LETTER FROM THE EDITOR Welcome Back McGill Law! Anna McAllister| 2L
I am delighted to be talking to you through what is the first edition of the Quid to be published on paper in nearly 2.5 years. COVID, in all of its splendour, drastically changed life at the Faculty. From having to attend Zoom University, to missing out on the wonderful in-person traditions like coffeehouse, our sense of community was tested. It seems (not to tempt fate) that we have made it through. Coffeehouse has returned. We have lost our excuse not to make the trek to New Chancellor Day Hall when the weather is bad by tuning into class via Zoom (looking at you last Tuesday’s downpour). Masks are once again becoming something reserved for Halloween. And, best of all, the Quid is back in paper format. While only a 2L myself, I witnessed last year the incredible resilience of the Quid team as they dedicated hours to preparing a publication that only ever came to fruition online. This year, in addition to reinvigorating the Quid’s physical publication, we hope to help the McGill Law community rediscover old Quid traditions that were once staples of each edition. For instance, ‘overheards’ were once a Quid staple. Overheards typically included funny and quirky things said during the week
at the Faculty. Identified by year alone, or in the case of profs, by name with their consent, it was a way for everyone to have a well-deserved laugh and admire the fact that if we weren’t in law school, I am sure we would all have lucrative careers in comedy. Always published in the spirit of good fun, we invite you to submit your overheards to the Quid’s email (quid.law@ mcgill.ca) before 5 PM every Thursday. Enjoy this lovely example from November 2013:
As we work to reinvigorate old traditions, I also hope you will join us in creating new ones. First of all, welcome and congratulations to all our 1L’s and welcome back to our returning upper year students. It has been fantastic to see the Gelber Library bustling with activity this September, just as it should be. While on the outside our library may appear to be just as you left it (potentially in 2020…) there have been some notable internal changes happening.

One of the biggest changes is the retirement of our esteemed Head librarian Daniel Boyer. After twenty-four years at the Gelber, Daniel retired last April. Under his leadership the Gelber has secured exemplary standing among comparative law libraries around
the world. Daniel’s presence and institutional knowledge has been very much missed. In the meantime, our interim Head Sonia Smith has been doing an amazing job taking on this major role while also continuing her Liaison librarian duties. This is no small task and we all appreciate the extra hours Sonia is putting in while we await the appointment of a new Head Librarian.

And at the end of this month we will say goodbye to another Gelber institution, longtime Library Assistant, Brock Cummings. Brock has been with the library for
over 38 years, previously in Rare Books, Central Acquisitions and McLennon Reference then joining the law library in 1989. One of the last remaining members of the original Gelber Law Team who moved the collection from New Chancellor Day Hall into the newly built Nahum Gelber Law Library in 1998, Brock will be very much missed by all here at the Gelber. And finally, as some of you may have noticed, I (Ana) am still here! After starting at the Gelber last year covering a maternity leave position, my temporary placement has recently become permanent when our previous liaison moved on to a private law firm. I am also very happy to announce our Wellness Corner has returned; take a break from your studies and de-stress with a puzzle or some light reading! Finally, this is our last month for our current exhibit in honor of McGill’s bicentennial, so take a moment to look at some history from the Law Faculty before our next (rather seasonable) exhibition.

