ocal chef, community leader and mental health advocate Michael Edmonds has spent a lifetime understanding that kai has the power to connect people, strengthen communities and express care in ways words sometimes cannot. I asked Mike to introduce himself.

Passionate about serving his community, whānau and iwi, Mike lives on his tūpuna whenua at Te Kōpua with his partner and describes himself as someone driven by all things kai, from gathering, growing, harvesting, diving and hunting.

His love of food has taken him around the world.

Today he operates Karioi Katering, a business that grew from his passion for kai and recently catered for the World Surf League. Alongside this, he works in mental health and addictions and serves on several local, regional and international governance boards.

Yet despite the many hats he wears, his motivation remains simple. “What keeps me involved in serving and supporting the community is a strong sense of responsibility to give back and contribute to the wellbeing of our people.”

Working in community health has reinforced his belief that change comes from culturally grounded support and genuine connection. “I’m particularly motivated by creating spaces and programmes that reflect our values, uphold mana, and support longterm wellbeing rather than just short-term fixes.”

Some of his earliest memories are rooted in the traditions of gathering and sharing food. “I like to think how fortunate I have been throughout my life, being surrounded by kai gardens, hunters and gatherers feeding thousands of people at Tūrangawaewae Marae.” Family trips to Kaiaua Beach to gather seafood and time spent processing hunted meat on the family farm taught him early

lessons about food sovereignty, generosity and collective care.

The greatest influence on his culinary journey was his grandmother, Te Rongopai Tāwhiao, a trained chef who worked at Hopuhopu Military Camp during the 1960s before running the kitchen at Tūrangawaewae Marae. He recalls watching her prepare meals for thousands of visitors before returning home to cook dinner for her own whānau.

One of her food lessons still makes him laugh.

“Always leave one ingredient out of your recipes when sharing with others, so they don’t make it as good as you did - if you know my nan this is definitely her!” But it was another lesson from his nan that truly stayed with him. “Cook with love in your heart as you can taste it through your kai.”

His professional food journey took him across the Tasman, where he completed a chef’s apprenticeship in Australia and worked in some of Sydney’s finest restaurants. Although he enjoyed the creativity and discipline of professional kitchens, he eventually chose to leave the industry and continue learning on his own terms. Food became a passport to different cultures and ways of seeing the world.

“I have a fond memory of an elderly Thai lady teaching me Thai food when I lived in Chiang Mai Thailand, definitely my favourite cuisine.” These days he enjoys preparing kaimoana and Southeast Asian dishes, cuisines that celebrate freshness, balance and generosity. “Kaimoana has a strong connection to place, whānau, and gathering, while Southeast Asian and Thai dishes bring bright flavours, fresh herbs, spice, and balance that make meals feel special and memorable”.

Beyond nourishment, kai plays a central role in connection, culture and identity. “Preparing and sharing kai creates space for kōrero, strengthens relationships, and helps people feel valued and cared for.” For Mike, food is healing. It supports not only physical wellbeing but also wairua, belonging and the expression of manaakitanga.

“If we break the word down ‘Mana ā ki tangata’, ‘To uplift the mana of a person’.” Whether through health services, community initiatives or a shared

meal, he believes support should always uphold dignity, kindness and respect. When neighbours, whānau, or the wider community sit down to eat together, it builds belonging, and a sense of care that goes beyond the meal itself.”

It’s one reason he believes Whāingaroa is such a special place. “There is a real culture of looking out for one another, sharing what is available, and stepping in when someone needs support.

People often know each other through whānau, work, marae, sport, or local kaupapa, so sharing resources feels personal and collective rather than transactional. That creates a strong sense of belonging and responsibility to each other.”

As Matariki arrives, many New Zealanders gather to remember loved ones, celebrate the present and look to the future. For Mike, the season offers something deeply personal.

“Matariki, for me, is a deeply grounding time to pause, remember, and realign myself with the kaupapa that matters most in my life and mahi.

It is a time to honour those who have passed and acknowledge the ways their influence continues to shape our lives. It reminds me that true hauora is woven through relationships with whānau, whenua, and moana.”

Growing up, Matariki wasn’t marked by large celebrations. “It wasn’t really a focal point for my whanau growing up. We just knew that this was a time for reflection, wananga, spending time with each other.”

Today, he sees Matariki as more than a public holiday.

