Misinterpretation of a 2021 law introduced by state Sen. Joe Addabbo Jr. to ban the sale of whipped cream chargers, which can be used to get high, to people under 21 created a frenzy this week among those who thought it meant whipped cream in general. Addabbo’s office has since worked to clarify the misunderstanding, after headlines across the country sensationalized the matter, which sought only to address the misuse of the nitrous oxide chargers.

Queens preps for weed dispensaries As apps for recreational retail open, some are more ready than others

ast Thursday, the Office of Cannabis Management announced that New York State had begun accepting applications for the first recreational cannabis dispensary licenses.

The first legal adult-use retail dispensaries will be run by those impacted by the prohibition of cannabis. Qualifying business applicants must have a conviction for a marijuanarelated offense or have a parent, legal guardian, child, spouse or dependent with one in New York.

One Ozone Park man has already submitted one application and is working on a second, with hopes of eventually opening a dispensary in Queens.

“My business partner and I Jeremy Rivera are both justice-involved and we both meet the criteria,” said Jeremy Rivera, a 38-year-old from Ozone Park.

“Kush Culture is me 51 percent, him 49 and then Gourmet Buds is him 51 percent me 49,” he told the Chronicle this week.

Rivera spent eight years in prison for nonviolent crimes, two of which were

drug-related.

Now, he owns a construction-consulting company where he teaches OSHA and city buildings regulations and audits job sites for construction-safety compliance.

“I am and always have been ambitious.

Even when I was in the streets and I was dealing drugs, I was very ambitious.”

His business experience helps him check off the box from the state that requires applicants have experience owning and operating a “qualifying” business that has been profitable for at least two years.

His business partner owns a deli in Lindenhurst, LI. Although Rivera is a Queens guy through and through, he is not sure he will be able to open the dispensary here.

“I’d love to open a dispensary here, but I don’t know. It seems like I’m getting a lot of conservative views on this.”

He specifically wanted to open up a shop in Ozone Park but was told by community leaders that it might not be “the right place.”

On their applications, Rivera and his business partner ranked Long Island as their No. 1 preference on the first one they submitted but they plan to rank Queens first on the second.

According to the Office of Cannabis Management, a maximum of 16 Conditional Adult-Use Retail Dispensary licenses will be awarded.

Rivera says it is in this first round of licenses granted that the money is.

“Whoever is in for the first couple of months of the open dispensaries, they’re going to make a lot of money,” he said, citing New Jersey’s first 12 dispensaries bringing in $24 million in the first month of operation.

CAURD applicants will also receive support from the Social Equity Cannabis Investment Fund, which was included in April’s enacted state budget, according to the OCM. But if Rivera has to open up on Long Island first, he said, he will — and he has gotten a much warmer response from the Town of Babylon than he has here.

Though recreational marijuana use was legalized in New York in 2021, many are still uncertain about such nonmedical dispensaries opening up.

“There is a great deal of thought that needs to go into the issue of placement of legal marijuana dispensaries,” Councilwoman Joann

Ariola said she is not in favor of having dispensaries in her district but, since it is now law, it will come down to the details.

“We definitely cannot have them placed near schools or other locations frequented by minors,” she said. “The siting of any business like this is going to be very important, and I think it’s crucial that we get community involvement and support before dispensaries start popping up in our neighborhoods.”

Misinterpreted law whips up confusion Addabbo law to combat abuse of nitrous oxide gets widespread attention

Sundaes and strawberry shortcakes are still a go despite some recent confusion that a law enacted last year prohibits people under 21 from purchasing whipped cream.

In 2021, a bill introduced by state Sen. Joe Addabbo Jr. (D-Howard Beach) to prohibit the sale of whipped cream chargers, also known as whippits or whip-its, to those under 21 was passed to combat using them to get high.

Many took that to mean, however, that the actual cans of whipped cream could not be sold to those deemed underage by the bill.

Over the weekend, major media outlets sensationalized the story with headlines like “You now have to be 21+ to buy a can of whipped cream in NY,” “New York Wants People to Show ID for This Pumpkin Pie Staple,” and “Dem-run state bans teens from buying whipped cream canisters.”

A Daily News cartoon by Bill Bramhall even highlighted it.

But they all had it wrong: The bill refers to the cartridges that one would insert into a dispenser, or canister, for fresh whipped

cream, — not the cans of the stuff.

Minors can buy all the whipped cream they want, Addabbo told the Chronicle.

“There has been a misinterpretation of the language and intent of the bill,” he said in a press release Monday as his office sought to field the dozens of questions pouring in and set up interviews with news outlets to clear up the misunderstanding.

“My bill is not intended to prevent people under the age of 21 from buying whipped cream dispensers, but the small, individual charger or cartridge inside the whipped cream canisters that is the target of this law.”

