Hello and welcome to issue 2 of Connect Business. We are well and truly into the new year and January is under our belt for another year, hope it was kind to you. We have lots for you this issue, we meet up with the O Connell Family in Killarney who are a well-known family of solicitors, they tell us what it’s like to be in the law business and how it has passed down the family. We also check out what’s new in Business in the county and its refreshing to see so many new businesses of all kinds establishing around every part of Kerry. Education is something we think about this time of year so we chat to a few in the sector to see what the options are. We are also launching our Connect Hair and Beauty Awards, as you all know our Connect Kerry Women in Business Awards have been very successful the past two years and we will again be rolling them out this year for our Gala Night in June, but we have been asked to recognise an industry which is growing in the county that is the Hair and Beauty Industry, so we have given them a dedicated awards and again its simply amazing to see the amount of talented professionals in this industry, this is open to male and female and to staff members as well as owners of the business. Family Law! Being in the law business is not easy, the hours are long and the demands are high, but we chat with one family who have made it their way of Life. Marisa Reidy talks to Killarney solicitor Padraig O’Connell about the growth of his 36-year-old practice, which now sees him in the unique position of working in tandem with both his son and daughter.
BACK in September 1980, when solicitor Padraig O’Connell first opened his modest Killarney practice along with a sole secretary, he could not have known how successful a practice it would become. Neither could he have predicted just how big an influence his own family would have on that success – with his son and daughter now playing a huge role in the O’Connell law firm.
While Andrew is well known in football circles in Killarney – playing with Dr Crokes and being involved in the U21 and minor backroom teams – he is also a familiar face in courtrooms across the county. Equally, Katie is a very well known and successful barrister, Padraig laughs when I ask if he encouraged his daughter working primarily at Circuit Court level across Munster. Katie and son Andrew to follow in his footsteps into the So how does the family dynamic work in the legal world. professional world?
“I actually advised both of them against it – but only once – because it is a very difficult profession, but clearly they didn’t listen to me,” he said.
Andrew (33) is a solicitor with his father’s firm, while younger sister Katie is a Killarney-based barrister working on the southern court circuit, often teaming up with her father and brother on Circuit and High Court cases. Because the practice is so busy, now employing a staff of 16 - including five solicitors – Padraig says he is very happy to have his son by his side to take some of the pressure off. Having Katie in his corner also brings a ‘specific expertise’ he says - something he is happy to call upon whenever the need arises.

And in case you think Andrew and Katie’s desire to enter the legal profession came solely from their father, the writing was somewhat on the wall long before that from both sides of the family. Their mother Mary Lucey is the first cousin of District Court Judge, Tim Lucey, and her father and grandfather were both successful solicitors in Macroom. Padraig’s first cousin, meanwhile, is Circuit Court Judge – and Rathmore native – Elma Sheahan. CONNECT BUSINESS
“It works very well thank God. We have a very good working relationship so it’s all going well,” Padraig told Connect.
“Andrew trained here with me and it’s great to work alongside him and because Katie works in general practice, including criminal, civil and family law, she brings a specific expertise to the team.”

But having been in the business for almost for 36 years, earning a reputation as one of the county’s best known and regarded solicitors, Padraig says success does come with a price. “It’s a very tough profession and being so busy means working seven days a week, coming in at 5am and going to court four or five days a week, often to special sittings at weekends,” Padraig explained. “Then there’s the work at the garda station, when people are being questioned, so you’re pretty much on call all the time. I don’t ever go on holidays and was lucky to get a few days off for Christmas.” Clients too, can be very demanding, which poses another challenge – but one he and his team relish. “The everyday challenge is trying to provided people with a prompt, diligent and efficient service, which can be extremely difficult ,” he said. “The public are quite demanding and expect answers and results all the time, so it’s often difficult to tell people they don’t have a case, especially now when they can access the internet and come up with their own answers.” On that note, Padraig is adamant that he and his team only represent those who he can genuinely defend. “I always give people the option of getting a second opinion if they don’t like what I have to say, because I will not defend someone I know is guilty,” he said. “If, however, someone insists they are innocent, I will of course do my very best for them.” Being one of the main go-to solicitors in Kerry at

present means that, in the interest of his clients, Padraig has to know his limitations. And he has absolutely no issue admitting that! “I started in general practice and concentrated on criminal and civil and conveyancing. I don’t practice in family or employment law because you simply cannot be an expert in everything. The law is hugely specialised so it’s impossible to do everything.” So as Padraig, Andrew and Katie look ahead to another hectic year on the District and Circuit Court front in 2017, it’s all about preparation. “It’s going to be another challenging year. More of the same, but plenty of challenges, so it’s all about being prepared,” Padraig says.“Having your homework
done is half the battle so we just have to try to be one step ahead and take it from there.”