It is a framework for community wellbeing, leadership and collective reflection.

“It feels like a natural ‘reset point’ in the year where I can check in on my kaupapa, realign priorities, and set clear intentions. It’s a season that invites me to pause and honour those who have passed, to reflect on their impact on my life and mahi, and to carry their legacy into the way I lead and serve in indigenous health and social services. At the same time, it reconnects me with mātauranga Māori and the rhythms of maramataka, reminding me that our wellbeing is inseparable from whenua, moana, and the cycles of the environment.

Food sits at the heart of Matariki celebrations.

“During Matariki, kai plays the role of both sustenance and storytelling.” Gathering around a table or at the marae allows people to remember those who have passed, celebrate those who are present and strengthen relationships.

Most importantly, Matariki reminds us that community is built through everyday acts of generosity. “These are really challenging and uncertain times, everything is more expensive, cost of living has increased, but you are not alone! Taking a moment to share, support, reflect and awhi someone else, this helps build community, one of our greatest strengths in Whāingaroa.”

As our conversation came to an end, he offered one final reflection that captures both his approach to food and his hopes for the community.

“If readers take anything from my view, I hope it’s this: you don’t have to do anything grand to honour Matariki and strengthen community. Start with a simple meal, offered with genuine care, and let that be the place where remembrance, connection and hopeful planning begin.”

Perhaps that is the real lesson at the heart of Mike’s food journey. Kai is never just food. It is whakapapa, culture, care and community served at the same table.

MATARIKI AT THE TABLE WITH MIKE For those who are new to Matariki, celebrating doesn’t need to be complicated. * Gather whānau or friends for a shared midwinter meal using local, seasonal ingredients. A simple potluck, a home-cooked boil-up, fresh rewena bread and planting vegetables together can all become meaningful ways to connect with the season. * Use seasonal kai such as kūmara, rīwai, pūhā and watercress, and take time to remember those who have passed while talking about your hopes for the year ahead. Even a shared meal where everyone brings a dish inspired by Māori kai can become a powerful occasion for storytelling, learning and connection.” * For those who are still finding their confidence with tikanga, he believes the most important thing is to begin with openness and respect. Simply sharing a meal, learning a few kupu Māori, attending a local Matariki event, and reflecting together on the year that’s been and the intentions for the year ahead is an authentic way to start building a deeper relationship with Matariki. * Sharing kai is one of the most tangible ways to embrace Matariki’s three guiding principles: remembering the past, celebrating the present and planning for the future. When we prepare and share food, we create space to speak the names of those who have passed, tell their stories, cook their favourite dishes, and let their memory sit with us at the table. In the present, sharing kai is how we practise manaakitanga, offering hospitality, care and generosity to whānau and community.

Looking ahead, choosing seasonal, local food and caring for the environment through kaitiakitanga becomes a commitment to the kind of world we want our mokopuna to inherit.

MĀNUKA HONEY & BALSAMIC-GLAZED BLUEFIN TUNA WITH BEETROOT PURÉE & KŪMARA CRISPS If you know me, you’ll know I love fancying up traditional kai. I chose this dish because every ingredient is seasonal and locally sourced. It brings together different culinary techniques while celebrating our native flora. Before we taste our kai, let’s remember that we experience it with four senses first. We see it, we hear it, we breathe in its aroma, and we feel it in our hearts and bodies before we ever take that first bite. Kai should be a journey for the senses.

INGREDIENTS: Tuna 150 g bluefin tuna steak (I found mine on special at Raglan Wharf, but any firm, fresh fish will work) Beetroot Purée 4 uncooked beetroot 2 garlic cloves 1 teaspoon paprika Salt & freshly ground black pepper Water Mānuka Honey Glaze Balsamic vinegar Mānuka honey Butter Olive oil Kūmara Crisps 1 large orange kūmara Olive oil Sea salt To Garnish Freshly picked watercress

METHOD: While this dish has several components, the most important part is using seasonal, locally sourced ingredients. We’ll begin with the beetroot purée, as it takes the longest to cook.

Beetroot Purée Place the beetroot, garlic, paprika, salt and pepper into a saucepan and cover with water. Bring to the boil, then reduce to a gentle simmer and cook for 30–40 minutes, or until the beetroot is tender. Drain, reserving a small amount of the cooking liquid. Blend until smooth, adding a little of the reserved liquid as needed to create a silky purée. Taste and adjust the seasoning, then keep warm.