The legislation specifies that, Addabbo said, and there was no better way to word the bill than how he did it, something the state Attorney General’s Office confirmed for him.

The issue at hand was that the chargers can be used as a recreational drug if users crack them open and inhale the gas inside.

Addabbo took up the anti-whippit cause as concerns were raised in his district, and across the state, over the piles of used cartridges littering the streets.

Field day honors Simonsen A day of family fun in Forest Park next week will also honor the late Det. Brian Simonsen of the NYPD 102nd Precinct.

Simonsen was fatally shot in 2019 while responding to a robbery at a Richmond Hill T-Mobile store.

The annual event will take place on Sept. 10 from 1 to 5 p.m. at Victory Field at My r tle Avenue and Wood haven Boulevard.

There will be refreshments, bounce houses, cotton candy, giveaways and NYPD specialty units participating.

The event is hosted by the 102nd Pre-

cinct and Detective Squad and the Detective Brian “Smiles” Simonsen Memorial Foundation. The rain date is Sept. 17.

The foundation is a nonprofit that honors the fallen officer — an animal lover nicknamed “Smiles” because of his cheerful disposition — by providing scholarships to students and financial assistance to families and businesses in need and helping to vest police dogs.

Simonsen was a lifelong resident of Riverhead, LI, and spent his entire 19-year Q career in the 102nd Precinct.

Arrest in OP murder A New Jersey man has been arrested for the June 25 murder of a South Ozone Park man who was sitting in his car, which was parked near his home.

Officers from the 106th Precinct responded to a call of shots fired near 129th Street and Sutter Avenue and found 31-year-old Satnam Singh with gunshot wounds to the neck and torso. He was pronounced dead at Jamaica Hospital Medical Center.

Last week, officials announced that Rajtirath Bassi, 20, of Rahway, NJ, was arrested and charged with murder and two counts of criminal possession of a weapon. He is awaiting arraignment. The 106th Precinct credited tips from the community as well as Q detective work for leading to an arrest.

In its presentation, the MTA reiterated that drivers who live in the CBD and make less than $60,000 per year could claim their charges on their state income taxes. A few CBD residents pointed out during the meeting that they still would have to come up with the money up front.

Two hurt in subway incidents A 15-year-old boy lost half an arm and was admitted to Bellevue Hospital in Manhattan after falling between cars of an R train in Jackson Heights on Monday morning, while a another person is in critical condition after reportedly jumping in front of a train later that day at the 63rd Avenue M/R subway station in Rego Park.

The first incident took place at the Roosevelt Avenue-74th Street station at about 10:25 a.m., according to the NYPD. Published reports said the boy and friends were walking between cars when he fell, severing his left arm, and that the authori-

ties are investigating whether he was subway surfing or attempting to. Police say the boy was not a victim of a crime.

The MTA said E, M, F and R train schedules were affected, with some trains skipping the station while the rescue and preliminary investigation were conducted.

The Rego Park incident took place just before 5:30 p.m. The NYPD said the person was observed jumping in front of a train and was taken to NewYork-Presbyterian Queens hospital. Full train service Q was restored within an hour.

In regard to concerns that places like the Bronx would get more truck traffic and pollution — the plans are designed to divert trucks — the MTA said any adverse impacts would be “monitored.”

The MTA also says it will waive fees for cabbies and FHV drivers who want to test for positions including bus drivers, and advocate for those seeking paratransit licenses.

The letter from the FHV companies ridiculed both proposals as “poorly conceived and insulting,” pointing out that the MTA has been trying unsuccessfully to recruit FHV drivers for Access-a-Ride trips with little success.

They also said many of the drivers own their vehicles, rendering them useless for a bus driver.

The letter also said drivers will be on the hook for the fee “as our industry’s drivers do in London” as it would be very difficult to determine which passengers should be Q charged.

Blood drive in R. Hill The 102nd Precinct is hosting a blood drive with the New York Blood Center.

A bus will be outside of the precinct, which is located at 87-34 118 St. in Richmond Hill, on Tuesday, Sept. 6, from 12 to 6 p.m.

Donors will receive a free T-shirt that reads, “honor the fallen, help the living” on the back.

Walk-ins are welcome if capacity allows but appointments are preferred.

he State of New York is discriminating against our best drug dealers.

In order to get a marijuana dispensing license during the lucrative first round of permitting, you must either have a pot-related conviction on your record or have a close relative who does.

That means our best and brightest weed dealers — those who avoided getting caught all those years it was illegal — are now at a disadvantage.

They’re being denied the opportunity to sell product legally. So are, you know, legitimate businesspeople — the types who never got busted with illegal drugs before because, well, they were illegal.