THOUGHTS ON FROSH Welcome to the Faculty Zack Goobie | 3L
This frosh week was my seventh time participating in the annual activities for first year students, and my fifth as a frosh leader. I consider this event to be crucial to start a new academic adventure to foster a sense of belonging between your peers. I met some of my best friends during my frosh week in undergrad, and this year I saw first year students make friendships that will hopefully last a lifetime. I was surrounded by brilliant and energetic froshies and upper year leaders. Having enjoyed many different iterations of this action-packed week, I was blown away by the organization by the LSA and the dedication of my fellow frosh leaders. In my experience, there are always a couple events that do not go according to plan. This year, events started on time and the first-year students continued to show up despite very busy days. This year’s cohort was introduced to Coffeehouse with a bang. I had not been to a Coffeehouse in the atrium since I came to my Welcome Day before my 1L year, I remember looking forward to the different clubs hosting this event
in my years at the Faculty. I can only imagine how much fun it would have been to have Coffeehouse for the past two years and the conversations I would have had with upper year students. Many people consider this week as a weeklong boozefest, but the events showed a much different scenario. For instance, doing the scavenger hunt through the city made me feel like a kid again, and I
was so impressed by the teamwork of the Basketball Club. With various skillsets in our club, we were able to complete the tasks in a timely manner. There were both skillful and physical challenges, which made the event so great. These activities mimicked the Amazing Race Canada, one of my preferred television shows. Another personal favourite of this year’s welcome week was karaoke. Despite 3
Vol 44 ● No 1 not being much of a singer myself, I loved belting a variety of songs with my peers. These events have been put on hold during the pandemic, so the sense of pre COVID normalcy was welcome. The last evening event for frosh was a prom night; it was the perfect way to close an eventful few days. Not only did it fit with the High School Musical theme, but it was symbolic for the future lawyers in the room as their future lives will likely include networking in business attire.
As the days progressed, students became more comfortable with their peers, and started to ask great questions to upper year students about a variety of topics. I am convinced that these 1Ls student will be much more prepared for their upcoming challenges in law school compared to my cohort who started on Zoom. These in-person interactions cannot be replicated on Zoom. Many students have evidently worked tooth and nail to
be accepted at McGill, so it was very nice for them to relax with their peers before the readings start. I don’t think students could have benefited from a better welcome to the Faculty. They have already made friendships and connections that were so much harder to form on Zoom. I am convinced that the new cohort will bring incredible academic and professional contributions to the Faculty, our school is in good hands for the years to come.

La saison de hockey 2022-2023 arrive à grands pas. La saison précédente fut, pour le moins, tumultueuse. Un nouveau champion de la ligue fut couronné et plusieurs recrues talentueuses surent laisser une empreinte indélébile au sein de la ligue (la passe de Zegras me donne toujours la chair de poule). Suite à la fin de la saison, un nombre de changements vertigineux a eu lieu, en ce qui a trait aux joueurs et aux clubs. Par exemple, le joueur américain Johnny Gaudreau, qui figurait parmi les candidats pour le trophée Hart, quitta son ancienne équipe, les Flames de Calgary, afin de se joindre aux Blue Jackets de Columbus, malgré l'opportunité d'empocher une somme d’argent plus importante en restant avec les Flames. Quoique je désirerais écrire un article sur l'entièreté des échanges ayant eu lieu dans la ligue pendant l’été, je me concentrerai sur l’équipe qui a su vaincre les champions de la ligue : les Oilers d’Edmonton. L’année passée, les Oilers d’Edmonton ont eu une de leurs meilleures saisons, depuis plus de 15 ans. L’équipe, qui avait du mal à passer la première ronde des séries éliminatoires, et même à en faire partie, accéda à la finale de la conférence de l'Ouest, où l’équipe s'inclina à Colorado. Les sous-performants perpétuels ont finalement atteint, en partie, leur plein potentiel, à savoir une équipe pouvant rivaliser avec les meilleures équipes de la ligue et concourir pour la Coupe Stanley. L’été fut également 4
