Spring is upon us. January and February were busy months for the Washington Metropolitan Chapter of CAI. Jump Start January, the Chapter’s annual kickoff event was held on January 31st and we had approximately 400 homeowner, manager, and business partner attendees. This was the perfect opportunity to highlight the Community Association Civility Pledge, created by CAI’s College of Community Association Lawyers in an effort to help set the framework for effective community conversations. Additionally, I used this event as a chance to encourage our members to participate in a conversation about the importance of being intentionally inclusive so that the Chapter can grow a shared commitment to the principles of diversity, making us better able to serve our members and the communities in which they live and work.

WMCCAI’s 2020 Conference & Expo was held on February 21 and 22, 2020.

This year we expanded the C&E with pre-conference training sessions on Friday in partnership with the Central Virginia and Chesapeake Chapters of CAI. The event was a huge success. Thank you to our talented staff and the Conference and Expo Committee, led by Donna Aker and Chris Goodman for their incredible work and dedication.

In keeping with our organization’s mission of advocating and providing better living through community associations, the Chapter holds an annual contest, administered by the Outreach Committee, to recognize those communities that best demonstrate excellence in all facets of association operations and governance.

Representatives from each of the winning communities shared their best practices at Conference & Expo on Saturday, February 22. Congratulations to the Community Association of the Year, Communicator of the Year, and Charitable Community of the Year recipients.

Community Associations thrive through active participation of owners and residents. I know firsthand how much time and energy board and committee members put into the governance and operations of their associations, and these dedicated homeowner volunteers are vital to the community. We strive to meet the evolving needs of community association volunteers by offering a wide variety of educational events throughout the year for homeowners and volunteer leaders.

We have two exciting Chapter outreach programs in the next several weeks.

The 23rd annual Ronald McDonald House Landscaping Day will be held on Saturday, March 28th. Chapter members will gather to landscape the grounds of the Ronald McDonald House of Northern Virginia at INOVA Fairfax Hospital. This event is one of the Chapter’s proudest and most successful charitable works. Once again, we have partnered with the Alice Ferguson Foundation to participate in the Annual Potomac River Watershed Cleanup on Saturday, April 18. This is a fantastic way to celebrate the 50th anniversary of Earth Day. These family-friendly events allow us to give back to the communities we live and work in, and I would love to see you there.

Airielle is a Vice President at FirstService Residential. She has worked in community associations since 2004. Airielle has been an active volunteer with WMCCAI since 2007, earning the Chapter’s Rising Star Award in 2011 and Chapter Appreciation Award in 2018. Prior to joining the board, she served as the Member Services Council Chair from 2014 through 2015, chaired the Annual Awards Dinner Committee from 2011 through 2013, sat on the Social Media Task Force, and has written articles for Quorum.

Pia is a partner with MercerTrigiani, a charter member of the College of Community Association Lawyers, and past president of the Washington Metropolitan Chapter of CAI. She remains active on legislative matters, coordinating the lobbying effort on behalf of the Virginia Legislative Action Committee. She chaired the Virginia Common Interest Community Board from 2008 to 2019.

Tiago is an associate with MercerTrigiani and is a member of the Virginia Legislative Committee of the Washington Metropolitan Chapter of CAI. Belmont Glen Homeowners Association, Inc. seemingly rocked the world of community association architectural compliance, calling into question architectural review and compliance practices in Virginia common interest communities – or did it?

Community association lawyers across the Commonwealth have dissected and discussed the case. The impact of the ruling is undoubtedly cause for concern. But, did we learn anything new? Did the decision depart from the growing trend of cases that give narrow construction to restrictive covenants and rules? Is it not just another sign of caution to community associations to mind their due process p’s and q’s and only proceed when authority is clear?

The Case In Belmont Glen, the Virginia Supreme Court held that rules restricting seasonal decorations adopted by a Virginia property owners association were unenforceable because the rules exceeded the scope of, and were not reasonably related to, the restrictive covenants.

The rule giving rise to the case established specific time periods during which seasonal and holiday decorations could be displayed and required homeowners to apply for approval to display decorations for any other celebrations. The rule also required homeowners to turn lights off by midnight. Following a strict construction approach, the Court analyzed four covenants relied upon by the association in evaluating whether the association had authority to adopt the seasonal decorations policy.

Exterior Lighting – The first covenant prohibited homeowners from directing exterior lighting outside lot boundaries and installing exterior lighting causing “adverse visual impact to adjacent lots whether by location, wattage or other features.” Noting that the seasonal decorations rule did not mention “adverse visual impact” or regulate “location, wattage or other features,” the Court determined the rule exceeded association authority established by the exterior lighting covenant.1 Approval – The second covenant the association relied on prohibited homeowners from modifying or altering property without ap-

plication to and approval of the association.

