It’s no secret that WMCCAI is proud to be the largest chapter in all of CAI. At over 3,000 members, it only makes sense that we would host the biggest events in the organization, including our annual Conference and Expo on Saturday, March 10. We’ve got legislative updates for those interested in recent court decisions and local and federal legislation affecting how communities are governed and the impacts on residents. Educate yourself on emergency management or going green and reducing your community’s footprint. Maybe you want to run a more organized meeting, reduce resident complaints, or how to deal with short term rentals.

C&E wouldn’t be complete without a best practices presentation by our award-winning Community Associations of the Year in the small, medium, large, and very large categories, as well as Communicator and Charitable Community of the Year. The CAY communities have demonstrated excellence in all facets of governance, communication, facility management, financial management, risk control & insurance, and association leadership & management, incorporating CAI’s Best Practices into their operations.

Communicator of the Year goes above and beyond to establish two-way communication with their membership on everything from providing easily obtainable forms, documents, financial data, and unit owner information, to providing emergency communications, openly conveying information to its members, and having open meetings during which residents can converse directly with the board and management. Charitable Community of the Year performs charitable projects or provides outreach that extends beyond the boundaries of their association and impacts their surrounding area. I am truly honored to award this year’s winners at Conference and Expo and recognize these distinguished communities in this publication.

Sarah is the general manager of Broadlands, a 3,800 unit HOA in Loudoun County. She has been in the community management industry since 2000, first as a portfolio manager before transitioning to large-scale on-site management in 2012. Sarah has been active in the Chapter for more than 10 years and has served on various committees during that time. She has served on the Chapter board for six years, holding the offices of treasurer, secretary, and vice president. Sarah was named to Loudoun County’s Class of 2015 Top 40 Under 40 Business and Community Leaders.

How to Achieve the

Community Association

of the Year Recognition

H

ave you ever thought about your community being recognized as the Community Association of the Year (CAY)? Or what it takes to win this recognition? If so, please continue reading as I would like to share my journey of being a part of a community (Oak Creek Club Homeowners Association, Upper Marlboro, Maryland) that was recognized as the WMCAI Large Scale Community Association of the Year for 2016.

The CAY Award recognizes the communities that best demonstrate excellence in all facets of association operations and governance based on Best Practices recommended by CAI. To achieve this recognition it requires participation from all levels of leadership within the community. This includes your

board of directors, committee volunteers, and your management team.

Achieving this award takes far more than just beautifully landscaped grounds and wellappointed homes.

Having an Olympic-size swimming pool, walking trails, fitness center, gated community, restaurant, and golf access within the community will not guarantee your community a chance of winning this award. The best way to achieve this recognition is through a well maintained and managed operation with engaged residents, members of the board, and committees

Preparing for this recognition started years ago when the developer envisioned the community and the lifestyle that it would afford those that called it home. The preparation for recognition has continued through the years by having good management practices, strong leadership from the board of directors, and volunteers on the committees giving of their time to make sure that their community continues to excel. While having residents that care about the community that they call home.

Having a board of directors that understand community association leadership has been valuable in leading the community towards award-winning recognition. Our board meets regularly to keep the business of the association moving forward. They are informed, engaged and does not take their responsibility lightly. The board and the management team have a good line of communication and business relationship which has allowed for the business of the association to be accomplished.

Our board of directors encourages participation at the committee levels. The board encourages transparency and communicating out to the community. A recent example of this is when our Grounds Committee worked on a recommendation to install pet waste stations in the community. The board wanted to make sure that the committee heard from the membership at large and suggested that signage was put out at each proposed location. In addition to the signage, several communication pieces were sent out to the community advising of the committee meeting dates to discuss this recommendation along with providing an email address for the members that would like to share their comments but could not make it out to one of the meetings. As a result of the committee’s work, it was decided that pet waste stations were not something the community needed to move forward with at that time.