What kind of upside-down insanity is this? It’s a special New York kind. This is the only state in the nation that is limiting its licenses to sell legal marijuana to people with criminal convictions.

The goal, of course, is equity — to make up for the disproportionate negative impact the so-called War on Drugs has had on lower-income, minority communities over the years. Other states have taken measures to try to give people from such

communities a leg up on getting legal weed licenses, but none are doing it the way New York is.

Once someone is approved for what is called a Conditional Adult-Use Retail Dispensary license, he or she will be eligible for state help to set up shop from the new $200 million Social Equity Cannabis Investment Fund. That fund will be run

by Social Equity Impact Ventures, a “joint endeavor” (that’s the state’s wording) that includes as a key player former NBA star Chris Webber, who earned $178 million over his career. Does that really get across the message that the program is meant to help out the poor and downtrodden?

With all the money at stake, and the fact that past criminality is required, either directly or through a relative, the potential for corruption seems high. Also, will the licenses retain their value or become the next taxi medallion? We could easily see illegal sellers undercutting legal ones.

Conversely, it’s hard to see how encouraging drug sales in already-challenged communities will benefit society. Guess we’ll find out soon enough.

New tolls won’t work Dear Editor: Letter writer Michael Newman believes “Tolls would benefit most” (Aug. 25) because traffic would be reduced and buses would go faster. He states the MTA needs the money because of lower revenues.

Traffic congestion within the zone would only be reduced by 5 to 7 percent, which would have a negligible effect on bus speeds and air pollution. Congestion outside the congestion zone would certainly increase by more than that amount, negating any benefits.

As far as declining MTA revenues, this is mostly due to the highest percentage in history of riders not paying their fares. The days when bus operators insisted on fares being paid are long gone because of fear for their own safety and bus passengers know it. The MTA must address this issue, not seek other sources of revenue to make up for this loss.

We all agree on the need for improved mass transit, but congestion pricing will not increase service levels or lower fares, and not all the funds will go to MTA capital projects. Some will go to “road improvements” for things like redesign of intersections and unnecessary bus and bike lanes. Will funds for pothole repair, etc., now coming from the general fund, be shifted to come from congestion pricing revenues instead? This week a number of media outlets, from local to national, put out some bad reporting about the state ban on selling nitrous oxide cartridges to anyone under 21, a law authored by Queens’ own state Sen. Joe Addabbo Jr. It was carried in the lower house by Assemblywoman Stacey Pheffer Amato and became law late last year.

The canisters are used to make whipped cream. They’re also used by the young and reckless to get high. They call it doing whippits, and Whip-It is actually a brand name of one N2O cartridge.

Many must avoid transit Dear Editor: The main purpose of congestion pricing is to discourage people from driving their cars into Manhattan and take public transportation instead. However, there will need to be exemptions for certain groups. One such example is people with disabilities who possess an NYC handicapped-parking permit. In order to qualify for this permit you need both your private doctor and a city doctor to examine you and agree that your disability prevents you from being able to take public transportation. This makes it punitive to punish us with these high tolls for driving into Manhattan when the city agrees we have no other alternatives. If by

The lesson here may be to not jump on the bandwagon — not if all your friends are doing whippits, which are dangerous, and not if another media outlet reports something too good to check. Do your homework, kids. Only then may you have dessert, with whipped cream on top or not.

NYC regulations we are not able to use city buses and trains, then it is blatantly unfair to charge us the congestion price penalty because we are disabled.

That’s not to mention people traveling to the city for the finest hospitals and doctors in the world. Are sick people expected to take trains and buses? Or should they be expected to drag their children or elderly parents or grandparents on MTA systems, making the trip both longer and more burdensome?

What about shoppers traveling into Manhattan? If they are buying something small like jewelry, is it really safe to carry it in the subway? And if they are buying something large, how is it possible to take big boxes on trains and buses?

How about people who work jobs that begin late at night or early in the morning? Most of us do not feel safe using public transportation during off hours. How are they supposed to get to and from work?

Furthermore, this is the worst possible time

to even consider implementing congestion pricing. Right now we are desperately trying to get people to come into the city following the pandemic. And with the horrible increase in subway crime many are apprehensive of taking mass transit so they are driving.

In addition, there are many areas in the outer boroughs that are transit deserts with few subway stations, making access difficult.

This huge toll known as congestion pricing will surely not encourage more of us going into Manhattan.

I see no subway cops Dear Editor: Hello. Keeping count on my subway trips in recent weeks until I actually see NYPD anywhere. So far, my tally is 50 trips on six train lines in three boroughs and the answer is zero police seen.

Despite the press conferences, the clear message is ... Dear Commuter (seniors, kids, families, pregnant passengers, those with ADA needs, everyone): You are on your own!