assez actif pour les Oilers. Ils ont signé, ou résigné, plusieurs joueurs importants et cet article se focalisera précisément sur cet aspect. Je passerai à travers les signatures les plus importantes de l’équipe prétendante (mais seulement les joueurs – je ne discuterai pas alors de l’entraîneur Jay Woodcroft). De plus, je vous donnerai mes notes du travail fait par Ken Holland, le directeur général de l'organisation. Signature d’Evander Kane : 4 ans, 5,125 $ millions par année Evander Kane, sans doute le meilleur joueur figurant parmi cette liste, a véritablement changé la donne pour les Oilers en 2022. Dès son arrivée, Kane contribua de manière efficace aux Oilers d’Edmonton, en y rajoutant un bon mélange de ses compétences de la rondelle ainsi que son côté physique. Il marqua 22 buts, avec 17 assistances, pour un total de 39 points en 43 lors de la saison régulière. Cependant, c’était pendant les séries éliminatoires que le joueur canadien montra son efficacité et son importance au sein de l’équipe albertaine. En 15 matchs, Kane amassa 17 points, dont 13 buts. D’ailleurs, contre les rivaux jurés d’Edmonton – les Flames de Calgary – Kane eu un tour de chapeau, et neutralisa, avec l’aide de son jeu physique, le dangereux attaquant des Flames, Matthew Tkachuk. D'autant plus, Kane a offert à la vedette des Oilers, le fameux McJesus (Connor McDavid), une
véritable menace qui pourra jouer au sein de son trio, qui pourra patiner avec lui et qui pourra saisir et capitaliser sur ses chances de marquer. En gros, Kane est un attaquant habile et puissant qui contribue aux Oilers de maintes façons. De ce fait, il fut instrumental à la réussite que les Oilers ont connue la saison dernière et il le sera pour cette saison aussi. Pour 4 ans à 5,125 $ millions, il est une aubaine pour l’équipe et son contrat a une durée intéressante pour un joueur âgé de 31 ans. Note : A+ Signature de Brett Kulak : 4 ans, 2,75 $ millions par année Un jeune homme né à Edmonton, le défenseur Brett Kulak vit son rêve de jouer pour son équipe natale. Les partisans du Canadien de Montréal le connaissent bien, lui qui enfila le chandail de l’équipe historique pendant leur course jusqu’à la finale de la Coupe Stanley, et ils savent qu’il est un défenseur indispensable. L’année passée, Kulak amassa 5 points en 16 matchs pendant les séries, ce qui est impressionnant pour un défenseur. Par ailleurs, il est, effectivement, le prototype d’un 4e défenseur dans la LNH. C'est à dire, il est un défenseur mobile, physique, mais qui manie bien la rondelle et peut lancer l’attaque de l’arrière. Autrement dit, il est polyvalent. Il peut jouer sur la première paire si un des deux meilleurs défenseurs de l’équipe se blesse (comme
il l’a fait pendant l’année passée pour les Oilers), tout en étant une présence solide au sein de la deuxième paire. Il faut également mentionner que Kulak est un bon vétéran qui a eu du succès dans la LNH. Il est allé en finale avec le Canadien et fut vital pour les Oilers pendant les séries. Lorsque Darnell Nurse fut gravement blessé, Kulak prit son rôle à la première paire et performa bien. Il n’y a pas beaucoup d’inconvénients avec ce joueur, et sa polyvalence fait de lui un gros atout pour son équipe. Note : A Signature de Jack Campbell : 4 ans, 5,125 $ millions par année La signature de l’ancien gardien de but des Maple Leafs de Toronto représente un énorme risque pour les Oilers, mais un risque nécessaire. Si vous avez suivi les Oilers comme moi, vous savez alors que l’équipe a énormément besoin d’un gardien de but constant et efficace. Lors de ses saisons à Toronto, Campbell a montré que, en bonne santé, il est un gardien constant et un formidable. Toutefois, il eut des moments difficiles à Toronto, ce qui ne présage pas bien pour les Edmonton. Pourtant, ces moments difficiles que Campbell a vécus sont, en grande partie, dus aux blessures qu’il a subies. Un autre point d’interrogation se manifeste à l’égard du nombre de matchs que l’américain a joué. En effet, Campbell n’a joué que 135 matchs dans la LNH et seulement 49 la saison passée, mais le gardien de but a déjà 30 ans. Donc, le gardien a une tendance à éprouver, parfois, des difficultés et n’a pas une longue histoire dans la LNH. Néanmoins, lorsque Campbell est à la hauteur de son jeu, il est extrêmement efficace et fiable. Il apporte une confiance inébranlable dans le filet et son talent se démontre sur la glace. Il représente, ainsi, un risque de la part d'Edmonton, qui lui donna un contrat de 5 ans à 5 $ millions par année, mais l’équipe n’eut pas vraiment le choix : les Oilers avaient besoin d’un gardien de but et Campbell peut être la solution à Edmonton. Note : B