The Court determined that the approval requirement similarly did not establish association authority to adopt the seasonal decoration rules – on two bases. First, the Court suggested that restrictions on exterior lighting installations may be regulated only on the bases provided in the exterior lighting covenant (i.e., adverse visual impact, location, wattage or other features). Second, the Court determined that approval is only required for permanent changes and that seasonal decorations are merely temporary.

General Appearance Regulation – The association also relied on a covenant providing general authority to “regulate the external design and appearance of the Property. . . so as to preserve and enhance property values and to maintain harmonious relationships among structures and the natural vegetation and topography.” Following a rule of construction requiring interpretation of the covenant “from a reading of the whole instrument,” the Court concluded that the seemingly broad authority established by this covenant is limited by other declaration provisions – the association may only regulate the permanent modification or alteration of a lot.

Jean-Baptiste Alphonse Kaur and Bon Jovi to “governing or protecting common property and preventing ‘nuisance-like activities’ on individually owned property.” In doing so, the Court warned that greater implied design-control powers create risks for property owners, including creating uncertainty in how design-control standards can be applied.

General Rule-Making Authority – Finally, the Court rejected an association argument for authority to adopt the seasonal decorations rule in a covenant granting the association broad rule-making authority. The Court determined that the rule-making authority covenant requires that the adopted rules be in furtherance of other restrictive covenants. Because no other covenant authorized the regulation of seasonal decorations, the association was without authority.

Continuing Trend The Belmont Glen case may be a fine example of the adage – Bad facts make bad law. The Belmont Glen decision is indeed based on particular facts and circumstances. And, undoubtedly, the factual background of the case had to have had an impact on the case proceeding. Even so, the trend applied by Virginia courts continues to be a standard of strict construction – common interest communities may promulgate rules only to the extent expressly authorized in recorded covenants. In other words, community associations may only adopt rules that are authorized by clear, express language in recorded documents. This is nothing new.

• Provide clear information on the rule.

We have been taught, encouraged, implored to review the documents, to return to the source of authority. It is our mantra - or should be! Perhaps we have put aside or forgotten that important rule. Or, perhaps we have become too comfortable and pushed limits by relying upon general rule making authority rather than confirming and relying upon specific authority in the recorded governing documents. With the very best of intentions, perhaps we have given architectural review broad application. But the lesson in Belmont Glen – no more!

The long line of parking cases offers guidance, too. Reasonable rules based on general authority are not enough. Those cases teach us that associations cannot curtail or limit the rights of others without express authority in the recorded documents. It is not enough that the rule solves challenges created by insufficient parking, makes perfect sense and is modeled after local government parking compliance tallies. The courts have told us – owners have property rights and if the goal is to limit those property rights, you must look to clear authority in the recorded documents where property rights are granted and limited.

What Next?

Architectural review is not over for community associations. Association practices and procedures do indeed need to be reconsidered and restructured – ever mindful that the courts – at least in Virginia – will apply a strict construction standard when rules or architectural guidelines are challenged.

The first question each community should ask – do we need a rule?

If the answer is yes, the next question is – do we have authority for the rule? If not, do we want to amend the governing documents?

And, if the community has authority or amends to establish authority, is the rule clear and concise and uniformly applied.

But the primary lesson in Belmont Glen - care should be taken in development and periodic review of association rules and regulations and architectural guidelines to ensure the rules are based on express authority.

There is a secondary lesson that we should take from Belmont Glen – and it is about compliance. There is nothing to suggest in Belmont Glen that the association acted inappropriately – in fact – the general district court and then the trial court, where due process compliance would have been considered, ruled in favor of the association. But that may become lost in the record on appeal. So, associations should approach compliance with the goal of seeking voluntary compliance - first. And, in evaluating action, consideration should be given to the nature of the violation and its impact.

Transportation Management Plans FOR ASSOCIATION MEMBERS

cross the country, there are initiatives to better utilize public/mass transportation; many cities are starting to require Transportation Management Plans (TMP). Locally, the City of Alexandria requires any residential development over 20 units to participate in their Transportation Management Plan with no option to opt out. As of 2019, there were 75 communities participating in the program including commercial, residential, and rental communities.

The main task of the TMP Coordinator is to file a bi-annual report, ensure the TMP’s mandatory annual survey is completed and provide homeowners with information regarding the benefits and rules of this program. Transportation Management Plans establish strict requirements on how funds may be utilized and each participating residential development is required to set aside a certain amount of funds to be used towards an acceptable means of transportation.

For a homeowner’s association in 2019, the rate was approximately $102 annually per unit. The rate is reevaluated annually and increased based on the annual cost of living index. The TMP requires the funds to be kept in separate bank accounts to ensure they are utilized appropriately. The community can choose to supplement the purchase of metro fare or pay for the card in full. Depending on demand, the allowable expense back to the owner/resident may be capped. While the list of benefits to residents is quite vast, there are a few restrictions on how the funds can be utilized such as:

• Maintaining driveways, private roads, and parking lots, except where to support innovative transportation options (please check with the City beforehand) • Any uses that are listed in the first section, but are explicitly forbidden by the individual approved TMP

With public transportation coming back in style, Transportation Management Plans are becoming more popular in cities across the country. These plans assist communities in educating residents about local jurisdictions offerings and are developed to encourage use of the various ever-changing public transportation systems. While there are many pros and cons to a Transportation Management Plan, they are a great way for communities to work with their local governing officials; as we start to see an increase in the need for alternative means outside of car ownership.