Another example would be our annual budget preparation process. The board encourages the Budget and Finance Committee to be transparent during this process and for the membership to participate. There were multiple communications sent out to the

membership advising of the dates for the meetings as well as additional meetings scheduled during the budget preparation season to afford those that would like to be a part of the process an opportunity.

The board’s effective leadership and engagement, has assisted with having productive well run board meetings; where the membership is encouraged to participate.

The board ensures that comments and inquiries are received and responded to in a respectful manner. They also encourage educational growth about community association for the leaders in the community and the membership at large.

Having effective committees play a large role in being an award-winning community.

Our committees maintain a regular monthly meeting schedule. The committees welcome participation from the membership at the committee meetings. The volunteers participate in an annual jump start meeting hosted by the board and management. The meeting is an opportunity for the board to review the goals for the year, share their appreciation for the successes and share best practices. Our committees are engaged in the process and have been instrumental in assisting with moving recommendations forward to the board.

One example of how the committees contribute to an award-winning community would be our Grounds Committee speed mitigation awareness campaign that brought awareness to our community around the established speed limit within the community and pedestrian best practices. This campaign resulted in a recommendation for the installation of additional signage within the community and overall a better-informed community around the benefits of maintaining appropriate speed and pedestrian best practices within the community. As part of this process, the committee created informational fliers that were sent out to the membership with various speed mitigation best practices. The committee also participated in the process of researching best practices around speed mitigation and went out into the community to assess the potential locations for additional signage. There is great value in having informed and engaged committee volunteers.

The committee volunteers have been helpful with sharing their knowledge around various initiatives within the community with their neighbors, further ensuring the transparency of the association.

Another important layer in achieving award-winning recognition is having the right team in place managing the day to day operation. A management team that understands association management and follows the best practices will help to ensure your community is operating in an award-winning manner. Some important attributes of a successful management team should include attention to detail, leadership ability, communication skills, accountability, knowledgeable, engaged, and empowered. These attributes are important to assist with managing tasks such as community inspections, oversite of the financials, accounts receivables and payables, vendor management, capital project management, grounds management, risk management, and enhancement recommendations are just a few of the areas that an award-winning management team will consistently excel in.

As you may have gathered by now, there is no magic formula to follow for your community to be recognized as an award-winning community but rather a journey that involves the community. In line with the old saying “ it takes a village to raise a child,” In the association industry, “it takes a community to achieve Community Association of the Year Award.”

WHAT MAKES ASSOCIATIONS Awesome?

The board of directors runs the association on behalf of all the owners; they are elected by and represent the owners as a group.

They are responsible for the association’s financial health, oversight of the management company, and enforcement of the governing documents. The board makes all major decisions regarding the maintenance, repair, and enhancement of the common areas and amenities. They must fulfill their duties in good faith and in the best interest of the association.

Community associations thrive through the active participation of owners and residents.

I know firsthand how much time and energy board and committee members put into the governance and operations of the HOA, and these dedicated homeowner volunteers are vital to a community.

While some may feel that associations are too restrictive, I find the rules and regulations help build and preserve an environment that promotes the safety and well-being for its residents, creates a sense of community, and protects and enhances the property values. One function of a homeowner’s association is governing aesthetics via architectural guidelines. Covenant controls are often designed to enhance the quality and attractiveness of the neighborhood and provide consistency throughout the as-

sociation, which improves curb appeal and in turn helps maintain and increase the value of the properties.

My husband and I purchased our townhome in the fall of 2006 after a long search. As we began our search, our primary criteria were to find a home in a family and pet-friendly community that was walkable to the metro station and would allow our child to remain in the same school. The homes were a little older and more modest than some of the others in the area, but we immediately fell in love with the neighborhood. Much of the charm had to do with the age of the community, which was developed before urban sprawl had made its way to the area. There are huge open grassy areas, large playgrounds, tree-lined walking paths, basketball and tennis courts, as well as access to a largely unknown county park in the forest. A dog park was added a few years ago, which was a great enhancement.

I love the convenience of living in an HOA. My association, like many others, provides and arranges for important services like trash and recycling collection, snow removal, and front yard mowing and turf maintenance.