Kūmara Crisps Preheat the oven to 180°C. Slice the kūmara as thinly as possible—a mandolin works well for this. Toss lightly with olive oil and arrange in a single layer on a lined baking tray. Bake for 10–15 minutes, or until crisp and golden. Sprinkle with sea salt while still warm.

Mānuka Honey Glaze In a small saucepan, combine the balsamic vinegar and mānuka honey. Simmer gently until the mixture has reduced slightly and become syrupy. Stir through a knob of butter and a drizzle of olive oil to create a rich, glossy glaze.

Tuna Season the tuna lightly with salt and pepper. Heat a frying pan over high heat with a little olive oil. Sear the tuna for 30–60 seconds on each side, depending on its thickness, leaving the centre beautifully rare. Remove from the heat and allow it to rest for a minute before slicing.

To Serve Spoon the beetroot purée onto each plate to create a vibrant base. Arrange slices of tuna over the purée and drizzle generously with the mānuka honey glaze. Top with crisp kūmara crisps for texture and finish with freshly picked watercress.

t may be into its 16th year, but the Raglan Arts Weekend (RAW) promises to thrill, with new artists, demos and live events set to entertain its fans.

Participating RAW artists are working hard to make it an engaging and inspiring weekend, despite the event needing to work through some major funding setbacks. “We are so fortunate to have creative and bold talent, who add that sparkle to our arts trail,” says Nicky, RAW Co-Ordinator since 2019.

This year, there are five artist openings on the Friday night, and all sorts of educational and inspirational talks, demos and workshops. “There will be plastic waste turned into sculpture by robots, live kinetic painting in Volcom Lane, a UV art musical showcase, hat making, Intaglio printmaking, and so much more,” says Nicky.

Over 70 artists will be exhibiting in 43 studios, including 6 groups and 13 new studios for this year. Sadly, RAW’s Children’s Exhibition as well as the opening Cocktail Launch party at Iso had to be cancelled due to lack of funds. However, largely thanks to the partnership from Rangitahi,

the much-loved Hatch emerging artist incubator is still running this year with 17 artists being brought together by Shelley Meek, the Hatch curator for 2026.

“The Hatch is part of the RAW DNA now, and it feels like an incredibly important component of the Kaupapa of this event,” says Nicky.

ntrants, sponsors and locals recently gathered at the Raglan Town Hall for an evening of old-fashioned cinema charm as the Raglan Arts Film Festival Awards (RAFFA) celebrated this year’s winners.

The audiences were treated to a wide range of genres, from drama and documentary to romance, queer cinema, animation and thriller, showcasing the creativity and diversity of filmmakers connected to the community.

As always, the true winners on the night were the local filmmakers, actors, animators and storytellers whose work lit up the big screen, demonstrating the depth of creative talent in our community.

The judges were blown away by the exceptional standard of entries this year, making the task of selecting winners both challenging and rewarding.

Cash prizes and the coveted Chris Meek trophies were presented to the outstanding films and filmmakers recognised for their achievements.

Tell us about the Waka Kura programme (off to school programme) and what it involves.

Waka Kura is our new off to school programme.

Tamariki have the opportunity to participate in our Bush Park outdoor education programme and will visit Kura Taiao (onsite outdoor space) twice a week.

We offer 1:1 meetings with whānau and Karioi team leaders to discuss children’s learning priorities and school readiness. We work closely with new entrant teachers and take our children on termly visits to RAS. There are extended opportunities for early literacy and mathematic development in authentic contexts as well as the opportunity to participate in weekly lunch box days.

Our Waka Kura programme focuses on learning to learn dispositions such as self-care skills, taking responsibility, problem-solving and thinking skills, resilience, risk-taking and confidence. Waka Kura will extend on the strengths, interests and abilities of our tamariki as well as continuing to embody the Let’s Grow values of manaakitanga, kaitiakitanga, whānaungatanga, ako and tuakana-teina.

What benefits does it offer the children and families as they go through this transition.