I’m coming back from a walk down beautiful Fenit pier and a spin on the swings with my 2year old Charlie, what a great way to spend the morning. The whole time I keep reminding myself that I must check my passport to make sure that it is in date. In less than 3 months I’ll be off on a 5star trip to Dubai. I never thought that I would have a business I could run from home that would send me on an all expenses paid holiday! So how did this happen? Well in 2015 I had my son Charlie, I had leased out the restaurant that I had build up over the previous 7 years so that I could be at home with him. Cut to 5months later and although I loved being at home with Charlie I was now looking for something else to sink my teeth into. So one day I had a conversation with my sister where I explained that I didn’t want to go back to work full time, I wanted a job that allowed me to be at home with my son, spend time with my husband and still make a good income. Now anyone else probably would have laughed at me and told me I was dreaming but she said I have just the thing for you! She showed me a work from home opportunity under the umbrella of a company called Forever Living, which promotes health and wellbeing. College!
An Option at any Age Going to be college can be an exciting but a daunting time also, but for those who chose to go back later in life it can be even more difficult, what to do, where to go and how will I adapt, are just some of the questions, so we take a look at all the options.
Go Find A CAO Course That You Are Passionate About This time of year, Leaving Cert students are meeting with their Guidance Counsellors to discuss their college options. Some are very clear in what they would like to study and some are not. Like with any big decision, we can often be self-limiting when exploring career options. Common mistakes can include flicking through the C.A.O Handbook and college prospectuses ruling out courses, because the cut off points for last year are above their points target. Points change from year to year depending on the demand for courses and the number of places on the course. As the C.A.O Handbook 2017 does not contain information about course and subject requirements, students need to research their courses in the college websites as well as on www.cao.ie, www. qualifax.ie and www.careersportal.ie.
Careful Research is vital
Now is the time in the life of a second level student where all opportunities are possible, but lack of confidence in their ability and the sense that the challenge ahead is so overwhelming, can prevent them from truly exploring their interests and dreams. We may never be 100 pc sure that our choices will be what we expect, but through careful research, reflection and discussion we can improve our understanding of what we are signing up to, and whether it is likely to be for us. Students should seriously look at their ability, personality type, application, work ethic and their personal achievements when considering a career which interests them. They should also talk to as many lecturers and graduates as possible, seek work shadowing in their interested area and attend any remaining Open days.
Questions to ask yourself
• What part of the course do I really like? • Is there any part of this course that I don’t like? • What are the minimum entry requirements? • What are the subject requirements? • What were the cut off points for 2016? • Is there anything I don’t understand about this course? What are the specialisms in this course? • Is work experience part of this course? •What are the career opportunities in this course? 12

•Do I like this course more or less than the last course I researched? Answering the above questions should help them to identify their first preference more easily with courses of less interest, eventually eliminating these ones from the list. Eventually students will find that a small number of courses begin to stand out, and these are likely to be courses they are passionate about, and will probably end up as their top C.A.O choices.
C.A.O Application
Remember that applicants may go on www.cao.ie and click on ‘Apply’ to fill out the C.A.O form online. ‘Apply’ is user friendly as the C.A.O provides an interactive Demo to facilitate students if they wish to do a trial application. Students fill up to 20 places on the C.A.O form, 10 on the Level 8 and 10 on the Level 6/7.Students must apply before the 1st February if they wish to apply for a restricted course. Restricted courses normally require additional assessment procedures e.g the submission of a portfolio. Students must apply before January 20th if they want to avail of the discounted fee of €25 . The standard closing date for the C.A.O application is the 1st February and the cost is €40.
Order of Preference
Students should organise all their courses in genuine order of preference and not on assumptions about examination performance or what they think the points will be. In Round 1 students will receive an offer of the course highest up on their course choice list, that they are deemed eligible for in their Level 8 category. If you receive an offer of your third preference course, you may still receive an offer of your second or your first preference course in a subsequent round of offers, but you will not receive an offer of your fourth preference course or lower. The C.A.O online Change of Mind facility opens in early May and closes on the 1st July. Students can use the online facility as many times as they wish until the 1st July. This is free of charge.
Alternative Career Paths
Even though most of the focus for college is on the C.A.O system, there are alternative career paths. The further education (FE) sector has opportunities for students who may not secure the points they want through the C.A.O, but who may do well in a post-leaving cert (PLC) course in the area they want to study. If students get distinctions in all eight modules of a PLC programme, they have a good chance of securing a reserved place in their preferred C.A.O course for 2018. A database of such linked programmes is available on careersportal.ie. The most helpful and comprehensive source of all C.A.O and PLC course information is on qualifax.ie.

