Planning to bid? The atmosphere of a live auction room is electric, and while the process moves quickly, buying under the hammer is one of the most transparent ways to secure property. Because an auction contract is completely unconditional, preparation is key on the day. Strategies for the Room Determine your maximum limit while you are in a calm, clear state of mind prior to the event, and commit to sticking to it. Most buyers set limits at round numbers (like $800,000). Setting an unconventional limit (like $803,000) can give you the winning edge over competitors who stop on the psychological baseline. Stand or sit where you have a clear, uninterrupted view of both the auctioneer and the rest of the room. When you bid, do so with clarity and confidence to signal your intent to other active buyers. You can start with a strong opening bid to assert your position, and choose to counter subsequent competing bids quickly to maintain momentum. If you prefer to remove the emotion entirely from the room, you can formally appoint a trusted buyer's agent or representative to bid on your behalf. Standard Terms & Conditions The property is offered for sale subject to a reserve price set by the vendor. Subject to that reserve being met, the highest bidder accepted by the auctioneer will be the purchaser. The auctioneer regulates the bidding process, including the increments by which the bidding may be raised, and reserves the right to refuse any bid. The vendor reserves the right to bid personally, through the auctioneer, or via a designated representative, provided the bid is strictly below the reserve price. The auctioneer will clearly identify every vendor bid as it is made. The vendor maintains the right to withdraw the property from the market at any point prior to it being declared sold, without disclosing the reserve price. Should any dispute arise regarding a bid, the auctioneer holds the authority to resolve the dispute or re-offer the property at the last undisputed bid. Upon the fall of the hammer, the successful purchaser must immediately: Sign the formal Memorandum of Contract. Pay a deposit corresponding to 10% of the purchase price (unless an alternative arrangement was agreed upon in writing prior to the auction through a signed variation). Complete any required GST and scheduling documentation.

Don’t go in with your eyes closed. The last thing you want when you’re buying a property is surprises. So it’s super important to get your eyes over the building and pest reports well before the big day. Issues like roof leaks or cracks in the wall could be no big deal, or an absolute deal-breaker. And it’s up to you to find out. Remember, the more you know, the stronger position you’ll be in to make a good decision on auction day. Ask the sales agent for the reports, and if they can’t supply them, consider getting them done yourself - it could absolutely be worth it.

Know what’s hiding in the fine print. Once you’ve made the winning bid, you’re expected to sign it there and then – so it’s important to do your ground work ahead of time. You and your solicitor should go over the details o you know exactly what you’re bidding on. For instance, are there furniture, fittings or extras included? Make sure you know the answers to all these questions before you get the paddle in your hand.


04 Know your limits. It’s so easy to get a bit carried away in the heat of an auction, so the smartest thing you can do is set yourself a concrete bidding ceiling before you arrive. Know what each jump in bid will cost in repayments. And know the number you will not go past, even if it breaks your heart. A good tip is to set your final price as an uneven number – so it’s much less likely you’ll have the same limit as anyone else. When it comes down to it, that uneven number could be what wins you the auction.

Get in the game – officially. You can’t just turn up and start bidding. In NZ, if you’re planning on raising a paddle, you’ve got to register to bid – before or on the auction day – with some I.D to prove you’re really you. Couple of tips here: be sure to ask if there are any changes to the contract while you’re registering; and consider having a friend or family member bid for you, if you think the emotion might get the better of you. Just remember if you do decide to have someone else bid for you, they’ll also have to register.

Keep your cool as things heat up. This is it. The big moment. And as bids start getting thrown around, this is the time to take a few deep breaths and remind yourself of the game plan. Try not see it as a competition, but as a gradual process of moving towards your price ceiling. It isn’t aprocess of moving towards your price ceiling. It isn’t a race, and it isn’t personal. And know that every bid you make is a very strong indication of your interest in the property. And while you don’t get told what it is until after the final bid, it’s worth keeping in mind that the vendors will have a reserve price they want to sell for. If your winning bid comes in below it, you might have to negotiate for a fair compromise, negotiate for a fair compromise.

07 Have your deposit handy. Make sure you have your deposit sorted in advance, because you aren’t winning an auction without it. You are usually required to pay a 10% deposit of the purchase amount on the day of the auction. Speak to the agent in advance to understand how the deposit can be paid and make sureyou are prepared.

Selling your Rental Property? THE BIG ONE

HERE’S WHAT LANDLORDS NEED TO KNOW

Selling the property doesn’t automatically mean the tenancy ends.

Selling a property with tenants in place is possible — and often attractive to buyers. But there are rules around notice, access and timing that every landlord should understand. A little planning now can save a lot of stress later. WHAT ABOUT ACCESS & OPEN HOMES? Your tenant is still living in their home, so access for photographs, viewings and other sale-related activity needs to be handled properly.

WHAT TYPE OF TENANCY DO YOU HAVE? PERIODIC TENANCY There are circumstances where you can end a periodic tenancy to sell the property, including where you intend to put the property on the market, or where the property has been sold unconditionally and the purchaser requires vacant possession. The notice period depends on the circumstances, so it’s important to understand exactly where you stand before making any changes to the tenancy.

You need the tenant’s permission for access, and tenants can set reasonable conditions around viewings. They can also refuse open homes or auctions being held at the property.

FIXED-TERM TENANCY Selling the property doesn’t automatically end a fixed-term tenancy. The tenancy will generally continue until the fixed 1 term ends, unless you and the tenant agree otherwise. Know what agreement you’re working with before you make a plan.

DO YOU NEED VACANT POSSESSION? Not always. A property can be sold with the tenancy in place, with the buyer taking over as the new landlord. For investors, this can actually be a positive — particularly when the property already has a good tenant, rental income from day one and less risk of an empty property between tenancies. Before giving notice, ask yourself: Does the property really need to be vacant to achieve the best sale?

Sometimes, the answer is no. NOTICE PERIODS MATTER

For a periodic tenancy, the notice period depends on the circumstances. If you want to put the property on the market and end the tenancy, different rules apply than if the property has already been sold unconditionally and the purchaser requires vacant possession. Don’t assume it’s simply “90 days because I’m selling”. The details matter.

THREE THINGS TO THINK ABOUT BEFORE YOU LIST: YOUR TIMING When does the tenancy end? When do you want to be on the market? Do those dates actually work together? YOUR BUYER Are you targeting an owner-occupier looking for vacant possession, or an investor who would be happy to take over a quality tenancy? YOUR TENANT A well-managed tenant relationship can make the entire sales process easier. Give them clarity and communicate early once a smooth sales plan is established.