Starting school is a big step for not only the child but their whānau. It is our aim to support the transition process each step of the way. Waka Kura supports tamariki to develop a positive learner identity. While academic skills like writing and reading are important, they are typically taught at school. Readiness for school refers to a combination of cognitive and physical ability, self-care skills and responsibility, and social and emotional development. The programme is about supporting children to develop a lifelong interest in learning. It is our aim that Waka Kura gives tamariki the opportunity to engage in a range of learning experiences that will ensure they are confident in themselves and are excited about the next step in their learning journey.

How did you develop the programme and how do you and RAS work together?

Our Waka Kura programme has been in the works for a few years now and each year we built on what we were already doing. Our team leader Kat Robinson did extensive research around how we could improve our off to school programme and added some exciting components such as the weekly excursion to the

Wainui Reserve Bush Park. Bush Park excursions have been a goal for Let’s Grow for some years now so it is great to finally have it off the ground.

We are in constant communication with Nicole Bell (new entrant teacher & year 0-2 team leader) and Lisa Brunel (new entrant teacher) from RAS. We collaborate to support our tamariki through their transition from Let’s Grow to school. Currently we are having wonderful discussions around what else we could prioritise when it comes to preparing our tamariki as they take steps to feeling ready to start school.

What other aspects of Let’s Grow make it a unique experience?

At Let’s Grow we pride ourselves for providing quality ratios that well surpass government requirements. This allows us to get to know each child on a deep level and work closely with whānau to best support each child on their unique learning journey. Our tamariki are the designers of our daily curriculum where we let children lead their learning experiences, exploration, play and next steps in their learning adventures. We are passionate about supporting tamariki to learn about how they can be positive contributors to papatūānuku and we spend lots of time outside, learning about and playing in nature, exploring and gardening. We are lucky to have such beautiful nature right on our door step!

We are passionate about providing a nurturing learning environment where children have the freedom to play as well as engage in meaningful learning activities.

How are you celebrating Matariki at the centre?

This year we are exploring storytelling! Our whānau evening event is our Matariki highlight. We gather together to celebrate the past, present and future.

past our remembrance tree carrying their handmade lanterns. The tamariki join together to sing waiata for our whānau and then we enjoy hot soup and roasted marshmallows by the fire. Matariki is a very special time for us.

What are you offering young families at present as an opportunity to try Let’s grow?

At the moment we offer the first month free for all new 2yr old enrolments, the first two months free for all new 3 & 4yr old enrolments. In addition to this, families are also able to access the government’s family boost and WINZ schemes to help with costs. We welcome families to arrange a time to come and meet us and have a look at our space.

or Paul Irwin and Fiona Gates, purchasing Raglan Shuttle wasn't simply about adding another business to their portfolio – it was about investing in a service they believe plays an important role in the future of Raglan.

Already owners of the Harbour View Hotel, the couple saw an opportunity to combine transport, tourism and hospitality in a way that better serves both the local community and the growing number of visitors choosing Raglan as a destination.

"We've always believed that great communities are built around great local businesses," Paul says. "Raglan Shuttle has an excellent reputation, and we saw the opportunity to build on that while creating a sustainable transport business for the future."

Today, Raglan Shuttle provides airport transfers, local transport, ACC transport, school runs, charter services, group bookings and rental vehicles, with a focus on providing reliable, friendly service for locals and visitors alike.

For Fiona, the acquisition was also about creating stronger connections across the businesses they already operate.

"The transport business complements what we're already doing through the Harbour View Hotel," she says. "We work closely with visitors, local events and the tourism sector, so being able to offer transport alongside accommodation, hospitality and experiences just felt like a natural progression. It also creates opportunities to support other local businesses by helping visitors get out and explore everything our region has to offer."

The couple already have several new initiatives underway. Plans are progressing for a Friday and Saturday night taxi service, helping people enjoy Raglan's hospitality safely, while work is also underway on a range of local tour packages expected to launch from September ahead of the busy summer season.

"There's so much more we can offer than simply getting people from A to B," Paul says. "We want to showcase Raglan through transport, whether that's airport transfers, local tours, rentals, event transport

or helping people discover some of the incredible attractions throughout the district."

Like many transport businesses around New Zealand, recruiting drivers remains one of the biggest challenges.

"We'd genuinely love to hear from local people looking for flexible or part-time work," Paul says.

"Retirees, semi-retired people or anyone wanting a few extra hours each week could be a great fit. It's rewarding work and a fantastic way to stay connected with the community."