• Uses that are required elsewhere in the City Code, especially when not performing that use leads to liability. TMP funds are meant to help people leave their cars, or not purchase a car in order for getting around. TMP funds ARE NOT meant to shield property owners from liabilities. Some examples include: » Snow shoveling » Lawn mowing and landscaping » Repairs to make on-site and adjacent travel ways in a state of good repair (sidewalks, fences, roadbeds, etc.) » Storm water or drainage projects, except where to support a capital project (maintenance expenses are not allowed)

L

akeport Cluster in Reston, Virginia, is home to a wonderful group of community-conscious and caring people of all ages and backgrounds who enjoy its natural environment and constructed amenities and have banded together to achieve important goals. Your first impression is of mature trees shading quiet streets, a stunning vista across Lake Thoreau, and flowering bushes and plants wherever you look. We have made this a friendly and attractive community of 82 townhomes by using our lake and landscape to create inviting gathering spots, and one of Reston’s walking paths winds through our community, encouraging residents and others to exercise, walk their dogs, admire Lake Thoreau from benches on our dock, and stop to chat.

Lakeport encourages involvement at all levels: active committees, community-enhancing projects, and civic activism via engagement with Reston Association to improve our surroundings and the broader community and with local officials on urban planning and redevelopment. When we need something, the community responds—be it shoreline restoration, an Easter Egg Hunt or welcoming Halloween firepits for trickor-treaters, Neighborhood Watch, a movie night promoting the history of Reston, and even anonymous donations for charities and

amenities that are beyond our budget.

Recently, when faced with a 130’ lakeside dock that needed replacement, dozens of residents discussed how to use our Reserve Funds and attended meetings to review the likely uses of the dock, its aesthetics, and its engineering foundation. Cluster homeowners developed the final design, contracted the work to a builder, supervised quality control, and performed innumerable subprojects to improve the dock while staying under budget. The result is a beautiful facility that will last.

Soon we will repave our roads and parking areas, and volunteers with experience in asphalt contracting and project management have come forward. This is not an isolated example. We are a collection of people with a wide range of talents—technical, administrative, horticultural, etc.—and with the willingness to work hard for the common good of Lakeport via committees, other ongoing responsibilities (from maintaining Lakeport’s web page to cleaning goose poop off the dock), and ad hoc projects.

Lakeport’s Board, which meets monthly, assists owners by identifying areas needing maintenance through annual home inspections, revising standards to simplify repairs,

and developing online resources (quarterly home checklists, expected home element lifespans, disaster preparedness guides, aging-in-place resources, and safety tips). The quarterly e-newsletter, regular community announcements, and timely responses to emails address other issues.

Life in Lakeport, however, is not all work.

There are many group and individual activities to have fun, meet our neighbors, and discuss topics of interest. From our Book Club, to owners focused on supporting our local high school with scholarships, to TGIF get-togethers that rotate through homes, to outdoor parties, to a lake-beautification partnership with the art department at South Lakes High School, our residents understand the importance of “Play” in Reston’s motto: Live, Work, Play.

Lakeport is a great place to live because of its good neighbors and beautiful scenery—truly one of the best communities in America.

SPRING HILL COMMUNITY Association Community Association of the Year — Medium Category Managed by Gates Hudson Community Management, AAMC // Essay submitted by Pat Davidson

uilt on the grounds of the former Lorton Prison, the Spring Hill community has a colorful past and a bright future. The federal government sold the facility to Fairfax County with the stipulation that existing buildings be preserved and surrounding land be used for open spaces, parks, housing, and recreation. One parcel was set aside to build the Spring Hill Senior Campus.

In March 2006, the “pioneers” moved into Spring Hill. Amid the construction and unfinished streets, they fashioned an active lifestyle and forged a community that residents proudly call home.

Spring Hill offers residents who moved here from down the street, across the country, and over the ocean choices of living in single-family homes, condominiums, villas, apartments in historically preserved prison

buildings, or assisted-living and memory care residences. Our residents, who speak 25 languages, have learned to understand and value the customs of others at international club-sponsored dinners and have shared their diverse cultures. Our professor started a speakers’ series where George Mason University professors discuss a variety of topics.

Our artists, knitters, and Laughing Yoga gurus have conducted classes to share their particular talents. Our lawyers, engineers, nurses, accountants, gardeners, and singers have contributed their expertise to shape Spring Hill into a vibrant and harmonious community.

Remaining a great community is a continuing process. Our board had the foresight to create a strategic planning committee.