Signature de Kailer Yamamoto : 2 ans, 3,1 $ millions par année Mon joueur préféré parmi cette liste, Yamamoto incorpore presque tous les éléments nécessaire afin de réussir dans la LNH. Il est fougueux, talentueux, habile et possède une éthique de travail irréprochable. Celui-ci est une véritable force sur l’échec-avant et terrorise les autres équipes avec sa capacité à générer de multiples revirements. De plus, quand le jeu de Yamamoto entraîne un revirement, il est capable d’en profiter, marquant 20 buts et ajoutant 21 assistances pendant la saison régulière. Le jeune américain fut également un facteur pendant les séries, avec 7 points en 14 matchs. La seule détraction possible avec Yamamoto est sa taille : il ne mesure que 5’8 et donc il est souvent bousculé par les plus grands joueurs. Par ailleurs, j’aurais voulu que les Oilers le signent pour une plus longue durée afin qu’il fasse partie de l’équipe à long terme. Note : A Signature de Jesse Puljujarvi : 1 an, 3 $ millions par année "The Bison King is back". Jesse Puljujarvi, connu sous le nom « the Bison King » à Edmonton, est un joueur qui polarise les partisans des Oilers, c'est le moins qu'on puisse dire. Les partisans qui se fient beaucoup aux statistiques avancées adorent le grand finlandais, tandis que les gens qui jugent un joueur plutôt sur ce qu’ils voient maudissent ce dernier. D’après moi, il faut une combinaison des deux camps pour comprendre l’énigme finlandaise. Il amassa 36 points en 65 matchs, mais eut un très bon début qui fut miné par des blessures par la suite. Il a, donc, une certaine habilité offensive. Du côté défensif, le finlandais est fiable et responsable: il n’est pas souvent la cause d’un but. En même temps, le joueur finlandais peut manquer, parfois, un instinct de hockey surtout en zone offensive – il travaille fort, mais ne semble pas comprendre le jeu au même niveau que les autres joueurs du top 6. L’histoire de Puljujarvi est, alors, qu’il ne créera pas tant d’offense à lui tout seul, mais il ne coûtera
pas un match non plus défensivement. Finalement, je devrais mentionner qu’il y a eu une tonne de rumeurs en ce qui concerne le finlandais et son désir (ou manque de désir) de continuer à jouer à Edmonton. On dit que le jeune attaquant veut avoir une position plus importante au sein de l’équipe (premier ou même deuxième trio), alors que l’équipe le voit plus comme un bon joueur de troisième trio. Donc, il se peut que Puljujarvi soit échangé ou bien qu'il ne joue plus pour les Oilers après la fin de cette saison. Par contre, signer un jeune attaquant qui joue dans les deux sens de la patinoire pour seulement 3 millions était une bonne décision. Note : B+ Signature de Ryan Murray : 1 an, 750,000 $ par année Murray a finalement rejoint l’équipe qui aurait dû le repêché en 2012. À cette époque, les Oilers ont eu le premier choix du repêchage et il est unanime chez pratiquement tous analystes de hockey au Canada et aux États-Unis, que le choix fut entre l’attaquant Nail Yakupov et le défenseur Ryan Murray. Les Oilers ont sélectionné Yakupov, qui est devenu une des pires sélections dans l’histoire du repêchage, alors que Murray continua de jouer et devint un défenseur solide. Bien qu’il se soit fait blesser récemment, et que son talent a, depuis 2012, diminué, il est toujours un joueur utile qui pourrait augmenter la profondeur de la défense. En effet, avec l’entrée possible du jeune espoir Philip Broberg dans l’alignement des Oilers, Murray est, en quelque sorte, une assurance pour l’équipe : si Broberg a de la misère à s’adapter au niveau et à la vitesse de la LNH, les Oilers pourront se fier sur Murray pour le remplacer. Murray apporte, aussi, beaucoup d’expérience à Edmonton, gagnant la Coupe Stanley avec Colorado l’année passée. C’est souvent une bonne idée d’avoir une police d’assurance pour nous protéger contre des risques, c’est encore mieux lorsque la police ne coûte pas beaucoup et est assortie d’une durée assez courte. About the talk: How should a constitutional order respond to deep inequality? In some constitutional orders, the pervasiveness of inequality is at the root of complex debates about equality rights, but does not pose an existential risk to the polity. By contrast, in other polities, inequality is so pervasive that the existing constitutional order can no longer be considered legitimate. In these circumstances, the task of fashioning a new order can give rise to complex issues of constitutional design. Drawing on arguments that Ron Levy, Ian O’Flynn and I set out in Deliberative Peace Referendums (Oxford University Press, 2021), I will argue that the theory of deliberative constitutionalism provides guidance to constitutional designers and counsels resistance to populist impulses that arise when the very legitimacy of a constitutional order is questioned. 6

The Quid’s editorial policies are published in the first edition of each academic year as per our Constitution. Since the Quid belongs to all Law students, it is essential to adopt a transparent editorial policy that will guarantee both freedom of expression and the protection of individual interests. You will find below some principles that we hope will guide you when you write and review your articles. While they were developed after consultation with students and members of the LSA executive, they may not be perfect: we welcome your comments at quid.law@mcgill.ca.
