Case: A-29/2013 Issue: suspicion of plagiarism Your e-mail of July 14
Dear Dr. Sklyar,
Repetitive publishing to fasten the illusion of novelty at https://issuu.com/home/ published/-nwintracellsens12
Herewith we refer to the above mentioned issue containing a possible case of plagiarism in the paper of Dr. Strehle et al. titled “Outside Looking In: Nanotube Transistor Intracellular Sensor”. While we were checking the evidence, the following questions arose which we need to gain a complete picture in this matter:
(1) The paper mentioned above lists a couple of authors. Why did you accuse Dr. Strehle in particular and not the whole group or – for example – the corresponding author? Is there any (former) academic contact between Dr. Strehle and you?
(2) Did you inform any other authority (for example the Ombudsman of the Harvard University) about this case? Do you intend to do so?

Case: A-29/2013 Issue: suspicion of plagiarism Your e-mail of August 26
Dear Dr. Sklyar,
We come back to the above-mentioned issue. In your e-mail dated August 26th, you informed us that in addition to contacting us in the above quoted matter you also filed a complaint to the NIH (National Institutes of Health/USA) and to the director of a Japan Student Services Organization.
Considering the whole case, it becomes clear that the focus of your complaint lies on incidences having taken place in the USA – the paper was compiled at Harvard University and all authors of the paper “Outside Looking In: Nanotube Transistor Intracellular Sensors” were also located at Harvard University as it is marked in the list of authors. Hence, the main authority that should be concerned about this case of suspected misconduct is indeed the NIH.

Case: A-29/2013
Dear Dr. Sklyar, As we informed you in October 2013, the main authority to be concerned with your case is the NIH. Therefore, we asked the NIH resp. the ORI authorities to keep us informed about their view and judgment. The Deputy Director of the Office of Research Integrity answered that you were informed about their final assessment in September: According to their assessment there is an insufficient basis to sustain your claim of theft of ideas and intellectual property so they had to administratively close the file. Please let us know if you received a letter from ORI comprising such an assessment and – if so – why you kept us unaware of this fact. If you did not receive any message from NIH/ORI, please contact these authorities again. Anyhow, we see no reason for further investigation or additional measures after the above mentioned findings. In your e-mail dated 21th January 2014, you submitted further evidence to us concerning another possible case of plagiarism. Since the factual situation is comparable to your first complaint, our proceeding will be the same as before: please let the NIH know about the case

15.01.2017 Your inquiry to the German Research Ombudsman (A-79/2016) Dear Dr. Sklyar, We are writing in reference to your response to our letter of April 4, 2016, in particular your email of November 21, 2017. With your consent, we contacted the corresponding author of the paper published in Nature Communications in 2015. He informed us that your allegations concerning this paper have already been investigated by several parties in 2015, including the European Research Council, the Leibniz Institute for Solid State and Materials Research in Dresden, and the responsible board of Nature Communications. All of these investigations came to the conclusion that your allegations cannot be confirmed, i.e. that the above-mentioned paper does not include plagiarised passages going back to your publications. Since we do not reinvestigate matters that have been handled by other institutions, we will not pursue this inquiry any further. In addition, we would like to emphasize our three guiding principles again: confidentiality, fairness, and transparency. As we already mentioned in our last letter to you, you breached the confidentiality principle by publishing our letters concerning your last inquiry in 2013 on the website issuu.com. In addition, you infringed the transparency principle by not providing

us with all information relevant for your current inquiry, e.g. the fact that your allegations have already been investigated by other institutions and the conclusion of those investigations. We would like to emphasize that – according to our guidelines – we do not pursue inquiries if the above-mentioned principles cannot be guaranteed or have already been infringed. Since you have disregarded our guiding principles several times in the past, we would like to inform you that we refrain from taking any further actions related to your inquiries.