Armed with CAI best practices, skilled and determined residents started to “imagine the possibilities.” First, the community conducted a baseline survey that generated an incredible 61 percent response rate and identified where we were and where we wanted to go as a community. Second, residents participated in focus group sessions and identified our community’s strengths, weaknesses, opportunities, and threats.

Residents brainstormed over 300 ideas that were organized, analyzed, and normalized in a residents’ request list. Requests that weren’t strategic were addressed with

minimal expense. Third, the findings were presented at a standing-room-only town hall meeting. Over the last two years, we upgraded the fitness equipment, installed ADA-compliant doors, established a caring group based on the village concept, developed an emergency preparedness plan, and hired an activities director. The residents are the strategic plan’s real authors.

A key community value encourages residents to be involved in the community, its environment, and the greater metropolitan area. We obtained a grant from Fairfax County’s Neighborhood Enhancement Partnership Program to construct a rain garden. Residents and two grandchildren donated 275 hours of love, sweat, and labor to transform a nondescript piece of land into a place of community pride. Our project leader received the County’s Environmental Excellence Award. When it snows, we apply sand not chemicals on the streets and sidewalks. We celebrated Earth Day 2019 with speakers who talked about recycling, efforts to save the Eastern Bluebird from extinction, and solar energy benefits.

A fifth grader appealed to us that we remain active in saving the environment.

As stewards of the land, our residents are committed to leaving the world a better place for our grandchildren.

D

aventry is located in Fairfax County, Virginia, close to Washington, DC, with wooded and park-like surroundings. The variety of amenities, committees, clubs, and activities that bring the community together, make Daventry a desirable place to live. We have tennis courts, tot lots, a basketball court, and pool, which is home to our award-winning Dolphins swim team.

Our property includes paths and trails, some adjoining the county’s 42-mile Cross County Trail. Residents can participate in book, bridge, garden, and tennis clubs, and a young children’s playgroup.

Daventry’s 884 homes include 512 townhomes, 212 detached homes, and 160 condominiums. These comprise seven different neighborhoods within the larger community, each with an elected Neighborhood Representative who make up our seven-member Board of Directors. The Neighborhood representatives “wear two hats” serving as the point of contact for their neighborhood residents’ questions and assistance with matters related to the Association, and playing an important role in the legally mandated functioning of the board.

Board and committee members engage with the broader local community in many ways, including involvement in the Washington Metro Chapter of the Community Association Institute, exchanging information/problem-solving approaches with other HOA boards, working with local crime prevention police officers on public education and crime prevention, and bringing in local resources for “town hall” sessions to educate our residents about topics ranging from landscaping to recycling and environmental sustainability. For our large capital projects, we utilize engineers and engage local government officials to ensure that our investments meet future needs and comply with required standards. This outside engagement is an invaluable component of responsibly managing large projects.

As a large community in its fourth decade, Daventry has its share of challenges, however the Association’s volunteers and our Management Company embrace these challenges as opportunities. To help manage requirements and expectations, in 2018, Daventry re-negotiated its property management contract to include a full-time onsite manager. The board implemented a Code of Ethics/Conduct to establish expectations for our many volunteers; developed

Charters for each of our six committees to help guide their efforts; increased monthly assessments to better plan for and address the needs of our common area grounds and amenities; and, created a Long Range Planning Committee to assist the board with planning for capital items and adequately funding Reserves.

Daventry has a strong desire to keep the community informed. We recently moved to a technology platform designed for homeowner associations and re-vamped our website. We created an Association-sponsored Facebook group; we utilize eBlast messaging; each Board member communicates directly with their neighborhood; and, we also continue to employ traditional approaches, e.g. newsletters (also posted electronically on our website), and “sandwich board” signage to be sure to reach those less technologically inclined.

Daventry’s demographics have “ebbed and flowed” with respect to age, family structure, and culture. We are currently experiencing growth in families with young children.

These changing times contribute to both the vibrancy and expectations of our community and continue to keep Daventry forward-thinking and a sought-after place to live and play.

I

lived in Westridge for 21 years and still own a home there. When we moved, we kept the home so that I could stay involved in the community I love. After 20+ years in the Army, Westridge is the first place we lived where we could “put down roots” and call the community our home.

Westridge had everything to offer us – a beautiful community, tremendous neighbors, and unarguably the best amenities in that portion of Prince William County.

But most of all, it gives everyone a sense of place. Westridge has always been a great place to live and our byline of “The Natural Place To Be” lives up to its promise.

Our Home page states, “Welcome Home” not because it’s the home page but because Westridge is home. We have beautiful landscaped common areas, playgrounds, two pools, walking paths between neighborhoods and through the woods, a centrally located pond with catch and release fishing, wildlife galore with turtles, frogs, snakes, herons, eagles, owls and deer. We also have a beautiful, freshly renovated clubhouse with a 75 inch TV suitable for internal events or rental. All these make the community attractive from a realtor’s perspective, but what about the residents?

This is where some activism and pride in community comes into play.