Le Quid est une publication qui survit grâce aux contributions. La date limite pour les contributions apparaîtra dans chaque numéro. Les articles soumis doivent contenir le nom de l’auteur ainsi que son année d’étude. Si l’auteur écrit dans un rôle particulier (i.e. “Président de l’AÉD”; “Président d’un club étudiant”), ceci doit également être indiqué. While all submissions are presumptively publishable, potentially criminal speech (i.e. hate speech) and-or libelous speech are not presumptively publishable. In such cases the author must make a strong case that the information is accurate, that journalistic standards and ethics were followed; discretion to publish such articles lies solely with the Editors-in-Chief.
3) ANONYMOUS SUBMISSION POLICY The Quid will publish anonymous articles provided they conform to the Quid policy and operating guidelines. Anonymous articles present a challenge for content review for they do not allow the Editors-in-Chief to consult with the author. As such, if an anonymous article is rejected for publication, notification of rejection must be published in the Quid.

This policy is updated at the sole discretion of the Editors-in-Chiefs provided notice of update has been published in the Quid. 1) PRINCIPES GÉNÉRAUX Chaque item apparaissant dans le Quid Novi est un article d’opinion qui reflète uniquement le point de vue de la personne ou des personnes qui ont écrit l’item. Ni le Quid Novi, ni l’AÉD, ni la Faculté de droit n’endosse les opinions contenues dans les contributions publiées. Étant donné la nature de cette publication et ses ressources limitées, le Quid ne s’engagera pas dans la vérification de la véracité factuelle des contributions. Les contributions sont présumées dignes de publication, à moins de ne pas se conformer aux principes énumérés ici. 8
4) EDITING GUIDELINES Every item submitted to the Quid shall be reviewed. The Quid reserves the right to make grammatical edits to improve the readability or suitability for publication of an article. Copy Editors may also correct spelling mistakes. If a submission requires significant editing - in the view of the first person reviewing the article - this shall be indicated to the Editors-in-Chief. The Editors may refuse to publish the article for lack of suitability or may conduct significant edits and publish the submission. Minor edits need not be communicated to the author prior to publication. 5) CONTENT REVIEW POLICY All submissions made to the Quid shall be reviewed for content. There is a four-step review process. 1) Révision par le secrétaire de rédaction Le ou la secrétaire de rédaction ou le/la rédacteur.trice-en-chef chargé.e de la révision d’un article accomplit cette tâche en vérifiant s’il contient du contenu contestable. Le contenu contestable dénote du contenu que le ou la secrétaire de rédaction en question juge comme potentiellement offensant ou autrement inadéquat pour la publication. Les facteurs suivants seront considérés lors
de l’évaluation du potentiel offensant: le ton général de la contribution, les mots précis utilisés dans leur contexte précis, ainsi qu’une appréciation de la réaction potentielle du corps étudiant, des professeurs, des anciens étudiants et de la communauté juridique montréalaise. Si le ou la secrétaire de rédaction individuel estime que le contenu est contestable, il communique ceci aux rédacteurs en chef. Les items qui sont potentiellement inadéquats pour la publication incluent (sans s’y limiter): les contributions contenant des passages à caractère haineux; les contributions qui possèdent le potentiel de créer un environnement hostile à la faculté; et les contributions à nature diffamatoire. 2) Discussion At the second stage of review, the Editors-in-Chief and Copy Editor who did the initial review discuss their specific findings with one another in relation to the submission. If there is a finding of questionable content that is agreed to by a majority (i.e. at least two-out-of-three between the reviewing editor and the Editors-in Chief), the article goes for consultation. If there is no agreed finding of questionable content, the article is published as is or with edits at the discretion of the Editors-in-Chief. 