So Much To Offer School Leavers And The Mature Student KCFE, under the auspices of Kerry ETB, is now home to a very large selection of Post Leaving Certificate courses tailored to meet the needs of both school leavers and those returning to education to upskill or retrain.
The college has recently updated their website with details of over 50 courses on offer at its campus in Clash, Tralee. The courses on offer at the college are validated on the National Framework of Qualifications. Upon course completion graduates can either enter directly into the workforce or choose to progress to higher education in Institutes of Technology or Universities. Qualifications are well respected by employers as they are designed in consultation with industry ensuring that graduates are ready to take up employment when completed. PLC courses give people the opportunity to gain a solid foundation in a subject area and the compulsory work experience allows them to see first-hand what is involved in their chosen career area. The nature of the courses are practical providing the skills set required by employers. The progression rate directly to the workforce is quite high particularly for mature students. The points gained from doing a PLC can also be used instead of their Leaving Cert score to gain access to third level programmes. Progression links from PLC courses to University courses and IT’s have grown considerably. Trinity College, UCC, UL, Mary Immaculate College of Education, IT Tralee etc are now all accepting QQI awards from KCFE allowing students a second chance at securing their dream course. The application system for next Septembers intake is now open online at www.kerryfe.ie and interviews for places will take place both in May and August.
An Open Day will be held in the college on Thursday 2nd March and everyone is welcome. The college also plans to have an information evening for parents of school leavers the previous evening at the college. Any further queries can be directed to the college office on 066 712 1741.

KCFE - Graduate Success Story Catriona O’Donnell is a graduate of KCFE and is now employed as a Clerical Officer at Kerry University Hospital. “I joined Kerry College of Further Education, Tralee as a mature student who had left a part time job to better myself. For me I had reached a stage in life where I needed a career change. The college in Tralee has so much to offer adults who make the decision to return to education to upskill. There is such a broad range of courses and until I actually started there I never realised how many adults do this every year. I was accepted onto the QQI Level 5 Office Administration Course at KCFE. It is a very practical course and really well structured. The course covers all aspects of what’s needed to work in a busy office environment and opens doors to a variety of employment. I found the lecturers very helpful throughout the year and I enjoyed the social aspect of going to college each day. I made a lot of new friends. The skills I gained from this course made me very employable. I secured work as a Clerical Officer at University Hospital Kerry. Here I am based in the Accident and Emergency Department which is very busy and requires me to be able to multitask. There is a lot of responsibility attached to this positon. The skills offered on the Office Administration course are very much in line with what employers need in the modern office. I felt well prepared for work after finishing the course. I would advise people who are thinking about going back to education after years of being out to just go for it. There will be so many others doing the same thing and you will enjoy it. Mature students will find a very supportive environment at KCFE which will enable them to succeed. I am happy to highly recommend the college and the course to anyone.”
Ciaran O Coileain is a KCFE Graduate of Level 5 Engineering Technology. He is now studying on the B Tech (Ed) in Engineering and Materials Technology, UL. “My year in Kerry College of Further Education made a positive and lasting impression on me. I had a good leaving cert which I had completed in a boarding school in Roscrea. However, I dropped out of my chosen third level course and found myself a little lost. I spent a while working in retail, became a sailing instructor and also worked as an SNA. It became obvious to me and those around me that I had what it took to make a good teacher and I set about making it a reality. I took up a place at KCFE on the QQI Level 5 Engineering course and used it as a method of getting back into education. I hadn’t done engineering or technical graphics for the leaving cert but I knew it was an area I had an aptitude in. If I wanted to secure a place in Engineering Teaching in University as a mature student I would have to be able to prove at an interview that I was able for it and so making a success of the PLC in the subject area would allow me to do just that. I enjoyed the classes and found teachers had a very practical approach to everything. During my year in KCFE I got involved in an indoor soccer team and a few competitions all of which added to the experience. I am grateful to the college for providing me with the opportunity to get myself back on track. As a result of doing the PLC I secured a place on the B Tech (Ed) in Engineering and Materials Technology at the University of Limerick. PLC opens doors for people. My time in KCFE was inspirational and as I go through my teacher training now I know the difference good teaching can have on an individual.