Fiona agrees that people will ultimately be what drives the business forward, noting that a P endorsement is needed for anyone looking to join the team.

"We're fortunate to have Paul leading the business day-to-day alongside Claudia Arevalo, with support from others during the transition," she says. "The response from the community has been incredibly positive, and that's given us confidence that we're heading in the right direction."

For both Paul and Fiona, the most rewarding part has been investing in another business that directly benefits the community they call home.

"Our vision is simple," Paul says. "We want Raglan Shuttle to become a sustainable, reliable transport solution that supports locals, visitors, ACC clients, schools, events, tourism and our growing rental fleet for many years to come."

THE DA M ES BEHIND THE SCENES OF THE WSL: 65,0 0 0 SINGLE-USE ITEMS DIVERTED FROM L A NDFILL WITH ANNIKA STRICKER

ne local group that played a unique role behind-thescenes of the WSL was The Dames, Raglan's women-focused surf community.

The Dames helped keep thousands of single-use items out of landfill during the event. Annika caught up with founder Nina Dunyach-Ramos to reflect on the WSL, and her hopes for the future of women's surfing in Whaingaroa.

Tell us about your involvement behind the scenes of the World Surf League event in Raglan.

The Dames were involved through the Go Eco Wash Trailer initiative, helping wash and reuse plates, cups, and cutlery throughout the event. For us, it was really important to be involved in something environmentally focused.

As surfers, the ocean is our playground, our workplace, and where we spend

most of our time, so protecting it is something we care deeply about.

A big shout-out to Xtreme Zero Waste, who helped bring the project to life and provided a bit of funding to get it running. Without their support, it would have been much harder to make it happen.

What was a standout moment from the WSL that you'll remember?

One of the funniest things for me was that we're all surfers, and suddenly we found ourselves spending our days washing dishes! It wasn't exactly what we imagined when we got involved in a world-class surfing event, but we had an absolute blast. We had music pumping, lots of laughs, and somehow turned dishwashing into a pretty good time.

What makes it even more memorable is knowing the impact it had. Through the Eco Wash Trailer, we helped save around 65,000 single-use

items from going to landfill. When you stop and think about that, it's huge. If all those plates, cups, knives, forks, and containers were laid out end to end, it would probably stretch from Manu Bay past Indicators and halfway towards the harbour! Knowing we helped prevent that amount of waste from ending up in the environment is something we're incredibly proud of.

What was the atmosphere like during the WSL event from your perspective?

It honestly felt a little bit like being back home in France! There were people from all over the world, creating an amazing atmosphere in Raglan. The competition side of things brought a lot of excitement too, with supporters cheering passionately for their athletes.

The Brazilians were definitely making themselves heard!

It was great seeing people from Raglan at Manu Bay who never normally come down there. Suddenly, because of the event, everyone was there. It really brought the whole community together.

There was a real sense of excitement, connection, and pride in seeing Raglan showcased on the world stage.

What would you encourage the WSL to do differently next time?

I'd love to see even more involvement from local community groups and environmental initiatives.

The event already does a lot, but creating more opportunities for local organisations, youth programmes, and grassroots clubs to be involved would leave an even stronger legacy after the competition finishes.

What opportunities did the event bring for local women surfers and The Dames?

Events like these shine a spotlight on surfing and inspire more people to get involved. It also gave The Dames an opportunity to connect with other organisations, local businesses, and members of the community. For women surfers, seeing female athletes competing at the highest level can be incredibly motivating and empowering.

What would you love to see happen next for women's surfing in Raglan?

I'd love to see more women feeling confident enough to give surfing a go, regardless of age or ability. Raglan has such an incredible surf community, and there is room for everyone. It would also be amazing to see more programmes, coaching opportunities, and pathways that support women and girls throughout their surfing journey.

What’s happening at The Parlour over the winter months?

What are the benefits of the new space and why did you choose it?

Well the hot stone massage has been super popular and the perfect way to melt away tension and cosy up.

Basically the biggest benefit of this space is that we can grow here. There’s a huge space with a fireplace and a full kitchen plus a fresh purpose-built beauty room for us just off the reception area. There’s space for workshops, retreats and retail. It’s so exciting.