These shared services help to maintain a mutually beneficial and harmonious living environment. The front yard is mowed regularly so we can spend more time focused on family instead of yard work, and the leaves around the community and my home are always picked up right before Thanksgiving

My HOA has several community events throughout the year that provide an opportunity to meet and connect with neighbors.

The community playgrounds, sports courts, and dog park are a natural place for residents to congregate and engage with one another.

Many of our neighbors were drawn to the community for the same reasons we were, and it turned out there that there were other commonalities too. Friendships were born from these shared interests.

We have a great board, and they work handin-hand with management to carry out the operation of the association. The association provides community resources and ample, timely information through the website and social media pages. They do an excellent job of keeping residents informed about community news and project updates. I am very thankful for their service and dedication.

We love our neighbors, and they have grown into so much more—friends and a support network. We celebrate, console, support, inspire, and commiserate with each other. We gather for block parties, holiday and birthday parties, concerts, camping trips, festivals, and of course neighborhood events.

We’ve spent countless evenings watching all our children play and just enjoying the company of one another.

In 2014, as we prepared to welcome our third child, we knew we had outgrown our home. There were a lot of great houses in beautiful communities that could have worked, but there was always something missing. The idea of leaving our friends and our neighborhood was heartbreaking. We decided to end our search and instead complete a major renovation of our townhouse.

In the end, we built a new space for our family in precisely the place we want to be. I can’t imagine raising my family anywhere else.

SUFFIELD MEADOWS

S

uffield Meadows is an age-restricted community located in Fauquier County, north of historic Warrenton, Virginia. Suffield Meadows was built upon a former cattle and English holly tree farm. The clubhouse was the former owner’s 100-year-old residence which was refurbished for use by our residents. Suffield Meadows is unique consisting of 112 residences; 32 units in two multi-story buildings and 80 Villas and Cottages. There is also a 65 bed Assisted Living Facility run by Fauquier Hospital. Our residents may own a home, move to an apartment and then to the Assisted Living Facility without leaving the community. Suffield Meadows is situated on 112 acres of land, of which 80 acres are in conservation and contains miles of hiking trails.

Our homes are in park-like settings with lush landscaping and curved streets that add to the beauty of the community.

We are governed by formal bylaws and rules and regulations. The bylaws dictate the roles and responsibilities of the board, including the length of terms. The terms are generally three years and are staggered to prevent

more than two board members being up for election. The board of directors is responsible for the operations and maintenance of the community, aided by our community manager and on-site maintenance.

Operation and maintenance include a wastewater treatment plant that contains collection tanks, pumps, and a potable water drain field that must be monitored and maintained. In addition to the WWTP, our community is responsible for several miles of paved roads, walking paths, and wooden bridges spanning a natural creek connecting our conservation area to our common area.

The board holds regularly scheduled work sessions that all residents are invited to attend, during which the board discusses and votes on contracts and other measures.

There is a closed executive session once the general meeting is completed to discuss topics such as personnel matters, pending litigation, contract discussion, and violations of the bylaws. We also hold a monthly general board meeting and encourage socializing after these meetings.

Enhancements approved by the board include the construction of a new patio, the installation of a flagpole in front of our clubhouse, and the installation of a sign at our entry proclaiming this to be an age-restricted community. Suffield Meadows recently received FHA and VA certifications.

The board receives monthly reports from our community manager that include the results of any requested work, proposals for review, and any issues for the board’s opinion. A monthly budget and expense report are reviewed by the community treasurer and the other board members.

Our conservation area consists of meadows, woods, and wetlands. A trail system winds through this traversing a creek that turns into several ponds. This area provides sightings of various birds, fox, deer, beaver, waterfowl, bald eagles as well as a bear! We provide a conservation plan to both Fauquier County and the State of Virginia.