Perpetual plane noise Dear Editor: I was pleased to see the letter to the editor by Maria Becce regarding flight noise from LGA (“Plane noise roars back,” Aug. 25). I am a resident of North Flushing and have also suffered through the incessant airplane noise that plagues my neighborhood. Most days it is almost impossible to sit outside without being disrupted by the noise. The situation has gotten worse over the last few years (excluding the time during Covid when there were fewer flights leaving), and now there are instances in which planes are flying at midnight.

I am aware that there is ongoing discussion regarding the noise but it seems as though it is very much one-sided. I sincerely hope that these discussions can be taken more seriously by the FAA and a solution can be found that is amenable to both sides.

I hope the Chronicle and similar media outlets help the community to take up this cause.

Dear Editor: “Addabbo Maintains Stronghold in D15” (Aug. 25, multiple editions) failed to address a disquieting aspect of Joe Addabbo Jr.’s state Senate primary victory on Aug. 23.

My Rego Park neighborhood has been represented for many years by state Sen. Toby Stavisky. This year the area was gerrymandered out of Ms. Stavisky’s district and, in effect, bestowed on Mr. Addabbo. (He was bound to win the primary because he had the name recognition that his opponents didn’t.)

What I find particularly peeving about this is that I — and, I presume, my fellow Democrats in Rego Park — never received any official notice of the redistricting. When I finally figured out what was going on, it was 24 hours

before the primary and I could uncover little about the three candidates other than their obligatory campaign platitudes.

Is it any wonder that perfidious machinations such as this cause those of us who take politics seriously to fume indignantly?

Misguided on migrants Dear Editor: Re Edward Riecks’ Aug. 25 letter: “NY asked for the migrants”: Mayor Adams blames Texas Gov. Greg Abbott for shipping over 6,000 migrants to NY as “a political stunt.” But Adams ignores the real culprit, President Biden, whose bonehead border policies unleashed a tsunami of illegal aliens invading our country.

Adams calls them “asylum seekers.” Nonsense. Only 5 percent of them apply for asylum, notes the New York Post (Aug. 19). Many are welfare seekers, Covid-19 carriers (Post, Aug. 13), fentanyl mules for drug cartels (notes the Drug Enforcement Administration) and potential MS-13 recruits (says Immigration and Customs Enforcement) who take housing space away from homeless New Yorkers legally living here and strain an already-overburdened public school system. Operating New York as a “sanctuary city” for unlawful immigrants will add $300 million in annual costs to NYC’s budget (Post, 08/22).

I don’t oppose immigration. My grandparents legally emigrated from Europe in the 1920s. After being vetted and medically examined on Ellis Island, they settled in Brooklyn, where they quickly learned English, got jobs and raised a family without receiving public assistance. Unlike many current immigrants, they assimilated and were not “accommodated” by pandering politicians.

If immigrants want to come here, they must be willing and able to support themselves.

America should be a land of opportunity, not a destination for dependence on taxpayer-funded handouts.

At the same time, the Adams administration has cut most school budgets, which some argue will cause class sizes to increase.

A lawsuit against the school budget cuts appears to have been pushed back until Sept.

29, leaving potential negotiations well past the first day of school.

Last month, a group of teachers and parents sued the city, arguing that state law was violated because of the way the budget was passed.

A New York state Supreme Court judge sided with the plaintiffs and sent the education budget back to the mayor and City Council.

The city appealed and the appellate court blocked the ruling.

Unless an agreement is reached, the proQ posed cuts are expected to remain.

City Comptroller Brad Lander is calling for sweeping state legislation to implement reforms his office says are needed to turn illegal basement apartments into legal, safe and registered residences.

The Basement Resident Protection Law would create a Basement Board to protect the rights of tenants; administer funding for building owners to make safety upgrades; develop inspection regimes; and enforce tenant protections.

It would require owners to register all occupied basement and cellar units and establish basic rights and responsibilities

for basement-dwellers and owners.

Basement-dwellers would be protected from harassment, eviction and the denial of essential services.

The city and state would be required to provide affordable housing to those in units deemed to be so unfit for living due to egregious fire safety, habitability and flood risks that they must be vacated.

Upgrading basement apartments has taken on new urgency since Hurricane Ida, which one year ago drowned 11 residents in them. Lander is an ex-lawmaker but as Q comptroller cannot offer bills himself.

As first day of school draws near, budget and mandate still in limbo As the school year kicks off next week, a deal on mandating smaller class sizes in the city may be near, Gov. Hochul hinted, but proposed budget cuts remain in limbo.

Last Thursday, Hochul said that she supports the legislation that would limit class sizes in public schools “I’m looking closely at it. I’m inclined to be supportive,” Hochul said on WNYC’s “The Brian Lehrer Show.”

“I just have to work out a few more details with the mayor.”