3) Consultation Au stade de la consultation, les rédacteurs en chef doivent aviser l’auteur qu’il existe des préoccupations au niveau du contenu. Les rédacteurs en chef peuvent consulter d’autres individus au sujet de la contribution, à la condition de ne fournir aucune information permettant d’identifier l’auteur. Les rédacteurs en chef peuvent consulter avec des individus mentionnés dans l’article, d’autres étudiants, des groupes étudiants, des professeurs ou des anciens étudiants, à leur propre discrétion. La consultation n’est pas un concours de “Combien sont pour vs. Combien sont contre”. Compte tenu de la nature et du rôle du Quid, la consultation doit déterminer si le contenu spécifique est digne de publication. L’auteur peut être consulté à de nombreuses reprises si les rédacteurs en chef jugent que ceci est nécessaire. 4) Decision The Editors-in-Chief will discuss the results of their consultations and will render a decision to: [a] accept the submission as is; [b] accept the submission with minor edit(s) to be completed by the Editors-in-Chief; [c] accept the submission with or without minor edit(s) and publish a warning along with the submission; [d] return the submission to the author for modification with suggestions provided at the discretion of the Editors-in-Chief, or, alternatively, [e] reject publication without modification suggestions. The decision of the Editors-in-Chief is final and binding. The Editors-in-Chief, at their discretion, may publish a notice of rejection in the Quid with their reasons, indicating, at their discretion, the name(s) of the author(s). Alternatively, the author(s) may request that such a notice appear, in which case the notice will bear the format: AUTHOR -- YEAR -- TITLE OF SUBMISSION was submitted for publication but will not be printed in accordance with the Quid Policy and Operational Guidelines.
6) OVERHEARDS REVIEW POLICY Overheards at the faculty must be sent to quid.law@ mcgill.ca before 5 PM each Thursday to be published in the following edition. When an overheard mentions a professor, the Editorsin-Chief shall verify before publication if the professor consents to its publications as, to its publication with her name redacted, or does not consent to its publication at all. The Editors-in-Chief shall respect her decision. Overheards shall identify students only by their year of study (1L, 2L, 3L or 4L). The Editors-in-Chief shall be responsible to compile in a single document all the overheards received by the applicable deadline. This document is thereafter to be treated as a regular submission and shall undergo the content review policy described in section 5, supra. 7) POLITIQUE DE PRÉAVIS ET D’AMENDEMENT Les rédacteurs en chef publieront ces principes dans le premier numéro du Quid à chaque année. Des amendements peuvent être proposés uniquement par le personnel du Quid. Si un amendement est proposé, il sera indiqué dans le numéro subséquent du Quid afin d’offrir une opportunité d’au moins une semaine aux étudiants de rédiger des contributions. Les amendements doivent être approuvés par une majorité du personnel actif du Quid. Les rédacteurs en chef doivent publier un avis de tout changement ou de toute tentative de changement dans le Quid.

I grew up in Edmonton, Alberta, but completed high school and my undergraduate degree in Ottawa before coming to McGill. Before law school, my favourite classes were always those about modern Quebec history, making McGill and Montreal a perfect fit for my legal studies. My favourite place to go in Montreal is anywhere with friends and a picnic basket. When I am not working, you can find me enjoying some wine from the nearest dep (shoutout Green’s Superette on Milton), jokingly slandering UofT Law in the name of Martlet pride, and worshiping at the altar of the almighty Ms. Taylor Swift. 9