THE HEIGHTS AT PENDERBROOK

T

here is occasion that an exceptional community is defined by more than beautiful landscaping, steady day-today operations, and glitzy amenities; and while the Heights at Penderbrook (HAP) offers these and much more, I submit that we are worthy of consideration for Community Association of the Year because of how we are successfully managing a most unexpected and unfortunate hardship.

The trouble began in 2013 with a single atypical foundation leak. One leak became two, then five and it didn’t take long to ascertain that we had a potentially massive and complicated dilemma on our hands. That being said, the board and our management team did not panic but rather mobilized to remedy the issue quickly and efficiently. We hired a structural engineer to perform an assessment, and though definitive proof is unlikely, his professional opinion stated that the 2011 Virginia earthquake damaged the condominium foundation waterproofing base.

This ominous diagnosis was just the begin-

ning. Little did we know just how destructive the earthquake would prove to be to our association.

Initial prioritization of time and resources was critical. First, we researched the possibility of filing an insurance claim to no avail as this “act of God” was not covered. We relied heavily on management to schedule, follow up, and coordinate details. We consulted with legal counsel. And we informed the membership by every means possible with hard copy mailings, bulletin board flyers, email blasts, website updates and specific topic discussions during monthly board meetings. We hired experts to develop a comprehensive RFP to identify the ideally suited contractor for our unique circumstance.

And finally, after interviews, inspections and product testing, a contracting team was selected. Though still unaware of the full scope and magnitude of the damages incurred, we were moving in the right direction.

Armed with knowledge and a partner in place, the next step was to make a financial strategy, and this is where we excelled.

While most associations would have to resort to a special assessment or take out a loan to cover immediate, unexpected costs, we dug in our heels and vowed to avoid doing so at all costs. We developed a comprehensive long-term year plan that spread the costs of any necessary repairs over time to avoid hammering only current owners. We consulted and coordinated with our budget committee, legal counsel, management, and contractors to put our best foot forward. We pinched pennies, utilized excess operating funds, sacrificed landscaping projects, and deferred scheduled maintenance projects.

We capitalized on excess snow-removal funds that were available due to mild winters. And we implemented a small assessment increase that was in line with previous assessment increases through the years. In doing all this, we have been able to maintain our reserve funds at the requisite levels and keep our FHA eligibility. Smart, timely and

comprehensive decisions have enabled the Heights at Penderbrook to retain property values and continue business as usual even when faced with a true disaster.

Unfortunately, we are still experiencing the residual effects from the 2011 earthquake. To date, 26 of our 75 condominium buildings have received extensive interior and exterior repairs for waterproofing damage caused by the Virginia earthquake at an approximate cost of 1.5 million un-budgeted dollars. Yet, in spite of the obstacle created by this minor cataclysm, the Heights at Penderbrook not only endures but continues to thrive and operate at the highest level. Finances are in order, members are informed, and a solution is in place to successfully move the association well into the future. Sometimes a truly outstanding association is revealed by its management of adversity.

RIPPON LANDING

R

ippon Landing sponsors two yearly community clean-ups. The Boy Scouts volunteer with residents to clean-up the community and the association donates the roll-off dumpsters placed throughout the community. This is in collaboration with “Keep Prince William Beautiful” and Prince William County Neighborhood Services. We find it beneficial to partner with services offered through the County; for example—recently someone had dumped over 16 tires on the association property, and the county had them removed within less than 24 hours after we asked for advice on what would be the best way for removal. We take every possible step to maintain a clean community.

The association has many activities for children and adults. There are exercise stations along the community trails, and the children can go to various parks/tot-lots within the association. We also have tennis/basketball courts. The association hosts a summer pool party, bi-annual community yard sales,and a holiday parade with the OWL Volunteer Fire Department. Many residents look forward

to these events as it allows them to meet new neighbors and socialize with the board and management.

The association frequently has county officials attend the annual meetings to address topics surrounding the Rippon Landing Community. One such Town Hall Meeting included working with a neighboring community on the Route lWidening Project.

In attendance was our district supervisor; Frank Principi and his assistant.

