The Noláh project is currently in the pre-sales phase. Construction has already started, and delivery is expected in 18 months (around the end of March 2026).

Noláh is located in Bahía de las Palmas, Fonatur, an exclusive gated community by the sea. It is in an area with over $100 million USD in construction investments, including a high-end hotel and residential projects like EMMA (emma-residences.com) and Albaluz.

This will make it, in three years once fully operational, one of the most modern and luxurious areas of San José del Cabo.

What types of units are available?

The Noláh project offers 16 exclusive residences:

It’s important to clarify what is meant by pet-friendly. The answer is yes, residents are allowed to have dogs and cats in accordance with the condominium’s regulations However, some misunderstand “petfriendly” to mean that pets take precedence over people, which is not the case.

Does it have security?

Given the size of the project, with only 16 units, having 24-hour security would be very costly. However, there will be electronic access control, a video surveillance system, and a superintendent in charge of building maintenance and common areas.

What is the HOA fee and what does it include?

The expected fee is $4.00 USD per month per exclusive square meter. It includes: electricity for common areas, water pumping, water softening, elevator maintenance, cleaning of common areas, gardening, maintenance and cleaning of the rooftop garden, professional condominium management, virtual CCTV security, major damage insurance policy for common areas, and equipment.

How do the shared amenities with Albaluz work?

These are not shared amenities with Albaluz; each project has its own amenities, and they should not be confused as common or shared. Albaluz has a pool with sun loungers exclusive to Albaluz residents. However, Albaluz also has three public service spaces. Noláh residents will have preferential access to Albaluz's Beach Club, gym and spa, and lobby bar. This preferential access includes reservations and discounts on consumption.

What finishes does it have?

Practically the same as Albaluz in terms of quality and material specifications, but the look and feel is different, as seen in the renderings.

Do you offer a furniture package?

Yes, the cost is the same as in Albaluz.

$35,000.00 USD for a one-bedroom unit, $50,000.00 USD for a twobedroom unit, $65,000.00 USD for a three-bedroom unit.

What is the cistern capacity?

Raw Water Cistern: 39,000 liters

What is that construction on the corner, does it produce odors?

That construction is an underground pump station. It does not produce odors. It will be maintained, and there is a beautification and integration project for it.

When will the building in front be constructed and completed?

The intention is to complete the project on lot 5 by December 2027.

Does the price include appliances?

Yes, the same ones as in Albaluz.

How will the rooftop cabanas be delivered?

Sink, sink cabinet, minibar, TV screen, outdoor seating, and 2 sunbeds.

How much will parking cost?

There will be hourly and monthly rates, with special rates for Noláh residents. Pricing has not been defined yet, but it will be competitive and affordable.

Will there be storage rooms and insurance or protection against natural disasters?What type of storage room?

The apartments do not have extra storage rooms. The insurance is contracted by the condominium and is included in the HOA fee, but it only covers equipment and common area damage. Each owner must purchase their own insurance.

Will vacation rental platforms be allowed?

So far, we haven’t structured a rental program like BE Part of Albaluz. Therefore, vacation rentals will be allowed, but they will have to be regulated by the HOA rules.

Will renters have access to Albaluz amenities?

The benefits of priority reservations and discounts at Albaluz’s service areas are exclusive to Noláh owners. Renters will have to book and pay general public rates.

En todas las transacciones comerciales de compraventa de casa habitación, el proveedor se compromete a que éstas se lleven a cabo conforme lo dispuesto en la LFPC, su Reglamento y a esta NOM, por lo cual reconoce que los consumidores cuentan con los siguientes derechos:

1. Recibir, respecto de los bienes inmuebles ofertados, información y publicidad veraz, clara y actualizada, sin importar el medio por el que se comunique, incluyendo los medios digitales, de forma tal que le permita al consumidor tomar la mejor decisión de compra conociendo de manera veraz las características del inmueble que está adquiriendo, conforme a lo dispuesto por la Ley.

2. Conocer la información sobre las características del inmueble, entre estas: la extensión del terreno, superficie construida, tipo de estructura, instalaciones, acabados, accesorios, lugar de estacionamiento, áreas de uso común, servicios con que cuenta y estado general físico del inmueble.

3. Elegir libremente el inmueble que mejor satisfaga sus necesidades y se ajuste a su capacidad de compra.

4. No realizar pago alguno hasta que conste por escrito la relación contractual, exceptuando los referentes a anticipos y gastos operativos, en los términos previstos por la LFPC.