The free community event invites people of all ages and abilities to recreate the dance from Kate Bush’s 1978 hit Wuthering Heights. No dance experience is needed, with participation and fun taking priority over perfection.

or decades, a community swimming pool has sat high on Raglan’s wish list. Now a group of locals believes it has the expertise, financial backing and momentum to finally make it happen.

Speaking on Raglan Community Radio, Raglan Community Pool Trust members Fiona Edwards, John Latimer and Lauren Mills outlined their vision and the work underway to determine whether the long-discussed project is viable.

Historical records show locals were discussing a community pool as far back as 1911. More than a century later, the trust is taking a methodical approach, beginning with needs assessments, site investigations and feasibility work before settling on a design or location.

“We’re not close yet, but we are working on being close,” John says.

A substantial starting point The project already has a conditional funding commitment of up to $1 million from the Raglan Community Charitable Trust.

Fiona says the money would become available if the right site was secured and a sound business case developed.

“It’s a substantial starting point,” she says. “But it’s only if we get the right site, the feasibility plans come together and we get the right kind of pool that’s going to be feasible, functional and affordable.”

For Fiona, the project is about more than recreation.

Shortly after moving to Raglan more than 30 years ago, she was seriously injured in a head-on car crash. Unable to drive, she relied on her husband to take her to Hamilton so she could swim as part of her recovery.

“People swim for pleasure, people swim for safety, people swim to get back on their feet,” she says.

Experience behind the project John brings more than 40 years of experience in aquatic facility management and works with Community Leisure Management, one of New Zealand’s largest operators of public swimming pools.

His experience includes small community pools and major aquatic centres around the country.

Lauren is a former competitive swimmer who reached world championship level before illness ended her elite career. She has also spent years teaching swimming and says access to deep water must be part of any future facility.

“So many children learn to swim in a swim school and then get in deep water and freeze,” she says.

A mother of six, Lauren has taught all her children to swim and believes many young people learn skills in controlled environments but struggle when faced with deep or open water.

“I think we’ve got a really great team of people on the trust with some pretty special expertise in this small community,” she says.

Evidence of demand A needs assessment commissioned by the trust suggests there is strong local demand for a pool.

Completed by aquatic planning specialist Brendon Rope, it examined national, district and local trends.

One local survey found swimming was the highest-participation afterschool activity, with 67 percent of respondents taking part. About twothirds said they would use a community pool if one existed.

The trust says the benefits would extend beyond recreation to water safety education, rehabilitation, fitness, learn-to-swim programmes and social connection.

“There’s always a latent demand for pools, which is not met until the pool is there,” John says.

A practical community facility Rather than a large aquatic centre, the trust is exploring a practical facility designed around local needs.

Current thinking centres on a 25-metre, six-lane pool that could support lane swimming, lessons, aqua fitness, rehabilitation and activities such as scuba training.

The trust also sees opportunities to support Raglan Area School’s outdoor education programme, allowing kayak

rolling, scuba and water safety sessions to operate regardless of tides or weather.

Deep water would help swimmers build confidence for the harbour and ocean conditions common around Whāingaroa.

Finding the right location The trust has assessed 16 possible sites and narrowed the list to four.

Factors include parking, accessibility, infrastructure, ownership and proximity to schools.

Sites investigated include Lorenzen Bay Reserve, Wainui Reserve, land near the golf course and land offered by Rangitahi developer and trust member Dave Peacocke.

Trust members say finding the right location will be one of the most important decisions in determining whether the project succeeds.

Keeping it financially sustainable One concern raised during discussions with the Raglan Community Board is whether ongoing costs could fall on ratepayers.

John says modern pool management places strong emphasis on operational sustainability.

The trust wants the facility to cover its operating costs through a mix of swim lessons, lane swimming, fitness activities, rehabilitation programmes and other revenue streams.

Energy-efficient design, including solar generation, will also be considered.

“It is our intention to make this pool as self-sufficient and cost-effective as possible,” Fiona says.

The trust is also exploring an endowment fund to help cover future maintenance.

While detailed costings are still some way off, John says an outdoor pool could potentially cost about $3 million, while a covered, year-round facility could cost between $10 million and $15 million.

He stresses these are broad estimates and would depend on the site and final design.

Next steps The next stage is a detailed feasibility plan examining possible locations, concept designs, operating models and long-term sustainability.

Only then will the trust begin wider discussions with funders, regulators and the community.