Going Back To Reskill With The National Learning Network We chat to a student who has gone back and they tell us how it has been for them.. Breda Canty left school in the 80’s at the age of 13, she got work quickly as happened in those days, but by the 2000’s things had changed and Breda had to rethink life, she tells us in her own words how the National Learning Centre changed her life.
“I left school in the 80’s at age 13. I got employment pretty easily, and moved from job to job a lot. By the early 2000, I was finding it really impossible to get work. It was all about your CV and what your education was. I stayed moving from job to job, but when I had my son in 2005, I realized I needed a stable job, and more important I needed to get a better education. I found the idea of going to college very daunting, I could read and write no problem, I just didn’t feel confident enough to go there. Newly Renovated Glenduff Manor Reopened
Dingle native Michael O Malley, his partner Joannah Sambucci and son Aaron have cut the ribbon on the newly renovated and refurbished Glenduff Manor in Kielduff, Tralee, Co. Kerry following a blessing of the property by Father Pat Crean Lynch. Glenduff Manor formally Glenduff House which is four miles from Tralee and overlooked by the Brandon Mountains opened its doors with the creation of 10 new jobs on Saturday January 21st. Glenduff Manor, a wonderful Victorian hunting lodge was built in 1846 by John Hurly, Clerk of the Peace for Kerry, who lived at Bridge House, Tralee but retained Glenduff as his Country Estate. Over the last number of months major renovation works have transformed the property which still keeps its traditional charm throughout. Michael O Malley who is one of fifteen children, grew up in the Grove, Dingle and immigrated to Boston twenty years ago and went on to become a successful property developer. Michael commented: “The last number of weeks has been intense but it is very exciting to see the transformation as everyone involved put in a huge effort. Ann McEnery’s background is in Management Consulting and Software Sales. She made the decision last year to take the step into self employment. Ann really like art and design, and using her hands. Inspiration came from Liam Slattery a well known framer in Dublin who is very highly respected for his work. His hand finished frames are displaying in galleries and museums for over 40 years. Ann wanted to bring this standard of service to Kerry. In the last 10 years a lot of frames made are black or white and simple. Ann wanted to introduce bespoke custom designed frames to really enhance the picture and match its surroundings. All frames are made from raw wood, designed, painted and finished especially for each piece. In the last 6 months Ann has set up a workshop in a country cottage with a display area of her work. Customers vary from Antique Dealers, Interior Designers, those seeking to frame All Ireland Jerseys, artists, and those decorating their home. Ann won the Best Start Up 2016 with IRD Duhallow. To date Ann has had a steady stream of customers and is planning on expanding the business to have a showroom in a busy location.

What is a fixed term worker? A Fixed Term employee is someone who: Is employed under a contract which contains a specific start and end date or who is employed to carry out a specific task or project or the continuity of whose contract is contingent on a particular event such as the availability of continued funding from an external source. When would a company offer a fixed term contract? A Fixed Term contract would be offered in the following instances: • When sourcing cover for an employee who is out on Maternity Leave, Adoptive Leave, Long Term Sick Leave or any other period of absence from work. • When you require an employee to assist in working on a specific project that would have a clear timeline. • During busy periods for the business, e.g. summer, Christmas, etc. where there is a clear deadline. Is there a difference between permanent staff & fixed term contract staff? Effectively there is no difference between a permanent employee and a Fixed Term employee. Employees on a Fixed Term contract must be treated in the same manner as permanent staff members. How Long Can A Company Use A Fixed Term Contract? An employee can have a number of Fixed Term contracts provided that the combined duration of those contracts does not exceed four years. This relief is known as Business relief. Under Business relief, the taxable value of the gift or inheritance is reduced by 90% and CAT is payable on the balance i.e. the taxable value of qualifying business assets with a market value of €100,000 would be €10,000. Only relevant business property will qualify for the relief. “Relevant business property” is defined as the business or an interest in the business in the case of a business carried on by a sole trader or by a partnership. “Business” is defined as one which is carried on for gain and it includes the exercise of a profession or location as well as a trade. Relevant business property includes unquoted shares in a family company. Importantly, individual assets used in the business, such as a factory, will not qualify for the relief if transferred to the beneficiary without the business. To qualify for the relief the relevant business property must have been owned for a continuous period of 5 years prior to the date of the gift or inheritance. However, if the inheritance is taken on the death, the relevant period is 2 years prior to the date of the inheritance. It is important to note that this relief can be clawed back. If the business, or any business which replaced it, ceases to trade within a period of 6 years after the date of the gift or inheritance the relief will be clawed back unless the business is replaced within 1 year by other relevant business property. However, there will be no claw back of the relief where the business ceases to trade by reason of bankruptcy or as a result of a bona fide winding-up on the grounds of insolvency. Business Relief is an important relief, which can allow for the tax efficient transfer of a family business. It should not be considered in isolation however but rather in conjunction with other tax reliefs such as retirement relief for Capital Gains Tax purposes. Careful tax planning is required in advance of any business transfer to ensure that no unnecessary tax liability will arise in relation to same. Tell Your Story Through Social Media In 2017 I’ve often been asked by business people who have managed their business for the last 10 years without social media why they should get involved if they haven’t embraced it and their business is ‘fine’. It’s very simple for me and kind of reminds me of when my Dad bought a microwave for the first time. So my advice to any business that is second guessing whether or not they need to join an online platform is to just go for it, tell your story and give yourself the opportunity to connect with hundreds, thousands or even millions of people.