She said she has been in talks with Mayor Adams and expects a resolution in the coming days.

“There might be something about a funding source or a responsibility that’s, you know, on the shoulders of the state right now — and I have to make sure I’m protecting the state taxpayers as well,” Hochul said.

“So there are some loose ends, but philosophically it’s something I’m supporting.”

The Adams administration has opposed the bill, authored by state Sen. John Liu (D-Flushing), saying that the cost would take away from other priorities.

A group of parents who fear class size mandates will eliminate programs they seek out is circulating a petition that has garnered over 1,500 signatures.

“We ask Governor Hochul to veto the unfunded class size bill,” the petition reads.

“NYC parents want successful programs that help students and families, not controversial class size mandates that will sacrifice the education, safety and well-being of our kids.”

They say the expense of class size mandates will cut special-education services, mental health support, school safety agents, afterschool activities, sports, popular programs like 3K and Summer Rising and

Johnnie Jackson, 64, has lived in the threestory white house in St. Albans for most of his life, he told THE CITY. His father transferred the home over to him as a birthday gift in 1994, and a few years later the mortgage on

the home was paid off, city documents show.

He took out a $108,000 mortgage on July 29, 2010 to help pay for some repairs, and less than a year later sought to refinance the loan after seeing low-rate ads in local newspapers, he said.

But the refinancing company, Express Home Solutions, turned out to be one of many launched by David Gotterup of Long Island as part of what the feds say was a scheme to defraud homeowners and banks who lent money, according to federal court documents stemming from a 2015 case.

Jackson had signed paperwork that he thought was for the refinancing, but was actually to t ra nsfer the ownership of the house i nto the name of an alleged associate of EHS, James Campisi, accordi ng t o fe d e r a l prosecutors and city proper ty records.

An East Elmhurst man the government says planned to stab people in the name of the Islamic State faces up to 20 years in prison after pleading guilty to terror charges, prosecutors announced Friday.

Awais Chudhary, 22, pleaded guilty in Brooklyn federal court to attempting to provide material support to ISIS, the Islamic State of Iraq and al-Sham, a designated foreign terrorist organization.

Chudhary is a naturalized U.S. citizen born in Pakistan. He is due to be sentenced Jan. 3.

According to the government, Chudhary pledged his allegiance in 2019 to ISIS leader Abu Bakr al-Baghdadi and began planning for a knife or bomb attack in Queens. Evidence cited by prosecutors indicates he pursued the knife option.

Chudhary considered targets including pedestrian bridges over the Grand Central Parkway and the Flushing Promenade (now the Malcolm X Promenade) along Flushing Bay near the World’s Fair Marina, the prosecutors said. He sought guidance from people he believed were ISIS supporters, including on what type of knife to use and how to avoid leaving fingerprints or DNA behind.

In the case of a bomb, he would throw it off a footbridge onto cars on the Grand Central.

Chudhary sent an undercover officer a screenshot from an ISIS propaganda magazine depicting a human body and where to stab it, and made “several” reconnaissance trips to his potential target sites, taking video of the locations, the authorities said.

He said he was OK with dying in an attack.

He ordered items online that the government said he intended to use in an attack, including a tactical knife, mask, gloves and a cellphone chest and head strap to facilitate his recording of the assault, which he hoped would inspire other ISIS supporters. He was arrested Aug. 29, 2019 as he attempted to retrieve the items from an online retailer’s locker in Queens.

About two months later, al-Baghdadi killed

himself, along with two children, in a suicide blast as U.S. forces closed in on him during a raid in Syria, according to the general who oversaw the operation. The Islamic State already had lost all of the territory it had seized in Iraq and Syria, which at its height in 2015 was about the size of Great Britain.

The authorities hailed investigators for thwarting Chudhary’s plans in statements issued Friday.

“Awais Chudhary has admitted to planning to carry out a lone wolf terrorist attack in Queens against innocent civilians in an embrace of ISIS’s murderous cause,” U.S. Attorney for the Eastern District of New York Breon Peace said. “Thanks to the Joint Terrorism Task Force, Chudhary’s efforts to commit deadly violence on behalf of ISIS were thwarted, lives were saved, and he now awaits sentencing for his heinous crime.”

NYPD Commissioner Keechant Sewell called Chudhary “a naturalized U.S. citizen who abandoned the country that took him in, and instead pledged allegiance to ISIS and repeatedly and diligently promoted its violent objectives, adding that “the threat of ISISinspired terrorism remains very real, and the members of our FBI-NYPD Joint Terrorism Task Force will never stop working to identify anyone aiding groups that consider our counQ try their sworn enemy.”