For Fiona, who has wanted a pool in Raglan since arriving more than three decades ago, the project represents an opportunity that may not come again.

Whether it ultimately succeeds remains to be seen, but supporters believe Raglan may finally have the expertise, backing and community support needed to turn its long-held pool dream into reality.

INLAND REVENUE POWERS - THE TAX ADMINISTRATION ACT: CHECK OUT THESE FAQS W I T H G I N A J A N S E N L AW Y E R S

A

s part of its tax gathering activities, Inland Revenue has massive powers under the Tax Administration Act 1994 including powers to search and seize, obtain your personal and business information from third parties (such as Banks) without your knowledge and/or consent, and issue deduction notices against your employer (wages/salary), WINZ benefit or deduct amounts directly from your bank account.

At Gina Jansen Lawyers, we have been acting for taxpayers since 2007 ensuring taxpayers’ rights are recognised and helping to resolve very scary tax issues for our clients. We have witnessed the brutal effects Inland Revenue can wreak on a taxpayer’s life when taxes and other debts, including child support and student loans, don’t get paid.

What powers does Inland Revenue have to take money from my account?

Under section 157 of the Tax Administration Act 1994, the Commissioner has the power to issue a deduction notice. These can be placed against: employers, banks, business debtors, house sales (lawyers trust accounts) and anyone Inland Revenue determines owes you money or where you have placed money. They can ask for the deduction to be up to 100% of the funds held. There is substantial caselaw where these have been challenged in the Courts.

How does IRD know about my house sale or that I have money in the Bank?

Usually done behind the scenes and without your knowledge, Inland Revenue can issue a section 17 notice on anyone to supply Inland Revenue with both personal and business information about you. They do not need your permission, nor is this a breach of your privacy under the Privacy Act. Typically, Inland Revenue starts

this process by asking your Bank for copies of your bank statements so they can review all of your accounts and the transactions to ascertain if, and where, you hold or receive money including any payments you may receive regularly through your business i.e. from a debtor of your business. After that, Inland Revenue may then section 17 the debtor for more information about the contract it has with you, to determine how often, and how much you receive before issuing a section 157 deduction notice to divert the payments away from you, or your business, to Inland Revenue to apply against your unpaid taxes. Inland Revenue cannot however overdraw a bank account or exceed any credit balance available.

Isn’t this illegal?

The short answer is no. Inland Revenue, as the agency appointed by the government to collect taxes, has massive and wide-ranging powers under the law to do their job. As everyone knows, taxes need to be collected to pay for New Zealand’s costs, such as health, education, roading. Deduction notices can be issued for the non-

payment of GST, income tax, PAYE, penalties and interest, child support and student loans i.e. mostly any tax or debt managed by Inland Revenue. What’s worse is that under sections 4 and 6 of the Criminal Proceeds (Recovery) Act 2009 (CPRA), a perceived criminal activity “…engaged in by a person that if proceeded against as a criminal offence would amount to offending punishable by a maximum term of 5 years or more”, such as “tax evasion” under section 143B of the Tax Administration Act (and a multitude of other tax acts under the Act), allows Inland Revenue to restrain or seize assets without the need for a conviction. The CPRA is often used by the Police to seize assets from criminals, but the Act also allows Inland Revenue to sidestep using a section 157 deduction notice for tax in default, and aim for assets potentially purchased by a taxpayer from the proceeds gained by not paying taxes (such as houses, cars, boats, chattels, business assets), and to sidestep firstly gaining a criminal conviction in the Courts against a taxpayer and/or their business. This can come as a real shock to taxpayers when Inland Revenue sets its sight on you.

I’ve just found out I owe IRD taxes. What should I do?

Sometimes, and legitimately, taxpayers get behind with the payment of taxes. Our law firm are specialist tax lawyers who have years of experience advocating for, and negotiating with Inland Revenue on behalf of clients to get resolution. While we highly recommend that taxpayers don’t allow the problem to get to the scary stage, we will strenuously negotiate so Inland Revenue is not tempted to use its massive powers to search, seize and deduct money without your consent. We also regularly appear in the Courts once legal proceedings are served: whether that is for criminal action (for example the non-payment of GST and PAYE), or bankruptcy and liquidation action against insolvent taxpayers in the High Court and debt collection in the District Court.
