, or team name, must be registered with TREC in order for you to place ads, whether they’re in print, online, on TV, radio, billboards or on brochures. There are even more ways you can inadvertently violate TREC’s new rules. Sending emails or text messages to the public, handing out business cards and posting properties and business announcements on your Facebook and Instagram pages are also under the advertising umbrella. Real estate license holders who are most confused about TREC’s new rules are those who don’t do their own marketing, promotions, and advertising – primarily those who work with an agency. But one shouldn’t assume that just because you don’t order your own business cards, write your own ads or post property photos on Pinterest that you’re in the clear. Just getting the font size of your broker’s name off a point or two could put you in violation of the statutes. Fortunately, the deadline is a few weeks off. Don’t wait until you receive a notice of violation in the mail. Go to TREC’s website right now and find out what you need to do. RL

To help minimize confusion, license holders can go to trec.texas. gov to see nearly two-dozen examples of advertisements that can “create the impression that a sales agent operates or is responsible for a brokerage,” which is a violation of the Texas Real Estate Licensing Act (TRELA) code of conduct. And Article 12 of the National Association of REALTORS’ Code of Ethics reads, “REALTORS shall be honest and truthful in their real estate communications and shall present a true picture in their advertising, marketing and other representations.” Along with passing these rules, another older statute was repealed. License holders were required to put their designation – i.e. “REALTOR,” “agent,” or “broker,” – after their name in all advertising. According to TREC, you can still use these terms in advertisements but it’s no longer a requirement. TREC’s examples for how license holders can violate the new rules and mislead consumers include using titles like “owner,” “president,” and “CEO” after the agent’s name. Doing this can give the impression that an agent runs a brokerage. And the wording in a website URL or email address can also imply ownership of a