Employees volunteer for holiday as agency tries to keep streets clean

During a hearing regarding the city’s sanitation budget earlier this year, Councilman Jim Gennaro (D-Hillcrest) noted that, despite it being required by city law, many of his constituents occasionally go two weeks without having their recycling collected, as their Monday pickup days often coincide with holidays.

“It’s always been the case that it would be too much money ... to get the Department [of Sanitation] to do that which the law mandates, which is weekly pickup of recyclables. Weekly means weekly,” he said.

Though at the time, then-DSNY Commissioner Edward Grayson said that it would be too costly, it seems that Gennaro may finally get his wish: This Labor Day, the DSNY will continue pickup for those with Monday collection, the agency said Tuesday.

“New Yorkers want the trash picked up, and we are testing as many options as we can to do so quickly,” a spokesperson said in a statement.

The Uniformed Sanitationmen’s Association’s (or Teamsters Local 831) contract stipulates several holidays during which those working on those days will receive overtime pay (in this case, time-and-a-half). As such,

Harry Nespoli, president of Local 831, seemed more than open to the idea, and repeatedly emphasized that this is a “pilot program.”

“The commission is focusing on keeping the city as clean as possible,” he told the

Chronicle. “It’s something that they’re going to look at to see if it’s going to make the city cleaner and convenient for the public ...

We’re willing to try it.”

Contrary to the previous thinking, the agency said cost isn’t a deterrent in this case.

“We believe this will be revenue-neutral, because it will mean less overtime during

the week cleaning up after the holiday,” the DSNY spokesperson explained.

Nespoli also pointed to the lightening of the load later in the week as an incentive.

“Labor Day, you get a whole bunch of new people, and there’s a whole mess,” he said. “So now if we’re already there, looking to work, we could clean that mess up, so the next week coming in, or the next day, then it’ll be a lot cleaner.”

Nespoli said that if the program is a success, it could become a permanent staple on future holidays. He noted that the union’s contract expires at the end of this year; that could be a point of negotiation.

Nespoli was not sure where his members stand on the program, but was clear that different people would have different priorities on the holiday.

“You can’t blame people that want to spend more time with their families,” he said, “and you can’t blame people that say, ‘You know something? I can make a little extra money here. Let me work.’”

Those who receive Monday trash and recycling collection should put their material on the curb between 4 p.m. and midnight Sunday; compost will be picked up Tuesday.

There will not be street sweeping on Monday, and alternate-side parking will not be Q in effect.

Less than 72 hours after it was announced and denounced by Councilmember Vickie Paladino (R-Whitestone), a plan to house 115 families bused to New York from Texas at the Hotel De Point in College Point was nixed Monday, her office said.

“I am thrilled to see our efforts and concerns in regards to College Point have not fallen on deaf ears and the city is exploring other options for housing migrants,” Paladino said in a statement. “The people of College Point and District 19 as a whole are my top priority, and their interests come first.

Promises made, promises kept.”

But whether her vehement disapproval of the plan — in which she referred to the migrants’ arrival as “yet another burden,” arguing that it would stretch area school and law enforcement resources too thin and calling upon federal authorities to close the Mexican border — played a role in the plan’s reversal is unclear.

Asked for comment on the situa-

tion, Mayor Adams’ office referred the Chronicle to the Department of Social Services. A DSS spokesperson said that the change in plan was due to a contract issue with the hotel.

“As part of our legal and moral obligation to provide shelter to anyone who needs it regardless of background or immigration status, we are working around the clock to ensure that we are welcoming recently-arrived asylum seekers in need of shelter services with open arms,” the spokesperson told the Chronicle via email. “We did not move forward with this site because of a contracting issue but remain committed to identifying an alternative location in this area to provide shelter services.”

The spokesperson did not say what the contract issue was, and did not immediately respond when asked.

A source familiar with the matter was adamant that the contract dilemma was the sole reason for halting the plan; outreach from the city was not a factor. The same source said Paladino’s tweet con-

Briarwood has scored “a major victory” in negotiations with the city over a 175-bed men’s shelter, according to Councilman Jim Gennaro (D-Hillcrest), who on Friday announced an age restriction on residents and other details to which the Adams administration has agreed.

The Chronicle first reported exclusively on Aug. 25 that the city’s Department of Homeless Services has agreed to limit the controversial men’s homeless shelter slated for 138-50 Queens Blvd., to men 55 and older.

“While I understand that this compromise will not please everyone, this shelter service provider has been under contract with the City since the de Blasio Administration,” Gennaro said in a statement from his office last Friday. “This contract was entered into without the input of my office or the community. Given the totality of the circumstances, the shelter for senior homeless men is a much better alternative for Briarwood.

“I am confident that, under the careful strict and watchful eyes of the service provider, Westhab, this shelter will be a considerate neighbor all while helping the City’s most vulnerable population,” the councilman added.