We keep the community informed of such events via the newsletter, website, street representatives, and informational signs. We encourage residents to participate in community events and encourage committees’ participation. Community volunteers are recognized at the annual meeting and social events. The board and management also personally acknowledge volunteers.

Each month, included in the board packages are CAI “Best Practices” and informational training topics. The CAI materials help the board become great leaders and keep them

informed of their roles and responsibilities to management and the residents. The committees are also encouraged to use CAI “Best Practices” when working with the board and management.

Rippon Landing encourages owners and residents to continue to work with the board, committees, and management to keep our community a great place to live.

I

began to help on our fledgling committees and, as I approached retirement in 2010, I became more involved and was elected to serve as chair of one of our committees. In 2013 when the developer handed the board to the residents, I was elected not only to the board but also as president of the association.

Having already taken the CAI Fundamentals course, I understood the value of CAI’s many support tools and insisted that all of our new board members begin their tenure by attending the CAI course. The board began in earnest implementing policies and processes based on CAI’s recommendations, and now have 17 formally published resolutions to guide our operations.

On a personal basis, it has been exceptionally rewarding to learn the intricacies of HOA leadership and help our great community become even better.

Potomac Green is dedicated to providing a rich quality of life to our 2,500 residents. Our social committee plans over 20 major social events each year, most of which sell out. Our Lifestyle Director arranges many events for residents such as trips to New York, shows at the Kennedy Center and Wolf Trap, plays in Washington, local area trips, and health and wellness events. She is also the focal point for members to pursue common interests in hobbies and in recreational, social and cultural endeavors via our 35 clubs and groups.

At the community center, we have small and large recycling containers placed at appropriate locations throughout the building; these are always filled to the brim during social functions. We also offer an industrial-sized

In the past year, we Implemented two new “green” initiatives: (1) We reduced usage of county water by over 5,700,000 gallons per year by spending over $50,000 to dig a well to provide irrigation water to our largest irrigation region, and (2) We invested $29,000 to convert our 400+ street lights to LED bulbs to reduce street light electricity consumption by 74%.

KEENE MILL WOODS II

T

o build 75% support for a crucial bylaw amendment, a daunting task, we could not leave any communication stone unturned at the Keene Mill Woods II Condominium (KMWII). Neighbors did come together in unprecedented numbers and, incredibly, passed the measure. But communication did not stop when the confetti fell. Diligently reaching out to our fellow neighbors, as a regular practice, has been essential to our success, as a community in transition.

KMWII owners had not been able to vote and elect board leaders since 1997, due to a high quorum set in our 1970s bylaws. We contacted our state senator, Dave Marsden, and he worked to pass a bill that allowed KMWII and other communities to seek court help to hold an election. We sought this help and were finally able to vote. There was a changing of the guard, and new leaders proposed the bylaw amendment to permanently lower our quorum and ensure owner voting every year.

To build support for the amendment, we reached out on doorsteps and in meetings, as well as on email and social media. We mailed an educational letter, well in advance, so owners could carefully consider the issues, know what to expect, and have time to ask questions. We posted a short YouTube video, with helpful graphics, and posted physical signs at our entrances: a thermometer that rose, as owner support grew. We set up a new system so proxy forms could be returned via text messaging, as a convenient option.

When the amendment passed, we also had many ways to get the word out and celebrate.

Our dynamic mix of communication methods was also key to building excitement for other new initiatives, such as electronic voting and a neighborhood Food Drive to help folks in need. To preview our annual inspection, we created and mailed a checklist for owners. It identified focus items and invited owners to take a self-inventory, well before the actual Inspection, making the process a cooperative effort.

We also regularly send email newsletters with meeting agendas, minutes, maintenance updates, volunteer recognition, Neighborhood Watch tips, event information, and pictures, among other items of interest.

We want to hear from our neighbors. The footer of every newsletter includes key contact information, so it is always handy. We also invite feedback through a quarterly survey and at meetings in our open forum. We provide a welcome packet to all new owners and offer to answer questions. As one example of valuable feedback: Prompted by a resident inquiry about volunteer opportunities, we created a partnership with our local high school so that students can earn school service hours, for helping the neighborhood.