5. Firmar un contrato de adhesión bajo el modelo inscrito en la Procuraduría Federal del Consumidor, en el que consten los términos y condiciones de la compraventa del bien inmueble. Posterior a su firma, el proveedor tiene la obligación de entregar una copia del contrato firmado al consumidor.

6. Adquirir un inmueble que cuente con las características de seguridad y calidad que estén contenidas en la normatividad aplicable y plasmadas en la información y publicidad que haya recibido.

7. Recibir el bien inmueble en el plazo y condiciones acordados con el proveedor en el contrato de adhesión respectivo.

8. En su caso, ejercer las garantías sobre bienes inmuebles previstas en la LFPC, considerando las especificaciones previstas en el contrato de adhesión respectivo.

1. Que una vez ejercida la garantía, persistan defectos o fallas en el inmueble. Asimismo, a que se realicen las reparaciones necesarias en caso de defectos o fallas imputables al proveedor, u optar por la substitución del inmueble o rescisión del contrato cuando proceda

2. Contar con canales y mecanismos de atención gratuitos y accesibles para consultas, solicitudes, reclamaciones y sugerencias al proveedor, y conocer el domicilio señalado por el proveedor para oír y recibir notificaciones.

3. Derecho a la protección por parte de las autoridades competentes y conforme a las leyes aplicables, incluyendo el derecho a presentar denuncias y reclamaciones ante las mismas.

4. Tener a su disposición un Aviso de Privacidad para conocer el tratamiento que se dará a los datos personales que proporcione y consentirlo, en su caso; que sus datos personales sean tratados conforme a la normatividad aplicable y, conocer los mecanismos disponibles para realizar el ejercicio de sus Derechos de Acceso, Rectificación, Cancelación y Oposición.

5. Recibir un trato libre de discriminación, sin que se le pueda negar o condicionar la atención o venta de una vivienda por razones de género, nacionalidad, étnicas, preferencia sexual, religiosas o cualquiera otra particularidad en los términos de la legislación aplicable.

6. Elegir libremente al notario público para realizar el trámite de escrituración.

Content of the Letter of Consumer Rights

In all commercial transactions regarding the purchase and sale of real property, the supplier is obliged to ensure that they are carried out in accordance with the provisions of the Federal Consumer Protection Law (LFPC), its Regulations and this NOM, and therefore acknowledges that consumers have the following rights:

1. Receiving, concerning the real property offered, truthful, clear and updated information and advertising, regardless of the means of communication, including digital media, allowing the consumer to make the best purchase decision by knowing truthfully the characteristics of the property been acquiring, by the provisions of the Law.

2. Knowing all the information regarding the characteristics of the property, such as: the extension of the land, floor area, type of structure, facilities, finishes, accessories, parking place, common use areas, utilities, and the general physical condition of the property.

3. Choosing the property that best meets the consumer’s needs and fits the purchasing power.

4. Not to make any payment until the contractual relationship is set in writing, except for advance payments and operating expenses, in accordance with the terms set forth in the LFPC.

5. Signing an adhesion contract registered in the Federal Consumer Protection Agency, in which the terms and conditions of the sale and purchase of the real property must be stated. After signing the contract, the supplier is obliged to deliver a copy of the signed contract to the consumer.

6. Acquiring a property that has the safety and quality characteristics contained in the applicable regulations and reflected in the information and advertising received by consumers.

7. Receiving the real property within the terms and conditions agreed upon with the supplier in the respective adhesion contract.

8 If applicable, the enforcement of real property guarantees provided for in the LFPC, considering the specifications set forth in the respective adhesion contract.

Receiving the corresponding bonus or compensation in terms of the LFPC, if, once

1. the guarantee has been enforced, defects or faults persist in the real property. Including the right to the necessary repairs made in case of defects or faults attributable to the supplier or opting for the replacement of the property or termination of the contract.

2. Having free and accessible reporting channels and processes for consultations, requests, claims and suggestions to the supplier, and knowing the address indicated by the supplier for service of process.

3. Protection by the competent authorities and in accordance with applicable laws, including the right to file complaints and claims before said authorities.

4. Access to a Privacy Notice to know the treatment that will be given to the personal data provided by the consumer, giving consent thereof and ensuring that personal data will be treated in accordance with the applicable regulations; in addition to making available to the consumer mechanisms to exercise the Rights of Access, Rectification, Cancellation and Opposition.

5. Receiving a treatment free of discrimination, without the support or sale of a real property being denied or conditioned for reasons of gender, nationality, ethnicity, sexual preference, religion or any other particularity under the terms of applicable law.

6. Freedom to choose a notary public to carry out the deed process.