Our reactivated Social Committee has held Open Mike Nights, Karaoke events, a Chili Cook-Off, Pool Parties, with many more events planned for the fall and holiday season. We have two organized community clean-up events per year offering trash collection, shredding, and recycling. We have partnered with Westridge Elementary School on several events for community outreach. We have an active Pool Committee that monitors pool operation, rules, equipment, and makes suggestions to the board. Our award-winning swim team, the Westridge Waves, is an integral part of the community and has an excellent relationship with the board.

We use an architectural review board to entertain change requests, have an active property inspection program, a covenants committee for dispute resolution, and have employed a tree service to proactively monitor the hundreds of trees in the common areas. We have conducted two community brainstorm sessions for improvement recommendations and have brought together the neighborhood boards to share their experiences. We have a lot of people who care.

roles and responsibilities. I’ve had the privilege of having served on the board for 15+ years. I’ve seen a lot of board members come and go but each new board member is committed to improving the quality of life in Westridge. They act fairly and compassionately.

When I moved to Westridge 31 years ago it was the newest and most beautiful residential development in the area. Today, it remains the same. Hundreds of homes have been built around us. But we remain the new, fresh, beautiful community we were 30 years ago.

Heritage Hunt Homeowners Association Charitable Community of the Year Managed by Associa - Community Management Corporation, AAMC // Essay submitted by Joanne Forrester

H

eritage Hunt Homeowners Association is an active-adult community where being “active” refers to more than aerobics or bocce! Members are active in many programs that benefit those beyond our gated entry!

Since 2003, the Heritage Hunt Women’s Organization contributed over $180,000 to local charities, thanks to the community’s generosity. Just this year, $13,250 benefitted 11 local charities, a scholarship recipient, and needy school children.

Most of the members of the growing 11year old Giving Circle of Heritage Hunt pledge a dollar a day annually to help needy Western Prince William County residents.

In 2018, 92 members awarded $30,250 to 16 non-profits.

Since 2001, Heritage Charity Classic has raised over $1.2 million for various cancer charities. The 2018 17th Annual Cancer Walk raised over $22,000 for Novant UVA Cancer Center at Lake Manassas.

Crocheters and quilters have made 6,908 blankets since 2000 for local nursing home residents; veterans in Richmond and Washington, DC, Veterans Administration facilities; and for at-risk, homeless, and traumatized children through local (Mobile

Hope of Loudoun) and national (Project Linus) non-profit organizations.

Crossroads-Connection is a six-year-old community-service organization that as part of a local church ministry provides a weekend food program for food-insecure children in local public schools. The program served 93 children during the 2018-2019 school year. Monthly, 15-20 residents gathered to pack and deliver bags of food to schools. These volunteers and others donated food items.

Several groups collect articles of clothing, non-perishable food items, school supplies, and more for the needy throughout each year. The Heritage Hunt Chapter of the Military Officer Association of America collected almost 250 toys in the community’s 18th annual Toys-for-Tots collection.

The front porch is another collection site!

One resident collects aluminum pull tabs for Ronald McDonald House Charities. Funds generated from recycling these tabs offset the expense of families staying in the Ronald McDonald House on campus at Inova Fairfax Hospital while their children receive medical treatment. In 2018, Heritage Hunt collected 140 pounds of pull tabs.

Another front-porch collection benefits Mobile Hope of Loudoun and veterans in Richmond, VA, and Washington, DC, Veterans Administration facilities. Since 2000, the community donated over 5,557 pounds of travel-size toiletries. This year, over 65 pounds of board games, playing cards, and jigsaw puzzles were also collected for veterans.

As with front-porch collections, several programs are the work of one individual! An example is the collection of 43 sets of king-size bed linens for the Warrior Retreat at Bull Run. Another individual initiated a Special Olympics bocce competition on community courts in 2016. Over the last four seasons,

$5000 that otherwise would have been spent to rent county facilities was saved. Four residents are coaches, 15 residents play in friendly competition with the Special Olympians, and other residents regularly cheer the players.

The community relations committee sponsors American Red Cross blood drives. Since January 2017, ten blood drives collected 200 units of blood, potentially saving up to 600 people.

The committee also sponsors a school volunteer partnership

program, putting volunteers in four elementary schools to mentor or tutor students or assist in the school office or library.

Over 30 residents participated in the 2018-2019 school year.

Community performing groups, including the High Steppers, Men in Song, and Women of Note, continue entertaining at senior centers and assisted-living and memory-care facilities.

As these programs grow and new ones get underway, what a difference the Heritage Hunt community will continue to make for those outside our gate!

T

he Dominion Valley Owners Association (DVOA) is well positioned to serve as the standard-bearer of WMCCAI’s Best Practices in Communications. The DVOA utilizes multiple methods to communicate with owners and residents, in concert with our strategic plan. Every opportunity is taken to keep the community informed and to seek feedback. A full-time onsite communications & activities coordinator assists the volunteer communications committee and administers the Association’s website, Facebook page, Valley Voice (quarterly magazine delivered to every home), and community news email blasts.