KMWII has come a long way as a community, and we look forward to future progress.

Great communication will continue to make that possible. We thank our neighbors for their support, as well as John Lyons of Gates Hudson, our manager, for his tremendous efforts to move KMWII forward.

LOUDOUN VALLEY II

L

oudoun Valley II is a young and vibrant community located in the fast-changing Ashburn area of Loudoun County.

We have a mixture of home styles, including single-family homes, carriage houses, townhouses, and condos and an exuberant population of international residents. Our residents are energetic with ever-growing participation in neighborhood events and a sincere desire to improve and impact the quality of life for those in the larger Loudoun community and beyond.

In an effort to reach out beyond the borders of our neighborhood, we are currently holding a food drive to benefit Loudoun Hunger Relief, which depends on food drives to make up almost 50% of the food that is donated to feed Loudoun families in need. In the past, we have collected dry and canned goods at our clubhouse in support of the Reston Interfaith Food Pantry, helping to provide food and emergency services to area families needing assistance.

Among the events that Loudoun Valley II has sponsored is a Nepal Earthquake Relief Con-

cert to provide support when a catastrophic earthquake struck in Nepal. We hosted the open-air concert on our clubhouse lawn to raise funds for emergency relief efforts.

The HOA has joined with the Marines’ Toys for Tots collections to make it possible for less fortunate children in the area to celebrate the joy of the Christmas holiday. This is a well-known program that offers a wonderful opportunity for our community to participate in improving lives for children in need.

Loudoun Valley II HOA has participated in a book collection drive to supplement school resources and help to improve the education of young residents of the area.

This spring we were proud to celebrate National First Responder Appreciation Day by hosting an appreciation luncheon and welcoming Loudoun County Deputies along with other first responders from fire, rescue, and emergency services. It was an inspiring opportunity to meet with and express our community’s sincere thanks to the brave

men and women who protect all of the residents of Loudoun County.

We have hosted and participated in the annual Alex’s Lemonade Stand to raise awareness of childhood cancer causes while collecting money for new childhood cancer research and cures. The bright yellow Loudoun Valley II Alex’s Lemonade Stand was a popular and attention-getti ng way to raise money for this important cause while encouraging community and others to get involved and make a difference.

We also provided support for the arts in Loudoun County, showcasing students while providing free display space for a student art show and an opportunity for student musicians to perform in our clubhouse, with both events open to the larger Loudoun community.

In August of this year, we welcomed parents to a sponsored “Meet the Principal” night at our main clubhouse at Loudoun Valley II. Parents had an opportunity to meet school

staff members in a relaxed and social environment before the school year began.

As we enter the colder months of the year, we have plans for a coat drive to collect warm coats for families who may require assistance. We will be joining again this year with the Marines’ Toys for Tots program so that our community members will have the opportunity to reach out with gifts and make a difference in the lives of children.

We know that our community will continue to provide a growing amount of charitable assistance and volunteer outreach as our HOA grows and moves forward into the future. We will continue to provide wide-ranging options and a variety of opportunities for our residents to help those who are less fortunate and improve life for those beyond our neighborhood.

t’s the most wonderful time of the year, but it’s not what you think. For many, it’s the holiday season but for those of us in the Washington D.C. metropolitan chapter, it’s awards season, the Community Association of the Year awards season to be exact.

Winners are announced yearly at Jump Start January for each of the categories (Small, Medium, Large, Very Large, Communicator of the Year, and Charitable Community of the Year) but what’s not known is the behind the scenes activity that goes into judging these communities. This article will provide a peek behind the curtain and give readers a judge’s perspective on the process. We trust that by sharing our observations, we will encourage other communities to throw their hats into the ring in hopes of winning this coveted recognition. We will also offer some tips that will set a community’s application above the rest. After all, why apply if you’re not in it to win and be recognized for your excellence?