The Adams administration has agreed to limit residents of a men’s homeless shelter planned for 138-50 Queens Blvd. to those ages 55 and older. Councilman Jim Gennaro is calling the move a victory for residents of Briarwood and GOOGLE MAPS IMAGE / FILE the surrounding area.

He thanked the Adams administration and DHS for listening to the community’s concerns and working with his office “assid-

uously” to make the shelter a better fit for Briarwood.

The shelter has drawn the ire of elected officials and civic leaders since it was proposed by de Blasio in 2020. It initially was planned for single men of any age, with the promise of on-site services and security.

Gennaro said the plans still call for 24/7 on-site security and an 11 p.m. curfew. It will prioritize clients from within the 24th Council District.

The city also has agreed to establish a special advisory board that will meet regularly with shelter staff and the DHS to discuss any community concerns.

Additional details about the board still are being worked out. A DHS representative last week acknowledged receipt of the Chronicle’s request for comment on the matter but did not respond otherwise.

Gennaro, DHS and the Adams administration will host a virtual town hall on the shelter beginning at 6:30 p.m. on Thursday, Sept. 8. It will be limited to 100 people. Briarwood residents wishing to participate are asked to contact Gennaro’s office by phone at (718) 217-4969.

The families in question are among the nearly 9,000 people who, after crossing over the Mexican border, have been bused to New York City and Washington, DC, by Texas Gov. Greg Abbott in an effort to force the hand of Democrats at the federal level on immigration policy. The New York Post reported this week that Mayor Adams puts the city’s total at almost 7,600 since May. So far, the Post added, 15 emergency hotels have been put aside for the asylum seekers.

Though it is not yet clear where the group of migrants who might have gone to the Hotel De Point will end up, the DSS said it is lookQ ing at alternatives in the area.

Differences between the three main types of diabetes

Hundreds of millions of people across the globe are living with diabetes. According to the International Diabetes Foundation, approximately 463 million people between the ages of 20 and 79 had diabetes in 2019, and the group expects that number to increase by almost 300 million over the next quarter century.

Diabetes is a complex disease characterized by the inability of the pancreas to make insulin or by the body’s inability to make good use of the insulin it can produce.

People diagnosed with diabetes will likely be told if they have one of the three main types of the disease.

Understanding each type can help patients recognize what’s going on with their bodies and what they need to do to overcome their disease.

Type 1 diabetes The IDF notes that type 1 diabetes occurs most frequently in children and adolescents, even though it can develop at any age. The body

of a person with type 1 diabetes produces no insulin or very little insulin due to an autoimmune reaction in which the body’s defense system attacks the cells that produce insulin.

As a result, type 1 diabetes patients must receive daily insulin injections to maintain their blood glucose levels.

The risk factors for type 1 diabetes are still being studied, but the IDF notes that family history, environmental factors and some viral infections have been linked to an elevated risk for the disease.

Type 2 diabetes Type 2 diabetes is the most common form of the disease, accounting for roughly 90 percent of all cases across the globe.

When a person has type 2 diabetes, his or her body does not make good use of the insulin it produces.

An unhealthy diet and sedentary lifestyle can increase a person’s risk of developing type 2 diabetes,

and oftentimes type 2 diabetes treatment plans include adopting a healthy diet and exercising more frequently.

However, the IDF notes that many type 2 diabetes patients will ultimately need to take oral drugs and/or insulin to keep their blood glucose levels under control.

Gestational diabetes Gestational diabetes, or GDM, affects pregnant women and is characterized by high blood glucose levels during pregnancy.

While GDM typically disappears after women give birth, mothers who experienced GDM and their children are at increased risk of developing type 2 diabetes later in life.

Diabetes affects hundreds of millions of people across the globe.

But many of those people can lower their risk for diabetes with a few simple strategies.

Lessons learned kayaking with the Park Service on Jamaica Bay The breeze was cool and the sun had not fully pushed through the clouds that morning and Mill Basin was calm.

I paddled slowly along the shoreline and at other times paused to drift with the current.

Kayakers trickled in and out over the course of two hours. The open-paddle format allowed people to join anytime throughout the two-hour session.

Paddlers could explore the area at their leisure and get down the technique as guide Chris Wattenbarger gave guidance.

I had kayaked for many years but only upstate in the Adirondacks, on quieter, freshwater lakes, making the more lively waters of Jamaica Bay, with the occasional bowrider passing through, an added challenge.

What I had no idea about, was the real technique that goes into kayaking.

It’s a “push” not a “pull” sport, Wattenbarger told me, which took some mental effort to adjust to.

I thought you simply pulled the paddle through the water to propel forward.