We also utilize town hall meetings, community-wide online surveys, and resident forums at each board, committee, and annual membership meeting to seek feedback on specific issues as well as general satisfaction levels. In addition, physical mailings and notices update the community on important matters like the annual meeting; the annual budget update; changes to governing documents; and notifications of scheduled exterior maintenance for covered homes. Up-to-date information is available 24/7 on the HOA’s website, including online forms and requests; community news summaries; calendar; directory; resident services; HOA documents; classified ads; and contact information.

Our board developed these multiple communications channels to reach Dominion Valley’s many diverse residents and homeowners (2500 homes, approximately 10,000 residents) because our demographics include young families, singles, and retirees.

People of different generations prefer different means of communication. In general, baby boomers primarily use email, while younger generations prefer social media.

The board wants to be able to quickly disseminate important HOA-related information (social events, scheduled common area maintenance, etc.), and to instill a sense of community spirit through effective communication. In 2017, in response to a community-wide survey, Facebook was added to supplement the use of blast email. Since then, improvements to our Facebook Page and website have made it easier for homeowners to navigate and access useful information. Links were established between the website and Facebook, with icons to enhance usability. For example, there are icons for residents to report maintenance concerns, covenants violations, streetlight outages, snow removal concerns, access to the Association’s governing documents, and more.

The board measures the effectiveness of membership communications by direct

feedback from residents, and through periodic reviews compiled by the communications & activities coordinator. Those reviews summarize indicators like blast email open rates, and HOA Facebook page visits by type of item posted. Monthly resident forums are another indicator. For example, this year a task force reviewed the feasibility of adding a dog park in our community after several residents came to the board resident forum and presented their recommendations and ideas. Resident surveys also have been effective in obtaining feedback; for instance, this year two online surveys were conducted – one regarding the potential use of speed tables to deter speeding on our private streets, and a possible change to our design guidelines that would allow the installation of roof- mounted solar systems on homes here.

In summary, the board strives to stay in contact with our residents through multiple communications methods. This varied communications menu is critical to the continued success of our beautiful community.

However, when homeowners, especially homeowner leaders, have an inability to separate their personal standards, needs, and goals from what is in the best interest of the community, situations can balloon out of control very quickly. Despite being part of a community, owners and residents demonstrate a certain level of entitlement and control that isn’t seen in other organizations. This sentiment is frequently what drives the emotional responses to issues that occur within community associations. While community sponsored activities help homeowners feel connected to the community, these events and activities (including social activities) are governed by business practices and concerns, such as financial impact and potential liability considerations.

Oftentimes board members fail to understand that they have been elected to operate a business and they fail to separate their own personal opinions from what is in the best interest of the association. It is important for board members and managers to understand that decisions should not be personal, but rather should be in the best interest of the association.

However, interactions with members are personal. How we approach a situation or how we treat someone is personal and may greatly influence whether a matter is resolved amicably and how a homeowner will perceive and relate to the association.

Imagine you slip and fall in your community parking lot. After seeking medical attention, you notify the association of the incident and are told that someone will be in contact with you. After several days, you have not been

At this point you are probably irritated and feeling as if no one is concerned about what occurred and no one cares about you. You have suffered physical injury. You may have lost time from work and incurred out-of-pocket medical expenses. You have been ignored and someone is going to pay!

If the scenario unfolded differently, you would have promptly received a call back from someone who first asked how you are feeling.

The caller would then provide pertinent information and addresses your questions and concerns. In this scenario you feel like someone “listened” to you and is concerned. Yes, you want the association’s insurance to cover any out-of-pocket expenses, but you are not seeking additional compensation or threatening to file suit.

A child is injured while at the community swimming pool. The pool staff properly attend to and document the injury and no further action is required. However, the next day the community manager calls the parents to inquire about the child. The manager asks if the parents have any concerns and answers any questions they may have. The few minutes it may take to make the phone call can make a big difference in how this family feels about their association and how they perceive their association feels about them.

Humans have a basic need to belong and feel accepted. Feeling left out or ignored can be stressful and can impact how we react. A study published in Psychological Science, a journal of the Association for Psychological Science, finds that a feeling of inclusion can come from something as simple as eye contact from a stranger.* So, imagine how a timely response or unexpected inquiry can make someone feel. Members who feel a personal connection to the

However, for the community members it is very personal. Therefore, addressing a matter as if it is personal can sometimes be the best business approach.

Looking Back at Conference & Expo – Evolution 2020

S

o far, 2020 has brought great things to WMCCAI! This year’s theme for the Chapter’s kick-off event, Jump Start January, was “Resolve to Evolve”.

Then, Conference & Expo, the Chapter’s premier event of the year held on February 21 and 22 followed suit with the theme of “Evolution 2020”, a clear indication of just how much evolution has occurred.

