adversely impacted a horse’s prior performances i.e. upper respiratory tract surgery or surgery to correct lameness, limb inflammation/pain or gait dysfunction.

• A horse is required to have a long period of rest to heal a preexisting injury i.e. tendon/ligament strain.

• Lameness or musculoskeletal inflammation/pain.

• Injury to any part of the body which could potentially adversely impact on the horse’s performance or consist of a welfare or public perception issue on race day, or have resulted in an interrupted preparation.

• Any condition or occurrence that has resulted in a horse missing consecutive days of normal exercise or sufficiently interrupted, and thus adversely impacted, a horse’s preparation for its next race.

• Any systemic illness that has adversely impacted on a horse’s health or wellbeing or may have resulted in an interrupted preparation i.e. colic attack, any illness causing loss of appetite.

Important Changes To Thoroughbred Registration Arrangements

Thoroughbred Racing participants using the RWWA CRIS site would have noticed the below link from Racing Australia (RA). Racing and Waging Western Australia (RWWA) wishes to confirm important changes to registration functions.

Australian Financial Services Licence *Conditions

1. This licence authorises the licensee to carry on a financial services business to:

(a) provide financial product advice for the following classes of financial products: interests in managed investment schemes limited to:

(A) horse racing schemes only; and

(b) deal in a financial product by: issuing, applying for, acquiring, varying or disposing of a financial product in respect of the following classes of financial products:

(A) interests in managed investment schemes limited to:

(1) horse racing schemes only; to retail clients.

TRANSFER’S OF OWNERSHIP – POLICY ADVICE

It is a requirement under the Rules of Racing for the name or names of every person or persons having any share or interest in the ownership or lease of a horse to be declared to RWWA prior to racing. Backdating transfers or similar where such dates retrospectively affect the ownership of a horse in a race already run is therefore contrary to these principles. Furthermore once payments have been correctly made by RWWA based on recorded ownership details, it is impractical to attempt to re-allocate stakes to revised owners after the event.

From 1 December 2019, administrative duties attached to registration queries and applications will be moved from RWWA to Racing Australia (RA).

This is being done to help facilitate a more streamlined registration process for industry participants.

While RWWA will retain the functions of New Jockey Silk Applications and Promotor Syndicates, all applications for Transfer of Ownership, Syndicates, Leases, Jockey Silk Renewals, Change of Percentage, Change of Share, Deceased Estates, Banking & GST, will be received and processed by RA.

These documents will be able to be processed online or by lodging them direct to RA by email deputyregistrar@racingaustraliahorse. RA can be contacted via their website, email or by phone 1800 870 799.

Approved Promoters

The following named persons are the only persons approved by RWWA and licensed by the Australian Securities and Investments Commission (ASIC) to promote ownership shares in horse racing schemes.

Prospective owners should be mindful that any person promoting shares in a racehorse must hold a current Australian Financial Services Licence (AFSL) with the *conditions shown below.

Industry participants, in particular those involved in horse ownership, are therefore advised when completing the required Application to Transfer (or similar document that alters the official recorded ownership,) the Date of Transfer cannot be dated prior to the horse’s last race start. The practice of back-dating the Date of Transfer so as to include dates where the horse has already raced will not be accepted and instead the Date of Transfer will be given the effective date of processing. Where race starts are not included in any back-dating then the indicated Date of Transfer will be recorded.

This policy shall be consistently applied across all codes.