Instead of that move, which relies on the smaller muscles in the arms and chest, think of pushing the blade that is out of the water away from you, which will in turn move the submerged blade through the water, he instructed. continued on page 23

Mercedes Gallese ventures out onto Jamaica Bay aboard a kayak to find peace, she says.

“You just let the waves take you,” she said. “It changes your whole perspective ... I get home and I’m happy to start over.”

Formerly of Rego Park, Gallese moved to the Rockaways during the pandemic, in part to be closer to the water. Now, she regularly takes part in the free kayaking program from the Gateway National Recreation Area that explores a variety of the inlets of Jamaica Bay with offerings for all ages and skill levels.

I felt the sense of peace that Gallese spoke of when I did the open paddle for beginners last Sunday out of Floyd Bennett Field in Brooklyn.

Eugene Ferkauf was born in Manhattan Nov. 13, 1920, the only son of Harry and Rose Ferkauf. Harry was a immigrant from Iasi, Romania. Yiddish was the language spoken at home; and the name Ferkauf means “to sell” in Yiddish. Eugene married Estelle Silverstein in July 1944. Eugene served in World War II and upon his discharge worked in his father’s luggage store.

After his father’s death he opened up his own 400-square-foot store in Midtown Manhattan, selling luggage and household merchandise — and discounting one-third off the retail price, which was illegal at the time.

In 1948 he and a friend together opened a store named E.J. Korvette. They circumvented the law by giving out membership cards as people entered the store, a technique coming from consumer cooperatives. The business exploded out to the suburbs, with 58 stores at its peak. Its cash cows were records and audio stereo equipment, which made record sales of $20 million in 1964.

Martin Howell, a retired journalist living in Forest Hills, spent much of his 40-year career as a foreign correspondent and bureau chief in Asia. He decided he wanted to give improv a try.

“I think I went to two or maybe three live classes, and then of course, the pandemic hit,” Howell said. DeFeo, who has brought her shows to places like NYC Health + Hospitals/Elmhurst, did some improvisation of her own.

“The great thing was we went online.

We went on Zoom,” he said. “That was a real godsend for a lot of us because you know what it was like. We were all completely locked down and isolated from everyone. The Zoom classes were a lot of fun, a weekly highlight for those weeks when we were completely locked down.”

As a journalist, he was always quick on his feet, though in news that could mean 30 seconds, as opposed to one second or even less required for improv. “It is hard work ...

But it lets me get out of your more staid behavior and become the class clown for an hour. That’s fine with me.”

“The dispensaries, in my opinion, should have been zoned for more commercial areas away from the residents,” he said.

Residents in Forest Hills have expressed outrage, he added, about a storefront on Metropolitan Avenue that is expected to apply for a dispensary license.

“This kind of dispensary causes a different kind of concern and brings in a different element,” he said, adding that people could light up right after their purchase.

To many, including Rivera and also Borough President Donovan Richards, it’s about education and “destigmatizing” marijuana use.

Richards also said the state’s equity focus is key and something personal to him.

“It’s about ensuring that we correct the wrongs, and that the communities who have been most impacted are the ones who see the biggest benefit through this application process.”

He cited his advocacy around the disproportionate number of Black and Latino people who were arrested for low-level marijuana possession and the fact that the 105th Precinct had more low-level marijuana offenses and summonses in Queens

Gotterup in 2017 took a plea deal on only one of the many indictments in the case, involving loan-modification scams, but it didn’t include Jackson’s home. So he’s not officially eligible for restitution, according to his lawyers.

In the 11 years since being scammed, Jackson has fought unsuccessfully to get the home’s deed transferred back over to him.

Further complicating the process is that there’s a six-year statute of limitation on what’s known as a “quiet title action” — a legal proceeding that determines the rightful owner of a property.

The clock started ticking as soon as the fraud happened, so the deadline passed in 2017, as the federal trial was ending.

Now Jackson faces eviction from the house he shares with his brother and two of his dad’s former caretakers.

He had some support from the federal investigators whom he helped on the case.

In July, they gave Jackson a letter for housing court that confirmed he lost his house due to a mortgage scheme. Following inquiries by THE CITY, the feds said they needed to amend the letter to note that Gotterup did not plead guilty to the charges in Jackson’s case.

“I think the state needs to do a good job at ensuring that, as they open up, it’s proportionate in all communities.”

As candidates prepare themselves for the opportunity, the Queens Chamber of Commerce is ready to support the businesses that will open here.

“I think the state’s done a pretty good job of setting this up for success,” said CEO Tom Grech. “It’s a process.”

He said it took him a while to rally around the notion of legalized marijuana but that the time has come.

“I just hope that folks have the ability to execute a business plan,” said Grech.

Rivera said it’s a learning curve and that every day is something new with the industry.

For now, he said, he’s preparing to meet with the community boards that are starting to meet again after a summer break to Q make his pitch.