For the first time in its history, C&E was a multi-chapter event in partnership with the Chesapeake and Central Virginia Chapters. Sometimes bigger really is better! Over 2,000 community association industry professionals, business partners and homeowner leaders gathered at the Walter E. Washington Convention Center in downtown DC for not just one, but two days of learning, networking and collaboration. To get a clearer sense of just how much C&E has evolved, let’s take a closer look at what happened…

The biggest evolution was the expanded education. Education Committee co-chair Todd El-Taher believes that “Obsolescence if a choice unwittingly pursued,” so he and the committee worked to develop a thoughtfully curated slate of education sessions for this event that would engage and challenge attendees. Todd’s newly appointed co-chair Kathryn Hutchison, CMCA, AMS, PCAM added that “the pursuit of knowledge is what keeps a person relevant, no matter their career.”

This year’s event offered over 20 education sessions with the primary focus aimed at more experienced managers. As a multi-chapter event, all education sessions were approved for PCAM recertification credit – a huge plus for manager members who have earned their PCAM designation.

Before this year, PCAMs were forced to seek out other options to fulfill their continuing education requirements. WMCCAI Executive Director Jaime Barnhart. CMP, CAE sees this development as “the opportunity we’ve been looking for to offer advanced level education to our PCAM members.”

Homeowner members, which constitute over half of our chapter’s total membership, have few opportunities to really learn about the industry as a whole, what issues their fellow volunteer community leaders are struggling with, or what successes they have achieved. The sharing of experiences and information is invaluable in fulfilling a role that is often a thankless endeavor – that of serving and giving back to their community to protect the investment they have made in their homes.

The education sessions at this year’s Conference had something for everyone…the experienced manager, the new manager working toward their CMCA designation, homeowner leaders looking to better their understanding of effective governance in their communities and business partners who need to know how best to serve common interest communities. C&E’s comprehensive approach to education in 2020 was truly evolutionary.

Other than education, what benefits does a homeowner gain by attending Conference & Expo? Is it to meet and talk to other homeowner members? To visit exhibitor booths that offer goods or services their communities might need?

With the E in C&E standing for Expo, and looking out over the convention center floor where over 200 booths offered a vast array of goods and services to existing and potential community association customers and clients, it’s readily apparent what C&E means to the chapter’s business partner members. As the largest event of its kind for any CAI Chapter worldwide, C&E represents a unique and notbe-missed opportunity. Chris Goodman, a business partner member with DoodyCalls, had this to say: “We have exhibiting at the Expo for the last 15+ years. It is an opportunity to showcase any new products or services we offer. We are able to connect face to face with many of our current customers. There a lot of attendees that still don’t know about us and what we do. It is our most successful and valuable show of the year!”

In a matter of hours, a manager and homeowner can talk to companies and contractors about everything their communities might need from landscapers to legal services, to paving and pool maintenance. And it’s fun – contractors want to make their booths attractive to attendees and come up with quirky themes and provide useful giveaways – not just the typical keychain or mousepad. The C&E welcome bags picked up at registration go home overflowing with gadgets and doodads of every stripe, not to mention business cards and pamphlets for further investigation.

The 2020 Conference & Expo was so much more than an excuse to get to visit downtown DC for a day, hangout with colleagues, and fulfill CEU requirements – although that still happens. It really has evolved into so much more! WMCCAI had a vision, in fact, a 2020 vision, to make C&E bigger, better and offer more to each of its membership types. In January, WMCCAI resolved to evolve and in February, it delivered! We can hardly wait to see what 2021 might bring…

Reflections on the Value of

AWARDS

W

hen Montebello Condominium Unit Owners Association (MCUOA) was named WMCCAI’s 2018 Very Large Community Association of the Year and Communicator of the Year, of course we felt it was a huge honor—one that we were happy to share as well as celebrate.

We participated in the winners’ forum at WMCCAI’s Conference & Expo, hung our award certificate prominently next to our community center front desk, placed our Community of the Year banner on the lawn next to our front gate, and gave tips to future winners at an education session for applicants sponsored by WMCCAI. The Fairfax County Board of Supervisors honored us with a resolution.

We didn’t realize then (though, maybe we should have) what the impact WMCCAI’s awards would have on our community, and that it was just the beginning.

Throughout 2019, our members and management have been both rewarded and inspired by this recognition of what we have done—and can do—to make our community such a great place to live.

For our board and committees, one of the chief rewards was the validation of our efforts to weave best practices into everyday policies and procedures. These include lis-

tening to the advice of the auditor, attorney and other professionals, and giving a new general manager room to manage. WMCCAI’s recognition also validated our ongoing progression to a service culture, initiated by our staff, and our commitment to resident feedback, including what is now almost three years of monthly mini surveys submitted by residents to our Quality Improvement Committee.

And knowing that we are on the right path has inspired us to move forward with new ideas and planned initiatives in many areas.

For example: • In June, two residents donated a plaque and organized a ceremony to recognize Montebello’s historic location—once the site of the mansion of the eighth Lord of Fairfax, a lifelong friend of George Washington.