It’s been said that it’s the little things that make all the difference and with the CAY application, this is true. Too many little mistakes can add up to big points being deducted from your overall score. It’s like that exercise in high school that many of our teachers did at one time or another, where you’re given a test with several questions and the object of the test is not to test your knowledge of a subject but rather, to see if you can follow instructions. Often, we see applications where it’s clear the applicant did not read the instructions carefully, and it’s a shame because in some cases, a deserving applicant lost valuable points or in the worst case, was disqualified altogether.

Did you know that a homeowner member is required to fill out the application, answer all questions, including writing the essay? Your community manager may proofread for typos and errors but should keep their input at a minimum. After all, we want to hear from the homeowners in the community! You, the homeowner, are the heartbeat of your communities and who better to tell your story as to why your community is the best at what it does. Believe it or not, it can be obvious that a management professional wrote the material or it was copied and pasted from a website. Essays must be 500 words or less.

If there are more than 500 words, then points are deducted. Double spacing is also more vital than most people realize. It makes it easier to read, and judges will deduct points for formatting issues. Again, these things may seem minor, but in the grand scheme of things, they add up.

Creativity and thinking outside the box are typically what make a community shine above the rest.

For example, when asked about methods of making the community environmentally “green,” most immediately think of their recycling efforts and will state they use the blue bins for metal, glass, and paper.

While this is commendable, it’s not especially noteworthy, as many jurisdictions in our area require recycling.

An award-winning community considers things such as landscape irrigation to recycle water, and dog waste pick up methods that reduce soil and groundwater pollution. They provide information on document shredding and how to recycle hazardous materials. Buildings make use of composite or recycled material for repairs, even in parking lots to fix potholes. Some communities offer conservation areas, bins for ink cartridges and batteries in their clubhouses, paperless accounts, switching to LED lighting, and more. We’ve even heard of communities using goats to provide weed control in common areas. Talk about out of the box thinking!

Transition of Community Association Control from the Developer to Homeowners

This is the third in a series of articles about public policies developed by the Government and Public Affairs Committee of the Community Associations Institute (“CAI”). These public policies are designed to provide guidance to associations and set the standards to which common interest associations and those who support the work of community associations may aspire.

Eventually, control of every community association is transferred from the developer to a volunteer board of directors selected by the community. For a successful transition, the needs of both the developer and the owners should be taken into consideration, and the parties should work together. Plans should be put in place to facilitate successful completion and sale of the project by the developer while providing an opportunity for owners to understand and participate in the operation of the association and prepare to govern.

CAI Public Policy - Transition of Community Association Control from the Developer to 32 | QUORUM

Homeowners - provides guidance and offers suggestions on how to make this process work for all concerned. CAI recommends several actions that the developer and owners should jointly pursue prior to transition, including: •

Educate owners about community association living and the rights and responsibilities of owners and the association.

•

Allow meaningful owner participation in association governance prior to the transition.

•

Keep open lines of communication between developer and owners which allows both developer and owners an opportunity to raise concerns relating to the community.

•

Ensure that originals or accurate copies of all relevant documents including financial documents, building plans, instruction manuals, and warranties, are in association files.

•

Operate the association as a separate legal entity, independent of the developer.

•

Provide full disclosure of budgets and other financial information relating to the association.

•

Prepare a reserve study. (National Reserve Study Standards (NRSS) provide that components of the development that: (1) involve common area maintenance responsibility; (2) have a limited useful life; (3) have a predictable remaining useful life; and (4) have a threshold repair/replacement cost should be included in the reserve study.)

In addition, CAI’s Research Foundation has made available for download on the CAI website, at no charge, a 51-page Best Practices Report on Developer-to-Homeowner Transition. This Report provides detailed information concerning the transition process.

Once the owners take control of the association by election to the board, they are charged with the fiduciary duty to investigate and assess both the finances of the association as well as the construction of the property. With the CAI policy - Transition of Community Association Control from the Developer to Homeowners - as a guide, the owners will be in a much better position to fulfill these obligations.