• Also, this upcoming spring, our Grounds Committee commemorated the planting of almost 100 new trees, the result of a resident fundraising drive, to revitalize the natural urban forest surrounding our 35acre property.

• Our Promoting Montebello Committee was re-energized to spread the word about Montebello to current and prospective residents through web redesign, brochures, Realtor surveys, press releases, and word of mouth.

• Pride and participation our community was reinforced with an annual showcase of

committees and clubs and other community spirit efforts such as logo merchandise.

• And to encourage quick engagement of new residents, the board has revived its sponsorship of periodic wine and beer receptions where newcomers mingle with board members, committee chairs, and senior staff.

• Our Building Representatives program, now an official Montebello group, includes volunteers from each tower who welcome new residents, providing them with information about our community and the surrounding area. A new position—military family representative—was created to assist current resident and recruit new residents from Fort Belvoir and other nearby installations.

• Promoting Montebello also is planning a community history book so that residents can add something about what living at Montebello has meant to them.

Montebello is in the midst of redesigning our community center. The architectural firm wanted to match the community’s self image with the design. Through surveys and interviews, residents were clear in the message that they wanted a design that reflected, not trees, but “sense of community.”

That sense of community is strong and pervasive. As residents, we know that Montebello is indeed a special place to live – and we are honored that others recognize that, too.

CLEAN-UP DAY and Celebrating Earth Day’s 50 th Anniversary

T

his April will mark the 50th Anniversary of Earth Day, the Alice Ferguson Foundation’s 32nd Annual Potomac River Watershed Cleanup, and the Washington Metropolitan Chapter Community Associations Institute’s 3rd year leading our own Watershed Cleanup Sites around our region.

On April 22, 1970, millions of Americans took to the streets and college campuses in hundreds of cities to protest environmental ignorance and demand change. Americans were tired of seeing on going pollution in their rivers and lakes from oil spills, toxic discharge from factories and power plants, regular discharges of raw sewage, toxic dumps, pesticides, loss of wilderness, and the extinction of wildlife. Do you remember when Lake Erie and the Cuyahoga River in northern Ohio caught on fire? It was 34 | QUORUM

tragedies such as this that led to the first Earth Day and ultimately the creation of the United States Environmental Protection Agency and the passage of the Clean Air, Clean Water and Endangered Species Acts to help prevent such disasters from happening again.

“Give a hoot, don’t pollute. HOOT HOOT.” In 1989 the Alice Ferguson Foundation (AFF) had its first Trash Free Potomac Watershed Cleanup Day. Over the years, 150,000 volunteers have removed more than 7 million pounds of trash from our watershed. During the 2019 Cleanup season, 9,745 volunteers, including volunteers from our chapter, reported removing 376,933 pounds of trash. In 2019, AFF encouraged volunteers to collect data on single-use beverage containers such as aluminum cans, plastic water bottles, and glass bottles. One of the cleanups in Virginia collected and disposed of nearly 5,600 single-use beverage containers with most of them being plastic water bottles! Data collected from these cleanups is essential for the support of implementing proven source reduction policies, such as a straw ban or bag fee.

The Alice Ferguson Foundation sits on the banks of the Potomac River in Accokeek, Maryland, directly across the Potomac

River from Mount Vernon. As a leader in the environmental education field, the Alice Ferguson Foundation’s (AFF) mission is to connect people to the natural world, sustainable agricultural practices and the cultural heritage of their local watershed through education, stewardship, and advocacy. Students of all ages come out to the farm to learn about the environment and to experience nature, some for the first time, with hands-on curriculum. Over the years, AFF has noticed more and more trash collecting along their shoreline and decided to do something about it. So, in 1989, the first Potomac River Watershed Cleanup was held at our property. The cleanup became an annual event and eventually grew into AFF’s Trash Free Potomac Watershed Initiative. Since 2005, this initiative has collaborated with individuals, local elected officials, businesses and community organizations to act for clean land, safe water, and healthy lives by preventing waste from entering our waterways.

In 2017 the Washington Metropolitan Chapter of CAI partnered with AFF and in April of 2018 we hosted our first Chapter-wide Watershed Cleanup Day; with 9 cleanup sites hosting over 200 volunteers picking up over 8000 pounds of trash. The Chapter’s 2nd cleanup had 15 sites, with almost 500 volunteers picking up nearly 10 tons of trash all

In celebration with Earth Day’s 50th Anniversary and our 3rd Anniversary of Cleanup Day, we are hoping to have more cleanup sites and volunteers to remove even more litter than last year. You can help by volunteering at any of our cleanup sites or by hosting a cleanup in your community. Clean up days can be conducted anytime during the month of April. The Washington Metropolitan Chapter of CAI will help support your efforts during the month of April through our partnership with the Alice Ferguson Foundation to provide bags, gloves, and other supplies in addition to Site Leader Training to help you host a successful community cleanup.
